Judge Gives Rust Armorer 18 Months in Prison

Tough stuff.


Hannah Gutierrez-Reed, the armorer on the set of "Rust" who was found guilty of involuntary manslaughter after cinematographer Halyna Hutchins was shot on set and died, was sentenced to the maximum penalty of 18 months in prison on Monday.

Judge Mary Marlowe Sommer gave the maximum sentence as Gutierrez-Reed did not "take accountability in her allocution," did not apologize for what she did and is not remorseful for her role, adding: "Your attorney had to tell the court you were remorseful."

An allocution is a detailed admission of every act the defendant committed. It's more than a plea, it's a narrative confessing guilt step-by-step. Sometimes it's required as part of a plea. Guuterrez-Reed was found guilty by a jury, though. I think New Mexico allows a defendant to make an allocution post-verdict to take responsibility for the crime, and get a reduced sentence if the judge approves.

The judge did not approve.

Gutierrez-Reed was found guilty of involuntary manslaughter in March following a trial that revolved around whether she neglected safety protocols with live ammunition loaded into the prop gun.

The state prosecutors said before Monday's sentencing Gutierrez-Reed "continues to refuse to accept responsibility for her role in the death of Halyna Hutchins" and instead has placed blame on witnesses, jurors, the set medic and more.

At the start of the sentencing, prosecutor Kari Morrissey claimed Gutierrez-Reed's jail phone calls showed her real character. NBC News reported that in calls with her mother, boyfriend and the paralegal for her attorney, Gutierrez-Reed said jurors were "idiots" and "a**holes" and complained about how long it took them to deliberate.

Sentencing the armorer to 18 months in jail makes it very hard for the state to give Alec Baldwin a sweetheart deal and sentence him to a month of community service on MSNBC. After all, he's the guy who actually fired the fatal bullet, and he is just as negligent as Guitterez-Reed.

But I trust The Regime to find a way to say "no intent."

Eh, I doubt it. She'll be okay, but probably will never be an armorer again.

But something tells me she won't serve 18 months. When they give Baldwin "community service" filming some gun-control PSAs, her lawyers will appeal and she'll be be quietly released after they reduce her sentence to six months with time served.

Absolutely. When something like this happens, there is not a single fuckup (action or person) in the chain. Baldwin certainly has culpability, too - but I suspect he *does* get a sweetheart deal.

I hope you're right, but I fear the opposite: the heavy sentence for the armorer is to assign scapegoaty blame on someone other than Baldwin and close the matter. "See? It was the armorer's fault. She got 18 months! Let's move on . . . ."

The armorer was negligent and deserves some of the blame. But Baldwin was the fucking idiot who shot the women. And to this day I am 100% convinced that it did not go down like he claims.

Remember that someone else also got shot. How did that happen? I've never seen a satisfactory explanation for how Baldwin was doing what he claims to have been doing, and one person ends up dead and another shot. The whole thing is a yuge stinky cover-up.

The civil case is separate and can be brought regardless of the criminal trial result, I believe.

Yup. Back when I was in school, some famous dude got away with something. I forget who and what it was, but one of my classmates commented - in full conformity with the official ideology - "it's disgusting that the rich get away with stuff like this."

I told her, "not at all. Rich people have an easier time in court because they can afford better lawyers, but it's celebrities that have always get away with it. You don't have to be rich, you just have to be famous."

There is *nothing* in the United States as powerful as celebrity. You have to *really* and very, very serious fuck up to face consequences if you're a celebrity. You have to be really, really bad - like dodge your taxes.

My wife, who loves me enough to keep me informed about cases like this despite my obvious disinterest, tells me that she also talked about getting around conditions of her probation and sneaking a gun into a bar.

She's an idiot, which is bad enough, but she's a connected idiot who discovered the hard way that she wasn't connected enough.

So, sports betting is suddenly legal in NC as of a few weeks ago, and the radio has been blaring with ads for an assortment of them. They all have promos going where you place a $5 bet, and then you get three figures in extra betting money.

The idea is to get you hooked, but I wonder if it's possible to place the $5 bet, get the $150 promo (some seem to go up to $250), place it on some kind of 1:1 odds matchup, and then cashout with at least a good portion of the promo amount.

That may be true but is a different issue.
The one thing I've thought about is that at some point, if that loaded gun was assigned to Alec, he was actually going to pull that trigger during filming eventually.
That bullet shouldn't have been there, and it was destined for someone in the future. If he hadn't been fucking around, it wouldn't have been the cinematographer, but might have been a co-star.

The civil case is separate and can be brought regardless of the criminal trial result, I believe.


