Law School Organization Holds Conference On How to Violate the Constitution and Evade the Law and Continue Practicing Hardcore Racial Discrimination

Of course. The law does not apply to the lawless left.

They are the aristocracy. They make the law, they do not suffer it.

The Association of American Law Schools (AALS) held a conference in July discussing how higher education institutions can continue to racially discriminate, following a ruling by the Supreme Court banning race-based admissions policies, according to videos reviewed by the Daily Caller News Foundation.

In June, the Supreme Court ruled that Harvard University and the University of North Carolina's use of race-based admissions policies is unconstitutional, halting the practice in all higher education institutions. In early July, AALS held a conference featuring several panels and speakers who suggested institutions use recruiting tactics, diversity statements as well as "data and analysis" to increase racial diversity.

...

"A lot of us have looked this problem square in the eye before, or this issue, and have come up with creative solutions to maintain the kinds of classes that we want," Cary Lee Cluck, University of Arizona James E. Rogers College of Law Assistant Dean, said during the seminar. "This is just another moment in time where we have to stop and reassess."

Kristin Theis-Alvarez, assistant dean of Admissions and Financial Aid at the UC Berkeley School of Law, noted Berkeley has a four-page personal statement that was a "direct outcome" of California's Proposition 209 in 1996, which put a stop to affirmative action in the state, according to the seminar. The school also allows applicants to submit an optional socioeconomic questionnaire and diversity statement rather than explicitly asking for race during the admissions process, Theis-Alvarez said.

And they're pushing the "personal statement" as the only criteria for admission because it allows black students to identify as such in official application materials. Previously, these schools claimed that Asians just didn't have "good personalities" and discriminated against them; now they'll just say "the personal statement was boring and didn't have the kind of passion I was looking for."

"In the past, applicants have included information about such things as gender identity, sexual orientation, race and ethnicity, disability, socio-economic background, being a first-generation college student or graduate student, being a student parent a re-entry student, their geographic diversity or ideological diversity and others," Theis-Alvarez said.

Harvard, UMass, and Tuft's are all similarly scheming to subvert the law.

They're employing the same "tell us you're black in your personal statement and how being black means you're black and have black perspectives on matters of black diversity" tactic previewed at the conference discussed above.

Harvard, UMass and Tufts hopefuls are being asked to give details about their upbringing, community and what makes them 'diverse' on application websites

This comes at the advice of the Biden administration, which on Monday began urging colleges to use a range of strategies to promote racial diversity

In June, the Supreme Court ruled 6-3 that colleges could no longer factor in race when considering potential students, ending a decades-old policy

Top US colleges are continuing diversity drives when selecting students despite SCOTUS's ruling against affirmative action - in part due to advice given by the Biden administration.

Harvard, UMass and Tufts hopefuls are being asked to give details about their upbringing, community and what makes them 'diverse' on application websites in thinly-veiled attempts to skirt the legislation.,

I like black music, black athletes, and black comedians.

Am I diverse now?

Oh no I can't be, because I'm white. The "background" statement is just a signal to look at my picture and verify my race.

But this is the basic idea: We won't admit students based on race. Wink. We'll just admit them on their "diverse" background features and interests, which have nothing (wink to do with race.

...

Colleges can also consider how an applicant's race has shaped their personal experience, as detailed in students' application essays or letters of recommendation, the guidance states.

That's the Biden Administration once again defying the courts. The Supreme Court said they could not admit based on race, and Biden is telling them: Keep on admitting based on race. Just call it their "personal experience in living as a member of the black race."

Students applying to Harvard are now faced with a question about their background with the preface: 'Harvard has long recognized the importance of enrolling a diverse student body.

'How will the life experiences that shape who you are today enable you to contribute to Harvard?'

And high school grads hoping to secure a spot at Tufts are being asked: 'How have the environments or experiences of your upbringing -- your family, home, neighborhood, or community -- shaped the person you are today?'

Does this necessitate the use of RICO, where organizations collude and conspire on how to skirt/break the law?

Or does it just require a prosecutor to arrest them for conspiracy?

90 Congress should pass a law that if your Uni endowment passes a certain level, student admission must be free of charge. Below that, it should be pro-rated. Endowments are supposed to be for allowing the upkeep and expansion of the school. Unless Harvard is planning on invading China, it doesn't need that kind of cash.

