Judge Cannon Blasts Democrat Prosecutor Jack Smith For Unprofessionalism in Seeking Gag Orders on Trump

Jack Smith, in a nakedly political move, demanded that Judge Cannon hit Trump with a gag order for... tweeting that FBI agents were permitted to shoot to kill in executing the search warrant.

That is true. They were so authorized. It's true that this is a routine boilerplate instruction, and that Trump wasn't home, but it is true that they had permission to shoot to kill if they encountered resistance in executing the warrant.

Trump's statements are protected first amendment speech, even if his claims are contentious. In no world does a prosecutor have any business seeking a gag order to stop a presidential candidate from making politically-charged claims.

Except when the prosecutor is just a campaign worker for Biden 2024.

Politico whines about Judge Cannon, yet again:

The judge overseeing the criminal case against Donald Trump for hoarding classified documents at his Florida home has again chided special counsel Jack Smith's team for its tactics -- this time over a request for an order preventing Trump from repeating baseless claims that FBI agents carrying out a search at Mar-a-Lago last year were authorized to kill him.

Even if these claims are "baseless" -- and they're not; they're true (if misleading) -- what business is it of a court or prosecutor to act as a Twitter Content Moderator regarding Trump's claims?

Will Jack Smith likewise ask for gag orders on Biden for repeating the "9% interest" lie? Why not? He has as much authority to seek a gag order about that as about Trump's claim.

U.S. District Judge Aileen Cannon turned down the gag order request Tuesday as she delivered another sharp warning to prosecutors that they need to make more concerted efforts at dialogue with Trump's counsel before bringing disputes to the court.

"The Court finds the Special Counsel's pro forma 'conferral' [with the defense] to be B? wrote Cannon, a Trump appointee. "It should go without saying that meaningful conferral is not a perfunctory exercise."

Cannon didn't rule out granting the request in the future, but she said prosecutors would need to to further engage with Trump's side over the issue before she will take it up again. She also questioned Smith's claim of urgency to file the gag order request, noting that prosecutors filed it on a "non-emergency" basis. It was submitted on the Friday evening before the Memorial Day weekend, leading Trump lawyers to complain that they were being rushed into responding.

So they lied.

In addition, Cannon appeared to fault Smith's attorneys for skewing how they described the stance that Trump's lawyers had taken on the proposed gag order. The judge suggested prosecutors had relegated Trump's response to "editorialized footnotes," rather than just reciting it neutrally to the court. She directed both sides to provide her with more details in the future on their attempts to work out such disputes and to do so "in objective terms."

While the judge seemed piqued by the prosecutors' actions, she turned down a request from Trump's defense to impose sanctions on the prosecution for allegedly defying court rules and her previous orders. However, Cannon said that was possible if her rulings aren't obeyed.

"Failure to comply with these requirements may result in sanctions," the judge wrote in the brief order posted to the south Florida federal court's online docket Tuesday morning.

...

Prosecutors have indicated they needed to move quickly with the gag request because of a series of inflammatory public statements by Trump claiming that FBI officials had given the OK to kill him during the court-ordered raid at Mar-a-Lago in May 2022. The claim stems from the inclusion of a policy on use of deadly force included in the operations plan given to agents prior to the search.

They're claiming that Trump's remarks may endanger law enforcement officials... um, what authority does a prosecutor have to stop speech he doesn't like?

His only authority over Trump's speech (debatedly!) is if Trump's speech interferes with the administration of justice in this one case -- he does not have limitless authority to gag Trump whenever Trump is disputing Democrat/Government Party dogmas.

Will he similarly seek a gag order on Cori Bush to stop lying about the death of Michael Brown -- an absolute lie that definitely puts cops' lives in danger?

Nah, of course not.

But we have to protect those dear, dear FBI agents from mere reputational damage.

I would have figured that was standard for any and all LEOs, FBI or not. Why else are they carrying guns?

No cop ever has a "shoot to kill" order, like some kind of assassin, but they do have a standing order to "shoot and don't worry if they're killed, but only if you absolutely have to, because they're trying to kill you".... which, honestly, should also be the standard RoE for any American citizen. It's the fundamental assumption that makes the 2nd amendment make sense.

So the question is, why even bring it up in the paperwork? Just to remind them? Hey, nudge nudge, you can shoot people, you know, right? Wink Wink.

@amuse @amuse
What if the entire Mar-a-Lago raid was part of a cover-up combined with a setup? Thanks to the exceptional reporting by independent journalist @julie_kelly2, we now know this scenario is more likely than not. It’s a chilling reality.

Democrats were desperate to ascertain whether Trump had kept a copy of the Crossfire Hurricane binders. Trump believed he had declassified them, but the DOJ maintained they required further review and redactions before release. Three years later, the DOJ still hasn't released them. Knowing that Trump felt entitled to retain a copy, they suspected he and his associates might have done so. The Democrats needed a pretext to reclaim the binders. The White House met with Jay Bratt, one of the original Crossfire Hurricane investigators, around the same time they pressured the GSA to send four to six pallets of Trump’s presidential records from a Virginia warehouse to Mar-a-Lago. This created the perfect opportunity to infiltrate Trump’s private estate and prosecute him for illegally retaining classified documents. Jay Bratt is now Jack Smith's top prosecutor.

98 I think there is too much focus on words and not on actions. Even if deadly force is standard language for a home raid that is even more reason why it should never have happened.

The left has tried for years to make Trump somehow less worthy than anyone else who has held the office and therefore fair game. I don't remember voting for him be President Light. I voted for him to be the complete package and we do not raid the home of former presidents.

