Supreme Court Seems Ready to Overturn 9th Circus' Judge-Made Law That Homeless People Are Allowed to Sleep On the Streets (At Least Until Cities Build Free Houses for Every Single Homeless Person)

One (1) aspect of the downfall of California isn't actually Gavin Newsom's doing, unbelievably enough. Cities on the west coast allow permanent homeless encampments because the leftwing circus called the Ninth Circuit Court of Appeals decided to make up their own laws and imposed the rule that homeless people must be permitted to camp wherever they like, until and unless governments create housing for all of them.

The Supreme Court is finally getting around to reviewing this lawless ruling.

The U.S. Supreme Court appears to be leaning towards supporting an Oregon city's crackdown on public sleeping, a decision that could have far-reaching implications for the escalating homelessness crisis under the Biden administration. The case, which challenges lower court rulings that deemed it "cruel and unusual" to fine or jail individuals sleeping on public land if no shelter is available, could redefine how cities and states manage the growing number of people living in tents, cars, and on the streets.

The Supreme Court's more liberal justices have suggested that the city's law amounts to unlawfully targeting individuals simply because they are homeless. Justice Sotomayor argued that "You don't arrest babies who have blankets over them. You don't arrest people who are sleeping on the beach," while Justice Kagan stated that "Sleeping is a biological necessity. It's sort of like breathing. ... But I wouldn't expect you to criminalize breathing in public."

However, the court's conservative justices have questioned where the line should be drawn between someone's conduct, which can be legally punished, and a status they are unable to change, which cannot be punished. They also suggested that homelessness is a complex policy problem and questioned whether courts should be responsible for managing it.

The conservative justices seemed especially receptive to this obviously-true notion that judges shouldn't be writing the laws.

62 One of the things I think about here is how cities have effectively created the concept of public spaces. It exists in all sorts of laws, and has essentially corrupted the way humans interact, to the point where this is where we are.

Suppose you own a business, or you own buildings in which your rent space so others can operate businesses...

Who owns the sidewalk? Who owns the parking spaces in front of your building?

Seems to me much of this could be fixed if we simply started with the premise cities don't own the "public" spaces, except maybe... MAYBE the roads.

We give the homeless single adults very little, even in NoVa...that's why they don't come here.

Most benefits are volunteer-oriented (like donated sandwiches for lunch from Church volunteers) - they don't get any cash from the state or locality.

Sleeping all over cities like invading locusts *is* conduct and -- by their own statement -- can be legally punished. A status they are unable to change would be having black hair or green eyes. Homelessness can be changed if one takes advantage of all the free programs that exist to lift you out of it.

Even the conservative judges seemed willing to acknowledge some phony line between conduct, which can be punished, and some kind of "status" they supposedly can't change, which cannot be punished. That's not a good sign coming from judges that should kick this stupid Ninth Circuit madness right to the curb.

I expect this will be 5-4. Just not sure in which direction.

She (a 16 yo) said her parents wouldn't let her boyfriend stay with them, so she is living with her boyfriend in the woods out in a tent.

Basically, her desire to fuck him was greater than her desire for shelter. Ridiculous.

This is only a single data point, but there are idiots like this, along with the truly mentally ill, and drug addicts (i.e. bums) that have burned every friendship and relationship.

In a very very high percentage of cases, people who are homeless long term are some combination of crazy and drug addicted. As cities have become much softer on homeless people, you see more people who are only drug addicted.

Under existing court decisions, one cannot be punished for something like homosexuality (which the courts have falsely decided based on bad science that one is born into it) despite it having some components that constitute action. So homelessness per se cannot be made illegal by a city but camping outside in public and private areas can be because they are not in effect necessary. Add in mental illness of street people where the Court decisions in the 70's opened the floodgates and you get our current crisis.
Classic example where the individualism of the 70's creates a tragedy of the commons in cities.

Gets complicated but I suspect that the 9th is going to get overruled here. Street druggies will be the hardest hit--they either have to clean up and live in shelters, spend time in the graybars motel, or leave to other destinations that will tolerate their druggie ness and mental illness components.

My pro bono clients were all fucked in the head. Some were relatively intelligent so long as they dutifully took their meds. But they rarely did. And they usually disappeared after a while, never to be seen again.

Running natural experiments allowing people with mental illness to treat themselves with the drugs du jour and live how they want to live in public places or squatting on private property results in the same mess in cities that Britain got into after the Enclosures Act and gin.

In some ways, our path is worse than theirs in that we enable by direct government spending to make the situation worse in our cities for citizens which makes them unlivable unless you have the means to screen them out of your life via politics or wealth.

I read this last night and there was not enough info. It seems the guy *did* violate the law, and the lawyer was going for a nullification defense -- which is legal, but most judges are hostile to. Fairly easy to fix the situation but neither the courts nor the legislatures want to do it. First, reopen all the state hospitals and staff them properly. Second, mandatory drug treatment programs with lengthy probation terms on all drug offenses requiring mandatory drug testing at regular intervals or being treated behind bars.
Third, as in this case, allow cities and states to prevent druggies and mentally ill from taking over the streets and fund flophouses that take them in but require them to live by rules.
