NY Court of Appeals Tosses Harvey Weinstein's 2020 Rape Conviction

There's a rule that you can't put on evidence of prior "bad acts" to prove that a defendant committed the specific bad acts he's being tried for in the present case.

It's not that such evidence is completely irrelevant; it's that it's unduly prejudicial to the defendant. Such evidence tends to poison the jury against the defendant well out of proportion to the actual light it sheds on the current crime being judged at trial.

But that's what the state of New York did to get their conviction. They had some weak evidence of rape in cases where the statute of limitations hadn't run out yet, so they put on evidence from other women claiming they'd been raped (in cases where the statute of limitations had run out).

I'm not even sure how this was allowed in the first place. I assume (I haven't read much about the case) that they used the special and often-abused exemption to the "no prior bad acts" rule, the "signature" exception. Prosecutors will sometimes claim that a method of committing a crime is so specific to one individual that it constitutes a "signature" in the modus operandi, and can then put on witnesses who testify about the same M.O. being used in crimes against them.

It's often a weak and bullshitty exception: "The bank robbers wore ski masks and gloves, that's a signature." Okay it doesn't usually get that transparent, but you can see the way this rule can abused, and where a judge will allow "signature" evidence in a case The Regime is desperate to win.

Another exception, which seems to be the one used in this case, is to claim you're not putting on these witnesses to prove his prior bad acts, but to shed light on his state-of-mind he had when committing the acts he's on trial for.

The prosecution put on three witnesses to accuse Weinstein of prior rape, and claimed they weren't presenting this evidence just to show he's generally a rapist, but to prove that his state in mind in the current case was one of intent to commit a sexual assault. That is, it wasn't just a mistake where he misread the woman's level of interest in him.

But I mean, come on: You can't tell the jury "don't consider this testimony as evidence that he committed the current crime, just consider it as far as his state-of-mind." That's telling people to put the information in a special vault in their brain that they cannot access except to answer one particular question. No one's brain works like that, not even the brain of Noted "Compartmentalizer" Bill Clinton.

The toxic Regime will let every criminal out of jail to pacify one constituency. Then, when another constituency must be appeased, they'll change the rules and start presenting/allowing evidence that is plainly out-of-bounds just to convict one guy. The Regime is controlled by people who are all suffering from untreated moral breakdowns, permanently on tilt, and eager to suspend the law or change the law to to satisfy whatever moral panic they're currently in. (Trump can tell you all about that.)

Any trial that makes the news is now a political trial.

Weinstein is still in jail over a 2023 conviction for a rape in California.

But this one is overturned, and he'll be retried, this time without the supplementation of "prior bad acts" witnesses.


Harvey Weinstein's 2020 rape conviction has been overturned by the New York Court of Appeals.

On Thursday, the court found in a 4-3 ruling that the judge in Weinstein's trial -- a landmark moment in the #MeToo movement that the 2017 allegations against him started -- had shown prejudice by allowing women to testify about allegations that were not part of the case. The court has now ordered a new trial.

Weinstein, the Oscar-winning producer of "Shakespeare in Love" and "Good Will Hunting," is serving a 23-year sentence at the Mohawk Correctional Facility, a medium-security prison in Rome, N.Y. He will remain imprisoned as he was also convicted of rape in Los Angeles in 2022 and sentenced to an additional 16 years in prison. However, Weinstein was acquitted in the Los Angeles trial on charges involving a woman who testified in his New York case.

"We reaffirm that no person accused of illegality may be judged on proof of uncharged crimes that serve only to establish the accused's propensity for criminal behavior," wrote Judge Jenny Rivera in the court's majority opinion. "It is an abuse of judicial discretion to permit untested allegations of nothing more than bad behavior that destroys a defendant's character but sheds no light on their credibility as related to the criminal charges lodged against them."

Judge Madeline Singas wrote in the court's dissenting opinion, "With today's decision, this Court continues to thwart the steady gains survivors of sexual violence have fought for in our criminal justice system. Forgotten are the women who bear the psychological trauma of sexual violence and the scars of testifying again, and again. This erosion of precedent, born from a refusal to accept that crimes of sexual violence are far more nuanced and complex than other crimes, comes at the expense and safety of women."

This is always the pitch: We have to break the rules to convict this defendant for political reasons.

At oral argument in February, Aidala maintained that Justice James Burke had stacked the deck against Weinstein by allowing three women -- Dawn Dunning, Tarale Wulff and Lauren Young -- to testify against him.

Each of the women told the jury that Weinstein had sexually assaulted them after they showed up for what they thought would be a business meeting. The so-called "Molineux" witnesses were called to show that Weinstein's assaults had a common pattern, and that he was not confused about whether or not the victims consented.

Weinstein's defense argued that the effect of the testimony, however, was to attack his character without shedding any light on the allegations for which he was actually charged.

"This is major prejudice," Aidala argued in February. "It's saying, 'He's a bad guy. He's a bad guy. He's a bad guy.'"

The issue of "prior bad acts" testimony was also raised in Bill Cosby's successful appeal of his sexual assault conviction in Pennsylvania. In that case, five women were allowed to testify to buttress the one allegation that was charged. The Pennsylvania Supreme Court overturned that conviction on different grounds, finding that prosecutors had reneged on a promise not to prosecute Cosby.

