FEC Commissioner to Soros Prosecutor Bragg: We Already Looked at Trump's Payment to Stormy Daniels. It Violated no Election Laws or Reporting Laws.

This is why Alvin Bragg refuses to say what crime he's claiming Trump conspired to "further:" He knows there is no crime at all. He thinks that the judge is so biased against Trump he'll let this case proceed without ever having to specify what law he's claiming Trump violated.

And who knows -- he just might be right about that.

Obviously you can't defend yourself if the prosecutor won't even tell you what crime you're supposed to have committed.

And that's the whole point.

And The Regime further proclaims its illegitimacy, and its intolerable tyranny.

A key member of the Federal Election Commission today rejected the Manhattan district attorney's indictment of former President Donald Trump as a violation of federal election laws.
"It's not a campaign finance violation. It's not a reporting violation of any kind," said FEC Commissioner James E. "Trey" Trainor.
In trying to stretch the law to make it look like a violation, he added, District Attorney Alvin Bragg "is really trying to make a square peg fit into a round hole."
In a 34-count indictment of Trump, the first criminal case ever against a former president, Bragg charged that a $130,000 payment made by former Trump lawyer Michael Cohen to porn star Stormy Daniels, which Cohen went to jail for in a plea deal, violated several campaign finance laws that splashed onto Trump.
But, said Trainor, the FEC and Justice Department already considered the case and tossed it.
With that as background, Trainor told Secrets today that it will be hard for a judge or jury to come up with a different conclusion since it's the FEC and DOJ that prosecute federal campaign finance law. He reiterated that in a Tuesday tweet that showed the FEC hearing room, and he wrote, "This is where campaign finance violations are tried."
Trainor, a Texas-based election lawyer appointed by Trump, listed several reasons why the FEC decided not to take up the payment to Daniels in 2018. He also released a statement, shown below, that he and Commissioner Sean Cooksey wrote in April 2021 explaining why the FEC voted to dismiss the case.
First, he said, Cohen took the blame in his plea deal. "At the end of the day, there's the person who committed the crime, and there's the person who is behind bars because of it," Trainor said of Cohen.
Second, the paperwork violation in question came well after Trump's 2016 election, so it couldn't have been done to help his election.
Third, it is not obvious that the reason for the payment and the reimbursement to Cohen was to influence the election, thus failing the "objective standard" of law. "It has to be something that anybody on the street can look at and say the only reason you did that was to influence the campaign," said Trainor. "There's a lot of reasons that he could have done it that aren't related to him being a candidate for president, and so therefore, it wouldn't have met the standard as campaign expenditure under federal law," he added.
Also, the statute of limitations on the case was running out, and it wasn't worth the time and expense to prosecute, he said.

Bragg has a back-up lie: He says that maybe the crime he's claiming Trump "furthered" was a violation of New York state election law -- but the law he mentions applies to state elections, not federal elections.

But he'll just keep up the guessing game, daring us to Guess Which Law I'm Thinking Of?

This is a serious, growing problem we have in America. The left has so warped and damaged culture that a lot of legal principles are in danger.

A lot of stuff is based on the "average person" principle, that its only illegal if the ordinary person on the street would be traumatized or react extremely to it. "Fighting words" for example -- I believe not an actual legal principle any more but an example of the concept. If what you said was so provocative and extreme that it would stir up the average person to violence, then its not protected free speech any longer.

States cannot enforce federal law unless specific statutes grant them that authority. FECA (Federal election statute) does not grant them that authority and because pols wrote it to protect themselves, has primary jurisdiction to determine what is and is not a violation of federal election law. Bragg cannot use state election laws as those pertain to state elections only and cannot be used against federal candidates. So, it is essential that the false reporting be tied to some criminal law in order to be something that Bragg can prosecute even under NY law. That is why the indictment is incoherent--if Bragg cites state law as the underlying crime, then Trump moves the case to federal court arguing preemption. If Bragg cites federal law, then it also grants Trump access to federal courts arguing preemption because only the federales can prosecute such a charge.

Won't work. US Term Limits v. Thornton and Powell v. McCormick strictly limit states to only consider what the Constitution itself says about qualifications--35 years old, natural born citizen, etc. There is no indictment clause as the Founding Fathers were well aware of the Crown's use of political prosecutions of House of Commons members, lords, or judges when they wrote those restrictions.

IF the GOP does not follow through on this, triggering the "we agreed not to do this" principle, then its worthless and loses its teeth. They HAVE to go after Democrats now.

My guess is some monstrous extrapolation that Trump was trying to destroy the constitutional government of the US (which could trigger the Espionage Act in theory) or even treason as a stretch.

What the special prosecutor is doing is trying to create a Big Lie in order to prosecute via existing statutes. Bragg is simply making up law which makes his indictment a harder reach if any competent judges get ahold of the indictment for judicial review.

VDH has it backwards in a sense. This is the French Revolution led by the monarchy against the peasantry and bourgeoise, a campaign of terror punching down from the top. The first Great Terror launched by Lenin and Trotsky after the Russian Civil War is the closest historical analogy, I think, although they had peasants as foot soldiers rather than a technocratic elite and apparatchiks.

N. Korea is filled with people with nothing to lose but when you are a starving population--they tend not to engage in mass revolt but riots. The left is consistently over time only about 22-25 percent of the population and the right is about 35-40 percent--the left is concentrated in cities that no longer produce much but consume a lot versus the right in rural areas that produce a lot but consume relatively little. The battlegrounds are the exurbs and suburbs where the 'moderates' live and moderation is mostly because their jobs depend on it. What they will do is purely speculative right now.

IN that case, perhaps, the closest analogy would be the time of Troubles in Northern Ireland between two intractable sides with no external force able to keep the peace (British and Irish governments). The Kansas/Missouri/etc. troubles were simply the harbinger of the Civil War to come because essentially the war had started but the political establishments were late to the game.

Not sure it will happen that way. Our federal government increasingly resembles the late Soviet Union complete with aging decrepit leaders and schlerotic policy. It is more likely to simply collapse if the money runs out than stagger on because once the nat government is unable to collect income taxes via only minor coercion--the US government is effectively bankrupt.

I don't know. They have corrupted just about every institution. They have subverted the election system. They have weaponized courts and juries against their political opposition. They are openly corrupting states and undermining civil liberties at will. They have left few avenues for people to address their legitimate grievances- and they honestly don't care. If there were a few people with courage and the guts to fight for them, perhaps they could be slowed. But I don't see anyone with the gall to stand up and fight. You have to believe at some point they are angling for conflict, because what they are doing cannot be maintained as legitimate. They don't really seem to care which should lead you to ask what exactly are they angling for.

Every single road out of town turned into a giant parking lot, and that was without enemy fire stopping the first cars to flee or people blowing up bridges.
