The AP Begins Scheming About Arresting Him for Arms Dealing

DeSantis is conducting his own foreign policy.

Someone in America has to.


Florida Gov. Ron DeSantis (R) has sent drones, weapons and ammunition to Israel to support its war against Hamas, a move that bolsters his pro-Israel stance in the battle for the GOP presidential nomination.

It's so sinister for a political figure to act in accord with his constituent's wishes.

At least, it's sinister if a Republican does this. In fairness, we don't see much of it so I can almost understand the surprise.

Meanwhile, Merrick Garland arrests and surveils all of Biden's political enemies and The Hill just applauds.


Jeremy Redfern, a spokesperson for DeSantis’s office, said that the Israeli Consul General in Miami requested Florida send drones, body armor and helmets to Israel for first responders to use. Redfern said that cargo planes carrying the items, which also included hospital and health-care supplies, were contracted by Florida.

He also said the office worked with the Consul General "to help get weapons and ammunition to Israel through private parties." He did not say who these private parties were.

Redfern also did not comment on what kinds of weapons were provided or how many drones and rounds of ammunition were sent to Israel.

DeSantis has been an outspoken supporter of Israel and has vowed that Florida will do as much as it can to aid the nation in its efforts against Hamas, which is designated as a terrorist organization by the United States. He issued an executive order earlier this month authorizing the rescue of Floridians in Israel using chartered flights.


The AP immediately began scheming about what laws it could claim DeSantis should be imprisoned for. Of course.

It's unclear whether DeSantis coordinated shipments of any weapons with the Biden administration. The Commerce Department regulates the shipment abroad of many types of U.S. weapons and technology.

"It is not illegal for the governor of a state to offer a measure of foreign assistance to another country," said John Kirby, a spokesperson for the White House's National Security Council. "There are laws and regulations which govern how the export process is handled and that's all done through Commerce. I couldn't speak with authority today about whether the governor has checked all those boxes or not."

The Commerce Department did not immediately respond to a request for comment.

The export of military equipment would typically require a license or some other authorization from either the Commerce or State Departments, depending on the precise item, said Thomas Krueger, a lawyer at the Akin Gump law firm who specializes in international trade and previously served as the director of strategic trade and nonproliferation at the White House's National Security Council.

"It really all depends on the specifications of the items themselves, to determine what kind of export authorization would be required," Krueger said.

So, objectively, this is *wrong* and DeSantis should not be doing it because it is the prerogative of the central government and all others are expressly prohibited. But we're also post-law and post-custom and this kind of thing has essentially become the norm - so play through.

Probably a lot of them. Just like how Abbott and DeSantis and various others could be imprisoned for trying to tackle the US border. There are things - including border control and foreign policy - that are exclusive federal prerogatives. I am sure it is all illegal and it is probably a pretty easy case to make.

But the reality is muddier, because literally *everyone* does this. Cases against Abbot and DeSantis are *already* slam-dunks, and yet both are also walking around as free men. There's a reason for that, it isn't just because both are powerful men and powerful men are special. It's also because a retaliatory action would almost certainly come - from some quarter - against Uniparty operatives.

Yes, you would be surprised what ITAR covers down to requiring export licenses for parts for various firearms. There are also some international treaties that have increased ITAR coverage over items. A lot of domestic companies actually warn consumers that purchases and shipping abroad of parts or ammo will not be allowed via their website.

So take a more ambiguous conflict. The reason for the general rule primarily is to keep the states from going to war with one another, which under ordinary circumstances is a fairly undesirable outcome. States could've easily ended up supporting different sides in WW1.

There wasn't a huge moral cause at stake in WW1 and the anti-German position was mostly ginned up in a top-down fashion. The US had historically been pretty tight with Prussia and then Germany.

England and France being on the same side was also an oddity of that war.

The US doesn't really start to develop more of a consensus foreign policy view until the Cold War.

Doesn't matter. Private entities are covered under ITAR rules and regulations as well. You need export licenses for any foreign shipment of items on the US Munitions List above. There are additional laws involving shipments into War zones.

About a dozen years ago, helped a friend move from California to Florida using a giant U-Haul. When we got to the Arizona State line (I think it was on I-10), the Border Patrol asked us to pull out so they could run their drug l-sniffing dogs -- as well as for permission to search the contents of the U-Haul.

My friend is a big firearms advocate and instructor, does his own ammo reloads, and had buckets of spent cartridges in the U-Haul. We were a little worried that that might raise some red flags, but they were cool with it (especially since he had already chatted with them about what kinds of firearms they use and their training).

I've never had one. I'm sure I've had the flu a few times, but the only time it lasted more than 24 hours was when it was Covid. Then the fever lasted a bit longer, but the cough went on for a couple months.