Character evidence alleging past bad acts gets problematic when it involves uncharged crimes. Had Weinstein been tried and convicted of those past crimes, it would have been allowable because it would demonstrate a pattern of ability to commit those crimes in the past. Essentially what NY prosecutors did was use uncharged past bad acts to argue that that this evidence applied to the particular case at hand.

Goes back for a retrial is what will happen.

Ah, I see the press is dutifully hiding information.

The prosecutors SPECIFICALLY promised not to prosecute Cosby so that he could not invoke the 5th amendment in a civil trial.

Then, USING THE EVIDENCE FROM THE CIVIL TRIAL, the prosecutors charged him with crimes.

They should be in jail for deprivation of rights under the color of law.

But there are no consequences for the ruling class. They get a "scolding" and then go on to do the same thing again.

I had a friend say, "I know at least one juror will not convict Trump." My response, "that didn't work out during the MOST bogus rape/defamation trial." Not one person had enough critical thinking skill to know that woman was a nut case.

It was a surprise that the appellate division, which is the first level of appeal in NYS let it stand. The trial judge screwed this up , just like the Judge in Trump's case are screwing up. Fast forward to now. The New York judiciary is allowing Trump to be prosecuted based on an act for which the statute of limitations has expired. They've further allowed other charges to be falsely compounded and brought based on that unlawful charge.

New York courts routinely do things like this on a regular basis. To the point they've even ignored SCOTUS in cases like Bruen.

Meanwhile criminals and illegal immigrants roam free.

People are leaving New York for many reasons. But one of those is increasingly a justice system that has been weaponized against the average person or business who doesn't agree with them.

It is more to the point that the appellate court has handed the Trump team a cudgel to apply to the judge in the case. Bragg just introduced the Natl Inquirer editor to testify about how stories are squelched and this is the key to the argument that the payments to Stormy and McDougal as well as to the doorman to squash a stupid story about Trump impregnating a maid at the Trump hotel constitute a pattern of misbehavior.

Since all of that, like whether Weinstein actually had relationships with the accuser, were uncharged activity (in Trump's case because there is literally no law that prohibit disclosure agreements and payment to prevent disclosure), the past bad acts to show they are a bad person is not allowed due to the Weinstein appellate ruling.

I only ever heard one juror talk about the case, at length, and the impression I had was she would have voted guilty if it wasn't for all the obvious holes they were able to poke at the work of the cops and the techs.

So in a sense, "sticking it to the white man" could be construed as saying "no" when the system tries to railroad defendants. Which it does. A lot. And not just to ex-NFL running backs.

To that level, they are trying to apply a NYS statute that deals with state elections to make the misreporting of financials from Trump Inc (categorizing campaign expenditures as legal ones) which is the whole 34 count bullshit where each check payment to Cohen is alleged to have benefited Trump illegally in the 2016 election.

FEC and the Feds already investigated and declined to charge--even the tainted SDNY Trump haters did so. So can Bragg change a state statute to apply to federal elections (which actually creates a federal appellate question to the whole deal) and now has this appellate court ruling undermining his case.

Actually has a logical basis to it if you view each trial as only pertaining to the facts of the case at hand rather than whether the person is a 'bad' un that needs to be locked up whether or not they did the crime at hand.

Nothing pisses an old lag off more than being accused and convicted of a crime they did not commit. Many of them will more or less admit sotte voce that they got what was coming in just convictions but they cannot stand being convicted for things they did not do.

For a long time, that is how sloppy cops solved crimes--they go to the persons likely to have committed the crimes on past behavior and if necessary build a case to frame them because the cops reason even if they did not do it, they should be locked up to prevent the inevitable future crimes from the perp

The FEC looked at it and said nope nothing illegal here. IF he had used campaign funds that would have been illegal.

That is why he said she said still go to trial. Rape of spouse used to be absolutely barred from criminal action by states. The idea at the time was that consent was rendered when the marriage occurred and the the court should not be involved in domestic spats.

Even until recently legally speaking, spouses had an absolute bar on being able to testify against their spouse. This made criminal charges of domestic abuse particularly difficult as you had to have third party witnesses willing to testify instead of teh direct victim.

In 2016, Stormy Daniels let it be known that she was going to allege her and Trump had an affair.
Micheal Cohen, Trump's lawyer at the time, got wind of it and made her a deal: Cash to keep quite.
National Enquirer got wind of that deal with Stormy.
Cohen then paid them to spike it.
Cohen billed Trump for "legal services."
Trump, Inc entered the payment in the business ledger as same, "legal services."
At some point, certainly after Trump, Inc paid, but definitely not before, Trump may have been told, "those payments were to Stormy and the Enquirer."

This was felony fraud on the poor people of New York state _who _voted_FOR_Trump_ as those ledger entries were 1) indirect campaign expenditures that 2) should have been reported on FEC reports (an illegal campaign expenditure) that 3) deceived those Trump voters into voting for him had they but known he paid Stormy and the Enquirer.

These alleged false entries are a misdemeanor punishable only by a fine. And the statute of limitations has passed.
Unless they are done to further a second crime. Which has a longer limitations.

Yeah, my only position is that his trial was not impartial by the rules that our ruling class have set.

He might very well be guilty of everything he's accused of- he is a pretty awful person and I'm pretty sure he's guilty of a lot.

However, in a just country, you still have to prove it under the rule of law and the prosecutors/judges bent the law because getting him was more important.

Wherever there is money and power and men in positions to wield it, you will find women willing -- eager, even -- to assume their own position for it. Finance, management, education, marketing, etc -- and above all, politics.
