| The Morning Rant: Minimalist Edition![]() In short, Weiss, who originally thought Biden's gun purchase did not require prosecution, let alone a prison sentence, is now charging him with three crimes stemming from the transaction, which carry a combined maximum penalty of 25 years in prison. In the span of less than two months, Weiss went from zero to 25. Even allowing for the fact that sentences for gun crimes typically fall far short of the statutory maximum, that is a pretty striking escalation. It cannot possibly be justified by the gravity of Biden's conduct, which harmed no one. Rather, the dramatic increase in Biden's legal peril looks like retaliation for his decision to fight the gun charge. That sort of "trial penalty" is par for the course in a criminal justice system where prosecutors wield tremendous power to coerce guilty pleas by threatening to pile on charges and/or seek stiffer punishment if a defendant has the audacity to make the government prove its case. As David McGarry noted in a Reason article last March, 98 percent of federal convictions and 95 percent of state convictions are based on guilty pleas. McGarry cited an American Bar Association (ABA) report that helps explain why defendants rarely exercise their Sixth Amendment rights. In federal felony cases, the ABA found, the average sentence for defendants who go to trial is seven years longer than the average sentence for defendants who plead guilty. "Although a modest reduction in sentence is justified in some cases resolved through guilty pleas because a defendant accepts responsibility," the ABA said, "sentences should not be punitively inflated simply because a defendant exercised a fundamental right."Everything they say is true, and I still want Hunter Biden in jail for a 25 year stint in federal prison. We live in a post-law society, so the minuscule possibility that the horrendous system will be applied to one of the elites is too tempting to dismiss as an affront to all of our rights. And...imagine this case going to the Supreme Court, which is then forced to examine our gun laws and perhaps loosen them even more. The gun laws seem to be extremely arbitrary.

I've never heard the term trial penalty, but I like it. I don't know what the right answer is, but there is a benefit to pleading out. However, the fed incentive to forcing a plea is something that may need to be reigned in.

one reason to make a plea deal is going to jail for a short while might be better than being bankrupt. as i recall, billy dale c 1993 (the white house travel office guy) was willing to make a plea and take two or three months in jail but the feds demanded two years. they went to trial, jury acquitted him of all six charges in two hours and he had a half mil $ legal bill.

This is perfectly valid in terms of legal philosophy, interpretation of law, etc. and in a system that was itself lawful (and whose controllers were largely law-abiding), debates like these are meaningful in that they will guide that system and its controllers. But in an unlawful system run by people who are above the law, where law is merely a cudgel to be used against political opponents and enemies, it is of only academic interest. The controllers of the *next* system might see such argumentation and take it into consideration, but it has no bearing and - sadly - no meaning for the current environment. The gun charge gets all the attention precisely because it challenges the right even while completely uninvolving Daddy China-Bucks. Other charges that do involve Pappa Poopy Pants are deliberately left alone by the Prosecutor.

Reason is 100% correct about the federal judicial system. It is pretty scary.
That said -- the *rest* of us have to live under these insane gun laws that the left keeps pushing (including Hunters dad), why shouldn't the son of the President? For example, I know of a guy who was a passenger in a car, driving back from a friends house, when they get pulled over for a traffic violation in a 2A friendly state. During the chat with the cop, the driver mentions he has a couple of .22 rifles in the back from plinking earlier. No problem. Cop runs the passengers name -- OOPS, turns out he had a felony marijuana possession on his record from the 1980's. Guy gets mandatory sentence of 1 year in prison for being a felon in possession of a firearm, and there was nothing anyone could do about it, even though it was clearly fucked. Especially since the guy was eligible to get the felony annulled, and just "didn't see a reason to." So if those are the laws championed by Biden and co., then yeah -- only fair that Hunter gets prison time (he won't) for lying on a form to buy a gun. I would quibble just a bit. Only because it is an underlying premise in a number of parts of the constitution without coming out and directly saying it.
The right to private property is unique, and the basis upon which all the rights more vocally stated rest. It is the basis upon which the US productive business environment rests. I would almost argue the US Constitution is as pro- business document as exists anywhere in the world. And it was this insidious attack at property rights through government regulation that began the nibble through the rest of our rights. Once you eat the foundation away, you can attack the rest. They left was very clumsy about the way they attacked guns, and it has resulted in a major roll back of their gun grabbing ways, but look at how successfully the 1st amendment has been gutted - religion, speech and assembly are now all allowed as long as you say what the govt wants you to say. A lawyer friend and I were discussing the 2A. I brought up that maybe it was an economy of words. Looking at later writings of the founders, I think they meant "Because a militia needs to be well regulated, the right of the people to keep and bear arms...." . I know a guy with a felony conviction for a VERY serious crime, he's been working for years to get it expunged. Daylight is just on the horizon.
He doesn't have a drivers license, and he does like to go out to the desert and plink cans and whatnot. One of these days, he's going to get pulled over... he's made so much progress getting his life in order, but he's one itchy cop away from having it all crash down. It should always be kept in mind, when citing the American Bar Association (ABA) that it's just another leftwing skinsuit outfit, like all the others-- the left killed it, skinned it, and now goes forth wearing its skin.
As for coercing guilty pleas, the Federal Sentence Guidelines have ALWAYS provided a 2-level reduction (in the total offense level determined by the Court) for decades. If a def goes to trial & is convicted, it's often the case that the def in question will pick up OTHER sentence enhancements during trial-- testifying falsely in her own defense, to name one of the more common ones. Every federal criminal defendant gets a free, Court-appointed defense counsel if she needs and wants one. These are always experienced federal trial counsel. Defense counsel advises clients on the advisability of entering a plea. Oftentimes, defendants who plead out get less time because the Government has made plea-bargained concessions to facilitate the plea, in addition to the 2-level reduction which I mentioned above. After enough time has passed without a subsequent arrest and conviction, a former felon is no more of a risk to the public than someone never convicted of a crime. It is reasonable to restrict rights as part of the penalty for a conviction. But since the government was never required to prove guilt for most convictions, I think it is likely reasonable to restore full civil rights after enough time has passed. This should be a sliding scale that considers the type of conviction. A violent felon might need to keep their nose clean for 20 years after finishing their sentence - including paying any restitution required - where someone convicted for a low level nonviolent offense might wait as little as 5 or 10.