As a member of the ruling class establishment, my background - including my family and home life - has demonstrated that I am born to power, which coincides well with my will to power. We were the minority in my neighborhood, as most of my neighbors are professionals of some kind - bankers, executives, engineers, etc. - but we are the only elite family on the block. Being the "odd man out" was very troubling throughout my youth, and I have come to understand that revolutionary change is necessary. At Tufts, I hope to learn how to continue to leverage my elite position to ensure that enclaves for people like me do not include anyone who is not part of establishment power structure. Ethnic diversity, of course, will remain high.

102 I'm off the reservation on this one.

1. What they are talking about is admission into Communist madrasas. So what? They may as well just admit those who already support them. Why in the world do we care?

2. I really don't see college admissions as closely tied to ability as others do, and am not clear that they should be. Remember, it was precisely the "merit based" admissions systems which were in place for the last quarter of the 20th C which produced the "meritocracy" which David Brooks is so proud to be part of.

3. I also don't think the vast majority of those in a position to choose are capable of picking the best. Both my personal experience and my reading of history convinces me of this. The best thing to do would be to put in broad minimum requirements. Then choose by lot among all who qualify.

Posted by: Eeyore at August 18, 2023 03:43 PM (brAQZ)

103 [P]reviously, these schools claimed that Asians just didn't have "good personalities" and discriminated against them; now they'll just say "the personal statement was boring and didn't have the kind of passion I was looking for."
---
But with the disparate outcome inference that we are now used to, they really can't get those judgements too far apart, or that would be indication of bias in recruiting.

If disparate outcome almost inevitably points to discrimination, these colleges become liable at almost any skew.

They don't discriminate, they just get the outcomes they want. It's not a ruse, it's a reflection of a commitment to social justice writ large. The arc of history bends toward progress at all times, which is why the student body reflects the ideal makeup even without affirmative action!

It might be, outside of the elite corporations and government. I'm not sure.

When I was hiring (it was sort of high-entry-level work), I looked for brightness, background knowledge and the ability to reason through problems. I only asked about education at all if it was something really unusual - like the astrophysics PhD I hired. It was a weird shift and I was curious about it. He said that it was boring, because he just wrote grants all day and wanted to to do some real work and he was good with computers.

At least with the supposed underwater basket weaving classes you learn to swim and you have some baskets at the end. "Studies" courses produce negative learning and a crop of professors who have produced no worthwhile results.

Even the Feminists in 50 years can't describe how the Patriarchy is organized, how they indoctrinate everyone when women raise children till teenager at least, how they manage to impose these systems that uniquely produce this misty oppression without a single incident over a thousand years or more.

They told her in a Title IX class that she could be charged with harassment if she refused to use a students' preferred pronouns, they went on to tell her that the University would help female students with access to abortion services, they sent a 'dating-guru' to encourage students to fuck each other and the president said "This is a Christian college, but you can live whatever lifestyle you want here."

After hearing all that, she decided that perhaps the extra tuition she was paying to go to a private "Christian" university might not be worth it and withdrew.

Women burn themselves out trying to be everything, sleeping around "like the boys", going to school, working hard at jobs, traveling....and then, as they cross into their 30s and want to settle down, they don't want to marry men making less than them, but the number of men that meet their standards in small, and are either content playing the field as an attractive man, or looking to settle down with younger, more attractive women.

Its also a place to warehouse those affirmative action students that don't quit entirely a way to get a degree when for whatever reason they can't compete with the general run of students at the university.

Tends to also instill a resentful, entitled mindset for life that makes them failures going forward.

Most likely would have done well at some other college matched to their level and learned something besides anger and bitterness and become a productive member of society, but stunting minorities forever is what affirmative action is for..

The absolute biggest lie foisted upon this society right now is the one that says that you need a college degree - or, even better, and Ivy League degree - to succeed in life. Because of that carrot, parents all over the USA have submitted their kids to the ministrations of half-wits (by and large) who are the gatekeepers for their future. All -and I mean all - of the Left's power derives from having taken control of education in this manner. Once that power goes away, everything - from home prices to business opportunities - starts to come back to family control.

