Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside. That's pretty clear. Of course Bank of America will immediately cross-reference all marijuana purchases with gun purchases in in Minnesota, and turn over their findings to the ATF...right? ATF: Until recreational cannabis is federally legalized, pot users cannot own guns The federal agency that regulates the firearms industry sent an advisory on Tuesday warning that Minnesotans who use marijuana cannot legally own firearms, despite a new state law legalizing recreational use. Marijuana for adults is now legal in 23 states and even more have medical cannabis programs. But it's still a Schedule I controlled substance under federal law on par with LSD and heroin. The St. Paul office of the Bureau of Alcohol, Tobacco, Firearms, and Explosives noted that distinction. It means people who smoke weed or take marijuana edibles are "still federally defined as an 'unlawful user' of a controlled substance," and therefore are "prohibited from shipping, transporting, receiving, or possessing firearms or ammunition," the agency said in its release Tuesday. Part of me hopes that they crack down aggressively and start arresting, prosecuting, and jailing people for these clear violations of federal law. I think it's a felony that carries a five year sentence. I am assuming that more people on the left use marijuana (although that may be wildly inaccurate if we measure it by weight of marijuana consumed...thanks Garrett and JackStraw!). So that might be a good thing...disarming and jailing Antifa-curious dopers! But...part of me (most of me) is disgusted that there is even a form 4473, an ATF, and any restrictions on weapons purchases in the United States, except perhaps for violent felons. And I am comfortable discussing even that! This conundrum also calls into question the supremacy of the federal government, its involvement in drug regulation, which the last time I checked wasn't mentioned in the U.S. Constitution as one of its powers. The delightfully amusing reality is that the states are legalizing marijuana, and there isn't much the feds can do about it. My personal stance is that it is a bad idea...I think marijuana has corrosive effects on society, has been mostly ignored by scientific research from that point of view, and I believe it will be shown to be much less benign in the coming years. It's pretty simple actually, until congress changes the law Marijuana is classified as a schedule I drug and it's use is against the law no matter what the state does or says. States accept federal $$$$ for law enforcement so they are bound by the law the fed makes up. If you take the King's shilling you gots to do what the King says.

A big problem for keeping marijuana criminalized is is that every argument in favor of banning it also applies to alcohol, and every argument in favor of keeping alcohol legal also is an argument for legalizing marijuana. There's no intellectually honest way to treat the two differently.

I think there has been an effort NOT to study long term effects of cannabis, and the studies that have been done on its harmful effects, most people just ignore, or refuse to believe. I might have mentioned before that I was a transplant coordinator at the VA. Vets who smoked pot were adamant that it was harmless; but, the VA will not transplant anyone who uses pot.

.22 cartridges index (are supported in the chamber) by the rim, and in a long chamber you can fire various lengths from BB-Caps, shorts, regular and magnums, only limited by the ability to feed and put the whole cartridge in the chamber to fire. I am a liberal (classical), but this pot now is very damaging. My teen kids have multiple friends that had to go to the hospital with severe paranoid outbreaks (bordering on psychosis) due to only smoking marijuana or too many edibles. None of my stupid stoner friends in high school or college EVER had to do that. I usually hold very strong political opinions on what is right and what is wrong. If a felon is sufficiently violent as to proscribe their legally being armed, then said felon remains as a sufficient threat to society, as to require continued incarceration, until such time as they no longer constitute a threat.

Well.
I smoked a fair amount of pot in my 20s. I'll partake occasionally now, but less than once a year for the last decade or so. Mostly because the stuff available now makes me brain dead and I don't like that feeling. I do use a THC/CBD salve for various aches and pains, it is quite effective and it doesn't get me "high." First, I can't hold my a compact semi-auto and thumb back the hammer without gyrations.
Second most 9mm semi automatics are DA-SA. If you are not carrying with one round chambered, why carry? Third, Colt is not well known for semi-autos except the 1911 .45 ACP is not in 9mm. I have maintained that once someone completes his/her sentence then they have paid the debt to society and should get back all civil rights, including removal of the record. That is probably a workable, practical proposal that could be enforced. The problem for me is that I don't want to live in the kind of society that is willing to impose those kind of rules, because if they are willing to impose such restrictions on what I can do, they quite naturally will impose restrictions on what I am allowed to think and believe. I can't live with that, and I'm willing to live with whatever bad consequences come from allowing other people to have such freedoms.

..Once someone has served time and is released then they need to be back into society with full rights. If released on parole, then there con be continuing restrictions, but lifetime loss of rights means there is no endpoint to punishment and puts ME both in prison with the released felon, AND makes me his jailer.

While we're on the topic, it's worth looking at the hilariously self defeating fiasco that legalization in California has become. The idea was to legalize marijuana completely, then regulate it and tax it, thus diverting money from the cartels to the State. Conceptually, not a bad plan. But California has been so greedy and hamhanded that they now appear to have almost completely destroyed the legal distribution business, along with the finances of anyone who tried to follow their rules. Obviously, the business will now go back to the Cartels, who have the added benefit that what they're selling is no longer illegal, it's just a tax violation. Ooh, I'll bet that scares them.

