The Morning Report — 4/7/23

A good Good Friday morning, kids. There are a couple of local crime stories that naturally have major implications vis a vis Alvin Bragg and the essentially non-existent criminal justice system in this country. The fact is, there is no criminal justice system in this country. And that is a reflection of the fact that for all intents and purposes, there is no more country. None that I recognize that even bears a passing resemblance to the United States of America.

“Judge, the mother of the victim is in the building, walking down the hallway,” said Christopher Conway of the Bronx DA’s Office.

“What does that have to do with what we’re doing here?” replies Justice Naita Semaj of the county Supreme Court. “I understand you might want her sitting here in the courtroom, but what does that have to do with the actual task at hand?” Which was arraigning Tyresse Minter, 28, in the death of his stepson, Corde Scott, 15. After a lecture from the bench — Semaj snarking on about the prosecutor’s “preference” and how everyone else had made it on time, concluding, “Are you serious?” — they proceeded without the grieving mom.

She arrived at some point, only to flee the courtroom in horror at the judge’s behavior. The defendant pleaded “not guilty,” though he’s confessed to a host of material facts: Corde unquestionably died at his hands — strangled to death as the grown man pinned him in place.

Minter stands charged with manslaughter in the second degree and criminally negligent homicide, both bail-eligible offenses. Just a month before the Jan. 23 death, he was released on parole from a crime in which he shot the victim three times in the back. He has a long record that clearly qualifies him as a persistent violent felony offender and a multiple parole violater. So Conway requested remand — jail or at least substantial bail.

Minter’s defense attorneys — two lawyers from the Bronx Defenders — argued, basically, that the accused hasn’t fled in the months since the crime and has been reporting to his parole officer and doing all his Family Court-ordered programs. They suggested release on his own recognizance. The judge did just that — no bail, just supervised release. Nothing “can lead me to conclude that he is a flight risk,” and “I believe he greatly benefits from some sort of programming.”

Ah, “programming”! That’s surely enough to keep the public safe from a man who lost control sufficiently to kill a kid. This is a judge with contempt for the victim’s survivors, and for the public. Her only concern is for the perp — hoping he can “benefit” from therapy or other “programming.”

It should be noted, and it's a tragic commentary in and of itself of the state of our nation that I have to write this, that the perp, judge and victim are all black, so the race card element doesn't even necessarily enter into this incident. But the fact remains that this is not an isolated incident in either the city of New York nor in every major metropolitan area in the nation where, especially since the death while resisting arrest of the criminal Floyd, crime has literally been de-criminalized.

I have no idea where this judge Naita Smegma or whatever her name is went to law school but considering who is teaching at these law schools and more to the point the curricula that is being taught, you can bet your bottom dollar that she and Alvin Bragg, along with most of the judges and prosecutors in NY, DC and perhaps all over the country have the same mindset. Before we get to Bragg, let's go across the country to San Francisco.

Actor Sara Foster, daughter of legendary musician and producer David Foster, blasted San Francisco’s “liberal” leadership following tech mogul Bob Lee’s violent death in the city earlier this week.

Lee, a 43-year-old father of two who co-founded Cash App, was stabbed to death in San Francisco’s affluent Rincon Hill neighborhood around 2:30 a.m. Tuesday morning, devastating the tech community and raising alarms about surging crime in the city.

Foster, 42, shared a screenshot of The Post’s article about Lee’s final moments before his death on her Instagram story Thursday. In the accompanying photos, a smiling Lee appears with his two daughters.

“I have no words,” she wrote. “SF is a complete s—hole. I am a registered Democrat and feel confident saying liberal politicians are ruining cities.”

“Disgusting. My heart breaks for this family,” she added

Well, the scales have fallen at least off of one of Ms. Foster's eyes. Even with the recall of Chesa Boudin, the criminals run free in Frisco while the citizenry cower. And more and more of them, under the brainwashing of leftism still stare at their own navels and wonder how they can rid themselves of their white privilege that obviously is the cause of their misery. Feh.

