Judge Cannon Will Hold Hearing to Determine if Jack Smith Was Unconstitutionally Appointed (He Was), and If His Indictments Should Be Quashed

He was never confirmed by the Senate. Only an officer confirmed by the Senate has the power to bring prosecutions against senators.

But Merrick Garland didn't want Jack Smith to have to answer questions about his past and his politics so he merely hired him as an employee, not an "officer" of the US.

The liberal news media is full of false stories about how Judge Aileen Cannon of the United States District Court for the Southern District of Florida has delayed former President Donald Trump's trial unnecessarily for allegedly mishandling classified documents. But, in fact, the Biden Administration and its Attorney General, Merrick Garland, are themselves to blame for the current delay. Special Counsel Jack Smith claims to be an inferior officer of the United States, but in fact he holds no such office. Smith is a mere employee of the Department of Justice, and he lacks the power to initiate prosecutions. Lucia v. Securities and Exchange Commission, 585 U.S. __ (201 holds that only officers of the United States can take actions that affect the life, liberty, and property of citizens.

Judge Cannon has asked for oral argument on June 21, 2024 on former President Donald Trump's motion to dismiss Special Counsel Jack Smith's indictment on the ground that Smith was unconstitutionally appointed to his current job because he is not an inferior officer. Washington, D.C. super-lawyer, Gene Schaerr, has filed an amicus brief in United States v. Trump on behalf of former Attorney Generals Edwin Meese III and Michael B. Mukasey, as well as me and Professor Gary Lawson, arguing that Jack Smith was unconstitutionally appointed to be an inferior officer, and Judge Cannon has asked Gene Schaerr to participate in the oral argument, which he has agreed to do.

The Appointment Clause of Article II, Section 2 provides that: "the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments." Jack Smith claims to be an inferior officer of the United States appointed by the Head of the Justice Department, but he is instead a mere employee.

This'll be interesting. If she disqualifies him, then the Democrat partisan judge in DC will have to at least hold a similar hearing. If there's a conflict between their rulings, presumably an appeals court will then have to hear the matter to resolve which judge is right.

Trial has not begun yet in Florida. State court trials in NY and GA are not affected by Jack Smith's status.

Part of the issue is that courts are reactive and must wait for motions by the parties before proceeding and Cannon is being careful. Orders based on Sua Sponte (judge says just becuz basically) are frowned upon by appellate courts.

Already at Scotus regarding immunity case--Scotus could scuttle Jack Smith there by arguing he has no standing because he was illegally appointed in the first place.

See the Mukasey Meese amici brief at Scotus. This is now filtering down to the trial courts by parties making motions and right now one federal case in the in the DC Circuit (the Jan 6 case) and Florida's judge Cannon is in the 11th Circuit where the classified doc trial is going on.

By the clear light of the law via the constitutional advise and consent clause plus years of application to the special counsel statute (it has always been assigned to a current appointed and confirmed DA as an additional duty) to my knowledge, Jack Smith's appointment was illegal.

DC and Florida are in different Circuits. So if the trial courts were to disagree on Smith's qualifications to do what he's trying to do, the only way to reconcile would be to go all the way to the Supreme Court. An appeals court with jurisdiction over one courtroom won't have jurisdiction over the other.

At a certain level, rule of holes applies and the classified document case in Florida is on life support for a number of issues including selective prosecution, improper evidence handling, lying to the court by citing a Trump lawyer breaching privilege for the Mar a Lago warrant, and so on.

Like the Fani case in GA, the classified doc case is bleeding out.

The Jan 6 obstruction case over the immunity issue at Scotus might very well destroy much of what is left of the DC cases and could disqualify Smith.

That leaves the NY hush money case which is a dumpster fire constitutionally speaking but could give them Trump's scalp.

Most people have forgotten the prior Trump organization case already but that is likely to die on appeals

This is correct - the prosecutors in a case before a court announce their "legal" authority to appear there and prosecute their case...this Smith had to represent at that time he could legally represent the US against DJ Trump...if he is not legally able to do so, then it is a fraud upon the court...this actually much more serious than many are taking it. This is why Justice Thomas mentioned it, its prosecutorial fraud.

There are in fact three systems of "justice" in America:

Party Justice: where there are simply no laws at all. Carte blanche.
Rube Justice: where the laws are enforced but it's pretty arbitrary, just to keep people in line.
Enemy Justice: no limits whatsoever, law or no law, the state goes after you on all fronts for all things real or imagined because you're an enemy and they *will* get you.

Most of us get Rube Justice. Power players get Party Justice. Donald Trump and the Jan 6 defendants get Enemy Justice.

Heh. I once got a field service call when I worked for my college's IT department. On my way out, one of the bosses (not mine) heard my destination and handed me a couple pairs of latex gloves. She said, "you're going to see Professor X. She's gross. Trust me, you'll want these."

I am grateful to her to this day. Professor X's keyboard was fuzzy. I've never seen a monitor, keyboard or mouse that filthy. The PC itself was fine because it was tucked behind a filing cabinet. But her desk was a biohazard.

My kid did a presentation and diorama for her college class this year on this case...victim saved himself and cops didn't really believe him, but it was the polaroids that gave Dahmer away...ciop found them and then it was a "holy sh&t" moment.

It helped he took 13 years to commit his acts - he didn't do them often, so it was easier for cops to look the other way...

so DanMa'am gets into a wreck that was an obvious attempt to milk an insurance claim. She even got a ticket for illegal lane change or something. I gets me camera, measuring tape and collect some data...open a traffic accident book and start drawing up the evidence of what appeared to be a set-up.

The argument isn't whether Smith was naturally going to get the court to agree he had authority, the point is - he had none, he knew it and so did the DOJ. The legal appointment of junior officers for the US is not unknown or even legally vague. There is a whole senate approval procedure set up for it and that fact would not be unknown to the US AG or Smith. The reason or motive to avoid it was to prevent appointment all together for someone to prosecute this case.

Smith and the DOJ presented to Cannon's court that he was a legal junior officer of the United States with full authority to prosecute a case, when they knew full well he wasn't...I think they are in serious trouble.
