The Morning Rant: Minimalist Edition

The text of the 2nd Amendment of the United States Constitution is in clear English, and for anyone who bothers to pay attention to the grammar, it is a robust defense of our God-given, natural rights to self defense and defense against tyranny.

The great question of our day is whether that right can be restricted. And that isn't intentional hyperbole. The two primary rights of a free society are speech (from which flows other freedoms), and defense, which protects that and all of our other rights. Obviously the various anti-freedom states have gutted the right to keep and bear arms, and even for people who live in Constitutional-Carry states, the hodgepodge of conflicting state laws makes simple travel through America a risky proposition for anyone who wants to exercise that right.

Can society restrict the right to keep and bear arms to certain classes of people? We already prevent those younger than 18 from purchasing rifles (21 for pistols), although possession is a state matter, which mitigates the effect of the federal law. But felons are prevented from purchasing weapons and possessing, even if their felony is non-violent, as a recent appeals court ruling has held.

This isn't quite a rant, because both sides of this issue make logical sense. On one hand is a right that should be immutable, since Man cannot take away rights granted by God and that are part of the human condition. And felons are still part of society and have served their sentences. Isn't the point of a legally defined sentence that it ends? Yet preventing presumably rehabilitated felons from exercising their rights flies in the face of that.

On the other hand...felons have demonstrated that they are incapable of functioning in a society of laws, and the assumption that a mere prison sentence has changed that fundamental outlook on society may be naive.

And on the third hand...I want Hunter Biden to go to jail for a very long time, or be offered a plea deal that forces him to rat out his doddering, corrupt, pedophile father! I really don't care that the justice system's obvious flaws and ridiculous power over us is being used to coerce a guilty plea. I want maximum pain for all involved!

This Reason article is shockingly coherent...I guess their drug dealer didn't show up the morning they wrote it. They explain the vile and authoritarian techniques for coercing guilty pleas, and explore how the justice system is...frankly...rigged.

Hunter Biden's Multiplying Gun Charges Threaten the Right to Arms and the Right to Trial

In short, Weiss, who originally thought Biden's gun purchase did not require prosecution, let alone a prison sentence, is now charging him with three crimes stemming from the transaction, which carry a combined maximum penalty of 25 years in prison. In the span of less than two months, Weiss went from zero to 25. Even allowing for the fact that sentences for gun crimes typically fall far short of the statutory maximum, that is a pretty striking escalation. It cannot possibly be justified by the gravity of Biden's conduct, which harmed no one. Rather, the dramatic increase in Biden's legal peril looks like retaliation for his decision to fight the gun charge.

That sort of "trial penalty" is par for the course in a criminal justice system where prosecutors wield tremendous power to coerce guilty pleas by threatening to pile on charges and/or seek stiffer punishment if a defendant has the audacity to make the government prove its case. As David McGarry noted in a Reason article last March, 98 percent of federal convictions and 95 percent of state convictions are based on guilty pleas. McGarry cited an American Bar Association (ABA) report that helps explain why defendants rarely exercise their Sixth Amendment rights.

In federal felony cases, the ABA found, the average sentence for defendants who go to trial is seven years longer than the average sentence for defendants who plead guilty. "Although a modest reduction in sentence is justified in some cases resolved through guilty pleas because a defendant accepts responsibility," the ABA said, "sentences should not be punitively inflated simply because a defendant exercised a fundamental right."

Everything they say is true, and I still want Hunter Biden in jail for a 25 year stint in federal prison. We live in a post-law society, so the minuscule possibility that the horrendous system will be applied to one of the elites is too tempting to dismiss as an affront to all of our rights. And...imagine this case going to the Supreme Court, which is then forced to examine our gun laws and perhaps loosen them even more.

Wouldn't that be a delicious byproduct of the Biden (pseudo) presidency!

I learned recently that replacing the stock on an AR-15 with one type of stock over another makes me a criminal, though it doesn't change the functionality of the weapon in any substantial way.

55 one reason to make a plea deal is going to jail for a short while might be better than being bankrupt. as i recall, billy dale c 1993 (the white house travel office guy) was willing to make a plea and take two or three months in jail but the feds demanded two years. they went to trial, jury acquitted him of all six charges in two hours and he had a half mil $ legal bill.

Which is why, correct as that "Reason" article may be and as valid as the argument points on the various hands may be, none of it is relevant.

This is perfectly valid in terms of legal philosophy, interpretation of law, etc. and in a system that was itself lawful (and whose controllers were largely law-abiding), debates like these are meaningful in that they will guide that system and its controllers.

