Good morning, kids. One of the real stalwarts of our movement is Professor William Jacobson over at the invaluable Legal Insurrection.com. He and his team consistently produce quality reportage and opinion and as a result earn a considerable number of links each day on this page. That said, it makes it that much harder to criticize someone whom you admire, but with all due respect, I gotta do what I gotta do:

So I think he’s in a lot of legal trouble, and I’ve been saying this on my website for a while and people, you know, attack that. But hey, I live in the real world and the real world is telling us that Donald Trump has a lot of legal problems. He’s probably going to get convicted in one or more of these cases. And people need to wake up and people need to understand what’s happening. And people also need to understand that, while he is not to blame for the hyperpartisan actions of the prosecutors, he left himself very vulnerable. He handed a lot of this stuff to them on a silver platter, and they are now exploiting it. It’s a bad situation.

And now he’s going to roll out, apparently Monday, a new report about Georgia election fraud. I mean, are you kidding me? It’s two and a half years later.

What is the endgame here? Trump supporters don’t seem to understand, what is your endgame? There is no process to decertify an election that took place two and a half years ago. The way you stop this growing totalitarianism is to win the next election, but everything they’re doing is set up to lose the next election. You’ve got to win the next election because Fani Willis and Alvin Bragg and Jack Smith are just the first of a wave of totalitarian attacks using the law enforcement and prosecutorial powers of the state that’s coming our way.

If you read the entire interview, while his analysis of the situation from a purely legal perspective makes complete sense, it nevertheless irks me for a number of reasons.

First of all, like so many other folks he seems to be looking at this situation as if it's normal, or at worst at the extreme limit of normal political discourse. It isn't, and ceased to be that way during the period from 11/8/20 through 1/6/21.

Second, he states, "while he is not to blame for the hyperpartisan actions of the prosecutors, he left himself very vulnerable. He handed a lot of this stuff to them on a silver platter, and they are now exploiting it. It’s a bad situation."

I read and reread the link and nowhere does he elaborate on how Trump made himself vulnerable. By his words up to, during and in the wake of 1/6 (none of which could possibly be construed by a sane rational person as calling for a violent overthrow of the government)? By his legal actions in the retaining of declassified documents post his departure from office that led to the the Mar-a-Lago FBI Gestapo raid? By a legal NDA with Sloppy Daniels? To my way of thinking, Donald Trump's only vulnerability was and is because he exists and from a policy standpoint alone poses an existential threat to the counter-American revolution that began with Woodrow Wilson, exploded under FDR and was completed with Obama (not to ignore the aiding and abetting by every subsequent GOP administration minus Harding/Coolidge and to a lesser extent Reagan in that time).

Third, and this one is at the heart of what irks me is his assertion that "The way you stop this growing totalitarianism is to win the next election, but everything they’re doing is set up to lose the next election. You’ve got to win the next election because Fani Willis and Alvin Bragg and Jack Smith are just the first of a wave of totalitarian attacks using the law enforcement and prosecutorial powers of the state that’s coming our way."

Professor Jacobson, the reason that this wave of naked totalitarianism is happening in the first place is because 2020 was stolen, and the now institutionalized mechanisms for Democrats to rig all subsequent elections have been thoroughly cemented in place. How do you propose that Donald Trump or for that matter any other GOP candidate win the election or any subsequent election? You rightly rail against, as even I have, Donald Trump re-litigating the 2020 election as a pillar of his 2024 campaign. Yet what happened in 2020 cannot and must neither be ignored nor minimized. But again, to do so presupposes this attitude of "business as usual" when by even the most cursory examination of events and the situation we find ourselves in proves it is anything but.

Even if by some miracle, the almost lead pipe cinch of rigging is overcome by Trump (imprisoned or otherwise by that time), the entire federal bureaucracy including the weaponized justice and intelligence communities will still be in place and even more determined to take him and all of us out. By any means necessary. Ditto and more alarming with the eager approval and participation of every Democrat and Leftist in this country.

If I can criticize Trump – and he is not above criticism even with everything happening to him – is that he too seems to be approaching the campaign as well as his persecution as if it's hardball American politics. At least from what I glean of his statements on the campaign trail. In fact, the very act of being on the campaign trail is itself kind of schizophrenic. And that goes for all the other non-hack candidates, of which there are only two, DeSantis and Ramaswamy.

