Supreme Court Unanimously Strikes Down the Colorado Supreme Court's Juvenile Internet Trolling Disguised as a "Judicial Decision"

The Court ruled 9-0 that Colorado had no power to exclude Trump from the ballot.

Court decisions are made up of two big parts: the ruling, and the opinion. The ruling dispenses with the issue directly in front of the Court. The "instant dispute," as they say. The matter right here in front of us. Here, that ruling is that the Colorado cannot exclude Trump from the ballot.

The opinion explains the reasons for the ruling, and announces how all similar cases in the future will be decided (or, at least, what the structure will be for deciding them).

The Justices were unanimous on the ruling, but the liberals did not join the majority opinion. The majority opinion still rules. But three Justices didn't join it.

Six Justices -- the five "conservatives," plus Roberts -- voted for an opinion stating that Congress alone has the power to announce who is disabled from holding federal office due to "insurrectionary" acts. Presumably Congress would actually pass a law stating that certain persons named in the law were insurrectionists and not eligible to hold federal office.


The three liberal Justices claimed that that goes to far, and that a state could rule that Trump (or any other office-seeker) was barred from seeking federal office if that person had been convicted under the federal law of "insurrection."

That's not a crazy position to hold, but the justices in the majority probably resisted it, because they know the left is just spamming out one lawfare case after another, and if they left any wiggle room for another series of lawsuits to exclude Trump from the ballot, they'd leap to do that, and we'd have another nine months of actions to bar Trump from the ballot and a bunch more Supreme Court hearings on the constitutionality of these lawsuits.

So the majority said, "No, that's enough of this bullshit. It ends now."

"Per Curiam" means "by the court;" no single justice is writing it. A "per curiam" opinion represents the entire court.

The ruling here is "per curiam," as it's unanimous.


It's certainly gratifying that @dhillonlaw client Donald Trump won the Colorado case before the Supreme Court. (I was not part of the superb SCOTUS advocacy, but I was very involved in DJT's challenge to Colorado's actions which SCOTUS upheld.)

Many unanimous decisions are written by an identified judge. When decisions are "per curiam" they generally fall into two categories: (1) the decision is very simple and obvious and (2) the decision is such that none of the judges want their fingerprints on it.

In this case, it's almost certainly the latter. It can't be #1 because of all the concurrences. That doesn't bode well for the immunity case. I think the Court is setting this up to fuck Trump on that case.

Doubt it. More likely Scotus gives the President at least qualified immunity that it gives to any other government employ and might prevent states from criminalizing official actions.

My guess is something like executive privilege case decision in US v Nixon. That case ratified executive privilege but allowed it to be overcome via individual criminal actions. Then they will send it back to district court.

There is also a pending legal challenge to the legality of Smith's appointment as it did not conform with the special prosecutor statute.

.. the immunity case has to be heard, the SCOTUS had no choice. The Appeals Court refused to take on many of the issues of the case. They just said 'no'.

Clearly, if there is immunity for judges and prosecutors, then the POTUS has some level of immunity. It probably cuts along the lines of official action vs personal actions. The Appeals Courts didn't eve make that distinction.

The Constitutional provisions were not at issue in the case, only the meaning of the 14th Amendment which specifically does not change constitutional eligibility for office--it adds that Congress has the power to create a law that punishes those engaged like in the South of a widespread insurrection against the established government by civil and criminal means. There is a criminal statute that already allows a candidate to be disqualified for office if they are tried and convicted in federal criminal court of engaging in insurrection. The civil law allowing disqualification lapsed in the 1890's.

Ever since one of my friends went into Law school, and seeing how he talked with his law school classmates, I am convinced that the legal profession is dominated by people who think that their ability to make an argument for a position makes it the truth.

I suspect that this is sort of a soft requirement for lots of kinds of legal work. It's a lot easier to do defense work if you can honestly convince yourself that your client is innocent, and a lot easier to prosecute someone if you sincerely think they deserve it. So it seems like a lot of what happens in law school is molding you into the kind of person who is very good at making complicated and technical arguments while at the same time jedi mind tricking themselves into believing those arguments.

