Federal Judge Throws Out the Chargaes Against "Far Right" Protesters Who Clashed With Antifa, Noting That the Feds Never Charged Antifa for the Same Crimes

Finally.

Finally.

Judge Says Feds Can't 'Selectively' Prosecute Right-Wing Rioters While Ignoring Antifa

'No individuals associated with the left, who engaged in anti-far-right speech and violently suppressed the protected speech of Trump supporters, were charged with a federal crime for their part in starting riots at political events. That is textbook viewpoint discrimination.'

By Luke Rosiak

A judge in California threw out charges against two far-right political agitators, saying the federal government engaged in "selective prosecution" by charging right-wing rioters but not the far-left agitators they fought against, and who did the exact same thing.

Robert Rundo and Robert Boman attended a pro-Donald Trump "free speech" rally in Berkeley on April 15, 2017, as members of Rise Against Movement (RAM), a "far-right, white nationalist" group that engaged in violence against left-wing groups like Antifa. One of those groups was By Any Means Necessary (BAMN), which would descend upon right-wing events to shut them down and start fights.

"Antifa and related far-left groups decided they needed to 'shut this down.' ... They came prepared for violence, bringing weapons including pepper spray, fireworks, knives, and homemade bombs," Judge Cormac J. Carney of the US District Court for the Central District of California wrote on February 21. "And they used those weapons, as well as their bodies, against Trump supporters and law enforcement.

But after prosecutors filed an emergency motion to appeal, the Ninth Circuit had one of the right-wingers arrested the next day, February 22. Robert Rundo "is to remain in custody pending resolution of appellant's motion to stay release pending appeal. No lower court may order his release absent further order of this Court," the appeals court wrote.

Judge Carney objected to the fact that federal prosecutors charged only right-wing participants, even though left-wing agitators performed identical conduct or worse at the same event--which prosecutors' own evidence acknowledged.

"No individuals associated with the left, who engaged in anti-far-right speech and violently suppressed the protected speech of Trump supporters, were charged with a federal crime for their part in starting riots at political events. That is textbook viewpoint discrimination," he wrote. "Most telling in this case is the government's silence as to why it never pursued a case against a single member of Antifa or related far-left groups with respect to their violent conduct at pro-Trump events."

"Defendants have established selective prosecution. There is no doubt that the government did not prosecute similarly situated individuals. Antifa and related far-left groups attended the same Trump rallies as Defendants with the expressly stated intent of shutting down, through violence if necessary, protected political speech. At the same Trump rallies that form the basis for Defendants' prosecution, members of Antifa and related far-left groups engaged in organized violence to stifle protected speech," he continued.

"Of the 20 people arrested at the April 2017 Berkeley rally, the government charged only Defendants and other members of RAM under the Anti-Riot Act. The government charged no members of Antifa, BAMN, or other far-left groups under the Anti-Riot Act for their use of violence to shut down the rally," the judge wrote.

"To put it simply, RAM and Antifa, which both appear to use violence to silence protected speech, are identical in material respects--the only difference is their speech and beliefs," the judge wrote.

Read the whole thing.

In another case of brazen selective prosecution, the feds have instructed a Blaze reporter who covered the J6 Mostly Peaceful Protests to surrender himself,
wearing only shorts and flip-flops.

Most likely so they can humiliate him by putting him in jail immediately.

Baker told Blaze News he's been instructed to turn himself in at the agency's field office at 7 a.m. wearing "shorts and sandals" -- which he said signals that the plan likely is to go for "humiliation" and place him in an orange jumpsuit, handcuff him, and do the "prisoner transport routine."

He added that after he's taken to the Dallas courthouse, he'll appear at a 10 a.m. hearing before a federal magistrate.

"They didn't have to go this route," Baker told Blaze News on Tuesday evening. "We have been told that my charges are only misdemeanors. And my attorneys have been assured that this will be an 'in and out' affair with 'no intention' to detain me. But rather than issuing a simple order to appear, they went the 'arrest warrant' route."

What's more, Baker said he still does not know what the charges against him are, noting to Blaze News that the powers that be won't tell his attorney about the charges because they believe Baker will post them on social media.

They're keeping the charges against a citizen SECRET because they don't want the citizen to tell others what the charges are??!

What cannot go on, will not.

The whole reason the left declared the Proud Boys a huge national problem is because PB got into street fights with the left's street enforcers: AntiFa.

Before PB did that, the left just considered them another Man-o-Sphere "problem."

Some PB guys got years in jail for getting in a street scuffle with AntiFa. Meanwhile, AntiFa are getting checks from several municipalities as compensation for being arrested for street thug activities.

I kept thinking judges (even liberal ones) would eventually be the adults in the room to all of this, like putting people behind bars for lengthy sentences that weren't even at the Capitol, but this might be the very first time a judge finally called it out.

All the others have been high-fiving the DOJ for overcharging on everything.

Judges really have covered themselves in shame with the whole "Get Trump" movement that's completely undermining our rule of law.

So judges will get collectively punished when the system collapses. One the lesser known facts of the French Revolution was that royal judges were viewed as mere extensions of the king and aristocracy. Even after the Revolution had concluded with Napoleon, the tradition in France is now never to trust judges.

They always have panels of three judges, their court of cassation (scotus) has close to eighty judges that are selected randomly to hear a case, judges have to go to judicial school and basically serve apprenticeships, and their highest constitutional court--the Constitutional Council is composed of legislative and Presidential appointees serving a limited term plus the former presidents of France that have quit politics.

Not really following either, but it appears that both were on "restricted areas" so no different from many of the J6 political prisoners. They were reporters though, and no MSM reporters were charged. But that makes no difference since freedom of press is not restricted to any class of people. ie, there are a lot of pissing on civil rights going on here.

63 Arizona(!) did something pretty fun along similar lines:

Criticizing Bragg, Arizona Refuses to Send Murder Suspect to New York. Source: New York Times On Feb. 8, a woman was found dead in a Manhattan hotel room, bludgeoned to death with an iron.

This week, the police announced that a 26-year-old man suspected of committing the crime had been arrested in Arizona, where he was accused of stabbing another woman a few days after the homicide in New York. A Manhattan prosecutor flew to Arizona to discuss bringing the man back to face charges.

In most homicide cases across the country, it would be a routine extradition. But on Wednesday, an Arizona prosecutor refused, saying she did not believe Alvin L. Bragg, Manhattan’s district attorney, could be trusted to keep him behind bars.

it's MAGA insanity. Bragg got a grand jury to indict Trump in New York. They will protect viscous murders for Trump. It's a mental disease. Trump is their Fuhrer. End of story.

It is happening in slow motion simply because the GOP pols in red states has no place to hide while in DC they can always blame the Dems.

The GOPe keeps trying stupid DC stunts in places like Texas with its impeachment of the AG or the GOPesters in the Indiana legislature are trying to do with AG Rokita but all that does is strip the bark off the little bastards.

Even in GA, the reluctant state GOP is having to deal with angry voters over the Fani stupidity tour and after expelling the first GOP senator from the caucus over it a couple of months ago, the state leg is moving forward by subpoenaing all the Wade texts and evidence from the hearing and even Chief Groundhog Gov Kemp came out of his lair and saw the shadow Fani was casting over the state and had to say her case looked political.

It is best to move slow on such matters because if the killing machine of a civil war ever starts, it will be difficult to turn off.

There has always been that right but you have to prove the defendants are similarly situated. In this case, you have antifa creating the whole disturbance via weapons wielding and violence and the ones of the right fighting to repel such. So if you are being charged on the basis of rioting, the antifa and the righties are on the same legal ground as far as facts and charges.
