"Jawboning:" Biden's White House Pushed FaceBook to Rig Its Algorithm To Suppress Conservative News Sites, and Boost Liberal Ones

Just some "jawboning," David French calls it. The government has first amendment rights too, he says, and the government's first amendment rights (which are not mentioned in the Constitution) prevail among the citizenry's first amendment rights (which are mentioned in the Constitution, somewhat prominently).

Those of us who aren't being paid 30 pieces of silver to shill for the grotesque left call it "illegal and unconstitutional censorship by a rogue government."

The Biden White House inquired in meetings with Facebook executives asking whether Facebook could tweak its algorithm to showcase stories from The New York Times and Wall Street Journal over content posted by "polarizing" conservative journalists and commentators in early 2021, according to meeting notes the social media firm turned over to Congress that are alarming some constitutional lawyers. The alleged focus of the meetings was to assist the administration while it struggled to combat COVID vaccine hesitancy.

Note that the Wall Street Journal is itself a liberal "news" source. People call the editorial page, the opinion page, of the Wall Street Journal "conservative." Or, rather, "Establishment, corporate open borders 'conservative.'" The news side of the WSJ is unabashedly leftwing.

The memos, reviewed by Just the News, chronicle a series of meetings between White House digital director Rob Flaherty and executives from Facebook, now known as Meta, in spring 2021 as the first questions about the efficacy and safety of COVID-19 vaccine began surging on social media.

The memos delivered recently under subpoena to the House Judiciary Committee make clear the White House was actively interacting with Facebook, and sometimes pressuring the social media giant to moderate content in a way that would encourage more Americans to get inoculations.

President Joe Biden would eventually mandate such shots for many Americans, though he was reversed by the courts and Congress.

On April 14, 2021, for instance, the White House's Flaherty asked Facebook whether it could promote The New York Times and The Wall Street Journal over The Daily Wire and Fox News commentator Tomi Lahren, according to Facebook meeting documents obtained by Just the News.

"Asked."

As I have repeatedly said, FaceBook, Google, and Twitter are tolerated monopolies who could and should be broken up or limited by the government, and would be if we weren't living in the worst of all possible worlds, a Corporate Marxist regime. Their existence is precarious; they depend on the government continuing its corporatist policy of permitting them to continue being monopolies and using that monopoly power to strangle competition. (Witness these companies ganging up to deplatform Parler.)

The government isn't "asking" these companies for shit. It's instructing them what they are required to do to maintain their current status as tolerated monopolies, and not become un-tolerated monopolies.

Flaherty asked Facebook employees "If you were to change the algorithm so that people were more likely to see NYT, WSJ, any authoritative news source over Daily Wire, Tomi Lahren, polarizing people. You wouldn't have a mechanism to check the material impact?" according to Facebook's typewritten notes from the meeting.

Lahren had publicly announced she was choosing to skip taking the vaccine, and Daily Wire filed one of the landmark lawsuits challenge Biden's mandate that companies force their employees to get the shots as a term of keeping their jobs.

Prior to Flaherty's question, he discussed COVID vaccine hesitancy with Facebook employees during the meeting, asking what the company was doing about it.

"We have to explain to President, Ron, people, why there is misinfo on the internet, bigger problem than FB," Flaherty was quoted as saying. "Where issues are, what interventions are, how well they are working, for products, want to engage in things that you know to be effective. I don't even care about specific methodology, you have better, richer data than we'll ever have.

...

Flaherty is cited in the notes as asking the questions "because candidly there is not a lot of trust towards FB" and the Biden White House wanted to know whether the platform was "finding things that are effective that you aren't doing" to combat resistance to the vaccines.

In other words: "FaceBook may lose its indulgences as a government-tolerated monopoly if they do not obey these government directives."

Ben Shapiro says he might sue. He must sue. THIS WILL NOT STOP UNTIL CENSORSHIP AND COOPERATION WITH GOVERNMENT TO SUPPRESS FREE SPEECH CARRIES CASH-MONEY CONSEQUENCES MEASURED IN THE TENS OF MILLIONS.