Brava to your daughter.

226 Some really smart law school (and medical school, and dental school, etc.), will make sure that they take only the best and brightest, regardless of all the "special" categories of people, and will churn out the best lawyers (and doctors and dentists, etc). Those people will ultimately rise to the top of their professions, because sooner or later you DO have to prove your mettle out in the real world. Incompetent lawyers don't get clients. Incompetent doctors kill people and get sued. It'll happen. Maybe not soon enough, but it will. The world cannot run on dullards for very long.

Why should people today pay for crimes committed by someone else against someone else and who are all dead now? We have had 50 years of affirmative action, AKA racial and sex discrimination against straight, white, males for long enough. Isn't 50 years of punishment for someone else's crimes enough?

One of the classic things you see on shows like Brian Atlas's Whatever is such young women arguing that men sleep around as much as they do, refusing to believe the statistic that a majority of young men haven't sex in forever, and then discovering they and several of the other women on the show are all having sex with the SAME guy.

Contrast this with men who study a subject, have practical skills and use them to help others, and who raise a family through hard work.

Honestly, I think HS should end at 16. This is how it was in the 1930s. FDR bumped it to 18 to create jobs and hold down the number of job seekers. 16 is a very good age to be introduced to reality. It is also good to break up the clicks that teenagers form in school. Better to work next to a tradesman for a year or so to focus your mind.

The elite schools are the training grounds for the ruling class. They will be fine. The state schools are going to fine, too - at least the major campuses. No risk of those going down.

I strongly suspect, however, that a lot of the other private colleges and perhaps some marginal/small state schools are going to fail over the next decade. Most of them run on razor-thin endowments and are not well-positioned to survive a decline in enrollment or serious financial pressure of any kind.

One could expect a school to have 12 to 14 percent black students in that scenario, comprised of those who earned their way in and the remainder through some bullshit rigged system.

Ayn Rand had a description of a railroad disaster in Atlas Shrugged as a climax which ends up destroying the last transcontinental link. There's a chain where over and over people with responsibility avoid it and pass the buck because they know the system won't reward them for stopping the disaster. Finally a junior guy lets a coal engine go into the unventilated tunnel and everyone on board suffocates and a train coming the other direction collides with it and blocks the track.

303 Women burn themselves out trying to be everything, sleeping around "like the boys", going to school, working hard at jobs, traveling....and then, as they cross into their 30s and want to settle down, they don't want to marry men making less than them, but the number of men that meet their standards in small, and are either content playing the field as an attractive man, or looking to settle down with younger, more attractive women.

Which is why the forecasted marriage rates for college educated women are all in the toilet. This is setting up to accelerate our own demographic crises in 40 years.

304 "Students applying to Harvard are now faced with a question about their background with the preface: 'Harvard has long recognized the importance of enrolling a diverse student body."

Importance? Prove it or it didn't/doesn't happen.

305 I have recommended to my kids to write the "overcoming adversity" essay from the perspective as a member of a group that has experienced significant discrimination in recent years, and how they have overcome it with their strong connections to their community and with teachers that are members of the same discriminated group. ie Christians, if anyone asks

306 We'll just admit them on their "diverse" background features and interests, which have nothing (wink to do with race.
Which also have NOTHING to do with the school's purpose in existing, which is EDUCATION.

But they see college as a way to bring people up, so it's a welfare program for those they see as "oppressed" or lesser.

307 My father was a huge advocate of U of Chicago for many of the reasons you articulated about Harvard of old. My parents went to my nephew's graduation from UoC last year and were disgusted by how far it had fallen since my sister graduated there in the 80s.

---------------------------------

Yeah. I graduated from UChicago in 1980. It was the most exhilarating academic experience you can imagine back then; while the faculty was already skewed solidly left there was no indoctrination and conservative viewpoints were respected. I was a big booster until about 2000 but no longer. They're still trading on their reputation for academic freedom but the reality is now pretty much the opposite.

308 Just have to find the right lawyer that's willing to take these conspirators to court using 42USC1983

Could make the lawyer as much as SPLC or more

309 What needs to happen is if the Supreme Court makes a ruling, and a group then willfully violates it, the court should have the right to strip them off everything they have and jail them, as they are now happily violating the constitution.
