Andrew McCarthy: This "Indictment" Does Not Even Contain an Actual Indictment

Even the National Review softcocks object to this latest brutalization of the law and our Democratic Norms by the party they softly support.

Andrew McCarthy:

What a disgrace.
It's always possible to be surprised. The indictment brought by Manhattan's elected Democratic district attorney Alvin Bragg against Donald Trump is even worse than I'd imagined.

Bragg's indictment fails to state a crime. Not once . . . but 34 times. On that ground alone, the case should be dismissed -- before one ever gets to the facts that the statute of limitations has lapsed and that Bragg has no jurisdiction to enforce federal law (if that's what he's trying to do, which remains murky).

Bragg's indictment charges 34 counts, just as we said it would, based on media reporting that clearly came from illegal leaks of grand-jury information -- a crime, you can be sure, that goes in the overflowing bucket of serious offenses that Bragg refuses to prosecute.

The 34 counts are arrived at by taking what is a single course of conduct and absurdly slicing it into parts, each one of which is charged as a separate felony carrying its own potential four-year prison term.

Trump reimbursed Michael Cohen in monthly installments during 2017 for the $130,000 paid to porn star Stormy Daniels right before the 2016 election for her silence about an alleged affair. That, in reality, is a single transaction: Trump paying back a debt to Cohen. Yet, because Trump paid in installments and each installment includes an invoice from Cohen, a bookkeeping entry by the Trump Organization, and a payment to Cohen by check, Bragg not only charges each monthly installment separately; he subdivides the installments into installments (as if the invoice, book entry, and check were independent criminal events). Voilà, one transaction becomes 34 felonies!

As I observed a few days ago, this is exactly the sort of abusive behavior that rogue prosecutors engage in, and thus that the Justice Department admonishes federal prosecutors to avoid. Here -- from the Manhattan DA's office that the legendary lawman Robert Morgenthau led for 34 years, no less -- we now have as egregious an example of this low tactic as one can find. In a real prosecutor's office, the district attorney is the adult who makes sure his inexperienced young subordinates don't abuse their enormous power this way. In the Manhattan DA's office, Bragg is the exemplar of abuse.

Alvin Bragg commits an even greater abuse: He has indicted a man while refusing to say, 34 times out of 34, what crime the man is being indicted for.

He's concealing this because, if he specified that he's attempting to enforce federal election law, the case would be dismissed instantly: A state prosecutor has no power to enforce federal law. (Not to mention, the FEC already looked at the Stormy Daniels payment and decided that no law had been violated, bringing up the doctrine of federal preemption: the state cannot rule in an area a competent federal body has already decided.)

So instead of admitting what law he is pretending to be prosecuting, Alvin Bragg just says, literally, "the law doesn't require me to disclose what law I'm claiming was violated, so I'm not disclosing that."

The worst due-process abuse of Bragg's indictment, however, is that . . . it's not an indictment. The Constitution's Fifth Amendment guarantees that Americans may not be accused of a serious crime -- essentially, a felony -- absent an indictment approved by a grand jury. The indictment has two purposes. First, it must put the defendant on notice of exactly what crime has been charged so that he may prepare his defense. Second, the indictment sets the parameters for the defendant's closely related right to double-jeopardy protection, also set forth in the Fifth Amendment. That is, by stating the crime charged, the indictment enables the defendant to claim a double-jeopardy violation if the prosecutor attempts to try him a second time on the same offense.

Here, the indictment fails to say what the crime is. Bragg says he is charging Trump with felony falsification of records, under Section 175.10 of New York's penal code. To establish that offense, Bragg must prove beyond a reasonable doubt that Trump caused a false entry to be made in his business records, and did so with an intent to defraud that specifically included trying to "commit another crime or aid or conceal the commission" of that other crime.

Nowhere in the indictment does the grand jury specify what other crime Trump fraudulently endeavored to commit or conceal by falsifying his records. That is an inexcusable failure of notice. The indictment fails to alert Trump of what laws he has violated, much less how he violated them. If any prosecutor were ever daft enough in the future to accuse Trump of falsifying records to conceal, say, a federal campaign-finance crime, Bragg's indictment would be useless for double-jeopardy purposes because it doesn't specify what criminal jeopardy Trump is in.