This is why I don't support Trump as a candidate. I support him as a martyr. I don't even think even he'll realize that that's what he is until they strap him in a gurney and get ready to put him to death. Or will he be hanged? As friend of the blog Robert Spencer pointed out a couple of weeks ago, the charges against Trump from Hack Smith include penalties up to and including capital punishment. Given the mindset of who and what is running this junta, and its entire base, and what they have done to this country just in the past 15 years since Obama, do you really think that they would not go all the way wild on that?

If I were Trump, I'd refuse to surrender to this Fanny Willis scumbag, go back to Mar-a-Lago and tell the Feds and the state of Georgia to get fucked. If I were Ron DeSantis, I'd ring Mar-a-Lago with state troopers and National Guardsmen and dare the Junta to try and enter.

Unfortunately, it seems that both Trump and DeSantis are equally willing to play the game when what is needed is for them and everyone like them to kick the damn table over and burn down the casino. Rhetorically speaking.

They won't. And I guess in that sense, Professor Jacobson is, in a way, correct in his analysis of Trump.

23 I agreed with your (as usual) fantastic analysis, JJ, until the very end. Because I don’t think Trump has any other choice then to do what he’s doing. If he declines to go along with the Fanni Willis and Hack Smith (great nic) farces, it doesn’t end well. DeSantis won’t defend him! He continues running against Trump and he obviously doesn’t get IT. Yes… if the rest of the GOP had cajones Trump could do as suggested. But they most assuredly do not and they’ve proved it by their words and their actions and inactions. Trump’s only choice is to first route his feckless GOP opponents (every single one of them) and then draw such a massive number of votes in the general as to wipe out the fraud. Then enter office as an avenging angel. Of those 3 steps, the first is certain, the second I’d give a 30% probability and the last a 10% probability. 33 During the bogus J6 committee hearings Liz Cheney opined that their goal was to either put Trump in prison or, at the very least, make him and his supporters in Congress ineligible to run, or remain in office.

To a certain degree that committee's goals are still in effect.

Trump very well may be indicted and may go to jail. He also may not. But if his name is not printed on ballots in any number of states (several come to mind right off the bat) he faces long odds in winning as a write-in. And runs the possibility of being DQ'd in those states for reasons.

There were also manufactured riots, a manufactured plague caused by illegal government bioweapons research, and an authoritarian crackdown on individual rights. Prior to that came four years of stage managed investigations and impeachments and campaign surveillance by agents of the State, with legislative stonewalling and legerdemain by both its Party factions.

Throughout, government control of the media was used to push all these initiatives, and subsequently, it's being used to help railroad the deposed President and his political allies, cover up the crimes of the current junta, and manufacture consent for an unprovoked generational war against a nuclear power.

This is, bluntly, a wholly unaccountable rogue superstate, and no campaign or debate performance by Trump or DeSantis is going to stop its momentum.

But Jacobson is sometimes too lawyerly in his analysis in that he gets hung up on small legal details early in the event that are not the primary reason for the actual event that took place and continues to justify his entire opinion on that detail. Comes with being a lawyer who wants to work with the letter of the law and ignores that the opposing lawyer doesn’t. Bianca can be the same way.

It's like Andrew McCarthy, Yawn Inanity and others vis a vis the police and FBI.

They refuse to believe their own lying eyes that the system that they are a part of and support is totally or nearly all corrupt. Same with Jacobson. Imagine being a lawyer and legal scholar and suddenly discovering that everything you work for, support and are a part of is worse than useless, but cancerous?

My assumption is that this is precisely why Trump is going to try to prove his case in the court of public opinion. I have no idea if it will work or if any of his evidence is any good. But the intent, I think, is clear.

The purpose isn't to "decertify" an election. That probably can't be done no matter what, even if it had all been proven on January 22nd of 2021. It's irrelevant, and if that is what people think this is about, then I understand their confusion.

I think it's about demonstrating that the fraud was real and that the election was stolen. Why? Two reasons: to enrage the base and make them want to try *really* hard to set things right, and to force an acknowledgement of fraud in an effort to level the playing field and create conditions for victory.

Neither will work, but I think that's the game.

Therefore, ANY attack against members of that community is perceived as a personal attack against THEM.

What I think the author is talking about is that Trump did things that *could* be twisted into crime by a system designed to twist anything into crime. He took classified documents. He was allowed to take them based on all history of the office, but one interpretation of the contradictory laws says he wasn't.

