THE MORNING RANT: The Fraudulence of Experts (and Has the Forensic Scientist from the O.J. Simpson Trial Been Fabricating Evidence?)

Over the past few years, the term “Expert” has lost its cachet, and for most of us on the political right, it is a term we now use with mockery and derision. While there is little to celebrate about the politicization of once-reputable institutions, or how various “experts” were able to whip up a freedom-suffocating mass hysteria over Covid, a much welcome side-effect has been the erosion of credibility of “experts.”

They never deserved the credibility that they squandered. The word “expert” was widely overused and abused in recent decades. Declaring a person with some level of subject matter knowledge an “expert,” and empowering him to determine how others may live their lives, plants the seed for him to become an authoritarian demon even if he was a kind and gentle person before being given that authority. An “expert” whose pronouncements are God-like and who may not be challenged is an extremely dangerous person…one who often can’t exercise restraint with the power given to him.

29 years ago, a story in Texas taught me to never believe the pronouncements from any one “expert” who has a talent for divining scientific truths that can affect others’ lives. In 1994, the Bexar County (San Antonio) forensic serologist, Fred Zain, was found to have repeatedly lied under oath and provided falsified evidence needed for prosecutors to obtain criminal convictions. Previously he had done the same for the West Virginia State Police. (I’ll go into a little more detail about Mr. Zain’s false testimony later in this piece.)

Ever since then, I’ve said that I would never convict a person solely based on DNA evidence, nor solely based on any one person’s “expert testimony.” Beyond that, I have never assumed that any expert in any field is reliable if there is incentive (fame, money, power, etc.) for providing a desired “expert analysis.” [Hello, climate scientists.]

Coincidentally, the O.J. Simpson trial occurred about a year later. I have no interest in re-litigating the O.J. trial, and I have little doubt that he was the murderer, but I felt like a lone voice at the time stating that I would not consider the DNA evidence if I were a juror. If O.J. could be convicted based on the gloves, shoes, his personal movement, etc., that is fine, but I did not trust the “one in 21 billion” expert DNA analysis.

It looks like my skepticism might have been warranted…

Forensic scientist Henry Lee, known for his expert testimony in high-profile criminal cases including the O.J. Simpson murder trial and the JonBenet Ramsey case, has been found liable for fabricating evidence that led to a wrongful murder conviction.

A Connecticut federal judge ruled Lee liable on Friday for his role in the wrongful conviction after tests proved that the stains identified as blood on a towel were not blood, reported the Hartford Courant.

Judge Victor Bolden wrote that Lee failed to provide evidence to support his testimony about forensic tests he said showed the stains were blood.

“Dr. Lee’s own experts concluded that there is no ‘written documentation or photographic’ evidence” that Lee performed a particular scientific blood test on a towel, Bolden said. “And there is evidence in this record that the tests actually conducted did not indicate the presence of blood,” the judge added.

Understandably, Dr. Lee is defending his credibility and protesting the Connecticut judge’s ruling. While I don’t know the truth, I rate the possibility that Dr. Lee may have fudged some evidence to be better than one in 21 billion.

If you’re interested in the Fred Zain case, below are some excerpts from an old Los Angeles Times story dating back to 1994.

Fred Zain, a police chemist whose expert testimony and lab tests helped put scores of rapists and murderers behind bars in two states over 13 years, now finds himself in the dock.

Zain is charged with lying in court and tampering with evidence in his laboratories, compelling judges in West Virginia and Texas to release men sent to prison on the strength of blood and semen samples Zain verified.

“I really have no idea why he did what he did,” said Jack Buckalew, a former superintendent of the West Virginia State Police. “The only possible reason I can speculate on is to enhance his status with prosecutors by saying what he thought they wanted him to say.”

Zain worked as a serologist for the West Virginia State Police from 1980 to 1989. He resigned to become chief of physical evidence for the medical examiner in Bexar County, Tex.

Texas has freed two men convicted on now-disproven blood tests done by Zain: Gilbert Alejandro, who served four years of a 12-year sentence, and Jack W. Davis, convicted of murder in 1990.

Zain’s work or testimony figures in hundreds of other Texas cases, and authorities say they will review each one.

A panel appointed by the state Supreme Court found that Zain, at numerous trials, fabricated or altered evidence and lied about academic qualifications under oath. The panel’s report said Zain was routinely “overstating the strength of results, overstating the frequency of genetic matches . . . reporting inconclusive results as conclusive, repeatedly altering laboratory records . . . implying a match with a suspect when testing supported only a match with the victim, and reporting scientifically impossible or improbable results.”

Even after Zain had moved to San Antonio, West Virginia prosecutors continued to seek him out to analyze evidence because his results were more favorable than those obtained by his successors, according to George Castelle, a Charleston public defender.

“After Zain left, the lab sometimes couldn’t make any determinations, or the defendant would come within 40% of the population, whereas Zain always gave better probabilities because he faked evidence,” Castelle said.

Lives were ruined, justice was denied, and freedoms were lost due to the fraudulent “expertise” of Fred Zain. “Covid experts” and “climate experts” are little different from Mr. Zain.

I'm curious about the people who recognize the BS in the Covid, but not the climate experts. It's the same playbook, but the Covid thing was so focused in both degree and duration that some otherwise "woke" people are questioning that which may not be questioned.