Can Foster be deprogrammed, or does she even want to be? If so, can she, extrapolate her disgust and revulsion for the criminal fiend who wielded a knife to the criminal fiends who wield law books, arrest warrants, indictments and the ironically the Constitution?

And that brings us to the persecution of President Trump by Alvin Bragg. Meh, he's just the tip of the spear. Alvin Bragg represents the de-evolution and transmogrification of the American criminal justice system and nearly a thousand year evolution of Anglo-American/Western jurisprudence into a weapon of political expediency by a tyrannical junta. So, again, while even some leftist pundits and lawyers are at a minimum raising an eyebrow at what Bragg is doing and others are screaming that in a sane world, this is a complete farce and an insult that should collapse of its own weight, the problem here is that we are no longer in a sane world.

They want Trump tried, convicted and imprisoned. Hanged by his neck on live TV if at all possible. And if you think the rule of law, the Constitution, or any sense of morals, ethics, propriety or common decency are going to stop this, the fact that we have plunged this far and this fast after a stolen national election should disabuse you of that if nothing else does. There's nothing standing in the way of these fiends. Even if Trump is convicted and then the conviction is overturned on appeal, he is not going to survive the ordeal waiting for him in D.C. as Julie Kelly warns us:

News coverage of Bragg’s faceplant is quickly disappearing from the front pages as all desperate eyes now turn to Jack Smith, the mysterious figure appointed by Attorney General Merrick Garland last year ostensibly to take over the Justice Department’s investigation into Trump’s culpability for January 6 and alleged mishandling of classified documents. As I explained here, Smith is special counsel in name only; the team of investigators and prosecutors who initiated the first set of inquiries simply changed letterhead.

Given the targets of Smith’s recent subpoenas, we can surmise there is nothing independent or impartial about his behind-the-scenes work. In rapid succession, Smith has successfully sought testimony from Trump’s inner circle, including former chief of staff Mark Meadows and White House lawyer Evan Corcoran. 

For the first time in history, a vice president will testify before a grand jury considering evidence of crimes committed by his former boss. Mike Pence, after winning partial immunity, reportedly will answer questions about his exchanges with Trump in the weeks leading up to the protest at the Capitol. Oddly, Pence will not be compelled to discuss what he did on January 6—a dubious protection considering his key presence throughout the day and into the next morning.

Of course, the public can’t read any of the government’s arguments since everything remains under seal. Ditto for court orders granting Smith’s every wish. As the most norm-crushing investigation in history unfolds in the nation’s capital, judges without explanation keep the files out of the view of the American people.

Out of view, that is, except for what D.C. apparatchiks want to spin. Selective leaks keep Smith’s inquiry in the headlines. CNN disclosed this week that Smith’s team is focused on postelection discussions in the Trump White House related to the possible seizure of voting machines. “Details about the secret grand jury testimony and closed-door interviews, neither of which have been previously reported, illustrate how special counsel Smith and his prosecutors are looking at the various ways Trump tried to overturn his electoral loss despite some of his top officials advising him against the ideas.”

The coordinated leak strategy is intended to give the appearance that the prison walls, once again, are closing in on Trump.

This time, however, it’s true. . .

. . . Smith might decide to pursue seditious conspiracy charges, which poses the greatest legal peril for Trump. Several men have been convicted or pleaded guilty to the rare charge, a crime comparable to treason. Five members of the Proud Boys are now on trial for seditious conspiracy; prosecutors have cited Trump’s off-handed (and prompted) remark for Proud Boys to “stand back and stand by” during the September 2020 presidential debate as a call-to-action of sorts that motivated the group’s unarmed “attack” on the Capitol. . .

. . . And to fulfill the bloodlust on the Left to finally see Donald Trump behind bars, there is a chance Smith will request, and a judge will grant, pretrial detention for the former president. Dozens of January 6 defendants charged with nonviolent obstruction or conspiracy counts have been denied release by D.C. judges; most have no criminal record and committed no violent act that day.

