No Quarter

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.
There is a reason why the Founders (James Madison, specifically) added this to the Bill of Rights. It was a direct response to the problems that the Quartering Acts in Britain caused in the Colonies. If there was no room in the barracks, colonists were required to open their properties to the Crown's soldiers. Initially, this was businesses, but that would change.

Following the Boston Tea Party, the British expanded the Acts to include private homes. This expansion of the Quartering Acts was one of the "Intolerable Acts" that helped precipitate the American Revolution. The Quartering Acts are not merely historical curiosities because they are making a comeback in American cities.

Governments - especially local governments - are once again going down this road. This time it is not about regular soldiers, but irregulars. The press calls them "migrants" or "asylum seekers" or "undocumented immigrants" because they abhor the proper classification of "illegal aliens" - but regardless of the name, these are beneficiaries of the new 21st-century Quartering Acts that our governments are imposing.

It's starting the same way and developing along the same lines. New York City is an example of what happens in other cities. Running out of places to stuff illegal aliens, the City turned to hotels. They've set up the "New Ellis Island" - what a despicable perversion that title is - at the former Roosevelt Hotel. Other hotels have seen tremendous damage and decay as a result of being used for housing illegals and the payments made to them will never offset the costs of recovery.

Running out of hotel space, the city opened more shelters at places like the cruise ship terminal in Brooklyn and in other locations - but the illegal aliens didn't like it:

The site was the subject of controversy when the city first began moving migrants there at the end of January, with some advocates comparing it to a "detention center" and a group of asylum seekers temporarily refusing to move there from a hotel in Hell's Kitchen, citing poor conditions.
But most of that is old news. The flood keeps coming, and places to stuff the invading hordes continues to run out. The problems have only gotten worse and the "solutions" get worse in turn.

New York is toying with sticking them in private homes:

Mayor Eric Adams now wants to start paying every day New Yorkers to shelter migrants in their own homes -- as the Big Apple struggles to find beds for the thousands of asylum seekers still flooding into the city.

In his latest attempt to battle the ongoing migrant crisis, Adams on Monday floated a half baked "private residence" plan, which could possibly see local homeowners getting compensation to put up asylum seekers.

New York City isn't alone, though the agitators for these kinds of plans in other cities tend to be NGOs. An NGO for Africans wants to expand its private residence operations in Detroit. In Baltimore, one of the NGOs wants the city to refurbish abandoned properties and then make them available to illegal aliens so those aliens can "spur growth" in the city:
"The gradual receding population in Baltimore is a sad situation," said Pat Jones, executive director of the Immigration Outreach Service Center. "I think that it is one that could be greatly helped by opening up some of these vacant (properties), rehabilitating them, and making them available, either for purchase or rent, to some of our immigrants coming in to the city. It might create communities that would spur more growth in the city. I'd like to see that."

Just like the British before them, America's cities are progressing down the path of the Quartering Acts. First it is businesses where the compensation will not offset the damages, but they still try to expand the operation. Now they're moving on to individuals. Put the aliens in hotels. Put them in properties with tax arrears. Ask people to put them up in their homes.

Right now, of course, this is all technically voluntary - but as this problem continues to grow, they won't be content with merely asking.

They do sometimes even before.

When I was in CO, there was a wildfire and the county decided to set up their fire command center in someone's house because he had a good location in the area. No choice, they just had the sheriff drag him out and took over his house for the command post.

That struck me as a pretty brazen Third Amendment violation. They weren't soldiers, but they were agents of the state taking over a private residence without due process.

It's the same basic issue: the state demanding that you quarter someone you don't choose to quarter. They aren't troops in this case - and so a Third Amendment case would be hard to make - but they're essentially similar.

I think this is one of those times when the Founders did not foresee the future well enough. They probably could not conceive of a time when the government would try to force people to quarter people in their homes who WEREN'T soldiers.

The DSK story was impossible to believe from the jump. Let's put aside how insanely nuts it would have been for a internationally-known star like DSK to risk it all to rape a maid. Her story made no sense. Not only was it another “he forced me to blow him” story – how is that even physically possible? – but her story kept changing. Then of course the inevitable civil suit. It was a shakedown arising from paid-for, consensual sex.

This was an early example of "me too" where everyone jumped to believe – or pretend to believe – the shaky (at best) story from a black female immigrant about how a white guy raped her. This is about the time I concluded that 99.99% of these "the rich guy raped me" stories were complete bullshit. These guys might well be lecherous pricks. But they aren't rapists.

There are tons of examples of this out there on the internet from this country and from others. Tourists who book a stay and find out when they get there that the hotel is a "migrant shelter" for most of its business.

