Top Story

  • The Supreme Court has a major First Amendment case among all the administrative law ones, namely Netchoice v. Humanity. This was actually two different cases filed against Florida and Texas laws requiring viewpoint neutrality in online moderation.

    This resulted in a circuit split with the two cases being decided in opposite directions resulting in the Supreme Court ordering them 9-0 to go back and do it properly this time. (CBS)

    The majority opinion (written by Justice Kagan) is favorable to the social networks, while a concurring opinion written by Justice Alito and joined by Gorsuch and Thomas was less so, but all nine justices agreed that the circuit courts made a dog's breakfast of their decisions.

  • Democratic senators on the Committee on Banking, Housing, and Urban Affairs have sent a letter to fintech company Synapse, its major banking partner Evolve, and everyone else in the vicinity saying, and I quote, "What the fuck guys? Get your shit sorted out or we'll come over there and sort you out." (Tech Crunch)

    Synapse imploded a couple of months ago when its Chapter 11 reorganisation plans collapsed and it was left without enough cashflow to operate. The problem is that Synapse operated as an intermediary between its customers, their customers, and banks like Evolve. And now nobody can get their money because Synapse was handling the details and Synapse is toast.

    Double toast, possibly, because between $65 million and $96 million of the customer funds deposited through Synapse have allegedly gone walkabout.

    Nor is Synapse the only source of drama there:
    On June 26, Evolve Bank announced that it had been victim of a cyberattack and data breach that could have affected its partner companies as well. The incident, according to the company, involved "the data and personal information of some Evolve retail bank customers and financial technology partners' customers" such as Affirm, Mercury, Bilt, Alloy and Stripe. On June 29, fintech company Wise announced that some of its customers' personal data may have been stolen in the data breach. Also last week, Thread Bank - a popular partner to BaaS startups such as Unit - got hit with enforcement action from the FDIC. Notably, the order issued to Thread, as the publication Paymnts pointed out, "is unique in that it explicitly calls out the bank's Banking-as-a-Service (BaaS) and Loan-as-a-Service (LaaS) programs."
    Bilt? Paymnts? For $65 million surely these guys can afford a new keyboard.

11 I just pulled up the Netchoice decision. It's obvious in the first two pages the lower courts made an unbelievable mess of it. Seems nobody can, dares, or even wants to, decide if Facebook is a publisher or a neutral provider, when it's screamingly obvious they edit everything they touch.

13 Okay think I'm done with work for the day (night, it's 03:45, started at about 10:00).

Got a package of 1,000 wax bullets delivered today, to go with the 50 .38 Special cases drilled for shotgun primers. I forgot how fast these things can be driven: the wax bullets weight maybe 18 grains, and with the 209s, if you push the wax bullets deep into the case they can move out at +1,000 fps from a 4-inch barrel!
I better be careful.

Again if as in 2016 I see Pa go to Trump I will know it's all over. September 22 the open street ballot boxes start, and no one has ever explained how in Pa in 2020 candidates ballot totals had negative votes by the thousands and numerous timed.

In this vein, the vindictive woman City Council President, of course a POC, who sent police detectives to my job (!!!) over a nasty letter I sent over Rona lockdowns, left the Council and landed at a non-profit. The building they were in was heavily damaged in a recent tornado, and now they moved into my office space. So now I have this horrific bitch haunting my workspace during the day, so I really am limited to nights only as I do not even want to deal with this person. She's now a private individual so it's not the same as insulting a public figure.

I let just about everything go to voice mail, so I avoid the temptation to give a click to speak to somebody. Checked Walmart, checked the credit card, and no problem. Area code 202 is DC and is popular with scammers, making the call look more official I guess.

Caller ID isn’t really a reliable indicator of where the call is coming from anymore.

The Indian scammers use a program on their computers which can “spoof” a Caller ID from anywhere in the world.

They’ve been doing it fo a decade or more.
Here I get multiple calls daily from our 843 area code and all of them are Indian scammers trying to get you to pick up the phone by making the call look like it’s coming from a local number.

Here in area code 302, the scam calls almost always use numbers from little burgs located below the C&D Canal. Places with signs that proclaim their reasons why you should live there yourself.

As I once put it, the phrase they all could put on such signs was, "Welcome to Smallville -- If You Lived Here, You Would Have Killed Yourself By Now"

That’s my usual course of action.
Last year they had me so angry because they were calling multiple times an hour 10 times a day at least, must’ve been a bad time and they were missing quotas and increasing calls.

Anyhow I picked up and cussed them out, told them nobody here was going to fall for their scams and stop calling this number!
Futile, I’d get another call within the hour, and go through the same thing with a different idiot.

At that time the scam was them calling from CVS Pharmacy, which I knew was B.S. so I asked “Tell me the address from the CVS you’re calling from?”
After taking a few seconds to think of an answer “Jessica” with the thickest Indian accent since Ghandi said “I’m calling from CVS Headquarters, sir.” I said “No you’re not, you’re a lying, GD Indian trying to scam old people in foreign countries out of money”
Click.

The calls continued the next day.

It’s hopeless, I gave up, and just never answer now, hoping they’ll take the phone number off their automatic dialer list one day.