The wildly overstated understanding of the mechanics of the problem, the solutions which make no sense, and the elites ignoring the proscriptions for themselves are the same in both. I'm hoping that seeing through the BS in one will lead some people to a real reckoning with the second.

I'm not counting on it, but it'd be nice.

In many criminal cases, however, the defense does not have the money to hire its own experts. That is one of the reasons why rich defendants have an advantage over poor defendants at trial.

It would be better to have publicly funded labs that are totally divorced from law enforcement or defense.

Usually this fraudulent "evidence" can be had for around 40-50k.

Still better than having such labs under law enforcement wing.

If the defense and law enforcement have to use the same labs and can hire outside opinions if necessary, then you will get a better result. Know several experts for hire in legal cases and the top DUI procedure expert in my state is a former retired cop in the State Police that trained state and local police how to conduct the tests.

There is no perfect system but a lot of poor criminal defendants get railroaded simply because they are too poor to pay for expert testimony and states are stingy with defense experts but not prosecutors.

Bad convictions are the result.

I once worked with a firm that did meticulous accident reconstruction/failure analysis. On one occasion, they were hired by an plaintiff's lawyers to do *nothing*. The plaintiff's lawyers did not want the defendant's people to hire them.

In every state, the state lab is placed under law enforcement and that includes fedgov. That is the problem--the experts are literally hired by the state for law enforcement.

Having a state funded lab under another agency is preferable just like having the state courts funded separately from the police is also required.

Does not prevent either side from going outside the system as well.

She essentially demanded a full breakdown of the entire testing process (we're 3 months into this, and everyone knows) and then wondered why we were having the meeting at all because there were so few updates (we're pending the client fixing some stuff on their end before testing can continue, but we have defects that we continue to monitor).

Very aggressive lady, essentially wasting my time and then complaining that I'm wasting time.

Well if they have a public defender the state has already paid for the accused's defense. If not, I suspect you'd see more plea deals to avoid trials. And if you were headed toward trial you'd indirectly incentivize prosecutorial misconduct to secure convictions so their heads don't roll come budget time.

The guy insisted that he was innocent , but took a plea based upon the evidence (the guy was a lifelong lowlife). Guess what ? About two years later it was found that the NYS crime lab had faked data or done no tests. The guy was let out of jail because of the lab fraud. Don't know the status of lawsuits

Washington State has a law that does that in self defense cases I think.

Scottish law infamously has a verdict called Not Proven so you get Innocent, Guilty, and Not Proven. I think that would be necessary for the reimbursement if the jury voted for innocent by something like a majority (7) of the jury for reimbursement.

obvious ramification - every defendant in every case is going to try to spend a million dollars or more in his defense. If he wins, he gets it back, if he loses - well, he's already going to jail, so why would he worry about bad debts? Also, every defense attorney in every case will raise their fees to $500 per hour and bill 12 hours a day, with the provision that if their client is found guilty they waive all fees.

It seemed so obvious for him to say that the odds in general didn't matter. He could have said the perp has an extended family in the area, so what are the odds of a match in this locality.
The jury took a short time to convict. In the end that was probably okay because the defendant probably had a long criminal history.

The worst "experts" are those that claim expertise in areas of "social justice" and "public health" - two made up concepts that are logically contradictory (The public is an abstract entity and thus has no health; an individual patient has health). They work in fields concocted by "progressives" and which are not evaluated on the basis of real world results; therefore, it doesn't matter how often they fail. Only their diplomas and resumes count.

Real experts are still needed, though, to solve actual real world problems: build bridges, design and build jets, perform open heart surgery, etc. Experts in these fields are judged by real world results.

I don't think that countering vote fraud is impossible. I think it's easily doable.

Set up cameras outside of polling station, counting the number of people going in vs. the the number of ballots cast. That's one easy thing that's been doable, in secret without the poll watchers finding out, since the invention of small scale video cameras.

And yet, Philly just continues to fester while Detroit says that there are 1000 ballots in a box with 10, and the state GOPs just shrug their shoulders.

Valentine's method is constant review of changing voter rolls starting at lest 6 months before the election. The Left creates voters many ways but they have to register them to vote them. The way they remove and add voters to the roll are easy to track and can be deleted by just providing evidence of fraud to local sheriffs. He doesn't need to shut down the grift but merely to reduce it and make it harder to pull off.

433 West Virginia resident here. I remember when the Fred Zain story first hit the news. The Glen Dale Woodall case was the one that broke it open, and it was big news in the local papers. At the time, there was a lengthy newspaper article, that described a cozy relationship between Zain and the state police. It was implied that the police would talk to Zain, and say, "We're really sure we have the right guy (wink, nudge), so we're confident your results will back us up, right?" Of course, there was no proof of this sort of thing, but it would explain a lot. Why else would Zain fake results? This was the beginning of a long change in my attitude toward police.

435 Years ago now, the Houston crime lab was proven to essentially be rubber-stamping the evidence that the HPD detectives needed for convictions. Many convictions were overturned, and the evidence still preserved had to be sent out to independent labs for re-analysis. It was a huge deal at the time, not just for overturning past convictions and derailing ongoing court cases, but the lab had to be restaffed and requalified from scratch.

DNA can be a poor indicator if it wasn’t analyzed properly, but juries are programmed from years of TV to trust it absolutely.
