Alec Baldwin Charged With Involuntary Manslaughter of Director of "Rust"

They say you shouldn't kick a man when he's down. I've never understood that. Whe you shouldn't kick him is when he's on his feet in a fighting stance, expecting it. When he's down is the perfect time.


The film's armorer was charged with the same crime.

I'm always saying, "I predicted this."

I definitely did not predict this.

I will predict a plea deal with no jail, though.

But I was wrong once already.

"Involuntary" means not willful, not intended. Negligent, in other words. This is what other jurisdictions might call criminally negligent homicide. Which is the right charge.

Alec Baldwin will be criminally charged in connection with the "Rust" shooting that left cinematographer Halyna Hutchins dead, prosecutors said Thursday.

New Mexico prosecutors will charge Baldwin and armorer Hannah Gutierrez-Reed with two federal counts of involuntary manslaughter over the death of Hutchins on the "Rust" film set in October 2021, when a real bullet was loaded into a prop gun.

Assistant director David Halls, who handed Baldwin the loaded gun, accepted a misdemeanor charge in a plea deal.

"If any one of these three people -- Alec Baldwin, Hannah Gutierrez-Reed or David Halls -- had done their job, Halyna Hutchins would be alive today. It's that simple," special prosecutor Andrea Reeb said.

Baldwin and Gutierrez-Reed will both be charged "in the alternative," meaning the jury will decide which of the two charges -- involuntary manslaughter or involuntary manslaughter in the commission of a lawful act -- they are or are not guilty of. Both felony charges hold a maximum prison sentence of 18 months and a fine of up to $5,000.

The expected thing to do was just to not file charges. Yes, the DA would have been criticized for going easy on a Hollywood bigshot, but people expected this sort of thing. It's standard corruption, standard easy treatment for the "elite." Criticism would have gone away in two weeks because, as the Joker says, it's all part of the plan.

So what I'm wondering is, how badly did Alec Baldwin misbehave and anger the prosecutors to spur them into charging him?

Answer: A commenter reminds me that Alec Baldwin has constantly lied about not pulling the trigger, which is a stupid lie told just for the sake of defeating an eventual prosecution. So I guess the prosecutors figure, well, if you're already working towards the jury trial, let's have one.

I don't think there will be a trial. If there is, Nick Rekieta will wind up with a new house.

It would be a ratings bonanza for CNN/MSNBC, as it would replace their non-existance schedulesl. Wall-to-wall coverage for $1M (from each network) to Baldwin for his "defense" for 3 weeks worth of trial is money well spent for them.

He'll still be convicted of Manslaughter and get 18 months, but he'll be +$millions out of the deal.

88 As much of a prick as Baldwin is, I hold the armorer responsible for this situation, not him. It was her job to make sure the gun wasn't loaded.

Baldwin shouldn't have been waving it around--I feel like they drilled that lesson into our heads pretty hard at the gun safety course--but then, he was also well within his rights to expect that if the armorer gave him a gun, it was safe to use.

104 Just simple training. Anybody who touches a firearm has to go to a brief safety course. When handed a gun, you make sure it's unloaded. When the time comes to load it, you and the armorer will inspect every round to make sure it's a blank. Any violation gets a stun gun to the privates.

Yeah, they've done a few vides on it, but it's just obvious on any low-budget action movie made after the barrel flash plugin became free in about 2002. It's cheaper to add in that plugin rather than get real guns, an armorer, and blanks.

Believing the gun had blanks doesn't really pass that test. Involuntary means you had a personal responsibility to eliminate the risk which became fatal but the risk in question doesn't meet the above standard.

I want to say that I read or saw where some new tech was used extensively in that movie, too, so that the guns' actions would cycle using batteries and it might even eject what looked like a spent cartridge, but the items the actors were holding weren't guns and were incapable of firing anything. The flashes were added in post production (I think that's the right term)

That's why it's involuntary manslaughter. If he had shot the camera man during a scene shoot, it would likely be just the armorer. But since he had no legit reason to discharge the weapon at the director, along with his overall responsibility as producer to ensure a safe work environment, a strong argument could be made he was criminally negligent in that responsibility.

159 Alec Baldwin now gets to understand that in flyover country the law is the law, and has to be treated with respect. Someone died, someone has to take responsibility for the death. He needed to have a lawyer prepare a legal rection to the event, plan a defense position, and at least make a lot of phone calls to influential people have to be made very quickly. If he has a lawyer working for him already, they suck and fail. Baldwin may escape jail time, but an actual trial will harm his reputation, it's still not La-La Land, and he'll still be liable for civil suit. The foolish armorer is likely getting jail time and her Hollywood career is over if she folds and takes the stand against Baldwin.

I honestly don't know, but if it's standard practice for the armorer to hand the actor the gun and say "It's okay to use," and for the actor to then use it without personally checking it, then Baldwin isn't any more in the wrong than the rest of them.

