When you say there's a "lack of afforable homes," of course you mean a lack of free homes.

There are a lot of cheap digs. These people do not want to work. They want to steal entire homes from people who do work.

John Stossell reports that this epidemic was caused by blue cities passing "tenant protection" laws that forbade property owners from evicting them even if they failed to pay rent for years and years. This law also empowered squatters to just break into homes and declare that they, too, were non-rent-paying tenants with a right to permanently occupy other people's homes.

The situation is so bad in California that vigilante squatter-eviction squads have formed to kick the squatters out. Technically these people are breaking the law, because California law says the squatters are the rightful occupants of the homes they squat in.

Hey Keith Ellison -- maybe we should go after the real criminals, the actual owners of the homes who make their homes too tempting not to steal.

Oh yeah -- that's exactly what blue cities are doing already.

Squatters were occupying a NYC apartment. The actual owner came to the apartment to clean it up.

The squatters beat her to death.

Recently, Nadia Vitel, a 52-year-old woman from Spain, traveled to NYC to clean out her late mother's apartment. She found squatters in her mother's home and they beat Vitel to death.


Remember, this is just "hysteria."

Ron DeSantis, who you might have noticed is one hell of a problem-solver ("More of a problem-eliminator," as James Bond said), decided that the squatter outbreaks of LA and NYC would not be coming to Florida.

He just ended "squatter's rights" in the state of Florida.

Once again, he's not lying. The same Illegal Alien Influencer who said he had not snuck across the border to work, but to go on a permanent vacation -- on the backs of US taxpayers paying welfare for his infant anchor-baby daughter, who he called his "gold mine" -- is now advising illegal aliens in how to execute legal home invasions.

Although this filthy freeloading criminal is now officially an "absconder" from INS, no one is trying to arrest him and deport him:

Moreno was waved into the United States, given papers and a place to stay, provided food stamps and a monthly stipend, and begged on the street, making $1000/day. At least that is what he claims.

He is listed as an "absconder," but despite posting videos that show exactly where he is, nobody is interested in finding and deporting him. Instead, he is allowed to give instructions to migrants on how to steal homes from Americans.

Actually Ace, many do have income: income they get from "tenants" they turn around and rent spaces in the squatted home to. You'll be shocked to learn these "tenants" are often drug dealers and prostitutes. You can see some of them in the videos. Tell me those girls aren't prostitutes.

Which is so astounding that it cannot be considered an "oversight."

A tenant has a lease or some kind of agreement. It may be in breach, but it is - or was - there at some point. Not demanding some kind of agreement as evidence was so stupid it had to have been on purpose.

The successful squatters have faked up a lease that they show the police when you call them. The police are not in the business of verifying the authenticity of leases so they just tell you to take them the court, the very thing the squatters want.

According to the previous post, there are 51.4M foreigners in the US and 25% of those are illegal... cuz we're determined to hew as close as possible to that "only 10M illegals" lie they've been telling us since the 80s. Yes. This. The problem isn't so much squatters rights -- although that is a problem -- but tenant rights.

What happens even in most squatting situations is that the squatters fake up a lease and claim they had a deal with the prior owner or whoever. When the cops show up, the squatters show the cops the lease. It then becomes a housing court issue. You can take away all the "squatters rights" laws in the world, but you'll still have the situation of scammers showing fake leases.

And it's very easy to fake a lease. Most residential leases are basically forms anyway. Just download a for and plug in your name. Done.

This will lead to, for example, a demonstrable policy of having all lease agreements notarized. Add yet more "compliance costs" to everything.

Due to various diseases and wars, many farms sat vacant due to the occupants perishing from disease or violence. In order to keep the farms in operation, they allowed individuals to step in and get the farm up and running again.

Of course it has since been given all kinds of legal "justifications" and protections as well as new names (adverse possession)...and taken on a whole different purpose (laziness).

I would tell them the story about how I went to housing court once for a client. There were a number of RE agents there waiting fortheir turn in court. One I knew told me he was there because a tenant had punched him out and the court wouldn't let him evict him. That is just one of many sad stories I could tell. The worst are the ones where a compassionate landlord rents to someone in need and then that person totally f's them.

That has been tried, and for a while LL posted executed leases on public real estate dockets like ACRIS. But it was viewed as a pain in the ass, had no real legal significance, and both LL and tenants didn't really want the terms and identities of the leases open to the public. So I don't think anyone does that any more. But the idea of a requirement that actual enforceable leases get recorded somewhere isn't a bad one -- although it's yet more government involvement in private transactions.

Second is the guy who transferred title to his mother, signed a lease with her, waited until the squatters left, busted in, threw their shit on the lawn and waited for the cops.

He then produced the filed deed showing the owner and an original of a signed lease saying he was the legal tenant.
At that point, the cops can arrest the squatters for trespassing.
Cheaper and faster than eviction.

In MO, it's only 10 years before a squatter can make an adverse possession claim. They also have to have treated the property as if the owner would--and provide evidence that this is the case.

There are provisions to take over abandoned property. Steve Lehto described a case where a person squatted in a home, maintained it, and finally claimed it as his own. However, he had to prove he was there for ten years, and kept it up.

It's from the common law, and squatting CAN make some sense.

If there's a property not being used and you turn it to productive use, I can see society wanting to reward that- the person who USES the property gets ownership. The premise is to avoid people locking up properties and never using them.

And, once the billionaires buy up all the property in the U.S. and herd people into the "15 minute cities", we might want that law back, too. (But they'll have long since ended it, anyway.)

It isn't many. Believe it or not most squatters are well organized. They will have the local police on speed dial and when they arrive the police are forced to admit that it is a Civil matter for the Civil Courts and have no jurisdiction. They can only intervene if there is obvious evidence of a crime (such as a broken window to get in etc.).

