Texas Attorney General Ken Paxton Did the Unforgiveable, He Defeated a Bush, and Now He is Being Impeached

Ken Paxton is a populist, Tea Party conservative who was first elected to the office of Texas Attorney General in 2014. He is bitterly hated by establishment Republicans in Texas, not only for his willingness to use his office to advance the conservative agenda, but also because he had the audacity to win without the establishment’s permission. Repeatedly.

The Bush-wing of the Texas Republican Party has allied with RINOs and Democrats to engage in lawfare against Paxton, but despite their best efforts he has kept on winning.

Finally in 2022, the establishment played a trump card to eliminate Paxton. They ran a Bush family princeling against Paxton, knowing that Texans have an unyielding love for the Bushes. George P. Bush (the son of former Florida Governor Jeb Bush) already held statewide office in Texas as the state’s Land Commissioner. Then 46-year-old George P. was going to eradicate the Paxton problem, which would also place him on deck as Attorney General to replace Greg Abbott as Governor when the time came.

But Paxton then committed the most unforgiveable political act that establishment Texas Republicans have ever endured. He defeated a Bush at the ballot box.

The establishment decided that the voters of Texas were wrong, and that this electoral obscenity must be corrected. So they proceeded to impeach Ken Paxton in the Texas House of Representatives. 100% of Democrats joined the RINO Republicans to produce a 121 – 23 vote to thwart the will of Texas voters and impeach Mr. Paxton, for the purpose of removing him from office. The Senate trial will be next month.

Mark Pulliam wrote an excellent piece at The Federalist last week that explains the ugly political warfare that is going on against Paxton. Here are some excerpts, but I encourage you to read the whole thing.

The Establishment’s Paxton Impeachment Sham Undermines The Will Of Texas Voters [Mark Pulliam -The Federalist – 7/24/2023]

Texas politics have long been rancorous, unscrupulous, and, in recent years, marred by bitter lawfare — weaponizing the legal system to circumvent election results.

Pulliam discusses the comical felony indictments in recent decades against Kay Bailey Hutchison, Tom DeLay, Rick Perry and others. He then brings it forward to the Paxton situation.

Another is the ongoing campaign to remove from office conservative Texas Attorney General Ken Paxton, whom Texas voters overwhelmingly elected in 2014, and enthusiastically reelected in 2018 and 2022.

Paxton’s real “crime” is that he threw his hat into the GOP primary for the AG race in 2014 after the anointed establishment candidate, moderate Dan Branch, thought he had the Republican field to himself. In Texas, the AG position has often been used as a stepping stone to higher office — a path previously trod by both Sen. John Cornyn and current Texas Gov. Greg Abbott. When Tea Party firebrand Paxton upset establishment-favorite Branch in the 2014 GOP primary…the powerful establishment was furious. Branch had been endorsed by George W. Bush and other moderates. In Texas, as elsewhere, the moderate (or “RINO” faction of the Republican Party loathes grassroots conservatives.

Pretty much any article about Paxton in the legacy media, or in Conservative Inc., will smear him as being ”scandal plagued” or “under criminal investigation.” It’s all a political hit job against him.

In retaliation for Paxton’s temerity, Branch’s establishment backers, who are supported by the state’s business community and control the Texas House of Representatives (where in 2010 then-House member Paxton unsuccessfully challenged establishment leader Joe Straus for speaker), unleashed a series of frivolous criminal charges against Paxton, which have been pending for eight years. Anti-Paxton forces orchestrated a flimsy fraud indictment from a paperwork violation unrelated to Paxton’s work as a legislator.

The conservative base fully understands what is going on, which has strengthened their support for Paxton.

The establishment fumed when Texas voters elected Paxton in 2014 despite extensive news coverage of the bogus fraud charges, and the consternation increased when he was reelected in 2018 and again in 2022 while the phony charges were still pending! Grassroots conservatives gave short shrift to the unproven allegations against Paxton, looking instead to his stellar record as Texas’ top prosecutor.

Paxton’s resounding GOP primary victory in 2022, against a crowded field that included George P. Bush (Jeb’s son and GWB’s nephew) … made the establishment apoplectic. In the primary runoff, Paxton beat Bush by more than a 2-to-1 margin. In the general election, Paxton outpolled his Democrat challenger 53.4 to 43.7 percent.

