Leftwing Regime Media Cries About Losing Power to "Fight Disinformation" as Heroic Judge Enjoins the Government from "Encouraging" or "Pressuring" Social Media Companies to Censor Protected First Amendment Speech

In case you missed it, yesterday, on the Fourth of July, a judge announced his decision to enjoin the government from any further "encouraging or pressuring" social media companies to censor Americans.

As of today, senior Biden officials -- including all employees of the FBI, DOJ, DHS, the State Dept. and the WH Press Secretary -- are legally banned from doing the following in order to induce or persuade Big Tech platforms to censor Americans

American citizens have the right to engage in free debate about the significant issues affecting the country.
During the COVID-19 pandemic, a period perhaps best characterized by widespread doubt and uncertainty, the United States Government seems to have assumed a role similar to an Orwellian "Ministry of Truth."

It is no coincidence that he released this on Independence Day. This was his own shot across the bow of an evil, freedom-crushing foreign government.

The most surreal fact of US political life is that the leading advocates for unified state/corporate censorship are large media corporations...

It's not that surreal. In 2016, America "voted wrong" and every institution dominated by college-educated upper-middle class bien pensants decided the public must never be permitted to "vote wrong" again, and decided at that moment to "fortify" the 2020 elections and also "fortify" the government's censorship machinery.

There's also the matter of the media feeling that it is on the brink of systemic collapse due to competitors in the news and opinion field eating their lunch -- and they have decided to simply outlaw their competition. A statement by the BBC admitted that one motive for its project of delegitimizing all non-state-approved-media was protecting its business from competition.

From Aaron Walker at Twitchy, here's some of the evidence of censorship the judge recounted in his order.

At the heart of the case is the question of whether Facebook, YouTube, Twitter (pre-Elon-Musk), and other social platforms were censoring purely out of their own desires (or potentially, their non-governmental advertisers' desires), or if this was done under the improper influence of the government. After all, when the government is forbidden from doing something--in this case, regulating the expression of private citizens--it is forbidden from doing it by any means.
That takes you through page after page of the facts, the court describing one deposition after another. And what emerges is the government and these various social media platforms had entered into an extremely tight relationship. The defendants--Biden, et al.--argued that they were just asking these platforms nicely to remove disinformation. But the way these government officials were acting, it wasn't really a request. These government officials treated these personnel at the social media companies like they worked for them.
For instance, we have this incident:

On February 6, 2021, [Rob Flaherty, former Deputy Assistant to the President and Director of Digital Strategy] requested Twitter to remove a parody account linked to Finnegan Biden, Hunter Biden's daughter and President Biden's granddaughter. The request stated, 'Cannot stress the degree to which this needs to be resolved immediately,' and 'Please remove this account immediately.' Twitter suspended the parody account within forty-five minutes of Flaherty's request.

The same Flaherty also demanded reports from social media companies like they were his underlings:

On March 15, 2021, Flaherty ... demanded a report from Facebook on a recent Washington Post article that accused Facebook of allowing the spread of information leading to vaccine hesitancy. Flaherty emailed the Washington Post article to Facebook the day before, with the subject line: 'You are hiding the ball,' and stated 'I've been asking you guys pretty directly, over a series of conversations, for a clear accounting of the biggest issues you are seeing on your platform when it comes to vaccine hesitancy and the degree to which borderline content as you define it -- is playing a role.'
The opinion goes on to quote an email from him which sounds very threatening:

I will also be the first to acknowledge that borderline content offers no easy solutions. But we want to know that you're trying, we want to know how we can help, and we want to know that you're not playing a shell game with us when we ask you what is going on. This would all be a lot easier if you would just be straight with us.

An employee of Facebook responded:

We obviously have work to do to gain your trust...We are also working to get you useful information that's on the level. That's my job and I take it seriously -- I'll continue to do it to the best of my ability, and I'll expect you to hold me accountable.

Andrew Slavitt, former White House Senior COVID-19 Advisor, had been cc'ed on all of this, and decided to add some fuel to the fire:

Slavitt ... responded, accusing Facebook of not being straightforward, and added more pressure by stating, 'internally, we have been considering our options on what to do about it.'

