The Hunter Biden plea deal was apparently more outrageous and far reaching than had previously been publicly known.

In return for pleading to the two misdemeanor tax fraud charges, with a joint recommendation of no prison time, Hunter was getting not just pretrial diversion on his felony gun charge that would leave his record clear if he completed probation, but also broad guarantees against further prosecution on a wide range of other charges that haven't been publicly aired as of yet.

Hunter refused to plead guilty without these guarantees, so the judge effectively blew up the plea.

Hunter wants to walk away from a decade of criminal activity, including potential FARA violations and other serious criminal charges, with a slap on the wrist.

It's a scandal that Biden's DOJ was willing to agree to this kind of a deal.

Fortunately, Judge Norieka isn't playing ball.

Hunter Biden's lawyer called the judge in his case pretending to be a lawyer for House Republicans to try and get the IRS whistleblower testimony against him taken down from an amicus brief in the case.

This has gone from a true crime to a sitcom.

She represented herself as being a lawyer for the House and instructed the clerk to withdraw the House's amicus letter.

First son Hunter Biden's legal team appeared to pull a dirty trick Tuesday to block the release of damning evidence ahead of his expected guilty plea to federal charges of tax evasion and weapons crimes.

The drama began in the morning when the House Ways and Means Committee filed an amicus brief to Delaware US District Judge Maryellen Noreika arguing that the 53-year-old had benefited from "political interference which calls into question the propriety of the investigation" into alleged crimes including money laundering, felony tax evasion and failure to register as a foreign agent.

The filing included testimony by two IRS whistleblowers who sat for transcribed interviews May 26 and June 1.

What happened next was outlined in a letter sent to the judge Tuesday afternoon by the committee's top lawyer, Theodore Kittila.


"[A]t approximately 1:30 p.m., we received word that our filing was removed from the docket," Kittila said. "We promptly contacted the Clerk's office, and we were advised that someone contacted the Court representing that they worked with my office [emphasis original] and that they were asking the Court to remove this from the docket. We immediately advised that this was inaccurate. The Clerk's Office responded that we would need to re-file. We have done so now."

Kittila included email exchanges with court officials and Hunter Biden's attorneys in the fresh filing.

"Hi Ted, Following up on our recent telephone conversation, the woman who called was a Jessica Bengels," confirmed court official Samantha Grimes. "... She said she worked with Theodore Kittila and it was important the document was removed immediately or they could file a motion to seal. I do deeply apologize for all the confusion on our part."

It is a disbarment-level offense to work a fraud on the court.

Regime lawyers don't get disbarred, though.


Bengels is the director of litigation services at the New York-based law firm of Latham & Watkins, where Hunter Biden attorney Chris Clark was formerly a partner.


When Kittila confronted the first son's legal team, Hunter's attorneys tried to claim the filing contained confidential tax and identifying information, even though the whistleblower testimony has been public for more than a month.


The time stamps from the emails also indicated the request to take the document down was made after Kittila refused a request to file the testimony under seal.

"As far as I am aware, the managing attorney from Latham called the clerk's office to note that personal tax information of the defendant had been filed in a non reacted [sic] manner and to inquire regarding having the information sealed, as we told you we would and as you said you understood," Clark wrote. "As far as I am aware the clerk took the filing down on their own accord. Your attempts to publicly file my client's personal financial information with no protection ls [sic] are improper, illegal and in violation of applicable rules ... We will seek all appropriate sanctions in response to your actions."

"You should probably take a step back from your statements," Kittila warned. "The clerk's office advised that it was represented to her that the request was being made by my firm. We will be advising Judge Noreika of this improper conduct."

"I stand by all of my statements and I hope you have an affidavit from the clerk in support of yours," Clark replied.

In an evening order, Noreika gave Hunter's attorneys until 9 p.m. to "show cause as to why sanctions should not be considered for misrepresentations to the Court." -- while noting they had not formally filed any request to seal evidence in the matter.

She is now claiming that her claim that she worked with the House and was therefore authorized to withdraw the motion herself was just a "miscommunication."

The judge asked if Hunter could still be prosecuted for his Foreign Registration Act violations - the DOJ said yes, and Hunter's lawyers said emphatically no.

The plea deal was intended to be Hunter's get-out-of-jail free card on all potential charges, and the DOJ chose to lie about that.

56 This is a fuck-up all around. No way the clerk should have removed the filing based on just a phone call, even if it really was the attorney who filed it calling. There are procedures to remove court filings. Most likely, the clerk got spooked by the claim of sensitive personal information, and decided in an abundance of caution to remove the document.

Funny stuff also happens with clerks. I was in a suit where the other side did not make a timely filing, so my lawyer did; his filing came in earlier by a day or two. What happened? Well the other attorney was friends with the clerks and the court there, and her filing was DONE FIRST. Funny that.

Not exactly. She was asking questions about the plea. There was argument between DOJ and defense about whether the deal provided future immunity. Doj said no and because of that Defense said the deal is null and void. And they are back to negotiating.

Sounds like she was poking around and Weiss got spooked she was gonna toss it and said it didn't provide something they had agreed to because it doesn't look as bad for the defense to back out.

They may bring a new deal in front of her today.