...

Constitutional law professors denounced the White House's actions outlined in the new memos obtained by Just the News, saying they smacked of censorship and raised serious First Amendment issues.

George Washington University law professor Jonathan Turley told Just the News on Wednesday, "This is why I have asked Congress to pass a law barring federal employees from engaging in censorship and targeting of citizens. Agencies have a right to speak in their own voices. Instead, the Biden Administration sought to engage in what I have called 'censorship through surrogate.' This is part of that pattern."

Normally, private companies cannot be held accountable for First Amendment violations, however the law provides an exception when a private entity is acting "under color of law." University of Tennessee law professor Glenn Reynolds told Just the News on Wednesday that the First Amendment issue is when the "government is asking people to censor speech, their action is attributable to the government, so both they and the government can be sued."

He believes that The Daily Wire and Lahren could "and probably should" sue the federal government and Facebook over the censorship.

Reynolds notes that these so-called "private companies" do not have, as the federal government does, sovereign immunity.

And of course the White House was pressuring FaceBook to censor true information as well. (Though it does not matter if the censored material is true or false for purposes of the First Amendment -- because, shall the government be our arbiter of truth? Men can speak whatever they think to be the truth, even if they are wrong.)

But they can't even claim they were just demanding censorship of "misinformation." They wanted the true stuff taken down most of all, because truth is the most convincing argument against a tyrant.

Facebook took steps to suppress true information or mere opinions about vaccines to avoid a "vaccine negative environment," according to internal company occupations viewed by Fox Business.

On a July 2021 call between Facebook employees and Surgeon General Vivek Murthy's Office, a Facebook employee explained they were combating misinformation, but also working to contain information they admitted was "not false."

Facebook told the Surgeon General's office they instituted "borderline demotions" for someone sharing "negative side effect posts" or even "posts questioning whether you should get a vaccine under a mandate, whether it's government overreach. We demote those. That's not false information, but it leads to a vaccine negative environment."

The Biden White House didn't want just true content restrained, however; even memes irked them.

In an email, Facebook's then-VP of Global Affair Nick Clegg discussed with his team a call he had with Andy Slavitt, President Biden's White House senior adviser for the COVID response. Clegg said of Slavitt, "he was outraged -- not too strong a word to describe his reaction -- that we did not remove this post" pointing to a meme about vaccine side effects.

A Facebook employee acknowledged demoting posts that created what they called a "vaccine negative environment." (Kurt Knutsson)

The meme in question used the popular image of Leonardo DiCaprio pointing at his TV, with the text, "10 years from now you will be watching TV and hear, 'Did you or a loved one take the covid vaccine? You may be entitled...'", a riff on commercials often seen for class-action lawsuits.

Clegg continued, "I countered that removing content like that would represent a significant incursion into traditional boundaries of free expression in the US, but he replied that the post was directly comparing Covid vaccines to asbestos poisoning in a way which demonstrably inhibits confidence in Covid vaccines amongst those the Biden administration is trying to reach."

The White House and Meta didn't reply to requests for comment.

Jim Jordan just released The FaceBook Files, Part 3.

Some major points:

Rep. Jim Jordan
@Jim_Jordan

In 2021, the White House wanted to control what narratives and true content was posted on Facebook surrounding #COVID19.

President Biden went so far to say that Facebook was "killing people" for allowing certain statements to be published on the site.

Rob Flaherty, President Biden's then-Director of Digital Strategy, repeatedly put pressure on Facebook to explain its content decisions.

"We have to explain to President, Ron, people, why there is misinfo on the internet..."

For example, Flaherty questioned whether Facebook was doing enough to reduce traffic from sites like the @nypost
.

"I'm curious -- NY Post churning out articles every day... What is supposed to happen to that from Policy perspective. Does that article get a reduction, labels?"

But that wasn't enough for the Biden White House. Flaherty wanted Facebook to go a step further.

He wanted Facebook to kick people off its site.