He called elections officials and demanded recounts in ways that could be interpreted - by hyper-partisan bad actors in government - as demanding the fabrication of votes. He called for a mass rally to apply pressure to the electors. There was no demand for violence (indeed, there were specific instructions and pleas to the contrary), but the bad actors can and do argue that assembly designed to pressure electors is itself treasonous.

It is easier to argue that Trump created the means of his own destruction than to acknowledge that arbitrary "guilt" is the purpose of American law.

State-level rebellion of some form - be it nullification or secession - is the way out. I favor nullification and triggering a crisis because it's the only way I see where one of the possible outcomes is not "war." War is still a possible outcome of that, but it is not guaranteed.

But the FedGov itself is finished. It cannot be fixed. Nobody running for federal office can fix it. People running for federal office are either on quixotic quests for vindication (which I think is Trump's situation) or they're in it for the money and power and can't wait to play the game at a high level if they sneak in, but can't wait to hoover up money by campaigning regardless (Christie and Hutchinson). Some might be in it for other purposes. A federal run as such, however, is pointless on its own terms.

How does one keep from being falsely accused? Every human does things every day that can be taken advantage of by a bad actor. Remember the "you commit ten felonies a day" thing?

As has been said in the past, Teh Donald is essentially a 70s Democrat. And, as has also been noted, he believes in an "America" that hasn't existed for over 70 years. I'd argue he was aware of the Dems' intentions (whatever that may mean), but dismissed them because he believed their screams were simply part of the partisan system.

I do agree that he does not seem to have learned from his mistakes. If he does win (which he will not), he is not going to go scorched earth on the left. And even if he did, the GOP would fight him all the way.

I don't know what the candidates themselves can do but 'Judicial Watch' is examining voter rolls all over the country and forcing states and counties to purge them. In Pennsylvania alone that was around 90,000 potential ballots cast. Notice Biden appearing in Pennsylvania much? He's here in Philly a lot.

I can't be all doom and gloom about 2024. There are some silver linings out there. Any spare change I had I wouldn't send to a candidate if election integrity is your issue. Send some to the lawyers at Judicial Watch.

If you want to blame Trump, and I can agree with this, is that the COVID lockdowns which he went along with and did little or nothing to end was the precursor to this.

That said, too many politicians and judges and the system were preordained to screw him over the moment he went down that escalator in 2015.
His greatest failing was his naivete that in the system. And I think we were all guilty of that to some degree.

This is probably true to a great extent. One of the problems of leadership is assuming burdens you don't have to because you have difficulty finding people who are reliable to take on those burdens.

I've seen it in my church with the pastor who has been burned by well-meaning, but ultimately unreliable people who left him to take care of the task that was assigned to them. As a result, his trust circle is fairly small these days.

In Trump's case, virtually EVERYONE in the Federal government was actively working against him from day one, so it's possible he felt the ONLY way to get things done was to try and take care of it himself.

But I think he did expect obedience. I think he did expect that if he gave an order, it would be carried out or the person would quit. That is how it works in the business world. You give the order, the subordinate does it. If he refuses to do it, he quits or gets fired.

I think the biggest development of Trump's administration is the staff's rampant rejection of orders and refusal to do as instructed. Trump's administration was largely insubordinate. He fired some of them, but not enough. After a firing, he couldn't get loyal people installed through the Congress - not that this is an excuse, but it is a factor.

When essentially your entire staff refuses to do as they're told, you're not really in charge. And that's Washington if you're not down with the program.

The rulers of Oceania decided to pick this as their excuse - not turning over documents - in order to raid DJT's home. But worry not, the correctors of misinformation at the Ministry of Truth are working diligently to make sure all official records reflect Big Brother's version of events. We must keep fighting Eurasia in Ukraine, whilst our allies in East Asia (we've always been at war with Eurasia) mind their business by taking a bit of islands called Taiwan and a chunk of the seas in that region.

There was a grand jury subpeona. There isn't supposed to be a protracted "discussion" about it. You comply with it or you file an objection. Trump's atty had represented to the court that they had complied with the subpeona. That does not appear to have been the case.

The act of refusing to cooperate and MAKING them arrest him for everyone to see will at least shatter illusions and delusions about where we are and how low we have sunk.

To not do anything and go along/play along as if all is normal in the good old US of A only legitimizes what they have done, are doing and will no doubt continue to do to all of us.