I said this previously but the woman who is now our county executive was formerly on state marijuana control board which was tasked with the regs and rollout of pot legalization in NYS. She was on a local radio station saying "the rollout will be done with equity, social justice and giving those negatively harmed by laws the first chance at licenses." This was last July or August and they're still fumbling around with it upstate. In NYC there are seven legal dispensaries and about 2500 illegal shops. Only a state could screw up something simple like pot dealing.ive read that some of the legal farms are having economic difficulties because of regs, taxes and the screwed up rollout. It doesn't surprise me that no one thought about guns and pot. Our leaders and bureaucracy are idiots.

If someone is sentenced to 20 to life, then what is their actual sentence? Five or ten years in prison? Ok, then once they are released from lockup, where does the 20 to life thing go? So even if we don't keep you in the joint the whole time, your original sentence is the time you are at least partially monitored. Including limiting your access to guns. One thing that irks me is the ease in some states and the general pain in the ass in others for someone to regain their firearms rights. There's a fella that lives in my complex, just a great guy, highly responsible, opens and closes his place of work and takes care of the money. He can't own a gun because he got in a minor, yet felony, jackpot over 20 years ago. I suggested petitioning for relief from disability, but Arkansas is very, very, hard ass about matters like that.

I'm personally neutral on pot, I think it probably offers some useful things for us but there's a lot of unknowns. A big part of the problem with felons and guns is when they came up with that idea, felony was pretty much limited to a small number of heinous crimes. Now that the US code is like 10 million pages of stuff there's all kinds of not so bad things that happen to be felonies. There is a disturbing lack of good research on the effects of marijuana use. What little there is, seems to show that pot is really damaging to young brains. But there just isn't enough out there. What I'd like to see are ways to use weed other than burning it to breathe in for a buzz.

He went up before the parole board, and flat told them he was going to sit it out and come out with a clean slate. No way he was going to comply with their conditions. He said it was six months, but at least he wouldn't get busted leaving the liquor store. He understood the no driving forever, but the other stuff was too much.

I agree. I think it's absurd that the government wants to restrict anyone's rights, gun or otherwise, for use of a substance the same government is also using to legalize. Alcohol can be beneficial but if you slug it back just to get blasted like a teenager, you're abusing it. If you smoke weed just to get stoned, you're abusing it. The thing is that in my observation, with pot, the more you use it, the more likely you are to use it just to enjoy it. That most people who get it for "medical reasons" may very well have started using it for their rheumatism but end up need to fix their aching bones a lot more as time goes on, shall we say. I was reading a book by Thomas Perry, who's written a lot of novels with guns in them.
He has a pair of contract killers, Paul and Sylvia, using revolvers as their go-to tool, outfitted with silencers. He refers in one passage to a guy shooting a 30-gage rifle. Kurt Schlichter gets his gun talk right in his novels. Not so for a number of authors. I'm more worried about the 100 million 3rd worlders and other high violence groups obtaining guns than non violent law abiding groups vapping or eating an edible at night or to relive inflammation and pain or treat PTSD. Same with mushrooms, which in the south growing up you could pick at your local cow field.
Hell, we used to be a proper country when you could buy opium, cocaine, and a gun. Less violence and more order back then. Not advocating for coke and opium just making a point. Oklahoma has "medical" marijuana "dispensaries," and just about anybody can find a doc to "prescribe." OTOH, Oklahoma voted down recreational pot, every county voting "no." The proposal mentioned the federal law problem!
Oklahoma used to have strict post-prohib liquor laws. In counties that weren't dry, the rules on serving were convoluted. BYOB to the "club," you get assigned a number, the bar is permitted to only serve you from your bottle, and can replace your bottle, that's it. Naturally, such a stupid arrangement became a joke. Bring in the smallest bottle of whatever you prefer, then they just poured and served from their own bottles, anything you want. One day, the Okla AG decided to crack down and enforce the liq law and start busting clubs. IIRC The vote to change the law, repeal BYOB & club stuff, passed swiftly and overwhelmingly. So with that model, I've been all-for the Feds cracking down on states allowing pot at all, much less with "weapons in the commission of a felony," 'tho the Fed law won't likely be changed as swiftly as OK bars. It's even weirder when you cross the border. It's legal (more or less, these days) in U.S. states and their counterpart Canadian provinces. But it is not legal to import or export as it is still a Schedule 1 substance.

I think that the headline is tge ATF overreaching again. That drug use is disqualifying is a part of the 4473 requirements to buy a gun from a dealer has nothing to do with continuing ownership of a gun should you then use drugs, and AFAIK, there are no Federal laws or regulations as to ownership or possession of ammunition.
