Jon Stewart Defrauded New York By Severely Undervaluing Home, Depriving New York of the Property Taxes It Deserved

He screams a lot about Mar-a-Lago having a low estimated taxable value in Florida, but being represented as being worth a lot more than that in loan applications.

And yet Jon Stewart did the exact same thing -- and defrauded New York in exactly the same way Trump allegedly did.

He's not just terminally unfunny, he's also a scumbag ignorant idiot.

Jon Stewart benefited by 829% 'overvalue' of his NYC home even as he labels Trump's civil case 'not victimless'

Comedian Jon Stewart ranted this week that Donald Trump's civil real-estate case overvaluing his properties was "not victimless," yet when it came to his own home, Stewart benefited from a similar inflation.

On Monday night, Stewart, 61, unpacked Trump's $454 million appeal bond, calling out experts framing the former president's New York civil case as not causing direct harm to any individual.

"The Daily Show" host rolled a clip of CNN's Laura Coates interviewing "Shark Tank" star Kevin O'Leary, who commented that the ruling didn't "go over well" with the real estate industry that was now fretting over the possibility of becoming the next target.

Coates responds to O'Leary by highlighting that Trump was found liable for falsifying business records in the second degree, issuing false financial statements, insurance fraud and conspiracy, all due to asset inflation.

"Everything that you just listed off is done by every real estate developer everywhere on Earth in every city. This has never been prosecuted," O'Leary replied.

In response, Stewart asked: "How is he not this mad about overvaluations in the real world?"

"Because they are not victimless crimes," he said.


To further his point, Stewart argued that "money isn't infinite. A loan that goes to the liar doesn't go to someone who's giving a more honest evaluation. So the system becomes incentivized for corruption."

Stewart also contended that failing to declare a higher market value on a property, while paying taxes based on a lower assessed value, constitutes fraudulent behavior.

"The attorney general of New York knew that Trump's property values were inflated because when it came time to pay taxes, Trump undervalued the very same properties," Stewart added. "It was all part of a very specific real estate practice known as lying."

But it didn't take long for internet sleuths to look into Stewart's own property history, which shows his New York City penthouse sold for 829% more than its assessed value, records confirmed by The Post reveal.

But according to 2013-2014 assessor records obtained by The Post, the property had the estimated market-value at only $1.882 million.

The actual assessor valuation was even lower, at $847,174.

Records also show that Stewart paid significantly lower property taxes, which were calculated based on that assessor valuation price -- precisely what he called Trump out for doing in his Monday monologue.


Because Jon Stewart is an unfunny old liberal high school girl, he reacted the way all aging liberal high school girls do on the internet, with extremely grating and shrieky sarcasm all sporting a shrill exclamation point.

6 The assessed value is basically never considered the market value, so much so that jurisdictions with which I am familiar will have both values - one "assessed value," and another "estimated market value" publicly available in tax records. It's just so goodamned stupid to not understand that these are terms of art and not literal valuations.

The "assessed value" of a property is not the value of the property if sold on the open market. AV is a set percentage of "market value" based on certain objective criteria like tax class. It will always be much lower than the actual market value.

Even the "market value" part of the AV calculation isn't an actual market value in the sense of what the property is actually worth. It's a value assigned to the property by NYC dept of finance. The property owner has no role in this determination, although the owner can petition to lower it if he thinks it's out of whack with comparable properties.

Your Assessed Value is based on a percentage of your Market Value. This percentage is known as the Level of Assessment or Assessment Ratio. Your Assessment Ratio depends on your tax class.

I loathe Jon Stewart as much as the next guy. But the apparent low-balling of his property has nothing to do with any actions or decisions by him. It's a function of the odd way NYC calculates real estate taxes.

No. When it comes time to pay taxes, you pay according to the assessor's, well, assessment of the value of the property and then pay taxes at the legally prescribed rate based on that assessment. You don't estimate your property's value when you pay taxes. The exception is if you think the assessor got it wrong and assessed your property at over market value - then you can contest the assessment.

But either way, you pay on the assessment.

I was quite familer with the values in this one subdivision. Initial sale price was $20/lot, $25k for corner lots. These were 1 acre lots.
In the Clinton years the bottom fell out and they were going $3k/lot.
Then things got much better and they were asking up to $50k/lot.

...then it got much much worse... half the subdivision was over run with lava. This was Leilani Estates in Hawaii, where the valcano erupted and covered a good part of that east side of the island.

When the flow stopped a relative who lived upload of the eruption managed to sell for what he bought in at when the low was $3k/lot. And his land was unaffected by lava or gas.

You can imagine the fluctuation and appeals on tax assessed values.

Or at least worthy of a big fine! I've been involved representing clients in maybe fifty NYC real estate appraisals/financings. This is how it goes:

1. Owner wants to borrow money.
2. Bank wants to lend owner money.
3. Owner has real estate as collateral. Pulls value from ass.
4. Bank works out approximate amount of loan with only tangential regard to value of collateral.
5. Owner agrees to term sheet with that loan amount.
6. Only then does the property get appraised by bank.
7. Lo and behold, the bank's appraiser appraises the property at just the right amount to justify the loan!

It's a game played by both sides that only gets tested in the tiny fraction of cases where the property is seized and sold to pay the loan.

Yup, but the game is played by all players. The seller asks for a certain price for a property. The borrower asks to borrow money based on his assessment of the property's value. The bank offers to lend money based on its assessment of the property's value. If they all agree on value and terms, the transaction happens. None of it has anything to do with taxes, at least not property taxes. The county's assessor determines *his* value of the property for tax purposes, and the owner can contest it if desired.

This entire case has been utterly preposterous. The bank agreed with Trump's assessment of the property's value. If they didn't, the loan would never have been written.

Honestly, many jurisdictions are only allowed to reassess properties a certain % each assessment period. There are caps, they can be effected by owners age, property sale during assessment period, a whole host of matters that cause a break from the assessment.

It's not even "playing the system," it's how the system works in virtually every case. It's not a dodge or a scheme, it's business as usual. Every property has up to four simultaneous values:
1. The owner's valuation
2. The buyer's (borrower's) valuation
3. The lender's valuation
4. The tax man's valuation

When a property is sold, parties 1-3 must come to an agreement. When a property is refinanced, parties 1 and 3 must come to an agreement. Party 4 is independent of the rest, but Party 1 can contest (usually unsuccessfully) Party 4's assessment in the event that Party 1 finds the assessment unreasonably high.

That's it. That's the entire system, and nobody has to "play" it. It's just the way it works every day, and has for decades if not centuries.

Then made that searchable so that people could search what their property had against similar, and challenge assessment values.

We did it for a few lawyers... at the time to make it go live they told us to stop... they got word the local government would never let it happen and didn't want any problems.

When it comes to government, they have all the info they need. Anything tax related is on them, not on you.. .if you are paying too much you can appeal, but if they are not taxing you enough, it's not your problem.

303 This is so stupid. Taxes are based on assessed value. The owner has no input on either number. It's just what the value is assessed at and the taxes levied. Most of us own a property. We just pay what they make us pay.

Stewart sold his property for more than it's assessed value like everyone does. The seller doesn't determine that number either. The buyer pays what the buyer wants to pay.

What Trump did is lie about the value of his properties, greatly overstating their value and in some cases their square footage, so he could obtain favorable loans from banks.

No evidence Stewart leveraged his properties to obtain loans. No evidence he over or undervalued his properties. This is desperate.