Yup. It won't work, but I'm glad to see it.

The reason it won't work is that these people are lawless. Some judge orders something? Who cares. They absolutely will keep on doing this until they are forced to stop through having it become personally risky.

Unless people - both within the tech companies *and* within the government - end up doing serious time in serious prison, as well as bankrupted by civil action, this does not stop. Some judge's ruling won't change things one iota, because those he's ordering to stop don't care in the slightest.

It does kind of undercut the entire notion of "rhetoric" where the intent is to use a combination of ethos, pathos, and logos to sway an audience to your side. If there is only one set of "facts" in play, then rhetoric is not even needed.

I'm an eyeore, but I thought Trump would win in 2016 and actually thought he would win in 2020 (putting aside whether he really did win).

I'd say (unfortunately) as a pessimist/eyeore I'm correct in my predictions about future outcomes far more often than I am wrong.

However, I've never counseled that we should just give up.

the reality is that the vast majority of Americans (even those who tend to vote republican) are ignorant of what goes on in Washington and still believe sources like NYT, CNN, etc. So, it's hard to believe anything will really come of this type of thing.

My guess on this lawsuit? the Circuit will strike down the injunction, the lawsuit will get dismissed or if there is a trial and award to plaintiffs, it will be overturned by the Circuit court and SCOTUS will refuse to hear an appeal.

Of course, I pray that I am wrong. I want to be wrong. I just doubt I will be wrong.

There was a story recently about CBP agents removing the barbed wire put up by TX police along their border with Mexico. There was a question as to whether or not the TX folks would arrest the CBP folks.

since before I went to college in the late 80's, the Leftists have been claiming that but for the lies told by the GOP (and Rush Limbaugh) the progressive left would never lose elections.

It is part of leftist hard-wiring to believe that the only reason anyone ever votes for a non-leftists is because of "lies".

The truth is that the people involved in the censoring don't believe they are doing anything wrong. They truly believe they are the good guys and the heroes. Most of them honestly believe they are fighting "misinformation" and that doing so is "saving democracy".

They are like religious zealots. And people who believe they are righteous are the hardest to defeat. Their consciences never bother them. They don't rest. B/c they believe they are doing the lord's work (in this case "the lord" being leftism).

I haven't read the gov'ts' arguments in this case to date, but my guess is that they are arguing there is no "censorship" going on b/c the gov't doesn't make any decisions regarding what to allow or not allow on the social media sites, but instead the gov't just shares information with FB, Twitter, etc. to allow those platforms to make informed decisions about what to allow content-wise.

I.e., the argument is that there is no "state action" by the gov't vis a vis what the social media platforms allow people to post. And because there is no "state action" there is no unconstitutional censorship.

And, I'd wager that the social media companies are saying "the gov't never pressured us to do anything" and "we never felt pressured" and "we made our own decisions".

And, my guess is that is what the Circuit court will hang it's hat on -- that there was no "state action" to censor, just decisions on what to allow on their own platforms by private parties.

Trump -in his policies - was one of the most, if not the most, conservative presidents of my lifetime (including even nominees who lost the general election). But, Trump was never part of the conservative movement, and I doubt he ever read any conservative outlets or listened to conservatives. I doubt he even knew much if anything about conservatives' claims of being censored by FB and Twitter.

I haven't heard the tapes, but I'm guessing they aren't quite as "smoking gun" as you claim (I.e., I doubt that the gov't official said something like "if you don't censor this information we'll do X and Y to your company", instead it's probably more like "we think that this claim is false information that hurts democracy and think it would be better if it weren't allowed").

but even if there are a few "smoking gun" tapes, the argument against them is simple - that was just a rogue government employee - that wasn't policy or what was done in the vast majority of cases.

Again, I want to be wrong, I pray that I'm wrong, but I'll be very shocked if this injunction stands and if the lawsuit leads to any real change. I'll be very happy if it does, but surprised. I'm not saying the Plaintiffs should give up. They should absolutely keep fighting.

Actually, this is sort of true. As a "prolife Democrat" under RvW he could always find some reason to oppose a pro-life Presidential candidate/SC justice. With Roe gone though that fig leaf is ripped away.
