THE MORNING RANT: Los Angeles’ Punitive “Mansion Tax” Has Become Law, Next Up Will Be the Consequences
Last November there was a referendum in the city of Los Angeles for a “mansion tax” that would impose a new transaction tax on any real estate sale in excess of $5 million. The referendum passed with 58% of the vote. The tax is steep and punitive – a flat 4% on properties selling for $5 - $10 million, and 5.5% on properties selling for more than $10 million.
The citizens of L.A. were presented the opportunity to go to the polls and vote to seize somebody else’s money, and that’s just what they did. It’s mob rule democracy at its finest…not unlike the three wolves and two lambs voting on what to have for dinner. On the other hand, rich Angelenos vote heavily Democrat, and they contribute crazy money to left-wing causes, so it’s also kind of funny to see the left-wing party that they’ve nurtured and funded turn on them and attack. Blue-on-blue political warfare in deep blue states is kind of entertaining to watch. The “mansion tax” law went into effect on April 1. So, for a house that sells for $5,000,000 there is now an additional tax due at closing in the amount of $200,000. For a $10,000,000 property, the tax would be a staggering $550,000! For what it’s worth, houses are not cheap in LA, in Dec 2022 the median sales price was $810,000 and in March 2023 the median price was $978,000. It caused a wild scramble in the month of March, with sellers of mega-million dollar homes desperate to close before April 1. LA’s Rich and Famous In Wild Scramble to Sell Homes Ahead of Mansion Tax [NY Post – 3/31/2023]Celebrities like Jim Carrey and Mark Wahlberg, not to mention a slew of lesser known multimillionaires, have all rushed to dump their homes in the last few months. After 30 years in his 12,700 square-foot home in Brentwood, Carrey made the big decision to list it in February for $29 million. So far, there are no takers. Same with Jennifer Lopez, who put her Bel Air place up for sale in February. James Corden is willing to slash and burn the price of his Brentwood Park house, recently cutting it from $22 million to $17.95 million. But that’s nothing compared to Mark Wahlberg. The “Ted” actor had put his 30,500 square-foot estate on the market months prior to the measure’s passage, at an eye-watering $87.5 million. But he ended up selling the Beverly Park property for $55 million — a 37% price drop — in February. Multiple brokers told The Post they felt Wahlberg could have done better, if not for the looming deadline of that multimillion dollar tax bill he would have faced starting this April Fool’s Day.Some sellers were throwing in exotic cars as enticement to close by March 31, because a Lamborghini is still cheaper than the mansion tax.
The “mansion tax” has led to quite a few “Hail Mary” marketing approaches, said Tatiana Derovanessian, a luxury agent with Keller Williams in Beverly Hills.Take the developers selling a five-bedroom, eight-bath Mulholland Drive mansion in the coveted 90210 zip. For $16.5 million, you can get the “the luxury home and the luxury vehicle of your choice, within the fleet that we have through O’Gara Coach Co., a Beverly Hills luxury car dealer.” The deal includes vehicles priced up to roughly $400,000, including an Aston Martin Vantage, Aston Martin DBX 707, McLaren GT or Bentley Bentayga EWB. The “mansion tax” on that $16.5 million dollar property if not sold by April 1 would be over $900,000.
By the way, this tax isn’t just on mansions, it is on any real estate, including apartments and office buildings. $5 million is not a lot for an office building or multi-family housing.

But not every Los Angeles property on the market traded hands last month, and real estate analysts say the new transfer tax is a new obstacle to completing commercial real estate sales this year. Some high-profile properties in the city of Los Angeles that didn't sell include downtown's third-tallest tower, the 62-story Aon Center, along with the roughly 1.2 million-square-foot 601 S. Figueroa St. and the historic 464,000-square-foot PacMutual buildings at 523 W. 6th St., to name a few.When the left embraced Covid as a religion and work-from-home as a sacrament, office vacancies exploded, especially in blue cities. This tax is yet another gut-punch for commercial real estate.

I decided to check on how the celebrity real estate agents on that show are responding. "The way that this ULA measure was passed is just mind-boggling to me," Altman added, "and I think it's one of the most ridiculous bills that I have ever seen in my entire 20-year career."
"Think about these people that bought houses three years ago for $5 million and they want to sell now," Altman hypothesized. "The market's down, rates are up, that happens. But now they got to cut a check for $200,000 out of their own pocket because there's no profit on that. So it's really going to rock the real estate market that we're in here in Los Angeles."Altman also discussed the mad rush to close deals before the end of March. He had a $28 million dollar listing that would have a mansion tax of over $1.5 million if it didn’t sell until after March 31.
"I'm seeing deals get done that should never have gotten done," the L.A. agent said. "I've even done as much as, on a $28 million listing that I have, we have offered a $1,000,000 bonus for anybody who buys and closes before April 1.""People who voted who said, ‘Oh, I don't have a $5 million house,’ which by the way, is not a mansion in L.A., we're talking about a four-bedroom, 4,000 square-foot house in L.A. is $5 million, so this isn't a mansion tax," Altman said. "This isn't a $30, $40, $50 million house tax – these are regular people that work bill to bill, that have to pay their mortgage just like everybody else, and now they're being penalized here." Items that are normally considered part of the permanent fixtures that convey being sold separately for exorbitant amounts; "service fees" for cleaning and other normal, routine real estate transaction activities suddenly becoming very expensive add-ons.
I'm not a real estate professional, and even I thought these up in five minutes. I can't imagine the loopholes that will get developed by the professionals.

By the way, this tax isn’t just on mansions, it is on any real estate, including apartments and office buildings. $5 million is not a lot for an office building or multi-family housing.

