Sefton: sefton at cutjibnewsletter.com | Prosecutors: Alec Baldwin Fired a Blank Charge at a Crew Member Before He Fatally Shot His CinematographerAs gp says, boy, they really kept this little tidbit secret for as long as they could, huh? So Alec Baldwin was already shooting his gun at people like he's a stupid, reckless child. That reinforces the case that he has the required state of mind of recklessness, which is something like "a gross lack of concern about the likely consequences of your actions."Alec Baldwin once fired a blank round at a crew member on the set of "Rust," prosecutors alleged in new court papers, as they accused the actor of being reckless with firearms while filming. Prosecutors in the New Mexico involuntary manslaughter case against the "30 Rock" star said they plan to bring evidence at his trial -- slated to begin on July 9 -- showing that Baldwin had a history of flouting safety protocols on set, which led to Halyna Hutchins' tragic shooting death in 2021. One such reckless moment came when Baldwin, 66, pointed his gun and fired "a blank round at a crew member" while he held the person target in his line of sight, prosecutors alleged in the Monday filing. Other examples of Baldwin ignoring safety procedures between Oct. 12, 2021 up until the day of the shooting included him using his gun as a pointer; firing the weapon after filming was over in violation of safety rules; holding his finger on the trigger in scenes that didn't require it; rushing armorer Hannah Gutierrez-Reed to reload his gun faster; and being on FaceTime with his family and making videos for them during firearms training, the court papers claimed. And before filming even started Baldwin -- one of the producers and the leading actor in the movie -- "asked to be assigned the 'biggest' gun available," the filing alleged.Well you can't blame a man for that. Prosecutors also plan to show that Baldwin was often angry on set, which gives rise to the idea that he was pointing the gun at the cinematographer in anger. Prosecutors said many clips show an angry and aggressive Baldwin, who can also be seen halting filming to yell and swear at the crew. "Mr. Baldwin can be seen screaming intermittently throughout the attempts at filming the scene," the filing claimed. "He exercises complete control over the set by stopping the acting sequence, cursing loudly and rushing the other cast and crew." Taken altogether this "intrinsic evidence" of Baldwin's "other acts" leading up to Hutchins' death shows that the incident wasn't an "accident or mistake" -- as Baldwin has maintained all along, prosecutors said.Guy's got a reality series coming up. This. That lawyer podcast guy had a very convincing argument when the murder first happened. He said that what was really going on was the murdered girl was asking Baldwin to do too many "takes" to get the right angle and Baldwin was angry with this uppity girl telling him what to do. She wasn't even the director. So he snapped and started firing at her in anger. I rate this theory as Highly Plausible. DUI's are expensive (for the common people) to recover from. There's the fine, of course. Then there's the loss of your driving privileges (if applicable) and the hassles with that. Getting to work, shopping, etc. Then you'll likely have to go through an expensive counseling routine, get tested for drinking at your own expense and so on.

DUI and DWI are used interchangeably in NYS. DWIA is, in NY, the lesser DUI in that is typical in other states, its basically a fine and go home, right now.
This guy did not submit to a BAC, which is his right, but the NYS courts have ruled that he cannot drive in NYS until his case is adjudicated if he did not submit to testing. Basically, he can get off with a suspended license for 6 months in NYS and $500 to $1000 fine. I guess never agree to a BAC road test... Bottom line - it's nothing to these guys except an embarrassment. Get an Uber, you idiot. Posted by: Boswell at June 19, 2024 03:58 PM (K+UlC) 191

I couldn't agree more that there is no reason to have even dummies on set. However, there were dummies, and there were blanks, and then, there were the live rounds - and Hannah Gutierrez was too hung over, or dumb, or careless, or rushed, or who knows what, to do her bloody job and make sure they weren't loaded into a gun. The prosecutor showed pictures during Gutierrez's trial that show the live rounds moving around the set - this gun, that gunbelt, then another gun - and remarked that is was Russian Roulette on that stage. You are absolutely right. Hannah Gutierrez was utterly delinquent, and failed her duty. But Baldwin bears responsibility, too. He was the final link in that fatal chain. He pointed the muzzle of the damned gun at Halyna Hutchins and Joel Souza, cocked the hammer, and pulled the trigger. He didn't check the gun himself, of course. What he and his lawyers keep missing is that even if the gun "just went off", if he'd followed the gun safety rules, Halyna Hutchins would be alive, and Joel Souza would not have received a bullet in his shoulder.
