Potentially Hugenormous: Supreme Court to Hear Appeal of Indictment of January 6th Defendant on Key Claim of "Obstructing an Official Act"

Federal prosecutors have been using this very vague federal law to lock people up left and right, and one man is challenging the law's application on the grounds of impermissible vagueness.

It is a bedrock principle of constitutional and criminal law that citizens have a right to know what the law actually is. It should be readily discoverable, if someone goes looking. They should not have to guess, and it should not be so malleable that prosecutors may claim it means whatever they may wish it to mean retroactively.

Making this challenge even more salient: the Very Special Counsel in the Trump prosecution, Jack Smith, is prosecuting Trump under this same silly-putty interpretation of the same vague clause.

The U.S. Supreme Court on Wednesday agreed to decide whether a man involved in the Jan. 6, 2021, U.S. Capitol assault can be charged with obstructing an official proceeding, a case with potential implications for the prosecution of Donald Trump.
The man is one of at least 325 people facing that charge for their alleged roles in the attack, which has also been brought against the Republican former president in the federal case charging him with trying to overturn his 2020 election defeat by Democratic President Joe Biden.
The justices said nothing about the Trump prosecution in agreeing to take up the case, but legal experts said Trump's lawyers could argue that the court's move should delay the start of his Washington trial on election subversion charges, currently due to begin in March.

Trump, the frontrunner for the 2024 Republican nomination to challenge Biden, is facing four concurrent criminal prosecutions. But the Washington case brought by U.S. Special Counsel Jack Smith is scheduled to begin first and is seen as the likeliest to be resolved before the Nov. 5 election.
The case taken up Wednesday by the justices involves defendant Joseph Fischer, who was indicted on seven charges following the Jan. 6 riot. Among his charges is one count under a provision of federal criminal law for anyone who "corruptly ... obstructs, influences and impedes any official proceeding."
The Supreme Court is expected to hear arguments in the case in the coming months and issue a ruling by the end of June.
Typically, the Supreme Court agreeing to review an issue in one case would not be a basis for pausing a separate case that raises the same issue, said Barbara McQuade, a law professor at the University of Michigan and former top federal prosecutor appointed by then-President Barack Obama. Still, McQuade said she expects Trump's legal team to make the argument because delay "has been his strategy throughout all of these cases."
U.S. District Judge Carl Nichols, a Trump appointee, granted Fischer's pretrial motion to dismiss his obstruction charges, ruling that the statute applied only in cases in which a defendant had taken "some action with respect to a document, record or other object."

I mean, you can't just suddenly declare a law means something that it has never before meant just because you really want it to and there is no law on the books to criminalize the conduct you want to punish. If there is no law criminalizing the conduct, guess what? It's not a crime. You don't just get to rewrite the law on the fly to make it a crime retroactively.

This is a foundational part of the law! There's a whole part of the Constitution forbidding the application of a new law to prior crimes!

Federal prosecutors appealed that ruling to the U.S. Court of Appeals for the District of Columbia Circuit. A divided three-judge panel on the D.C. Circuit in April reversed Nichols' ruling, saying the statute was not limited to documents and records, but instead "applies to all forms of corrupt obstruction of an official proceeding."
The charge carries a maximum sentence of up to 20 years in prison with a conviction.
Fischer is awaiting trial on his other criminal charges, including one count of assaulting, resisting or impeding officers and one count of civil disorder, among other charges.

Julie Kelly writes that the "untested legal imagination" -- the unfettered legal imagineering and dreamcasting of Jack Smith and Fani Willis and Alvin Bragg and "Tish" James -- is the mother of all the Trump prosecutions and the J6 prosecutions.

Donald Trump doesn't know Thomas Robertson. But the former president's fate appears inextricably tied to that of the former Army Ranger, who was convicted last year for his involvement in the Jan. 6, 2021 protest at the U.S. Capitol.