Depends on his base price he paid for the property. This tax will reduce resale prices going forward because it is relatively trivial to simply buy a mansion outside the tax area and still get most of the benefits. You would think multimillionaires are immune from market prices but the ones that keep it over time are rather stingy with their money and very sensitive to income/property/etc. taxes of a locale because it is less costly for them to leave.

No, for an $87.5 million property, the tax would have been $4.8 million. That's in addition to whatever capital gains tax that would be charged by CA and the federal government.
Finally, throw in the massive, sudden depreciation in mansion property values that occurred as a result of this tax. That home was no longer worth $87.5 million. So yes, a $30 million dollar haircut was extreme, but it may not have cost him nearly as much as it initially looks.

Back when I was a kid, I can vaguely remember the fight over Proposition 13 -- the Jarvis-Gann initiative. As property values in San Jose began to rise, people were being taxed out of their homes, and Prop 13 put the brakes on the punishment of happenstance of buying a home in an area that grew rapidly. (My parents bought their home for $35,000. 40 years later, the city grew around them, and neighbors' homes are selling in the $2M range. They'd have been pushed out to Vacaville by now, just to afford paying property taxes.)

When tax rates were 70% at the top rate, basically every upper middle class American voted Republican.
Now, it's totally flipped. I think at least part of that is, financially, the rich now feel safe with the Democrat Party. So it's all about cultural issues. Sure, they may pay a bit more, but they feel it's worth it.
Would that change if say Bernie Sanders type socialism dominated Democrat Party politics? I think it does move the needle. Suddenly "protect Trans kids!" takes a back seat to "protect my 401k!"

I have some friends that live in LA that work in the entertainment industry. Fairly successful. Nice house (but not by any means a mansion) around 2500 sq feet in Brentwood. He pays $50,000 a year in property taxes.

Just in my neighborhood they pulled two houses off the market this month. They paid about $100,000 over last years appraisal for them and now can't sell them for what they have in them. In one of the houses it appears the real estate agent moved in, not sure if it is her but I saw that truck at that house multiple times when it was for sale.

Taxes are a fascinating subject when I studied public finance in school and generally those with portable wealth are able to game the system far better but those with relatively fixed wealth are less able to unless they have significant political power (rural counties and farmers/lumber/etc interests on property taxes for example).
Property taxes have the virtue of almost being unavoidable due to the ability to take the property if not paid but are often quite unfair as to ability to pay. Sales taxes are more fair in some ways as every buying something pays and hard to avoid but their burden falls more heavily on the workers while not touching investors much or people able to move/buy in another jurisdiction that charges less.

I think you can beat this law. First off, you invest $5 million in a new business. The business buys the house. You live in it and py "rent" equal to taxes and upkeep. You move out, but the business still owns the house. Sell your stock in the business to someone else who moves into the house.
That way, the house was never sold. You give up the tax deduction for mortgage interest, if there was a mortgage (unlikely for Mr. LA Rich Guy), and for real estate taxes. But since PDJT limited local tax deductions to $10K, losing the real estate tax deduction probably has zero impact on Mr. LA Rich Guy.

No. The issue with leftists is that, mentally, they're children. They believe what they've been told. For years, all these rich Hollywood assholes have gone around repeating the mantra that "the rich should pay their fair share". They've said that secure in the knowledge that it'll never affect them. Just in my neighborhood they pulled two houses off the market this month. They paid about $100,000 over last years appraisal for them and now can't sell them for what they have in them. In one of the houses it appears the real estate agent moved in, not sure if it is her but I saw that truck at that house multiple times when it was for sale.

My SIL is a prime example. She and her husband are well off, probably 500k income between the 2 of them. SoCal Edison pays them an insane tariff for the electricity from the solar panels on their house, so much so that their (net) electric bill is negligible. She thinks they are making their own power from the solar panels and has no idea what's really going on. But at some point someone has to pay for all this. That's where the base fee comes in. So she will wind up paying just as much as she did before, plus she's paying for the solar panels and giving the electricity to SoCal Edison for (net) free.

Well, this is true, of course. They never index their taxes to inflation, so their taxes on the rich always end up hitting the average person, often sooner than you’d think.

I get a ROI in 10 or 11 years (including price of having to replace the inverter once), which is the point where I'm at right about now (bought 'em during Obama's reign of error). I've only had to pay the electric Co here once in the last about ten years due to it (I generate just about as much electricity as I use most most years).

Same with large companies. I constantly run into this problem when I get a new large company customer and they start asking for Net 90 terms, which they ALWAYS pay several months late. So if I agree, I'd be doing work for them that I wouldn't be paid for until about 5-6 months later. They get seriously pissed when I tell them that my invoices are due upon receipt.

Don't know if entirely accurate but: In 1940, the federal tax rate on income over $200,000 started at 66 percent. By 1944, the top tax rate on all income over $200,000 — about $3.4 million in today’s dollars — had jumped to 94 percent. In the 1950s & 1960s, when the economy was booming, the wealthiest Americans paid a top income tax rate of 91%. Today, the top rate is 43.4%.

Like the AMT in the early 1970's: $50K/yr was ENOURMOUS back then; today, not so much. With inflation rising, and a serious doubt that the $5M limit will adjust, you'll have homes in the hood falling under this in 10 years.

Next question: does the resulting "Quick Sale" reduction in home sales figures alter the sales taxes on these locations, will it alter the valuation for future property tax...what will the net loss to local govt/schools from that equal?

When Envy is the foundation of Progressivism this kind of tax was inevitable. It will be interesting to watch all the myriad ways the wealthy will evade this tax. At some point the losing the 500,000 capital gains exclusion is better than paying the new tax.