But none of the facts matter. Trump will be treated no differently in the banana republic-like atmosphere in the D.C. federal courthouse. 

After all, this is the same judicial circuit that has stripped Trump of executive privilege protections and insisted, as Judge Tanya Chutkan wrote in her 2021 order denying Trump’s first privilege claims, “Presidents are not kings, and [Trump] is not President.”

And that is how Trump will be treated. Not as a former president but as a traitor—the man responsible for inciting the “insurrection” that still traumatizes so many judges and jurors to this day, the leader who attempted to “overthrow democracy” on January 6.

By the way, when I wrote ""hanged by the neck on live TV" I was not being hyperbolic.

For most of our history, the Constitution’s words guided how our nation operated. Citizens had two ways to change the way the country was governed: voting and amending the Constitution. Today, however, neither works. The former has been undermined by a Democrat party that steals elections under the cover of night and calls you a conspiracy nut when you notice. The latter isn’t even a consideration because the Democrat party and the apparatchiks running the regulatory and security states are no longer constrained by its words.

America has become a tyranny where the people in power no longer feel the need to seek validation from the citizens. They decide on the outcome and manipulate the numbers to produce the result without even a fig leaf hiding their disdain for citizens. Whether it was Bernie Sanders in 2016, Donald Trump in 2020, or Kari Lake in 2022, the Democrat party and its entrenched government comrades have decided they no longer need to subject themselves to the will of the citizenry and, if anyone objects, they use the judiciary to crush that person.

America has been loosed from the anchor of the Constitution and the rule of law that kept our citizens free for two centuries. While the blood of the regime’s enemies may not yet be flowing in the streets, history very clearly tells us that, unless we change what’s happening, it will be. The question is, are there enough Americans who are familiar with history and willing to pull us out of our national death spiral before that terrible end is upon us? How Americans respond to Donald Trump’s persecution is the canary in the coal mine that will likely answer that question.

There is only one response to all of this. You know it, I know it and the whole world knows it. The question is, will that response ever happen? I have my doubts, not that in any way, shape or form do I desire it. I dread it. But I dread even more the prospect of just sitting on our hands and waiting for the figurative and even literal axe to fall

As President Trump – the last real American president – has said, they're after us, he's just in the way. Once he's out of the way, as Julie Kelly is strongly indicating, then no one is safe.

Before Karen Bass was elected in LA, a high level record execs wife was murdered, she was a big proponent was defund the police, her GOP opponent, though a former Dem, ran on a campaign of law and order, guess to which candidate all of the tech and smart money went?

I feel little sympathy for this tech exec, he and people like him created this situation, a little reported fact is that he moved himself and his family to Florida and he was back visiting the city he helped destroy, irony indeed.

One would assume that even basic thoughts of self preservation would make the judge wanna put this person away. Great content, JJ; I'm pretty sure we have for a long time been living in a post-Constitutional Age.

It would be safe to say that north of 95% of those who "wield law books, arrest warrants and indictments" are not even aware of a Constitution and never would let it interfere with their perceived job duties.

As is pointed out in the article, it's uncertain that this will actually pass as it's part of a larger budget.

So why not do something different...INCREASE funding earmarked for huge posters advertising the books (including pictures) that can be found inside the library!

Make sure they are prominently displayed on the outside of the library so that passing patrons can evaluate if they want to go inside and check out those books.

If you don't like the inflexibility and lack of judgment of "three strikes" type laws, this is exactly what you should *not* do. This is how you get those kinds of laws.

Actions like this catch-and-release of even violent offenders create more and more recidivism. Eventually, people get pissed off and demand that these activists be brought to heel. That's how you get "three strikes" laws - when people determine that the judges' judgement is poor, and so must be curtailed by more law. It creates an inflexible system with a ton of corner cases, but this is how it comes to be.

Its the latter. Lies follow motivation to lie. Not sure how one programs motivation into a system.