The Biden White House's effort to censor opposing viewpoints only grew.

So, they upped the pressure.

Flaherty demanded that Facebook "play ball" and work with the Biden White House on censorship.

He called it his "dream."

You know who else had a dream?

He recounts the White House demanding censorship of the Daily Wire, which I've noted above.

...

And of course, Facebook caved.

The company ADMITTED to the White House that it reduced content of certain posts -- even if the posts didn't violate the company's terms and contained TRUE information.

He has supporting documents in the thread.

I mentioned during some of the Twitter Files disclosures how much the language used was the kind of language used by a subordinate dreading a difficult conversation with the boss. It wasn't "partnership" language or "I'm doing you a favor" language, it was "I am being given orders I don't like" language.

Censoring, in broad terms has been around in our political system for over a century. What's been going on in, say the last 25 years however is different in that nonpolitical entities are being censored by the government.

I honestly don't care as much about the 'censoring' that goes on behind congressional doors to each other. That's for the most part, theater.

Posted by: Iris at August 03, 2023 12:08 PM (NaH5I)

Well, the argument has to be that they were acting as agents of the state when violating people's constitutional rights.

It's a tough argument to win most of the time, but most of the case law involves police.

The classic example is if police suspect a person is in possession of stolen goods, but do not have any proof. So they go to the landlord of the suspect, and say "hey, buddy, can you do us a solid? Can you go in to our suspects apartment on some kind of pretext, and while you're there, keep an eye out for these stolen goods, and if you see them, call us and tell us what you saw. With your "tip", we will have enough evidence to get a warrant."

Courts have said "in that specific scenario, the landlord is acting as an agent of the police, and he is violating the suspects 4th amendment rights."

So a lawyer would have to make a similar argument in this situation.

They are delusional and intellectually short to a dangerous degree. No one says that Trump does not have a right to free speech. But, he has yelled "Fire!' in a crowded theater, when there was no fire. He lied, to the harm of everyone else.

These propagandists must be called out on their continuing attacks upon our democracy, disguised as freedom of speech.

The Magats had their freedom of speech legal defense ready for charges of seditious conspiracy and inciting a riot. Jack Smith outsmarted them he didn't use those charges.

Smith even explains the difference when lying is protected and when it is not. The Magats are barking up the tree that doesn't have a squirrel in it.

Feels like they are prepping it to eventually go to SCOTUS
that or they just don’t have any other excuse.
The speech bit was completely refuted by several legal commentators (CNN and MSNBC). Trump went from speech to action.

Well, I don't think Biden is personally behind this either. I think the "deep state" as it were went in to a panic after the 2016 election, and the internet was forever changed because of it.

This stuff probably happened a little bit under Bush and Obama, but I'd peg 2016 as the year it went in to hyper drive. That's when YouTube began taking down / demonetizing any video that was even slightly outside the mainstream lockstep, Reddit shut down half of the subreddits, Facebook etc. were all massively pressured to keep "Russian disinformation" off their platforms, etc. So I'd argue this definitely started during the Trump years.

Posted by: Blonde Morticia at August 03, 2023 12:20 PM (lCaJd)

Technically, the Supreme Court only has original jurisdiction over a small number of issues.

But in practice, if any one on the court even so much as hints that they'd be willing to hear a case on a subject, lawyers will start petitioning for writs of cert on any case that's even close to what they think SCOTUS would hear.

that said, it usually takes many years for a case to go from inception to where it's ripe to be heard by SCOTUS.

Without anti-competitive actions like buying up competitors, I'm not sure that they will re-form.

From observation, it is the nature of social media that a monopoly forms... and then gets tossed away as old and worn out. If facebook wasn't buying up everything that might supplant it, we wouldn't have these monopolies. We'd have ephemeral monopolies, forever being replaced, so long as we actually enforced anti-trust laws and prevented the anti-competitive actions that keep them on top.