Even worse for the establishment, now that the Bush heir was dispatched, there was almost nothing to prevent Paxton from succeeding Gov. Abbott when he finally steps aside.

The establishment worried that Paxton, thrice elected as AG, would become the frontrunner to succeed Abbott as governor, decided to double down on its lawfare campaign. Provoked by Paxton’s claim that Texas Speaker Dade Phelan should resign for appearing on the House floor while intoxicated, in May the House voted to impeach Paxton on additional charges of doing favors for a wealthy campaign donor and terminating four staffers who claimed to be “whistleblowers.”

Paxton is suspended from his AG duties until the trial in the Texas Senate next month, where a 2/3 majority is necessary to convict and remove him from office.

In Texas, as in the nation’s capital, impeachment is just another form of lawfare. Convicting Paxton would bar him from holding public office in the future — precisely the establishment’s goal, contrary to the voters’ mandate. Such a result would be tantamount to a banana republic coup unworthy of the Lone Star State.

The Texas version of Kremlinologists are unsure if the votes are there in the Senate to remove Paxton or not. Republican Senators who vote to convict should plan on being primaried, and in Texas the conservative base holds the power in primaries.

If I could add one final bitter note as a person who defended both George Bushes in their darkest hours, this is an insulting betrayal.

It’s probably also worth noting that as “rare” and “solemn” as impeachments are, they are pretty much a political certainty for anyone who dares to defeat a Bush at the ballot box.

Bill Clinton defeated George H.W. Bush in 1992, ending GHWB’s political career. Bill Clinton was subsequently impeached.

Donald Trump defeated Jeb Bush in the in the 2016 Republican presidential primaries, ending Jeb’s political career. Trump was subsequently impeached.

Ken Paxton defeated George P. Bush in the in the 2022 Texas primaries, ending George P.’s political career. Now Paxton is being impeached.

I believe it was Ian Fleming who wrote, “Once is happenstance. Twice is coincidence. Three times is enemy action.”

As noted above, Paxton accused his persecutor, Texas House Speaker Dade Phelan, of conducting business while being intoxicated. Here is video of that incident.

It tends to remind people of the complicated familial relationships in monarchies, with earldoms, baronies, dukedoms, and so forth.

35 They already have secured one vote for impeachment by disqualifying his wife who is a senator.

That's, of course, unlawful as the only qualification to judge him in the Senate is to be a senator.

And Paxton has rightly pointed out, not only are all the charges vague to the point he can't even mount a defense, but that--even if they are-- all these issues were before the voters in the last election, so they can only legally impeach him for the term already served--not the current term.

48 I notice that the article itself (at least from skimming through it) doesn't seem to go into the actual impeachment rationale. It does link out to it. It's apparently linked to a now-settled (out of court) incident involving whistle-blowers (or "co-called whistle-blowers" - I'm not sure) who claim they were inappropriately fired after accusing Paxton of criminal behavior - specifically, bribery and abuse of office. The FBI investigated but did not charge, which is a big mark against the accusation because Paxton seems to be the kind of guy the FBI would love to take out.

I have no idea if Paxton is a good guy or a bad guy or an indifferent guy. As we now know, an accusation, impeachment, federal investigation or indictment isn't exactly a good set of signals for that. Whatever Paxton did (if he did it), he'd probably be just fine if he didn't cross the dynastic families or permanent bureaucracy.

52 "...knowing that Texans have an unyielding love for the Bushes."

Debatable. I know a lot of Texans who despise Bush. They are not Republicans as much as they are conservatives. But, yes, the GOPe of Texas has been a willing accomplice of Bushism which is actually more NE Liberal.

The Bush family/name is mostly mud. Their power, however, remains because Austin (centrally) is liberal. And too many in the GOP are actually more Democrat than Republican, but they have learned to change their spots since the (R) matters at the ballot box in Texas.

77 No, Texas is turning redder, but the republican party is trying their best to stop that.
---
To understand the depths of corruption of Texas Republicans, you have to know 2 things:
1) a lot of them were Democrats and would be Democrats tomorrow if the state flipped blue
2) they kept Strauss in the Speaker long after texas went red entirely on the vote of Democrats. It was such a joke to have a "Republican" Speaker getting elected by 100% of Democrats votes plus a few liberal Republicans. Then this "Republican" would block all conservative bills.
And the media would report only that Republicans blocked it.

