Federal Appeals Court Okays Texas' Law Allowing the Arrest and Jailing of Illegal Aliens

Federal appeals court allows Texas immigration law to take effect.
Law enforcement officers in Texas are now authorized to arrest & jail any illegal immigrants crossing the border.

Texas passed a law making the crime of illegal entry into the US a Texas crime in addition to a federal one. This gives Texas law enforcement the right to enforce this Texas law, even if Biden decides he's a King and can unilaterally repeal the federal law.

A federal appeals court has blessed the law.

A federal appeals court granted a temporary stay of a lower court's decision to block the enforcement of a controversial Texas immigration law, paving the way for it to go into effect this week if the Supreme Court doesn't intervene.
Last week, a federal judge in Austin, Texas, blocked the state government from implementing Senate Bill 4, which would allow state law enforcement authorities to arrest and detain people they suspect of entering the country illegally.
Judge David Alan Ezra wrote in his Thursday decision to halt the law that "If allowed to proceed, SB 4 could open the door to each state passing its own version of immigration laws."

Oh, no!!!

Texas appealed the ruling, with Republican Gov. Greg Abbott saying, "We will not back down in our fight to protect our state -- and our nation -- from President Biden's border crisis."
Over the weekend, the 5th US Circuit Court of Appeals granted a stay of Ezra's decision but put its ruling on hold for seven days, allowing time for the Biden administration to go to the Supreme Court.

I still do not expect this law to survive in the Supreme Court.

The Supreme Court in 2012 largely struck down a similar measure in Arizona dubbed the "Show me your papers" law. The high court concluded the federal government had the power to block the law but let stand a controversial provision allowing police to check a person's immigration status while enforcing other laws if there is "reasonable suspicion" that the person is in the US illegally.

But Texas is now citing the power of states to resist "invasion" as granting it the power to defend its own borders. The Supreme Court may buy into this claim, but I'm pessimistic.

Let's just say that 4 of those justices on the 2012 court are gone now. 3 of them voted in favor of the federal government (RBG, Breyer, and Kennedy).

Kennedy has been replaced by Kavanaugh. RBG has been replaced by ACB. Breyer has been replaced by KJB.

The last, Scalia, was replaced by Gorsuch who has been very amenable to western state concerns on SCOTUS.

I mean...I dunno, but I don't think it'll be terribly one sided either way.

I'm not seeing the issue.

Citizens have right to travel, so we're good.

A lot of US laws are a total patchwork. See knife and gun laws for example. My CCW from WA doesn't get recognized in OR. What knives are legal or illegal can vary based on what county I'm in and what cop wants to make it a big deal.

Tax laws are all over the place too. It's a genuine strategy for big companies to operate with a generic tax strategy until the locals go to court to prove they're not following local law, then to follow the ordered court tax strategy. This isn't because they're intentionally thumbing their nose at the tax law, it's because tax law changes so much according to different zones, districts, states, counties, etc. it's literally cheaper to do it this way than to find an expert for each of these areas and follow their recommendations.

Regarding traffic laws, yes, you must provide ID, BUT there must be an assertion of a crime being committed. You would be surprised how many cops go fishing and don't say why one has been stopped. Also, passengers are NOT obliged to provide ID.

Doesn't work that way. 5th circuit's stay on the district judge is valid until either Scotus takes up the case and decides otherwise or the judge actually goes through a trial allowing both sides to make a case rather than through the injunction route.

Personally, Scotus has the power to simply not hear the case as three Dem justices are not enough to actually grant cert (have to have 4). Thus, the border would remain open in states west of Texas but not Texas itself.

If she wants a starter book, I'd recommend Tom Woods' "The Politically Incorrect Guide to American History." It's a bit dated, but Woods in fantastic at clarifying on the general subject of seeing things beyond the leftist propaganda.

If she gets through that, he's written... I don't know dozens of books? Has a very fine podcast, and is generally an all around decent guy.

I know there are other sources for this sort of thing, but if someone is starting out, and really interested, you can't go wrong with Tom Woods.