AI could be instructed to fabricate a lie when there is absence of information or specific directives not to tell truth, for example, when ChatGPT is asked to say something nice about Trump. It lies and says that it can't because the algorithm was specifically instructed to deny the ability.

I'm with Jake. When I lived in Boston I was often out late at night and so were a hell of a lot of other people. Bars and clubs in many cities are open to 1 or 2 for a reason. Sinatra made a lot of money coining NYC as the city that never sleeps cause it never did.

No, he isn't. I strongly suspect that the junta has aligned on this issue and that Trump will walk away from this. Both of the major press organs (WaPo and NYT) are prepping the field for that outcome. When those two agree and work toward the same point, it usually indicates that the thing itself is a fait accompli and all of the deals and decisions have been made.

But that doesn't mean Bragg is hurt by it. Bragg will be taken care of. There will be no punishment. He will fill out his term and then probably be cashiered, sent to a think tank and given a book deal. He and his family will me modestly but comfortably compensated for his efforts.

This year's tray will have a take on this weekend's salad - "Apple and Snickers salad meets allergies and dip" with Granny Smiths, Pink Ladys, bananas, red grapes, and strawberries for dipping. Plus a shrimp cocktail circle, homemade deviled eggs (from today's dyed eggs), and hummus and fancy crackers. Something healthy around all the sweets, and yet a little Easter sweet, too.

I kinda don't think so, only because this is how things work now. Cars have gotten very, very expensive and they need very, very long-term loans. Auto loans that long are fiscally irresponsible because a 7-8 year term is essentially the entire value curve of the car. The asset, from the borrower's standpoint, is worthless for its entire lifetime.

This causes all sorts of problems that have to be solved financially, through things like gap insurance and negative equity and rollovers (we'll roll your balance forward onto the new car - don't worry about it being underwater literally forever, just get the gap insurance to enable the deal).

Autos are entirely financialized already and tremendous numbers of buyers never get off that treadmill.

They do. They are also largely already successful. Well over 80% -often around 90% - of cars are purchased with financing. Around half of adults have an active car loan at any given time. Some of this is hidden cash payments for various reasons (I did this - I financed a car through the manufacturer to get a major discount, then paid off 90% of the loan in month zero to minimize interest costs before letting it roll off over the next two months to satisfy the contract), but not much.

Getting people on the treadmill or keeping them there isn't a new goal. It's an old one that has been achieved. The EV push is an escalator, but only a fairly minor one. The next stage is probably non-ownership and non-possession. Use an autonomous Uber car, bro!

This is what happened to me in '17. I had the car I wanted and a price I wanted. I dickered with the dealer for two and a half hours getting that price. One of the strings was financing. Okay. Per the contract, they could claw back the rebate if I paid off the note before three months. So I didn't. I paid most of it immediately to reduce the principal balance and then the note rolled off in month three. The $1k discount on the purchase cost me $74 in interest. Easy math.

Some of that goes on, but it's fairly marginal.

In my case, I'm not financially secure enough to be granted loans, so we had to have me, my father, AND my grandfather arguing with the dealership until they finally gave in.

And they only gave in because back when my grandfather was still working, he was in charge of purchasing the fleet vehicles for where he worked, and always got them from that same dealership.

True, but the 7 year old car isn't worth all that much at that point. Most of the depreciation has been experienced and paid for. The old car might get you a down payment on the new car. Nothing more than that.

Of course, you can *keep* that old car and keep driving it until the wheels fall off (this is my approach). That option goes away with the EV that will now need the IC equivalent of a complete powertrain rebuild.

I added some modern bells and whistles like a bluetooth and USB compatible radio unit, 12V USB charging ports, and a backup camera. Even if I spend a thousand bucks a year on upkeep, I'm still ahead of the treadmill.

But not many of the hyper-rich on which San Francisco (and California) depends. If they start leaving, the books collapse almost immediately. New York is ahead of the curve on that, for now. They're not in full-blown fiscal crisis yet, but they're close. All it will take is another 1-2 dozen of their richest people leaving to push it over the edge.