90 Statewide elections are the funnel filter for the GOP. You'll see them fight harder inside their own Party at the state level than you will ever see them fight against any Democrat, at any level. Ever. Period.

The entire system is set up to keep anyone who isn't controlled opposition out of DC. Governor's races and Senate races in red states are for this purpose alone. If anybody but a Uniparty candidate makes it into one of those seats, it means the Party completely fucked up it's primary responsibility, and they act like it. It's why it so rarely happens.

No.
They are not just RINOs, they are Stupid RINO's.

Their legislative output is borderline illiterate, convoluted and intentionally weak.

The Republicans rule the state from top to bottom yet we still have serious and legitimate concerns that it could flip blue.
Because they block actual, serious conservative laws.

You really think the "private cause of action to sue abortion providers " was serious? It was intentionally allowed to pass because they were sure it would get tossed.

The Junta sticks our nose in it every chance they get. She could have said Joe is very concerned, or used a hundred adjectives to describe Joe's level of concern. 248 NBC News, Aug 6, In part... “We were concerned about heat with outdoor workers at the beginning of the Obama administration,” said Debbie Berkowitz, who served within it as a senior official for the Occupational Safety and Health Administration. “But as time went on, it was clear that indoor workers were suffering from heat stress,” too.

Washington is taking greater note. The Biden administration issued heat safety orders last month, and Democrats recently advanced new workplace protections. Union efforts, including a UPS labor deal set to air-condition vehicles for the first time, have added momentum. But as the 2024 presidential campaign revs up, policy efforts risk slowing even as the climate crisis intensifies.

It's NONSENCE. They took the easiest sites in which they can BS employers to "measure" for the greater good, i.e., union or potential union personnel.

If they knew how legally over decades, the Secretary (of Labor) would have promulgated laws but didn't because measurement and enforcement are virtually impossible. In lieu of promulgating laws, Fact Sheets and Hazard Warnings are available - the SAME as for several decades. No laws, beatable citations.

I think it's Goldfinger's line, after Bond has bumped into him in Miami (and busted up his little cheating-at-cards deal). Then Bond beats him at golf, and turns up a third time investigating Goldfinger's gold-reclamation plant.

The GOP as a party has always been centralized in the South because that was how federal patronage was distributed during the 100 years of Dixie Democrats. They long ago developed the beautiful loser candidates that would suck up money for useless candidacies.

And now, Governor Reynolds is a ruthless, under-the-radar DeSantis, destroying the Left and pushing all sorts of conservative initiatives through whatever powers she can muster. 358 I know which way I'm betting, and it's not because the GOP has shown itself politically capable on any level over the past 20 years of me paying attention to politics.

Yeah, the election was only last year. Paxton won 53 to 44 with these “scandals” hanging over his head. In the primary he beat George P. Bush 68 to 32, similarly “hampered” and was always referred to by fake news as something like the “embattled incumbent… beleaguered with legal and personal scandals”.

360 I don't think we can get rid of the establishment from within. We've been trying since the Tea Party days. They've shown that they'll pull in help from the Democrat establishment to maintain their position against us.

They'd rather betray their voters and hold onto power at all costs than do their jobs and represent us.

It's time for a new party. The GOP won't be around for more than a decade if we leave it.

Like you, I am not optimistic that the GOP can be reformed at the national level, doubtful in some states, and even hard to do at the local level.

Without free and fair elections and cutting off the massive campaign funding of oligarchs and other organized groups to something like a couple of hundred bucks period, no party system will work.

Been to Texas as well, I remember seeing a lot of roads and highways. A lot of them. Like seriously, a lot.

Well, yes but 30 years later you would expect it to be written about by someone in a book. I guess if it had ever been seen as a good idea, it would have, but this was never confused with being smart.

It's weird, in that Democrats CAN win statewide, and you can also get squishy Gopes in the Gov's mansion and Senate, although right now that's not really the case. Unless you consider The Parson to be squishy.