I thought there was a non-negligible chance that the 3 liberals plus Roberts would be 4 votes for something other than that. All they would need was to pick off another judge.

I'm much less optimistic than you are (and others above who say the same thing). It's the "for official acts" that would be doing a lot of heavy lifting. While I think a majority of judges would agree in theory that "POTUS has immunity for official acts," there is a lot of leeway in there to determine that what Trump actually did was not an official act. I can see the quips right now: "Insurrection is not an official act." "Crimes aren't official acts." Etc etc. I think at least the 3 liberals will go that way.

Even that sounds like a stretch. I would argue the original intent of these laws was dealing with the Confederacy and all of these "insurrection" laws are simply no longer valid.

No, Congress would have to pass a specific law that set about the conditions of the 'insurrection' like the Enforcement Act of 1870 Sections 14 and 15 using quo warranto procedure. It can't constitutionally do so by name due to the bill of attainder clause but has to write general language that allows federal courts to decide who is and is not to be excluded from the ballot.

Point it, no one has been charged with this - certainly not Trump. That was the farce behind the entire thing; if you want to say someone is guilty of insurrection, then you need to indict them under this statute and hold a trial. It is a violation of Due Process to declare someone guilty of a crime when there has been no trial.

I think it will be much worse. At least in 2020, there was still some semblance of law enforcement and that burning down cities might get you prosecuted and sent a way for a long time. We now know that ain't true. Only a tiny fraction of the 2020 arsonists and violent savages were prosecuted, and even then mostly for wrist-slap offenses. 2024 and 2025 will be more emboldened.

And to take a step back when the left screamed that the 2000 election was stolen they were given a broad license to give steps that would improve the process from their perspective - including being given the right to audit the ballots themselves which they famously did and found Bush's votes in FL were slightly undercounted.

I think it will be much worse. At least in 2020, there was still some semblance of law enforcement and that burning down cities might get you prosecuted and sent a way for a long time. 626 I am going to dissent on the 9-0 and "unanimous on the decision" bits.
This was a 5-3-1 decision that is presented as unanimous for purely political reasons and to cover the partial dissenters.
The two concurrences read more like dissents, accepting the final outcome but disagreeing to a major element of it, namely that only Congress can classify what is disqualifying and the process for carrying out that disqualification. This is major.
Under the main pseudo-concurrence, the three proggie justices clearly want to reserve some authority, either to the federal judiciary or perhaps the executive, to summarily disqualify people from running for or holding federal office for insurrection. They are absolute on this, accusing the majority of the kind of judicial activism that the proggies indulge in, reading things into the text of the Constitution and going beyond the scope of the question at hand.
Barrett's pseudo-concurrence subtly endorses that position, even while appealing to unity and support of the decision as a purely political act. That is possibly more disturbing than the quasi-dissent the proggies issued.

Perhaps I missed the joke. Naming individuals specifically in a law would constitute a bill of attainder, would it not? The law would have to describe a type of individual or action covered by the statute, rather than naming them.

Otherwise, the CA minimum wage law could have said it applied to everyone except Panera Bread.

631 The SC ruled 9-0 that states can't enforce Section 3 of the 14th Amendment. It seems obvious that this is the case, and the wildly partisan parts of the legal community who argued otherwise have beclowned themselves.

The per curiam opinion goes a smidgen further and says only Congress can provide the process by which someone can be DQ'd under Section 3. The liberal trio objected to this, saying that in making that ruling, the Court went beyond what it had to say to decide the case. Under normal circumstances, the liberal trio would be correct, but the Supreme Court is not made up of idiots, and the per curiam authors knew what they were doing.

If someone other than Congress could provide the structure for DQ'ing a candidate, the only someone who could do it would be a federal judge. If the per curiam hadn't said what it said, these deranged anti-Trump folks would likely have filed a new lawsuit in federal court in front of the proverbial Hawaiian judge, who would not only have DQ'd Trump, but would also have entered a national injunction prohibiting any state from putting Trump on the ballot. The PC opinion was necessary to forstall that possibility.