The margins are that narrow. It's terrifying from a risk-management standpoint.

Uh, yeah, it started in 2014 when Obama implemented his policy that allowed "unaccompanied minors" who crossed the border illegally to stay. They are lost in the system by design. The way to stop this is to build the wall and to stop rewarding unaccompanied minors.
But I'm going to guess Hick doesn't want to do that, he just wants to spend more money on more programs that encourage more kids pouring across the border.

I think the late 90s/early aughts is a sweet spot in car history. The mechanical reliability and fuel efficiency were very good without going into marginal returns territory. There were electronically-assisted diagnostics, but the cars could still be worked on comparatively easy. Most of the safety features that really move the needle - ABS and side airbags - were available, at least on higher-end marques.

Most of the later aughts into today have been spent, in my opinion, chasing marginal improvements in stuff that matters (safety, efficiency, reliability) and shiny doo-dads. Those doo-dads are probably now a net weight on reliability, making them a bad idea.

A notable exception is probably vehicle stability control. That was a great invention, and is a mid-late aughts development (mainstream, anyway).

I recognized him, he saw me recognizing him, gave each other a nod. So tempted to go over and ask for a selfie but didn't. I think he appreciated it.

Couldn't believe how old he got and was kind of shambling off the train. And that was 5 years ago.

330 There is more than one possible solution. If the GOP had any nerve they could avert whichever coming disaster - tyranny or war.

They would immediately begin arresting all Democrat politicians in their states, and refusing any subpoenas or indictments for their own. Lock those Democrats in prison, in solitary confinement, for lengthy terms. Openly persecute their activists. Nullify federal laws, challenge the government to enforce them, order their Guards to disregard federal orders, and make an impassioned case for federal troops to do the same.

If the red states did that as one, I think the feds would blink and the Union would collapse.

But the GOP has no courage and this will never happen.

Yesterday, after The NY Post reported the step-father's release, he was re-arrested. The NY Post again, in part, "Gov. Kathy Hochul said Tyresse Minter — who was released Wednesday by a lenient Bronx judge after getting hit with manslaughter and negligent homicide charges in Corde’s Jan. 23 slaying — was back in police custody over a parole violation.

“My top priority is public safety,” Hochul said in a statement. “Earlier today, the Department of Corrections and Community Supervision issued a warrant for Tyresse Minter, and he is now in custody.”

If you are in a recovery situation, your vehicle needs to be in neutral in order to be recovered or towed or put on a flatbed.

I have seen tow trucks just pull front wheel drive vehicles lifted at the rear, front tires locked and smoking. They don't care, especially if the car was parked near a courthouse and the meter said violation.

All that was just fine. But this, THIS, this will be "the death of our Republic".

Pundits on the right continue to say this for pretty much everything. "If the Marxist Left does X, then THAT will be the death of the Republic!" ... Marxist Left does X... "Wait, no, if the Marxist Left does Y, then THAT will be the death of the Republic!" ... Marxist Left does Y... "No, wait, if..." These people are as annoying & empty in their statements as the "climate change" hoaxers. Only difference is that while the earth is in no danger of dying, the Republic already has.

The unpleasant fact is that throughout history armed revolution, in the vast majority of cases, just lands you with an even worse tyranny. Hell, almost every communist state was the result of an armed revolution against tyranny.

The American Revolution was a shining example of the very rare exception. The French Revolution and every communist revolution was an example of the rule.

I don't have any brilliant answers. I just know I don't want to end up in goddam Cambodia. Everything I see leads at best to the Balkanization of the United States. With a lot of luck, maybe some of those new states will be free ones. Most probably will not.

We can see how well Balkanization worked in its namesake. Problem is, THEY don't want to budge. They have othered us. They have controls of the levers of the deep state and Gov't. We are quickly approaching the same guaranteed rights as in the Constitutions of Mexico and China; pretty words on paper, and nothing more. That's why they push so hard to disarm us; an armed population is much harder to suppress.