I do believe though, the legislature has mostly purged itself of Gopes in leadership positions. I don't follow it very closely now, but last I saw the Governor wasn't going to be able to override any legislation they passed, even if he wanted to, and right now, he doesn't seem to want to.

431 "Do you think half of the Republicans in the Texas House are Rinos? "

Easily a quarter of the R's in the House are Democrats. And at least a quarter more are RINOs.

433 NO I dont care about his so called state securities fraud! That has been pending since who knows when just so RINOS can say he's under investigation! If my senator votes against him he will find himself primaried!!!

434 man I'm bummed I missed this thread, I have followed Paxton's path of being tormented by RINO's, dems and liberal press for almost a decade.

Every bit of Paxton's distractions come from liberal press initiatives that date back him beating Rove's client Dan Branch in 2014.

I had to go to ancient Dallas TV station reporting to get away from the 'Texas Observer', Texas Tribune' and other such lib rags that now contribute to Hearst publications.

Posted by: DanMan at August 14, 2023 04:05 PM (DB6tu)

435 I don't know if anyone upthread mentioned this but Paxton's original trial that was instigated by the 'Texas Observer' had Collin County charging him with fraud for not registering as a broker. Paid the fine and thought that was it but they persisted and got a grand jury to indict.

When the county asked what it would cost to prosecute him three attorneys out of Houston (Kent Schaffer, Brian Wice and Natalie Lagorda (?)) estimated it would take $30k. Collin County budgeted $100k and their first invoice came in at $245k! They eventually got paid but their next invoice was for almost $500k and it was never paid.

Collin County dropped the case while Paxton was requesting a speady trial. Wice and Schaffer are in the current mix and have not only revived the Collin County case, they got it moved the Harris County (Houston).

The federal Western District of Texas court got caught extorting witnesses in the 2020 case out of Travis County (Austin) and were removed from that case only to see it move to Garlands DOJ when it got revived by the house.

My Texas rep Stan Kitzman voted to impeach and will serve his first and last term because of his vote.

436 Meh. Paxton is sus. Establishment doesn't have the power here in Texas anymore (see Ted Cruz's first primary fight)...

Posted by: Catch Thirty-Thr33 at August 14, 2023 04:23 PM (+aJOl)

439 quick correction: 'Texas Observer' is the rebuilt 'Texans for Public Justice'. That was the original complainant for the Collin County case.

442 One of the saddest parts of this case is that Louie Gohmert, my ex-representative and a man I have admired for many years, took the buyout from the Bush family (apparently) and joined the Anti-Paxton chorus. I guess he got a big payoff, because now he's out of Congress and has gone totally dark. He used to be all over Tyler and East Texas, but he's vanished.

445 The Republican Establishment or GOPe is a bigger enemy to America's conservative citizens than the Democrats have ever been.
Just think where we would be today if the Republican Party had not undermined their own leader for 4 years and then helped the Left steal President Trump's reelection with millions of phony votes.
I hate the Republican Party and hope they die. Forever. After President Trump, I will NEVER vote for them again. And I am not alone in that sentiment.

Posted by: Tracy at August 14, 2023 07:13 PM (8fkk+)

446 Looking at the basic drive of the Republican Party to both reflexively hand victory to the Left in everything, AND to force their voter base to submit to themselves and the Left; can anyone tell me a reason why after 2024 that anyone who is conservative or who believes in the Oath should have anything to do with the Republican Party? And the decision point will be earlier if the 2024 election is cancelled or obviously rigged ahead of time.

And assuming that there is some sort of a legitimate electoral political process in force after 2024, there is no reason to be a Republican. Another political vehicle will have to be found.

447 It tends to remind people of the complicated familial relationships in monarchies, with earldoms, baronies, dukedoms, and so forth.

We fought a war of independence to get away from that.

You are not a professor of history, I take it. You also know nothing of the history of the Bush family if you think familial relationships and double/quintuple standards don't apply in the US,especially in the political system.

448 George P. might've been the designated heir for the dynasty but he made one huge unforgivable mistake as Land Commissioner: he messed with the Alamo (mainly as a payoff to cronies). Eventually Texans are going to get tired of getting screwed by Republicans (looking at you Cornyn) and just quit showing up at the polls. THAT'S how Texas goes purple, then back to blue (yes Texans used to vote Democrat before the party went bat shit crazy)