We needn't speculate why Bragg is being so coy about this. He doesn't have another crime. At his press conference, be blathered about federal campaign-finance law, but he knows he lacks jurisdiction to enforce federal law. He further mumbled something about state election laws, but those -- as you might imagine -- apply to elections for state office, not the presidency. And the DA's stream of consciousness about Trump's intent to defraud tax authorities is belied by the fact that he does not accuse Trump of evading taxes -- despite having already prosecuted the Trump organization for tax evasion, a case that neither named Trump as a defendant nor cited the hush-money scheme as a source of tax crimes.

In any conspiracy case, you are required to state what crime the conspirators conspired to perform. The law is just called "conspiracy," but it always requires the prosecutor to specify what crime is being conspired. You can't have a conspiracy to commit a legal act -- that's not a conspiracy, that's just an agreement. Or a business partnership.

But Alvin Bragg, who sent out Day One memo instructing all prosecutors to no longer bring felony charges except for a handful of the crimes that make the covers of newspapers, but instead to charge them as mere misdemeanors (and plead down from there!), is now treating a misdemeanor (which Trump isn't even guilty of) as a felony by invoking a conspiracy to further a felony -- and then refusing to say what felony he's claiming was so furthered.

Soviet criminal enforcement chief Lavrenty Beria infamously said, "Show me the man and I'll show you the crime." But Alvin Bragg is going his Communist Tyrant role-model one better: "Show me the man, and I won't show you the crime -- but I'll prosecute and persecute him anyway."

The judge in this case knows this case needs to be dismissed. But he wants to inflict maximum damage on Trump and cause maximum turmoil in the party, so he scheduled the next hearing for December -- just a month before people start voting in the primaries in January.

In a way, this is all irrelevant, as Alvin Bragg and the Media will have their day, smearing Donald Trump now and in the future.
Bragg may even get a conviction from his jury, and maybe it gets overturned on appeal, and maybe not. It will drag on for years.
The process is the punishment.
CNN has a poll that says 60% of the people approve of this, but most of us have no idea exactly what Donald Trump was charged with. Writing checks to Cohen?
The CNN poll, inaccurate as it likely is, shows us the "other side " of this farcical nonsense. There are many people in government and the media that want Trump out of the picture...in prison or dead.
Trump has money and lawyers to fight this onward legally....but the rest of us likely do not have those resources. So when the "law" comes for us, what then do we do?

To give you a visual representation of how few people voted, there are 1400 blocks in NYC and it's five boroughs, there are roughly 8 million people in NYC, that roughly works out to 5700 people per block, and Bragg got roughly 37 blocks worth of votes out of 1400.

He's illegitimate as are most of the elected leaders in NYC.

Several years ago, when I sat on a local grand jury at the circuit court level, the Prosecuting Attorney was very clear about each crime that was being prosecuted. We were also provided a physical copy of the relevant statutes so that we could read for ourselves what each crime meant and the criminal penalties for each crime.

Totally transparent. Of course, we have an awesome Prosecuting Attorney, not a piece of garbage like Bragg.

123 This has done nothing but solidify the vote for Trump. I've entertained the notion that perhaps he should sit this one out. I am now convinced the entire future of any opposition to Democrats rests on his re-election- and this proves Democrats feel the same way. One does not go to these extreme, precedent setting subversions and risk it all if you're confident of a win. You are looking to take out or weaken a political opponent because you fear his prowess.

I therefore believe DeSantis and some others will have their chance. But that time is somewhere in the future. We need to get behind Trump in a way that not only gets home elected, but crushes Democrats for generations. This is the clarion call to do that.

I hear many of your feelings for Trump. I have a profound disregard for many of the things he's done and the things he says. But I've learned over the years you go to war with the army you have, not the one you want. I truly believe you can also read the battlefield by the way your enemy reacts. That said, Democrats aren't going after Trump simply because of their psychosis. They are going for the throat of a movement that has the means and backing to decapitate them.