But in an unlawful system run by people who are above the law, where law is merely a cudgel to be used against political opponents and enemies, it is of only academic interest. The controllers of the *next* system might see such argumentation and take it into consideration, but it has no bearing and - sadly - no meaning for the current environment.

That said -- the *rest* of us have to live under these insane gun laws that the left keeps pushing (including Hunters dad), why shouldn't the son of the President?

For example, I know of a guy who was a passenger in a car, driving back from a friends house, when they get pulled over for a traffic violation in a 2A friendly state.

During the chat with the cop, the driver mentions he has a couple of .22 rifles in the back from plinking earlier. No problem.

Cop runs the passengers name -- OOPS, turns out he had a felony marijuana possession on his record from the 1980's.

Guy gets mandatory sentence of 1 year in prison for being a felon in possession of a firearm, and there was nothing anyone could do about it, even though it was clearly fucked. Especially since the guy was eligible to get the felony annulled, and just "didn't see a reason to."

So if those are the laws championed by Biden and co., then yeah -- only fair that Hunter gets prison time (he won't) for lying on a form to buy a gun.

I know a guy with a felony conviction for a VERY serious crime, he's been working for years to get it expunged. Daylight is just on the horizon.

He doesn't have a drivers license, and he does like to go out to the desert and plink cans and whatnot.

One of these days, he's going to get pulled over... he's made so much progress getting his life in order, but he's one itchy cop away from having it all crash down. The wife, custody of his kids, the good job... all of it.

The right to private property is unique, and the basis upon which all the rights more vocally stated rest. It is the basis upon which the US productive business environment rests. I would almost argue the US Constitution is as pro- business document as exists anywhere in the world.

And it was this insidious attack at property rights through government regulation that began the nibble through the rest of our rights. Once you eat the foundation away, you can attack the rest. They left was very clumsy about the way they attacked guns, and it has resulted in a major roll back of their gun grabbing ways, but look at how successfully the 1st amendment has been gutted - religion, speech and assembly are now all allowed as long as you say what the govt wants you to say. This is completely in violation of the constitution.

It also has one of my favorite Rush deep cuts - a song called "Prime Mover". Probably too much synth for folks who gave up on Rush in the 80s. But like the vast majority of their catalog, the lyrics are outstanding. It feels a lot like "Vital Signs" (another favorite of mine) to me.

Because the plea deal is a deal between the prosecution and the defense.

The judge doesn't have to honor it.

Basically, yeah. The internet is full of vids of people arguing with cops, that they don't have to show them ID, they have a right to carry weapons, etc. Same vids show cops busting out windows and dragging the person out of their vehicle, while said person is shouting about their rights.

Or worse, be one of those people with a felony record, telling the cops the gun you have, it is your "right" to carry it. Sometimes those situations end with yellow tape around your vehicle.

He doesn't have a drivers license, and he does like to go out to the desert and plink cans and whatnot.

1) If Hunter gets the same penalty that normies get (prison time), I think that would be fair. Although judges do tend to give lawyers a bit of a harder time, since they should "know better." So if he gets 3-5 years, I'd say he got off fairly easily

2) We can debate the definition of "arms," but it certainly, at a minimum, includes any arms that would have been in useage in 1789. So long arms, handguns, cannons, etc.

3) Yes, I would say RPG's would be covered.

3a) "Rights" aren't subject to your "common sense." That's kind of the point of rights.

3b) I'd be more than willing to have a good faith national discussion on re-writing the 2A to be more specific if you'd like. As your side likes to say, no one is coming to take our guns. So this should be easy enough to solve. We can all probably agree that "nuclear bombs" shouldn't be in civilian hands. Deal?

If there were no incentives to plead guilty, presumably every federal criminal defendant would go to trial, because... why NOT?

383 After enough time has passed without a subsequent arrest and conviction, a former felon is no more of a risk to the public than someone never convicted of a crime. It is reasonable to restrict rights as part of the penalty for a conviction. But since the government was never required to prove guilt for most convictions, I think it is likely reasonable to restore full civil rights after enough time has passed. This should be a sliding scale that considers the type of conviction. A violent felon might need to keep their nose clean for 20 years after finishing their sentence - including paying any restitution required - where someone convicted for a low level nonviolent offense might wait as little as 5 or 10.
If we consider someone so dangerous or their crime so egregious that we can't reasonably envision ever restoring their rights, then we should probably be asking why they were let out in the first place.