That's because the prosecutions of Trump and his supporters, including Robertson, have often depended on reimagining the law in novel ways.
To advance the narrative that Trump colluded with Russia, for example, the Department of Justice seized on the little-used Foreign Agents Registration Act to justify probes and wiretaps of Trump allies. In the Georgia election fraud case against Trump and numerous campaign advisers, Fulton County District Attorney Fani Willis is using a law intended to combat organized crime, the Racketeer Influenced and Corrupt Organization (RICO) Act, in what even her supporters describe as a stretch.
In Washington, D.C., prosecutors are using a financial crimes statute passed by Congress in 2002 in response to the Enron scandal to bring felony charges against hundreds of Jan. 6 defendants, including Trump and Robertson. Lawyers for both and for other Jan. 6 defendants argue the law is being misapplied. The controversy could soon wind up before the Supreme Court.

Federal prosecutors so far have charged more than 300 Jan. 6 defendants with obstruction under that statute. In August, Smith's office handed down a 45-page indictment against Trump, claiming his attempts to persuade Vice President Mike Pence to reject some electoral college votes and organize alternate slates of electors, among other acts, also represented an attempt to obstruct the certification of the 2020 election.
Smith's indictment is hardly the first time the DOJ sought to nab Trump on the obstruction count. It represents the culmination of a years-long effort dating back to 2017, when Special Counsel Robert Mueller investigated Trump for violating 1512(c)(2) as part of his probe into Russia's role in the 2016 election.
The second volume of Special Counsel Robert Mueller's "Report On The Investigation Into Russian Interference In The 2016 Presidential Election" enumerated multiple instances where Trump allegedly violated 1512(c)(2).
Mueller concluded that Trump's behavior in office met the statute's largely undefined language regarding obstruction. "Section 1512(c)(2) applies to corrupt acts -- including by public officials -- that frustrate the commencement or conduct of a proceeding, and not just to acts that make evidence unavailable or impair its integrity."
Robert Mueller, special counsel: His Trump-Russia probe cited multiple instances where Trump allegedly violated 1512(c)(2). But charges were never brought.

Mueller, however, did not refer Trump to the Justice Department on the obstruction count even though he repeatedly suggested the then-president should be investigated accordingly. Attorney General William Barr disagreed with Mueller's assessment and did not charge Trump.
But the government's desire to broadly interpret the statute in Trump-related cases did not end there.

47 IF you go back to the Enron cases which incidentally involved gross misconduct by Andrew Weissman (who wrote Mueller's report and reportedly threw a fit that Mueller did not seek an indictment), the so called 'honest services' provision was grossly extended for the CFO Jeffrey Skilling of Enron and Conrad Black in order to convict them (I think Patrick Fitzgerald was the ass that did that to Black). The honest services provision originally only covered public employees but was extended to private employers as well. When employed against public officials, it was aimed at preventing bribery and kickbacks. The court decided unanimously that neither Skilling nor Black committed an honest service violation and limited the application to simply cases where a private or public employee violates fiduciary responsibilities because of a bribe or kickback being involved.

The fact that relatively harmless people are in prison for this absurb charge and there is a number of them is an out that both Kavanaugh and ACB can use. Simply speaking, criminal laws are to be interpreted strictly not broadly because of the vagueness problem. No one can be expected to have a duty to obey the law when the law itself encompasses possibly all outcomes. In the Skilling v. US, the court stuffed Posner's dumbass interpretation of honest services and Ginburg criticized him in her opinion as under his criteria, denial of honest services could include taking home a company stapler or using office supplies such as the photocopier for private use.

Ginsburg clearly indicated that was a ludicrous reading of the statute which made the application of the law vague. The court unanimously decided that to save the statute, it would be interpreted strictly as it was designed by Congress in the past--to apply to kickback or bribes to influence an employee's action contrary to their fiduciary responsibility to the firm/agency.

There were always many opportunities for Trump to derail the trial schedule, and he has now done so. The decision by SCOTUS this morning to take up the challenge to Sec. 1512 -- with 2 of the 4 counts charged against Trump being connected to that charge -- was the final straw. There is no reason now for SCOTUS to expedite the appeal of the immunity issue. While the cases are different, both will have a huge impact on what happens with the DC case if/when it ever gets to trial. So SCOTUS can deal with both on parallel tracks with similar schedules.

Oral arguments at the end of April and decisions at the end of June is the most likely result.

THEN an entirely new scheduling order will be necessary in the case -- if there still is a case.

That new schedule will bump up against the FL case which I expect will be reset for mid-to-late summer.