Although there's definitely a tolerance for tech monopolies from the government, part of it may be that these different types of platform are not viewed as being competitors in the same line of business by the government. Tik-Tok and Facebook aren't as obviously competition as different oil companies. I don't think we've heard of any instances where the government was considering blocking an acquisition between the social media companies.

Maybe it's a Boomerism, a holdover from the Cold War era? It just doesn't have the same bite it did maybe 50 years ago. Fascism, on the other hand, stings and stings hard.

What the left is pursuing these days is straight up fascism. You've got corporations working hand in glove with the regime, in exchange for the right to be a monopoly. Big Govt + Big Corp. Like Ace said, the worst of both worlds. True conservatives don't like Big Business, they support free enterprise, which is not what Big Corps want anymore.

The new fascists also support racial and ethnic quotas, segregation, and other ways of dividing us on racial grounds. That's pure fascism, too. The only thing they're missing is nationalism. It's why we should call this new variety "global fascism."

You mean, try to do what the last, oh, 100 years of Republicans have tried to do, while the government continued to grow exponentially despite the GOP's efforts to stifle it? Heck, they couldn't even slow the growth rate, let alone shrink anything.

You might as well propose that we bring back Victorian morality, restore the birthrate to greater than replacement rate, and renew the debate over monarchy vs. republic while you're at it. Continuing to focus our efforts on that Sisyphean task rather than more realistic, attainable goals leaves us with nothing -- the story of the last century of Republican politics.

Precisely why that narrative needs to be disrupted by calling the new left fascists. What argument is better to have, whether communism or fascism is preferable (the framing the left wants) or who are the real fascists, the left or the right?

Because virtually every other part of the definition of "fascist" applies to the new left. The only part that doesn't is the global vs. national part. This is why it's a new variety of fascism. We do this with terminology all the time. Marxism itself has more than a dozen varieties -- classic Marxism, Trotskyism, Stalinism, cultural Marxism, Leninism, etc., etc.

Besides, it drives the left bananas. Let them try to explain why their policies aren't fascist.

You are nuts if you think this isn't happening with the social networks in private settlements that aren't disclosed to the general public. Some regulatory entity will come in, find ticky tack violations (which are present in every business) and see them used to enforce provisions about moderating content. We see this in the EPA and the DOJ and while most are harmless, they can and are used to justify onerous burdens on the socials to regulate posts under the guise of public safety.

Fascism is here, and it shows up in a polo shirt and khakis, from the local, state and federal government, telling you what your business can and cannot do.

There's a difference between alliances of convenience (such as the relation with the USSR) and spreading an ideology intentionally to structure similar governments globally.

Why do the fascists want there to be an Arab empire to be pals with?

They believed and acted on the belief of spreading fascism in other nations and empires, even if intuitively there is seemingly no benefit in doing so. Arguably it seems to recreate the pre-WW1 state of Europe being at peace but divided into several empires.

US globalism at any rate didn't exist to be anti-globablist about.

331 322 Modern usage of jawbone is in the sense of "persuasion", but there is also the Biblical usage, as when Samson slew 1,000 Philistines.

"And he found a new jawbone of an ass, and put forth his hand, and took it, and slew a thousand men therewith." /Judges 15:15

More coercive than persuasive.

I know right? Weird. Maybe important?

First, there is negative utility in calling globohomo "fascist". I know if X is bad and if we say Y which is also bad X it will make Y seem even more bad has some marginal utility but the confusion it sows as many times greater aside from the fact that rectifying names is crucial.

Second, fascism was not a homogenizing movement as was Sovietism/Communism.

It just wasn't no matter how many ppl say it was.

I did note that the USSR was much more about an ordinary global empire centered in Russia. That fascists proselytized and seemed to believe in awakening race consciousness in other(presumably rival) countries. Possibly a side-effect of being socialist and the consequent importance of the narrative of a mass awakening and transformation of society.

Nationalism is originally characterized by a leveling and unifying process within the country. Language, laws, and identity. In combination with an empire, one would imagine a nationalist empire would seek to say, Germanify the world. And yet it is the Russian satellites that speak Russian, and not French or Poles that speak German.