It is, but actually limited in practice as it is in much of the EU. Limits that would have our left screaming their vajajay encased heads off about. What this does is make it part of the constitution so a law can’t come along and make it illegal, as it is in some EU countries. It’s part of the constitution now.

I have a huge problem with Terry. Common Law not withstanding, it doesn't pass Constitutional muster. That's one of the points of the Constitution. Common Law is easily followed into tyranny, and the Constitution checks precedent.

The Constitution says due process and security in papers and belongings. It doesn't say, "unless an older Common Law precedent allows us to pretend otherwise."

However, the colors that I didn't see correctly before are drastically changed. I can see the red hue over everything, and I'm fairly sure that's not "SEEING NORMAL".

However, I could describe correctly how neon colors look and distinguish colors that I couldn't previously. (Certain blues and purples, for example.) I could tell that my wife's red hair was actually red, as well.

So does it "correct" your colorblindness? No. Does it allow you to see some colors that you couldn't distinguish before? Yes.

So don't wear these all the time like an idiot, but use it to appreciate things in ways you couldn't before.

Due process itself does not create a separate right but instead is a process must be in place to protect them--in this case imprisonment etc. Due process then would be to support the warrant of the 4th provisions and that has been basically limited since the founding to places and things that you can exclude others via property rights.

And before Katz, basically in public, your rights were negligible over privacy which is a modern conception of the law and how common law informed our constitution.

It really is not their place as a Court of Opinion.

I was afraid that this case could resolve for Trump but in a way where the fed takes just a little more power of elections away from the state.

However, I think that the SCOTUS' point of saying that states should not be making state-wide decisions as a sort of policing of federal amendments to have threaded the needle.

The problem is essentially without originalism of some form, whether intent or textualism, the Constitution itself becomes unmoored and malleable. The whole Living Constitutionalism movement itself is based on Positivism that the law should be whatever Scotus says it to be based on the Great Principles of the Constitution and Critical Legal Theory goes beyond even that and argue it should be viewed as a document that permits positive discrimination to minority groups and punish white privilege embodied in the document.

That *can* work, but with two downsides:
1. It's transactional. You have to have *and* keep having money, or the gold-digger will leave.
2. It takes a whole lot of money. You have to both be rich and be rich enough to look rich while still being rich. If you're rich enough to appear rich and wear your money (and drive your money, etc.) but not rich enough to do that *and* actually have amassed enough assets to keep paying for all that, you're not actually rich enough to pull it off. Most of the actually rich people are the ones without mortgages and driving around in payment-free Camrys and with a few hundred grand in the bank - but that's all invisible and so can't be used as an attractor from the start. Being rich enough to have all that and be wearing designer brands and driving flashy cars and having boats and stuff means you're stupendously rich. And yeah, different rules apply to the stupendously rich.

I have a nose piercing. Not a septum piercing, so no bull look here and I don’t wear a ring, I have a tiny diamond stud. I blow my nose like everyone else, it doesn’t go shooting out the side of my nose like a geyser. It’s a very tiny hole. I use saline to keep things clear when I have a cold or allergies. I would do this if I didn’t have a piercing because who likes a stuffy nose? There is no difference at all from the pierced side to the non pierced side. I don’t want mucus hanging out in either nostril.

Morrison was pulled over due to her vehicle having multiple violations. Her husband - Darius McLean - pulled behind the police car which prompted the officer to approach him.

As you can see in this video which was shot by Morrison and uploaded (but now deleted) by her sister, her husband was verbally combative, and according to police resisted arrest (you can see he wasn't too compliant at first).

"It's 'cuz I'm black!" McLean yelled.

During her husband's arrest you can hear Morrison shouting "I work for the mayor!" - seemingly in an effort to get out of the situation.

The Fed law says illegal immigration is illegal, and they must face deportation. Biden is declining to enforce the law. Issues with that aside, that doesn't prevent Texas from passing their own law that mirror fed law and enforcing that. Courts have always blessed that action - why wouldn't you want both the state and the feds enforcing the same law?

Hence unless the federal law says the states can't do this, then they can. It actually shows Biden is a liar - they don't want it enforced and want to prevent Texas from enforcing it.