The issue will be whether the DC case will be set in the fall of 2024 during the middle of the general election campaign.

My guess would be -- "No."

If the five conservatives are united, Roberts has no power to influence the opinion. There's no reason to because the five already agree and can impose it as they will.

The only time Roberts has influence is when someone like Kavanaugh is weak in the knees and Roberts can offer to be the fifth vote.

Dobbs was decided well beyond what Roberts wanted (reportedly, he wanted a nationwide 15 week ban), but Alito said, "Fuck it, homie," and pulled Roe out by the roots. Roberts then signed onto the majority afterwards for...reasons. He doesn't want to seem powerless, I think, but he's pretty much powerless on cases like that.

For this particular case? Some. That will solve a problem for Trump but far more importantly, it will end some of the persecution faced by hundreds of people who did nothing wrong. That's a win if the case goes well and it might go well.

But more broadly? No. There are limitless "nebulous" laws from which they can pick next time. Even if all this plays out again in the same way right up to SCOTUS throwing it out, they still ruined the lives of hundreds or thousands of people through outright criminal conduct for the purpose of persecuting domestic dissidents. That part doesn't change.

The pause on proceedings does not lift the gag order or protective order over classified materials, she added. Neither side had argued over pausing these orders.

No, but it doesn't surprise me. This is pretty common nowadays. I have worked for three companies and have associates and friends who for at least five others that do this.

Hit your "diversity" goals, or your bonus and stock get reduced.

The GM of my division (now former GM, but not because of this) said the following in an internal update call:
"It is not just about getting the best person for the job, it's about getting the best person for the job who contributes to our diversity."

This is the *norm* in large companies now. If that doesn't make your blood run cold as an investor, nothing will.

It's a one-two punch when it comes to H1Bs. H1Bs enable dramatic wage compression because the visa *requires* you to work. If you get laid off, you either find another job fairly quickly or you go back home. They don't want to go back home, so they'll take less money to seal the deal. This makes H1Bs very, very desirable and so layoffs hit citizens before H1Bs, because they can go hire an H1B at a lower price, and then they own his ass.

Second appears to be simple in-group preference. In my extensive experience in the tech sector, Indians prefer to hire other Indians.

Both of the remaining two counts have serious legal problems attached to them.

One is them is "Conspiracy to defraud the Government." The problem is that the Supreme Court said several years ago that as used by Congress, the phrase "conspiracy to defraud" means to take money or property by misrepresentation or deceit. Trump's alleged actions weren't for the purpose of acquiring money or property from the Govt so there is a significant issue about whether that statute applies here.

The remaining count is based on the Voting Rights Act (IIRC). The problem is that statute has always been used to enforce the right to vote -- not the counting of votes. The factual allegations are that Trump tried to alter the vote count after the election by getting state officials to throw out some number of votes he claimed were invalid.

But the right to vote wasn't denied to the voters in question -- they cast their ballots. The issue was whether their ballots should have been counted under state law. That has never been a factual basis to apply the law under which Trump is charged.

It's highly likely that he climbed through the ranks (there or elsewhere) and was appointed by a fair number of his own birth nationality and class. White men didn't give up those positions, they were kicked out. Sometimes it was surely "we've had enough of you, white man" but most of the time it is likely the demographic and money shift within the enterprise. After a certain amount of your managers are Indians, the workforce will start to shift. I've watched it time and again.

Once I realized that socialism was super big in India, it made sense. They did (and still do) have a highly stratified society that would be very amenable to arguments against the class system in a lot of socialist writings, essentially taking the cultural structure that imposed economic conditions and saying it needed to be torn by the root and replaced by something classless, like utopia!

In my experience, political affiliation or voting habits and personal lifestyle don't correlate well.

As Dennis Prager puts it about the American Jews - who tend to be successful people with strong family structure and with an emphasis on hard work and education yet consistently turn out large margins for the Dems when it comes to voting - they need to "preach what they practice."

TJM has the right of it. The advantage for Scotus is that they can toss Trump's case by resolving the Jan 6 cases in favor of the appellants (prisoners).

Roberts authored the McDonnell decision and Kavanaugh is a big proponent of stare decisis. That would tend to work in favor for the appellants in this case.