If Hunter's lawyers are telling him it's actually broader than what the words on the paper say and that the DOJ implicitly agrees to an unwritten understanding that they won't go after the other charges, then that's something Congress should get to the bottom of when Weiss testifies.

If Hunter's lawyers aren't telling him that and they're just assuming it to be true, that's malpractice and Hunter should get back the millions he paid them. He can take a break from painting for a couple of weeks.

What i giant scam they run, where if you or I lie to the court we get sent to prison. But lawyers do it and the threat is maybe they'll get disbarred or censured. They should be held to an even higher standard and be imprisoned for a minimum of double the ordinary time of an average person. Especially since they A) should know the laws front and back B) their lies are a direct attempt to circumvent the of law, where most people are charged for honestly just not knowing or screwing up what they said.

In the end, though the judge found him credible, believeable, and honest. Me, not so much, although I had done my best to be truthful, even under cross, by him.
To this day I wonder if he had dirt on the judge (during the varous trials, the lawyers of the plaintiffs had their emails infiltrated spewing phishing emails to everyone on the email list except him).
So no respect for the "Just Us" system.

It depends on the jurisdiction and age of the judge. In the old days, most judges were former practicing attorneys who paid their dues over decades and many were smart or at least experienced. A few of these are still around. In the new system, it's all political patronage and most judges have never actually practiced law to any real degree. They just have the right demographics and sucked the right dicks in the Democrap party machine.

If I did anything even remotely like what this woman attorney did here in my local district court - I would likely be at least suspended for 6 months if not disbarred. But, she won't even get a slap on the wrist.

America is no longer a rule-of-law nation. We are an aristocracy where those in the leftist camp don't have to obey laws. Which will ultimately lead to those of us on the right refusing to obey laws. Which will lead to violence and anarchy.

An aside - as a practicing attorney I can tell you I lost faith in our legal system over the last 10 years. Most judges don't even pretend to care about the law anymore. The federal judges in my local district are pure political actors who issue decisions based solely on what outcomes they want. And b/c of the way the appeal process works in federal court - it's nearly impossible to appeal most of those decisions.

Judges almost never reject plea deals. They reason, and rightly so, that the prosecutor is adverse to the defendant, and in the best position to determine what is a reasonable plea deal.

Judges only reject the most obviously corrupt, smelly-stinking, sweetheart plea deals that could not possibly be the product of arms-length dealing. Hunter's was in that category. The prosecutor was functioning basically as Hunter's lawyer.

My guess is major political pressure on the judge behind the scenes through the local legal community in Delaware.

The judge is the sentencing authority. Prosecutors can recommend a sentence, but the judge makes the sentencing decision.

So, when there is a plea agreement for a particular sentence that plea agreement is conditional on the judge accepting the sentence, which the judge does not have to do. Judges generally go along with plea agreements because it moves cases along and helps resolve cases quicker. But, in cases where the plea agreement is nonsense - such as this one - the judge can say no.

So, when there is a plea agreement for a particular sentence that plea agreement is conditional on the judge accepting the sentence, which the judge does not have to do. Judges generally go along with plea agreements because it moves cases along and helps resolve cases quicker. But, in cases where the plea agreement is nonsense - such as this one - the judge can say no.

Its fishy. Certainly the Clerk was under the impression the person calling was calling about a mistaken filing they had made and wanted to claw back. If an adverse party, they would file something, seeking emergency temporary seal pending briefing. You don't just call of the clerk and tell them to take down an opponent's filing. If you want an order, you call the Judge - staff attorney, conference call your opponent or do it via email. Directly calling the clerk and suggesting a take down is inappropriate. She didn't use a fake name. So maybe she didn't claim to be the filer. BUt the clerk certainly concluded she was the filer or calling on behalf of the filer. She may not have lied to clerk directly, but she KNEW what she was doing.

the judge can only sentence for the charge that the defendant pleads guilty to. However, if it is clear, as in this case, that far more serious charges should be brought, the judge can refuse to accept the plea.

However, the judge cannot require the prosecutors to actually prosecute any specific charge - that is up to prosecutor's discretion.

So, in a case like this, where the judge says "this plea deal is b.s." and the prosecution doesn't want to charge or prosecute more serious crimes - I don't know what the outcome will be. It depends entirely on public pressure I think. I mean in theory the prosecutors can just refuse to charge at all if the judge won't agree to the deal. But, hopefully the public would be outraged by that. But, in today's world, who knows?

Clerk did not want to be the one who let social security numbers or home addresses or whatever get out into the public. This is a fuck-up all around. No way the clerk should have removed the filing based on just a phone call, even if it really was the attorney who filed it calling. There are procedures to remove court filings. Most likely, the clerk got spooked by the claim of sensitive personal information, and decided in an abundance of caution to remove the document.

At least in NYC, it would be the ECF clerk who could remove filings. The judge's own clerks would not be involved in that. Although presumably, the judge's clerk could ask the ECF clerk to take it down, and the ECF clerk would do it.

The one kid's first defense lawyer who made his opening statement stuttering, stammering, and spraying spittle on the jury and then walks away, waves to the Judge and walks cockily back to his seat. For the most part, the news cycle doesn't work anymore because the media has changed. What matters is the drip, drip, drip which has soured the public on the Bidens---elections are a totally different thing because of fraud but despite the best efforts of the media--Biden is the second most unpopular president in polling history at this point in his second term.