You need reading comprehension. There are additional laws that apply to shipments in war zones such as the US Neutrality Act and the Logan Act among others.

Simply put, unless you spend a lot of money on compliance via the State and Commerce departments, it is more a demonstration of support than anything that will help Israel in the short run.

And the goverment can actually issue a simply policy guidance under discretionary powers to not grant third party export licenses to ship to war zones.

I am too lazy today to spend time on WestLaw and Lexis doing your research for you. You can find open source on the relevant documents via the State Department and Commerce Department federal register pages and websites to determine what their legal position is.

I had that one. Laid my ass out for a week and it took me about month to really feel good again. It was way, way worse than my experience with COVID was, but about like my dad's experience with COVID (same strain - I got it from him) was, except he recovered fully within about 8 days (he was flat for about three).

It's crazy how wildly different the experience can be from person to person.

Sec. of State Lansing also was vastly amused because he had to implement Wilson's order to let the Germans use US State Dept telegraph lines against his feverent opposition. The Brits helped the US authenticate the cyphered telegraph at the US embassy to allow Wilson to claim that a US State Dept employee on US soil obtained the telegraph. The murky coverstory was to allow the Germans to believe their cypher had not been broken.

I go back and forth on this. For many years I never got the flu shot. Then after several years of suffering through the flu each winter, I got one. Then I did it again the next year. For several years I didn't get the flu.

Is it a crapshoot whether the shot will help? Yes. Apparently it's only about 30% effective. Is 30% better than several days of sitting on the toilet and feeling like death? I personally think so.

However, now that Pfizer and others are likely slipping Covid "vaccines" in with the flu shot, I probably won't get the shot. I dunno.

I go back and forth on this. For many years I never got the flu shot. Then after several years of suffering through the flu each winter, I got one. Then I did it again the next year. For several years I didn't get the flu.

Is it a crapshoot whether the shot will help? Yes. Apparently it's only about 30% effective. Is 30% better than several days of sitting on the toilet and feeling like death? I personally think so.

However, now that Pfizer and others are likely slipping Covid "vaccines" in with the flu shot, I probably won't get the shot. I dunno.

Sounds interesting. The funny thing is that the NYT's reporter (an actual German spy) at the Zimmerman press conference in Germany to address the notorious Telegraph scandal was trying to wave Zimmerman off of Germany admitting the contents of the Telegraph's alliance offer with Mexico was legitimate. He failed and was aghast at it.

Tuchman's thesis was that Zimmerman believed that British agents had stolen the Telegraph from the German ambassador sent home from the US after the unrestricted submarine warfare approval or via Germany's embassy in Mexico . So there was nothing to gained by denying it.

Traditional neutrality like the Swiss or Swedes followed did not require a neutral nation not to finance or make money shipping munitions. It was the customer that would be at risk. The US followed that line throughout its early history which nearly resulted in wars with France and then did with Britain in 1812.

Arguing the latter point ignores that had Wilson wanted to go to war, he might have gotten Congress to declare it after the sinking of the Lusitania or at least broken off relations with the Germans.

Wilson was superb at rhetoric and his speech to enter war was more that we needed to go to war to end all wars. He was also a decisive executive and when the tide ran out on peace, he did not hesitate to go to war unlike Buchanan who slinked out of office.

There are so many laws on the books and spending authorizations that unless Congress say specifically do not spend money on this such as the Boland Amendment or Hyde Amendment, presidents can shift money from one priority to another. Trump used this vague legislative authority via the Corp of Engineers funding to authorize some of the Wall being built after Congress refused to grant him money.

I strongly suspect that DeSantis is sending only stuff that is legal for individuals to own, much of which is still very useful to armies in war time. Obvious examples:
1. Sidearms with holsters and ammunition.
2. Helmets and 'bullet-proof' vests.
3. Drones that can be adapted to carry explosives. I read a year or so ago that Ukraine was buying a particular model of Chinese drone on the open market that was well suited to dropping grenades into open tank hatches. They quickly realized that if they bought the entire stock, not just the x thousand they needed that month, Russia wouldn't be able to buy any, so they did.
4. Shotguns and shells. The US military found sawed-off shotguns extremely useful in clearing out multi-story underground bunkers on Iwo Jima and Okinawa. Of course, they're illegal in the U.S., but I'm sure Israel can quickly and efficiently turn perfectly-legal full-length Florida shotguns into sawed-off shotguns if they need to go into the Hamas tunnels to rescue hostages or kill terrorists.
5. Which reminds me: night-vision equipment would also come in very handy in tunnels and high-quality binoculars outside.
