It was a setback for the rule of law and established a dangerous precedent for prosecutors. This legal embarrassment reveals new layers of Trumpian damage to the legal foundations of the United States: Mr. Trump's opponents react to his provocations and norms violations by escalating and accelerating the erosion of legal norms. The case appears so weak on its legal and jurisdictional basis that a state judge might dismiss the case and mitigate that damage. More likely, the case is headed to federal court for a year, where it could lose on the grounds of federal pre-emption -- only federal courts have jurisdiction over campaign finance and filing requirements. Even if it survives a challenge that could reach the Supreme Court, a trial would most likely not start until at least mid-2024, possibly even after the 2024 election. This item does, however, seem to answer the question I've had since the outset. How can an alleged federal election law violation be adjudicated in a state court? I still don't get the technical aspect here, but that was the first thought I had when the ridiculous indictment was announced. I suppose there could be some state law about business documents - but with no injured party, how TF does such an item become actionable? Not like there was tax fraud, or misrepresentation of business facts in sale of a privately owned company, where the document charge would be an instrumental one, supporting the bigger charge. In my own experience, I worked for a major, conservative/libertarian icon out of Missouri who among other things bankrolled Josh Hawley.
The one caveat is that this scion hated Trump, probably because Trump boinked his girlfriend when this guy was a lawyer in New York. When Trump won, starting in 2017 it's like this scion stopped caring about the family business. Quality went out the door, there was no more cohesion, and he sold out his stake in the company. You can stop write there. I realize this has been some type of dogma and troll sine qua non around here, but factually it isn't true. What we need is a party that focuses on election reform and doesn't run like little scared children when Democrats call them election deniers. There are some fundamental issues that need to be focused on with state electoral process, combatting fraud and especially GOTV. But frankly, the GOP and its "leading candidate" only use that as a throwaway line for fundraising. They done exactly zero that will make a difference and that heavy lifting is being done by outside organizations.