An acquittal in the criminal case would have no bearing on the civil case, since the standard of proof in a criminal case is 'beyond a reasonable doubt' but the standard in a civil case is 'by a preponderance of the evidence.' Thus, it is theoretically consistent that a criminal jury could acquit, but a civil jury could impose liability based on exactly the same evidence. It just means that the evidence was just strong enough to meet the lower civil standard, but not strong enough to meet the higher criminal one.

According to him, he was asked to point the gun at her for a particular camera shot - to see if it would play better than how the script was written. That “down the barrel” shot isn’t unusual. What is, however, is that blanks were mixed with live ammo, and Alec had his big fat finger on the trigger, whether he says he did or not (even if he checked first, would he have known this was live versus a blank? I don’t even know. I would hope so). Do I think he pulled it on purpose? No. I think he is dumb and was careless on a lot of levels in this case and many others on that set. In this case, the consequences were horrific.

From what I vaguely recall - so take it with a heap of salt - they went to the range sometime before the film shoot and they used the movie weapons. Someone left a round in one of them and the armorer didn't clear the weapon.

Yes. Those weren't prop guns. They're real guns.
So during down time they'd load them up and shoot up the desert. Typical gun fun.
So it really was up to the armorer to make damn sure after these little excursions that every single gun was emptied, the gun was tagged as emptied, and then set aside to be loaded with blanks or not for the next scenes needing them.
She did not.

Because they pretty much have to in order to be realistic.

I suppose one could build a replica of an old Colt Single Action that only accepts blanks, but it would be expensive to make it look right, and you'd have to manufacture one of these for every kind of weapon used in any movie. It's much more cost-effective to use real guns and leave them in the hands of a competent film armorer.

One part of this equation was sadly missing on the Rust set.

A female deputy I know was working a drug case with a husband and wife locked up for meth. Wifey got out first and her husband would call from jail and tell her where the drugs were, where the guns were and where the laptop was of him and her and the whole family of 3 kids having inappropriate sexual relations on video. He got 9 consecutive life sentences and wifey got 40 years.

All from jail house calls which allowed for warrants to search the trailer.

And as far as I know, they tell you that they're recording and monitoring everything, and tell you so in plain language. I've never been arrested, thankfully, but I have gotten calls *from* people in jail and every time, there is a long disclaimer before the call is connected.

You take a Colt replica, a Ruger Vaquero, or a half dozen other makers and you slug (fill) the barrels.
You crimp the ends of the ammo so the powder doesn't fall out. Down along the underside of the barrel before where the slugging starts, you vent it so gasses can escape.
Flames and smoke are added post production.

Semi autos NEED a barrel obstruction to even make a blank cycle the slide.

That is simple liability law that applies to Whorreywood as it does to a machine shop and its owner and employees.

For civil liability, as producer of the movie, Alec is legally responsible for the acts of his 'agents' including Alec the actor. A wrongful death suit then by the estate of the cinematographer (and other guy that was injure) sue Baldwin in his role as producer. I assume that Baldwin had liability insurance but that can sometimes get sticky over willful misconduct that is a whole nother kettle of fish.

Loves The Witcher. Loves Warhammer. Seems extremely down to earth. Even met Russell Crowe when he was a kid playing rugby, a story that Crowe actually told.

Brandon Lee was killed when a prior live round was caught in the barrel and then fired out of the gun when a blank was shot. He might have survived but since he was supposed to get shot and fall down in the scene, it took a while for the crew to realize he'd been actually shot.

It's stil strange to me that Standard American is something that an English actor has to "put on." To me it's normal, while the BBC announcer dialect, or other UK dialects, are ones to "put on."

She obviously had no idea on how to be a set armorer; apparently it isn't something that you learn by osmosis. That the hazards of letting the cast and crew get in the habit of putting live ammo in the "prop" firearm never occurred to her, speaks volumes.

While she may work in Hollywood again, I'm doubtful that she will ever be allowed to touch a firearm as a set armorer: she's a proven risk.

Because they pretty much have to in order to be realistic.

I suppose one could build a replica of an old Colt Single Action that only accepts blanks, but it would be expensive to make it look right, and you'd have to manufacture one of these for every kind of weapon used in any movie. It's much more cost-effective to use real guns and leave them in the hands of a competent film armorer.

You could slug the barrel, but that would be damned dangerous for the pulling the trigger on a live round. Deservedly, yes, but still...

Just modify the cylinder. You know why you can't load a .357 round into a .38 revolver? Because the .357 brass is longer, and the hole in the cylinder is machined with a step the thickness of the brass at the shorter length of the .38 round.

Reverse this. An insert thick enough to interfere with the the bullet is welded in from the barrel end just short of the brass length.. The felt wad will blow right past it,big bang, flame and smoke out the end, but any brass with an actual bullet in it can't be inserted.
