Colorado Court Punishes Trump's Purported Interference In An Election By Themselves Interfering In An Election

Trump's "crime" was using what were arguably legal processes to challenge an election, and for calling for people to "fight" for a win.

The left is seriously now claiming that calls to "fight" are "insurrection."

But only for Republicans, of course.

When Kamala Harris declares that BLM to "should not stop" their riots, but should continue them through the election, that's perfectly legal, of course.

That's not insurrectionary at all!

And of course Saint Sodomy Barack Obama called for "hit[ting] them [Republicans] twice as hard."

The Colorado Supreme Court says that's "insurrection" -- and then uses their own highly-disputable legal processes to rig an election.

This ruling is stayed until January 4th. If Trump appeals to the Supreme Court, which he of course will, they will stay this indefinitely, until the Court rules.

And the Court will rule against this madness. Otherwise, they might as well declare a Civil War themselves.


Colorado Ruling Knocks Trump Off Ballot: What It Means, What Happens Next

The challengers who sought to disqualify Donald J. Trump prevailed on every legal issue, but the case is almost certainly headed for the Supreme Court, where they would have to do so again.

They "prevailed on every legal issue," which is highly unusual, because they had to to arrive at this ruling, and they decided beforehand they would arrive at this ruling. After that, it was just check-boxing all the sub-rulings they had to make to get there.


The Colorado voters who sought to disqualify Donald J. Trump from the state's 2024 Republican primary ballot ran the table on eight distinct legal issues on Tuesday night. To ultimately keep him off the ballot, though, they almost certainly will have to do so again -- in the U.S. Supreme Court.

In a 4-to-3 decision that set off a political and legal earthquake, the Colorado Supreme Court on Tuesday said that Mr. Trump had engaged in insurrection and therefore was barred by the 14th Amendment from holding federal office.

"This is a major and extraordinary holding from a state supreme court," Derek Muller, a law professor at the University of Notre Dame, wrote on the Election Law Blog. "Never in history has a presidential candidate been excluded from the ballot under Section 3 of the Fourteenth Amendment. United States Supreme Court review seems inevitable, and it exerts major pressure on the court."

The Insurrectionist Left is inventing lots of new, unprecedented "law" to disqualify opponents they don't like.


The majority on Tuesday said every key legal issue came out against Mr. Trump.
"The sum of these parts is this: President Trump is disqualified from holding the office of president," the majority said in an unsigned opinion, saying that his efforts to overturn the 2020 election results amounted to engaging in an insurrection and that Section 3 of the 14th Amendment, ratified after the Civil War, bars insurrectionists from federal office, including the presidency.

The majority added: "We do not reach these conclusions lightly. We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach."

There has never been a criminal finding that Trump engaged in "insurrection," an absolute prerequisite for this finding. So this "court," in a civil case with a mere preponderance-of-the-evidence standard, decides, "Oh, well we think it was insurrection, even though no prosecutor has even alleged that and no other court has determined that, and so we'll make this decision entirely on our own."

Viva Frei has a cynical theory: The Colorado Supreme Court knows this decision is lawless and will not stand. But they intend to infuriate MAGA supporters into committing violence, so that they can then use that violence retroactively to justify the exclusion of Trump from the ballot for the "safety of the Republic."

So, be smart.

I don't think so. I think it's about providing a model for states that matter. Colorado does not matter. It will not go to a Republican in the general election, no matter what. It's a rotten state with cheat-by-mail and ballot harvesting. That outcome is known and so this doesn't matter as far as how Colorado goes in the election.

But somebody needs to blaze a trail for states like Wisconsin, and you can be sure they will look at what SCOTUS does very closely. If SCOTUS doesn't bat this down, then it's all clear for swing states to do it. If SCOTUS does, they'll trial it in another state (or in CO again) with a tweak to the methodology.

The argument I'm seeing on this is that he doesn't have to be "found guilty" of a crime, because the Constitution is clear about what an insurrectionist is, and he qualifies as one. They're spinning it as a true Constitutional issue, not one of criminal law.

A lot of it is funded by dark Democrat donor money and the Soros aligned groups headed by Marc Elias. In NY, Democrat appointed judges just overturned the redistricting that was done according to a constitutional amendment the voters passed. They are now seeking to have that map redrawn against the constitution to favor Democrats. Keep in mind that many of the NY seats that flipped, gave Republicans a House majority. The goal is to eliminate that majority. That impacts everyone.

IIRC some state or county out west (Washington?) made the Republican Party ineligible to run for public office. Whether that stands is debatable, but they're trying hard to abolish the right politically. And succeeding in many cases, if not hamstringing the party into uselessness. As I posted on your thread, the Supremes are going to sit on this one until it's moot. The Colorado opinion has an automatic stay if it's appealed, so when Trump files the appeal, the Supremes go into their normal timing cycle, and Trump wins the GOP primary in March, then the Supremes dismiss it as moot.

The only thing remaining is that the finding of fact that Trump committed insurrection will have precedential effect in Colorado. When the Colorado GOP files for the November election with Trump at the top of the ticket and the Secretary of State refuses to put him on the ballot, we will go through all this again. The Colorado GOP shoud file in federal court for injunctive relief on the basis that Colorado is systematically disenfranchising voters and the Trump campaign should file on denial of due process.

This is different by an order of magnitude. If this ruling stands, then any State Legislature can decide who, and who will not, be on its ballot ahead of time - meaning that there will be no actual elections, ever. Venezuela has been doing this ever since the Communists took over. Note that Colorado has chosen to do this in spite of their being NO legal determination of the charges made against Trump.

This is literally a Life or Death moment for the Republic. Sadly, even if it is overturned, it won't put the collapse off for too much longer.

I am no Constitutional Scholar, but I do believe Federal law sets out a process for disputed electoral votes. An objection is presented in writing, one member of both the House and Senate signs it. Both houses agree. Additionally, when there are competing electors or the authenticity of the certificates are disputed, the dispute goes to the State and are resolved according to State law.

If my understanding is correct, the CO Supreme Court's theory is retarded. A dispute doesn't mean Trump gets to stay POTUS for life.

They won't suspend the election. Not this one, not the next one, not any of them. Elections are a useful fiction. They will "manage" the elections to ensure the right outcome, but elections are psychologically important. Even though they're fake and the ruling class knows they're fake and increasing numbers of people know they're fake, they're still important.

I strongly suspect that they will never cancel an election. The election - managed as it is, illegitimate as it is - is the means of declaring, "my power is legitimate." That fiction will be maintained.

Courts don't have the authority. Yes, the legislature of a State can allocate electoral votes as they please through legislation. Courts cannot.

That's why they're trying to attach it to a Constitutional requirement, it's not the State of Colorado making a decision regarding electoral votes or voting process here.

President Joe Biden said Wednesday his predecessor Donald Trump “certainly supported an insurrection” but that it was up to the courts whether that disqualifies him from running for president.

The White House and Biden campaign had previously declined to weigh in on the Colorado Supreme Court ruling saying that Trump is disqualified from the 2024 primary ballot in that state because he engaged in insurrection.

“I think it’s self evident” that Trump is an insurrectionist, Biden told reporters after stepping from Air Force One in Milwaukee.

“Whether the 14th Amendment applies, I’ll let the court make that decision,” Biden said.

376 USSC won't touch it. The dems are counting on them keeping it off the docket, because that allows the Colorado "non-ruling" to live on in perpetuity until it's useful.

This ruling is the fallback should Trump succeed in the election. No insurrection charges exist at present against Trump. But, that doesn't mean that they aren't going to be filed regardless of merit (and we've seen the crapshoot that exists in certain courtroom jurisdictions).