When Biden finally admitted he stole, yes stole, documents from a SCIF in the Senate that he never had any right to take and kept them unsecured for decades he was allowed to negotiate a search with his lawyers present. Trump had the right to have those documents as a former POTUS.

If Trump had sent the FBI to raid Obama's house Democrats would have burned the country to the ground and everyone knows it.

104 Jack Smith was chosen for the Trump case BECAUSE he is a political assassin.

I keep reminding people that he was at the Obama Justice Department and indicted a hugely popular Republican governor (He beat his Democrat opponent by 30 points. Thir. Ty.), one who had been talked about as a possible Republican candidate against Obama. In the aftermath, the Republicans lost to Terry McAuliffe by .1% (there are lots of reasons for that, Republicans shooting themselves in the foot certainly a part of it but all of it in the disarray after the felony indictment). Smith convicted the Governor of a Federal felony.

This conviction was overturned unanimously by SCOTUS based on this: what he had been convicted of was not actually a crime. (please note all the commentary about NY Trump trial and the lack of an underlying crime).

No matter. Smith paid no price, while Governor McDonnell was out of politics, out of $27M, and his marriage ended.

Remember, our government is far worse than we can probably imagine. I mean heck, it's known children are being trafficked into the US across our border. American citizens are being killed, either directly, by illegals, or, indirectly, by all of the fentanyl being smuggled. Yet, the PTB does nothing to secure the border.

They bankrupted Flynn over asking Russia not to go overboard in retaliation for Obama kicking out delegates.

The only way that that would have been a "violation of the Logan act" is if the Obama administration's official policy is that Putin should go nuts and double the retaliation. In that case, Flynn could have been said to "interfere" with diplomatic policy.

I doubt that is the case.

If you read the Flynn transcripts it is about 90% "We can talk about this in January" and only one little piece of advice: "Don't go nuts on retaliation, we'll talk about this in January".

Remember Kislyak is the guy Obama set up a meeting with for Trump's nominated AG. Most likely the Obama administration had recruited Kislyak to keep calling Flynn about "preparation" for Flynn's role as NSA head.

Posted by: lin-duh

There seems to be two choices.

1) The FIB are the deep state's authorized death squad, permitted to kill anyone and everyone, including other federal agents, and the former President and his friends, family, and employees.

B) The lawyers insist on this "boilerplate" for every warrant. But now that it's known that it's "boilerplate" and not really an authorization to kill, it's become meaningless on every warrant it's applied to, both past and future. And any FIB agent who kills anyone should get the full George Floyd Show Trial treatment, with conviction on every count.

This fellow attended gun shows and sold the occasional firearm there. The ATF decided he was a dealer and needed an FFL. The problem? They didn't tell him. They just showed up with 20 guys in plain clothes at 6am and kicked his door down. So the man blazed at them inside his home and you can guess how that turned out. Very little publicity about this poor fellow.

202 Prosecutors have indicated they needed to move quickly with the gag request because of a series of inflammatory public statements by Trump claiming that FBI officials had given the OK to kill him during the court-ordered raid at Mar-a-Lago in May 2022. The claim stems from the inclusion of a policy on use of deadly force included in the operations plan given to agents prior to the search.
++++
1. They authorized deadly force in the raid.
2. Trump publicly mentioned his dissatisfaction over the fact that they authorized deadly force in the raid.
3. Upon examination, Trump was correct in his assessment of the facts (deadly force was authorized) and stated his opinion on it (it displeased him).
4. Since Trump mentioned a factual matter, and the facts of the matter don't look good for the Party, Trump must be silenced.

It's probably standard.

Trump's treatment was standard (at least). Biden's treatment was not. Of the three standards of "law" in this country, Trump and Biden are at opposite extremes. Biden is subject to Party Law. Trump is subject to Enemy Law. Neither is subject to run-of-the-mill, arbitrary Rube Law.

They didn't do that to biden.

They do early morning raids to catch people unawares, and in bed. President Trump's people had been working with the DOJ about the documents and was under the impression they'd arrange a time to retrieve the documents. There was no sense of urgency, whatsoever.

Military has rules of engagement and they cannot just light up some local guy because they bump into you.

Now, when your mission is 'take that hill' -
- no resistance, no shooty,
- resistance, light them up.

Doesn't matter the level of 'resistence', same with the FBI boilerplate. Any level resistance then lethal force is authorized.

Even a locked door, little dog, or woman holding a baby.
All been found sufficient for LEO to light them up.

Montec being didactic against Trump is one thing. What I find frustrating is his on again and off again acknowledgement of the fraud. It's both normal and unusual at the same time in his own words.

I mean...I'd respect him more if he was out with the view that there was no real different in fraud between 2016 and 2020, that the mail in ballots were secured, and that the fuckery was just normal levels. But this very morning he said it was extra level fuckery while also explaining that any stories of blacks voting Republican in greater numbers this year are nonsense because they didn't in 2020.

A massive leak of Mexican military intelligence has exposed for the first time in two decades U.S. gun shops and smugglers tied to 78,000 firearms recovered south of the border – and which types of guns are being trafficked.

As part of the leak, emails relaying U.S. government data between Mexican military leaders and PowerPoint presentations by Mexico’s attorney general show which American straw buyers were tied to the most weapons as of 2022.

Of the other six top purchasers, half are linked to the Bureau of Alcohol, Tobacco, Firearms and Explosives scandal known as Fast and Furious.

What's even more egregious was the "don't wear identifying clothing" order. I've never heard of such a thing when serving a search warrant.

Either the FEEBs are too stupid to know that they're armed, or they were recklessly risking a blue-on-blue shooting. For an unprecedented search warrant on a former POTUS, at his residence with Secret Service protection, to just say, "Yeah, it's business as usual" is giving the DOJ too much credit.