There are tons of examples of this out there on the internet from this country and from others. Tourists who book a stay and find out when they get there that the hotel is a "migrant shelter" for most of its business.

It's already being done at the AirBNB level. The fight between hotel owners and AirBNB was never about the guy who rents out a room to make ends meet. The fight was against developers and others who bought properties -- sometimes entire residential buildings -- solely to operate then through AirBNB as commercial hotels.

The industry is already in place to do the same to run-down properties, as you both suggest.

I think that was the vision, yes. "We wrecked the hotel business, so let's bail it out by shoving illegal aliens into hotels."

But a lot of these places get destroyed by it. The rates the hotels are being paid won't cover the damage and to ever get paying customers again, the properties will need major work after being used this way.

So it's either permanent and the hotel operates as an alien camp until it wears out and falls down and then the owner writes it off, or someone takes a huge bath to rehab the property, or the owner just abandons it afterward.

That's a good HOA. But that's easier to prove -- they could see his listing. Proving those 6-8 people that are always at your house aren't part of your family and that you're basically running a halfway house for illegals in violation of HOA rules is more difficult. And the governments can fix that fairly and easily. Those are commercial properties, so quit giving them residential tax rates. The big benefit to AirBnB is they can undercut the hotels by paying lower taxes and avoiding the hotel-related fees.

Start taxing them as the commercial properties they are and a lot of that goes away. The business model doesn't work without it except in its original form: I'm letting out a room in my house while I'm on vacation.

Sevier County, TN, I think, started doing this.

And the governments can fix that fairly and easily. Those are commercial properties, so quit giving them residential tax rates. The big benefit to AirBnB is they can undercut the hotels by paying lower taxes and avoiding the hotel-related fees.

Start taxing them as the commercial properties they are and a lot of that goes away. The business model doesn't work without it except in its original form: I'm letting out a room in my house while I'm on vacation.

Sevier County, TN, I think, started doing this.

That is my understanding as to the gist of trademark v. copyright but as I said, this is a highly esoteric IP matter and Scotus has demonstrated little aptitude for these cases. For example, in patent cases, Scotus is outright being stonewalled by the US Patent Office on a variety of issues.

But there's a difference between, say, finding Amelia Earhart's body, and Jimmy Hoffa's. We already pretty well know how Amelia died (unless they find bullet holes in her plane or her body, I guess). Whereas Hoffa? If we found his body, we'd still not know exactly who whacked him. We might suspect, but it seems way premature to say the case is solved.

Not only are the people who actually created the IP dead and have been for decades, but it creates this massive black hole where something like 99% of the material made that's still technically in copyright can't be used by anyone except those who own the copyright and aren't doing anything with it.

Irving Brant's been dead for decades, and his six-volume biography of Madison as been out of print for almost as long. If I wanted to bring that to the masses, no publisher would touch it because they know someone else has the copyright. It would have to be the Brant estate, who doesn't seem to care. What good does that do?

Thanks! I did Corbet's once. It's not often open because it needs a lot of snow and is usually skied off by 10 am. But I saw my chance and skied it. Won't bother with it again. It's just a cliff. You don't really ski it as much as just grab your nuts and hold on.

From my limited understanding, the US was actually one of the outliers in international copyright using the older Paris convention instead of the more recent Berne convention on copyright. During the last extension of copyright in the 90's, the argument was that the US should follow the Berne convention instead Paris Act of 1971. The US joined the Berne Convention in the 80's and thus enabling legislation had to be passed by Congress to implement the Berne treaty and change existing US law.

That was the wedge to extend copyright law as the bill was considered must pass by the Administration and Congress.

Your proposal is rational and quite good but would be hated by the general public because in part our political class is so despised and because of envy.

The state of Arkansas used to have a very low constitutional limit on pay as did a lot of other Southern states. What happened is that pols made their living via grifting of various sorts to make up the difference. The public was happy with that apparently.

Rationality and actual application of sound economics is something alien to a lot of folks despite the fact that public economists like Buchanan and Tullock have great insight in how to properly create incentives for government workers to do what is needed.

413 Not only is that 'housing for migrants' a rather obvious violation of the 4th Amendment, but as a person who'd experienced Section 8 housing becoming common in my neighborhood, I can tell you that there are reasons - bad ones - for the reputation that Section 8 renters have.

They are in a neighborhood that they couldn't afford on their own. Their kids are used to the lax standards of conduct of the 'hood of their previous life. They bring in those standards, make those formerly affordable, and largely working class neighborhoods unliveable.
