Supreme Court Appears Poised to Reject Challenge to Trump's Candidacy, and Might Even Reject It... Unanimously

The argument is now over. The disqualification advocates may have expected a cold reception, but this was perfectly glacial. Notably, some of the toughest and most skeptical questions came from the left of the Court.

One threshold question is this: When the insurrection clause speaks of "officers" being disqualified from office, does it even mean the president, whose qualifications are spelled out in the Constitution, with no mention of insurrection being a bar?

Or does it just mean the people the Executive appoints to fill federal posts?

Even Katanji Brown Jackson seems to think "officers" means "appointed officials," not constitutional officials like the president:

Even Roberts is antagonistic. The 14th Amendment, he says, was written to reduce the power of the states (establishing that federal rights were the rights of all citizens, whether or not states wanted to grant them, etc.).

Why then, he asked, would this same Amendment grant states the power to veto federal presidential candidates?

...Chief Justice Roberts asked a deadly question of why the 14th Amendment (which is designed to limit the power of states) would be used to enhance this power of the states. He suggested that Murray's arguments are "ahistorical."


One of the main arguments from the left is that the "Insurrection Clause" is "self-executing." That is, the clause says that no "insurrectionist" can qualify for office, and no additional conviction, hearing, tribunal, etc., is necessary to enforce this claim.


And therefore, they argue, people can bring stupid lawsuits and state courts can decide who is and who is not an insurrectionist.

Whereas those arguing it's not "self-executing" say: There needs to be a law against "insurrection," and you need to be convicted against violating that law to be disqualified.

Usually, Congress enables constitutional commands with statutes. Constitutions are, of course, not "laws." They are vague, when laws demand precision. And Congress usually passes laws to explain exactly how a constitutional clause will be implemented.

This is just bizarre: There actually is and long has been a federal law against insurrection. Further, there is a law which says anyone convicted of "Insurrection" is disqualified from holding federal office.

Kavanaugh wants to know why, oh why, should that not be considered the controlling legal authority for disqualifications based on "insurrection."

People with more experience and knowledge please check and correct me, but to me this sounds like SCOTUS is trying to thread the needle.

If they reject it, they will do so on this basis described here - "what is an officer, and is the President an 'officer' according to the agreed definition" rather than rejecting it because there was no insurrection. By doing so, they define a heretofore irrelevant piece of Constitutional minutiae while declining to address the root premise, leaving the "insurrection" field and argument open for use against others or in different ways.

I think his selection process is probably wrong. Some of his picks were pretty good (or at least were in the moment, but broke weird after the administration), but many were not. Rex Tillerson at State was a bizarre choice I tried to rationalize as having to do with MidEast relations. It got undone quickly. Sessions should have been fired the moment he recused himself.

But that aside, I think it's down to selection criteria: is the person Trump's friend or in his club? If so, he might appoint you to something big. There is also the factor of confirmation nonsense and obstruction, but I think that's secondary.

Has Trump widened his talent pool? I dunno. I hope so. I think it's pretty important.

Much of the case involves settled law but whether the President is an officer of the US is not well defined in scotus for a variety of applications such as the emoluments clause. That application is where Seth Tillman filed an amicus brief.

State ballot access for federal offices is pretty much an issue of US Term Limits v. Thornton where a state may not put additional qualifications on a ballot for a federal officer (term limits) and that borrows from Powell v. McCormick which ruled refusing to seat an elected representative was unconstitutional and beyond Congressional power. Congress may expel them with 2/3 majority but not declare the seat vacant by refusal to seat them.

Then there is the 14th meaning and whether the fact that Congress repealed punishment in the 1890's as well as Congress controlling who is or is not an insurrectionist via waivers.

This is true. It is also true Trump has made some hiring decisions that are, in simple terms, crap. Not all, but some big ones. We can analyze why - the biggest being he felt the people he could trust most were family, failing to notice one of those was a card carrying Dem. This is problematic and epically so.

I am a Trump fan, but I am not blind to his flaws. I think we need to be hyper aware of them because that is where we need to apply pressure should some miracle occur and an actual election happen with Trump as a candidate.

That depends entirely on how much Trump knew - or people who Trump had advisors - knew about who Bolton really was.

As an outsider, I kinda liked Bolton at the time. He had the appearance of being "tough" and a track record that wasn't an undifferentiated series of disasters.

Then it turned out that he was the cheapest whore in Washington, selling himself for the political equivalent of a ham sandwich and had coincidentally blundered into a personal history that had the occasional success. Did Trump's people know that in advance and not tell him? If so, the advisors sucked. Did nobody know it and they got blindsided, too? If so, they didn't have adequate experience. The former is a much greater sin than the latter, though both are related to personnel.

Trump's balance is, by estimation, mostly incompetent, followed by bad actors, followed by good actors. Some of each.

Everyone else's balance is 100% bad actors (and of the same kind - insider hatchet men - though with a different outcome).

If Trump can manage to keep out bad actors this time - and that very much remains to be seen - the balance will move further into his favor, even if the number of incompetents is approximately the same.

He's doing it still with the DA's, the judges and special council hounding him in various legal suits. Those cases may very well be without merit, but I doubt that matters anymore.

As others have noted, not every pick for his administration was his own. I would have thought the vetting processes would have been better.

But you have to remember he's trying to select people to go against the uni-party's agenda. there aren't a lot of great, well known people out there that are willing or able to do that. Particularly if they want to seek further, higher office in the future, which most do. AND whoever he picks has to get confirmed, which makes it even harder.

And that would be true for anyone who would pursue an agenda similar to Trump's.

I'm not excusing Trump's bad choices, just putting them into context. I imagine the pool he has to pick appointees from is pretty small compared to other Presidents (who would follow the uni-party's bidding).

I suspect so, yes. They appeared to do good work, though, until the end. I don't know how to classify them. Best case, they saw personal benefit in doing a good job. Simply put, appointees make a living in DC and cannot afford to be out of favor with the apparatchiks that live there. Being able to turn a stint in an administration into gold is why they are upset at Trump for harming their market value.

I liked his foreign policy - thought it was pretty strong - I'd like that again. Domestically he spent like a drunken sailor. Liked his nose for deregulation, it did open up the economy. He fought for his court nominees. Especially Kavanaugh.

Disagreed his picking the fight with McCain, and we were paid back in spades by McCain torpedoing the ACA repeal. Makes enemies needlessly, hurting him down the line, sometimes critically. His desire to get a deal gets in the way of the long term ramifications of it. His backtracking on the whole woke BS is a huge red flag for me. He mishandled covid from the beginning - his need to be out in front of everything boxed himself in, when he should have realized he was being played when he could have done something about it. Spends way too much, though that seems to be a trend. W spent a ton, Obama, spent more, Trump more than that, and then Biden into the stratosphere. We have already covered his poor personnel management.

I prefer him to Biden.

Just for the record, I've not read where a single legal expert, on either side, brought up the point that Jackson asked, prior to the SCOTUS hearing. So I guess EVERYONE who hasn't previously made Jackson's argument is an incomptent. At least, according to you.