You may not like the circumstances, nor do I, and there will be a time to move on from Trump. That time isn't now. In fact more than ever, by Democrats own admission, Trump will be in the best position to defeat them. I know a lot of people from many political persuasions who have (shockingly) come to the same conclusion this is bigger than Trump and they feel that danger. 275 With the caveat they would cheat if necessary, it is far more difficult to steal sufficient Senate and House seats than to attain congressional majorities, hence the drive to eliminate two Senators per state. I think they actually are trying to take out Trump because it would make the down ballot races more competitive for Democrats since Trump does bring in a few more non-Republican votes in a general. I don't think they are concerned at all about the presidency, which they will "win" one way or another.

His appeal to the working class is very real, and the way the primary calendar works prevents serious cheating by pushing serious problem states far back into the schedule.

It's one reason I think Biden will easily win re-nomination no matter how unsatisfied the country is with him. His only opponents will be trying to out-woke each other while will play terribly in a place like SC, which has a pretty secure election apparatus.

He just sat there and smiled like a loaf. I was probably half his age and was getting annoyed because everyone was just sitting around looking at each other.

I hate talking to strangers and I had a feeling that I could have been told to shut up by everyone in the room but I went ahead and pushed the discussion forward. We had one holdout who gently offered that she just didnt' like the laws involved and the arrest. This is politics not a debate society. They idea is to be known when you are seeking higher office.

Like him or not Trump is fantastic at retail politics. He makes himself known to everyone. That's a big reason he took down the Inevitable Hillary. And he did it the running for the first political job of his career.

I don't think Ron DeSantis is a RINO plant, but I do wonder how he will perform on the National Stage, when he does not have the "F-U" money that Trump has.
Ron will have to deal with the National GOPe, and it is important to remember that the top 100 or so donors that finance the GOPe largely have more in common with the top 100 donors that control the DNC than they do with us.
Ron is a good guy. I have no problem with him. But he will be compromised by his own party, just as Donald Trump was, if he compaigns as he has worked as the Governor of Florida.

To give you a visual representation of how few people voted, there are 1400 blocks in NYC and it's five boroughs, there are roughly 8 million people in NYC, that roughly works out to 5700 people per block, and Bragg got roughly 37 blocks worth of votes out of 1400.

He's illegitimate as are most of the elected leaders in NYC.

I certainly don't think DeSantis has it in the bag, if anything it's probably still Biden's to lose even with him as the nom.

But I have zero doubt Trump brings far more negatives than whatever positives Trump brings to the table. Trump will lose simply because of how he'll campaign. And Trump fatigue even among Republicans is very real. Let's be honest, half the people here hate him. How do you think independents and soft Democrats are going to feel?

The whole election will be about Trump, how he's unfairly persecuted, and how the election was stolen from him. And I half way agree with him, and even I know this is a guaranteed losing platform.

Hey, I tried telling people Trump was a gamble, but without much need to say it, Hillary was a sure thing in the opposite direction.

Trump wanted to make more deals with the Dems and he campaigned on making deals. We lucked out in the Dems wall of refusal to make deals with an outsider.

But, I have to shake my head that you still don't seem to know what you're getting with Trump. He also asks a lot of questions and throws things out there for his advisors.

I'm not really worried that Trump violated the doctrine about guns if it went no further. He also asked why we couldn't use nukes, but we never came close to using nukes during his term--heck he even declined to kill Iraqis by droning them.

Exactly wrong. The Florida law is for permitless CONCEALED carry, which would only be a big deal in Illinois or Jersey. In reality, most of the red states have long since adopted Constitutional Carry (no permits for open carry, usually requires a holster). .

Adopting concealed carry is a decent start in a state that previously enacted gun restrictions after Parkdale. And your confusion on the issue is understandable given that Conservative Inc. has been insisting that this is actually constitutional carry. But gun rights advocates know the difference, and they won't tolerate being lied to.

But the main problem the elites have is that they have a proxy war with Russia, and are doing their best to infuriate China into opening a second front.
