This forces the other side to throw itself on the tender mercies of the Alito Court.This is from the Washington Post, as quoted in that Esquire article: The U.S. Court of Appeals for the 5th Circuit in New Orleans has long leaned conservative. But the arrival of a half-dozen judges picked by President Donald Trump — many of them young, ambitious and outspoken — has put the court at the forefront of resistance to the Biden administration’s assertions of legal authority and to the regulatory power of federal agencies. Their rulings have at times broken with precedent and exposed rifts among the judges, illustrating Trump’s lasting legacy on the powerful set of federal courts that operate one step below the Supreme Court.Never forget that all those highly principled NeverTrump Republicans who preferred Hillary (and Biden) to Trump would also prefer to have our courts packed with leftists rather than the conservatives that Trump appointed. (I’ll admit that I was a Walker/Cruz NeverTrumper in 2016, but I ultimately voted for Trump because of the courts. Specifically, there was a 0% chance that Hillary would appoint conservatives, and although I had serious doubts about Trump, there was a better-than-zero chance he would appoint conservatives, and he generally did.) That said, government by a conservative judiciary is not feasible nor sustainable, and where we have had victories, the left will ensure that it never happens again. That is why court packing and impeachment of conservative justices is so high on the left’s wish list right now. Above all else, conservative governance is almost impossible when seemingly any and every conservative law that is passed is likely to be blocked by some judge – any judge – and thus the will of the people is subjugated to the will of individual, unelected judges. There are thousands of examples, but this one is recent and relevant. Judge Blocks Tennessee Law Restricting Drag Performances in Public [Reuters – 4/03/2023] We all learned in civics classes about our government’s system of checks and balances, but there is no check on the judiciary. One federal judge has taken it upon himself to stop implementation of a state law, and there is no legal recourse against this judge. The state of Tennessee can’t remove him from office or vote to overturn his ruling, nor will Congress impeach him. The only check on this rogue judge is that another judge will overrule him. Thus there is no “check” on his power from any other branch of government. Some people argue that the “check” on judicial activism is to win elections and have better people appointed, but that is like stating that the check on unconstitutional legislation resides at the ballot box, and that the courts should have no authority. (Which is an argument I’m receptive to discussing at this point.) There is no check on our omnipotent judiciary from the other two branches of government, and conservatives have never had the fortitude to even impeach one left-wing judge. It is understood by all parties that conservative legislation is usually DOA, even if passed into law by the legislative and executive branches, because the left can go judge-shopping and find one “Hawaiian Judge” somewhere to throw the legislation out. If the left refusing to consent to a right-wing court brings a halt to the era of judicial tyranny, then that is a positive development. Andrew Jackson is alleged to have responded to Supreme Court Justice John Marshall in regards to the Worcester vs Georgia case, "John Marshall has made his decision, now let him enforce it." It would warm my heart to hear Joe Biden, or Gavin Newsom, or Kathy Hochul, or some other elected Democrat executive effectively state "Samuel Alito has made his decision, now let him enforce it."There is clearly momentum building among the left to delegitimize any conservative court and its rulings so that the left can govern independently of the courts. Those terms are acceptable, so long as the right follows suit and does the same. Red states will be much freer if emancipated from the tyranny of unelected judges. ++++ It won't. When they reject a court's ruling and do whatever it is they do anyway, they will wrap themselves in the justification that the courts have no right to do X, Y, or Z. They will succeed, since the FedGov is largely on their side anyway and won't send an army to force them to comply with something they don't want to see happen, either. When there's a shift and a leftist court makes a ruling that a conservative state rejects, the states will wrap themselves in the justification that the courts have no right to do X, Y, or Z. Then the feds will force them to comply, by force of arms if needed. This isn't about rules, it's about power. If you want to fast-track a truly terrible idea to the carefully engineered conservative majority on the Supreme Court, the best way to do it is to file it in Texas. If your case fails there, take it down to the 5th Circuit for some CPR. Once there, your chances to prevail are fairly good. This forces the other side to throw itself on the tender mercies of the Alito Court.

So, an O/T update on my dad.
Things looked a bit better late last week, but it seems there were other issues which lead to complications over the weekend. We had a call with the Dr on Saturday where he declared my father's colon had failed and was no longer functioning. They did emergency surgery Sunday AM to remove it, so he'll be on a bag for the rest of his life. Attempting reattachment at this point in his life is highly unlikely. He's a bit better today with the breathing tube removed, so he's breathing on his own but can't really talk due to soreness and all related to that. I don't think he knows what all has gone on over the last week, but is going to be extremely pissed when he finds out, I'm quite sure. The road just got a lot longer and steeper. Awhile back, some institute put together a look at the justices voting patterns vs. time on the bench. The y axis was conservative at the top, and liberal at the bottom. X was time. There were two interesting takeaways. 1) The liberal justices were very tightly clustered in y, and stayed that way; virtually a horizontal line, with very little spread. IOW, they voted monolithically. 2) The Republican justices were higher on y, but more broadly distributed, and almost uniformly trended down as their time on the bench increased. I think I remember how this works from a Schoolhouse Rock cartoon that came on between Scooby Doo and He-Man cartoons. A law is created when Congress writes hundreds of pages into a bill wherein most of the details on how it will be enacted is to be determined by bureaucrats in the executive branch. Who in turn fund NGOs who then sue the executive branch in court about the rule so that the rule can then be enshrined into law by our Black Robed Masters.

I think Judicial overreach should be self limiting as our system was envisioned. The Supreme Court, the only one constitutionally created, does not rule on law but rather on cases, the threat being that any similar cases that wind through the system will be equally ruled, making it effectively a ruling on the law. The counter threat is that the executive can still arrest people and flood the system. The counter-counter threat is that Congress will side with the judiciary if the Executive is overactive in this way.
What is killing us is not institutional power, but rather Party, or if you prefer, Ideological power. The Congress, the Courts, and the Executive, rather than being protective of their own power, are controlled by a faction that only cares about outcomes that benefits a Party or Ideological faction. I used to live in one of the few nice neighborhoods in Oakland. Great place for eating and drinking and cooking...and even the Coliseum was in good shape.

Which will *probably* fail. Exit taxes might succeed, but imposing taxes on non-residents won't because the other states will fight them tooth and nail on it. They want that money for themselves, and there is a serious - and legitimate - Constitutional problem with it. This will be one of those times that the Constitution suddenly matters again.

In a system where judges are almost never impeached, this is effectively true. But there's another layer here: judges can make bad or improper rulings without rising to the level of impeachment. Blocking a law a judge simply doesn't care for doesn't justify impeachment. But what IS supposed to happen is that laws and the constitution are under the legislative branch, and they are supposed to use that to overrule and fix bad decisions, along with the vote of the citizens. And that's not happening, either. Aside from a few very rare instances, none of the checks and balances are being used. They're all in place, they are just not begin implemented. Presidents are supposed to veto laws and refuse to execute bad ones. Congress is supposed to overrule bad executive vetoes and control the purse to rein in executive overreach, etc. If all three branches wink at each other and decide to just not do that so that each can abuse their own power, all that's left is the ballot box and, well....