163 Yes. This. The problem isn't so much squatters rights -- although that is a problem -- but tenant rights.

What happens even in most squatting situations is that the squatters fake up a lease and claim they had a deal with the prior owner or whoever. When the cops show up, the squatters show the cops the lease. It then becomes a housing court issue. You can take away all the "squatters rights" laws in the world, but you'll still have the situation of scammers showing fake leases.

And it's very easy to fake a lease. Most residential leases are basically forms anyway. Just download a for and plug in your name. Done.

Squatter and "adverse possession" laws once made sense. They originated 100s of years ago when a lot of land was available and some was deeded to someone who abandoned it, moved away or died, leaving the land technically owned but not being used. Someone else coming on the land and actually using it eventually become the owner. But even then, the period required was like 20 years. Not this 30-day shit.

188 Speaking as someone pretty much stuck in CA, I have acquaintances with this crime problem, mostly it occurs with people who own a 2nd home (I don't).
If the owners go thru civil courts that is a lengthy and expensive process. Sometimes the owners just pay the squatters to leave. A settlement, if you will.
I've heard of extra-legal methods also, but obviously can't recommend them.

Yes, but there are a non-trivial number of empty properties that are listed because the owner had to move for work or whatever.

And they aren't that hard to find. Just go to Zillow and look around. The ones where interiors are empty or "virtually staged" are unoccupied. Look for the ones on the market for three months or longer, not under contract, few or zero price cuts. That's your target. It's trivial.

They paid the squatter and got $690k off the home as a result. However, the buyer found out about the arrangement and there is a suit pending on that. There are, also, criminal charges of some nature as well.

The fakers climbed into leadership and abandoned their principles while saying the right things during election season.

However, the change is slowly happening (the ejection of McCarthy is a sign of that), mostly because the GOPe keeps shooting itself in the foot. How do you retain power within the party if you get 40 of your most loyal footsoldiers in Congress to resign in 2018?

Essentially, Congress is still fucked, but slightly less fucked than before. It'd be better to expect DC just got removed from our reality by interdimensional beings than for Congress to start being remotely conservative, though.

Washington, which always like to top CA in idiocy institued rules that a landlord can't evict a tenant during winter. It will shock you to learn that many tenants simply stop paying rent in November. And by the time the landlord can even start evictions in April, they will have lived for free for 1/2 a year. And then it takes several more months for the eviction to actually happen.

And even more shockingly after this was implemented a bunch of landlords said fuck this and took their homes out of the rental pool. Which drove up rents and hurt the honest tenants who pay their rent on time.

Who could have POSSIBLY foreseen any of these unintended consequences?

I have never understood how anyone can say someone that actually owns a property can't kick you out. The dynamic should be the tenant has to prove why they can stay, not the other way around. The NY case was sickening. I have heard of blue state people going through similar bullshit. For instance, if I squat in an empty home, and after ten years the owner has never had anyone check on the status of the property, there's an argument to be made that the home has been abandoned, and the title owner might not even be aware that he or she ever had a claim to the property. By squatting, I put an otherwise "wasted" property back into use. That's just one example. There are others.

Squatting in such circumstances was recognized under English Common Law, and each state has different laws on the subject. But up until recently, those laws required a long-term (i.e. at least a decade) unchallenged habitation. The stuff that's being pulled now is nothing like the traditional legal form of squatting.

Anyone squatting in a property there will be frog-marched out and given a year in the local jail for failing to keep the property in compliance with the local property association's property appearance regulations.

I own vacant land that someday will be developed. Likely decades from now. That's not an invitation for someone to grab it in the meantime and put up a camper and then I have spend tens of thousands in legal bills to have them removed.

My lawyer told me many years ago that the landlord tenant code that prevails in my jurisdiction is written so as to favor deadbeat tenants and sleazy landlords.

If you are a tenant whose landlord does not complete repairs and simply could care less, you have big problems. Just as does the landlord who has tenants that know the game and could care less.

I did have a deadbeat tenant (a skilled carpenter BTW who was not broke) who simply wouldn't pay his rent for months. My assistant totally coincidentally overheard him bragging to some friends about how he knew the game is played and that he had me over a barrel.

That afternoon I had his windows boarded while he was out and the door padlocked. When he called to protest I told him tough luck, pal, take me to court. It will take months and guess what, I have more money, better lawyers, and I'm going to make your life miserable.

It took months. In the end I received some compensation in court, but was reprimanded by the magistrate, who told me, "You know better, don't do it again."

This was circa 1995. Wouldn't recommend that course of action, but I enjoyed it then.

The problem with those "$1 houses" in Detroit is usually all the copper plumbing and wiring is gone. The roof is usually shot, leaking water everywhere, and mold is pervasive. Most of those houses should be bulldozed.

But I'm coming from the argument that there is no "good" reason to allow someone to steal property, even if the owner is not constantly securing it.

If something is truly abandoned, there's a legal process for determining that and it can be sold. Not some rule where whoever gets their first and then refuses to leave somehow has legal title.

Was this "Build Back the Block"? Two ghey-guys buy run down or abandoned houses in Detroit, and fix them up to be livable again. The neighbors (mostly black folks) love these guys, because they take run down houses, fix them up, and keep the neighborhood from sliding down even worse...making their lives kind of a hell.
I don't know about them selling any houses for $160K, but they have rebuilt some houses and made a tidy profit. And they rebuilt one house and decided to make it theirs, and moved in.
They haven't found any dead bodies (yet) in any of the abandoned houses, but that is usually where dead bodies are dumped, in abandoned houses. Some of the houses were in REALLY bad shape.

DeSantis used Cruz reruns for some key positions. It would have been a hard slog anyway because of Trump's name recognition but it was made harder by what the Dems did to Trump. +