Kurt Russell wasn't really a huge star, and Escape from NY was no real financial success. Carpenter was really frustrated because all of his Russell movies bombed (this, The Thing, and Big Trouble in Little China, and then, eventually, Escape from LA).

He was simply not a box office draw. If he was, he could have sold something like Big Trouble in Little China, but he didn't.

The mistake modern Hollywood keeps making is that these popular 80s properties are actually not that popular. They're popular with the film geek crowd, which has some crossover into the professional world (Scorsese recently praised Carpenter, actually), but that's a far cry from mainstream popularity.

Given that its been over a year, I assume they have been waiting for Alec Baldwin to agree to a plea and now the prosecutor, tired of the bullshit, is upping the ante. She says she anticipates an expensive trial, and wants emergency funds, so she's making appropriate noises.

I am sure at some point his agent/manager/wife/lawyer/investors will talk him into settling this. Who knows, maybe they will still let him off with probation. But at some point, if he is stubborn, they will go for jail time. I'm having trouble seeing Alec Baldwin surviving state jail time.

It's a matter of discipline and basic gun safety. A person handling firearms, no matter what the use, needs to adhere to basic gun safety. If they didn't teach or instill that in Baldwin, I would also be suing the production company and anyone else in that chain. I see more in line with the effort to do a massively expensive sequel to Blade Runner. Blade Runner was a bomb in the early 80s and clearly grew in appreciation of the decades. Everyone in Hollywood knows it, and many decision makers are fans.

Is the general public a fan of Blade Runner, though?

Not so much, it seems. It's like movies about Hollywood. Hollywood loves to make them, but they're generally not that much in the money making department. Hell, one of the best of them, The Player, made less than $30 million at the box office in the early 90s.

It surprises me after seeing the new top gun that it actually got made. You have Mav the hero of the story getting favors from his Admiral friend, showing the young kids that the old white guy is better than they are, and that they need to sit down shut up and learn. All that while swooning the girl, and patching up a relationship with his dead friends son.

Fuck them. They're actors. They need to just learn to ACT, which means doing the research on how a gun moves when it recoils, and practicing until they can get the movement close to reality. The rest can be done with editing.

Here in Clownifornia, ordinary citizens can't own otherwise legal NFA registered machine guns (unless they were grandfathered in). Same with any other NFA items. But the film industry has exceptions written into the law specifically to allow them to buy, own, and use any damned NFA firearm they want.

If a citizen can't own it, there's no fucking reason that the film industry has any business owning the same item.

Well, it works until it doesn't. And legally this is a bit troubling; *I* can arbitrarily proclaim that I'm in charge of gun safety, hand a weapon to someone and tell them to point it at another and pull the trigger, and if they blast someone - well maybe I'm legally liable, maybe I'm not. The shooter is DEFINITELY liable, both legally and ethically. The 4 rules don't have exemptions for entertainers. Sometimes - think military training - other groups also have to point weapons at people. They never, ever, ever, ever do so without proper safety checks on the part of both the wielder and a second party.

This has been downright laziness and arrogance on the part of Hollywood, plain and simple.

374 To clarify my post above, this could have been avoided with the simple expedient of the actor verifying the status of the weapon. As could literally EVERY other Hollywood shooting I know of.

The military has specific procedures for clearing weapons before doing stuff like this. If blanks are involves it extends to brass-rodding the bore also - which I may point out would have saved Brandon Lee.

To trust a gun isn't loaded just because someone else says so is the height of stupidity, and to insist you're above doing so is simple arrogance. And if you're incapable of doing it or being trusted with it (even if just under supervision), then you can't be trusted with a firearm in the first fucking place.

During shooting of the Errol Flynn version of The Charge Of The Light Brigade, the filmmakers did some horrible stuff to trip the horses for realism during the battle scene climax. Killed a shitload of horses on set. Flynn was so enraged at the horse slaughter that he tried to kill director Michael Curtiz on set but the crew pulled him off the director before he could throttle him.

Flynn was a drunken degenerate asshole, but I can't say I blame him.

The end of the round (the part that goes into the gun) looks a lot different. For a revolver though, you'd have to pull the round out of the cylinder to see, from the back the rounds look the same.

However whomever loaded that gun should have known the difference. And certainly the fact that it went onto the set with live ammunition means someone really screwed up. And if that screw up was due to poor work practices then the producer is implicated.

It's just illegal to do it America now, though we can still see the effects in a bunch of old Westerns (pretty much any Western before about 1955 where a horse falls forward is a horse trip using wire).

Ha! It was one of those "religious" gun arguments. And I don't think the 92f is a bad weapon per se (garbage M9'a not maintained subject for another day) but it was a vast improvement over the 1911, especially for accuracy. But you also have to remember that certain groups with more latitude had access to other handguns they felt were better then the M9 and so it became this constant emotion infused conversation borne on frustration.

Eh, maybe nothing. Baldwin is a dime a dozen from a political standpoint and is a big name. Protecting him isn't worth all that much, and pretending to not protect him isn't particularly expensive. It isn't like alienating Alec Baldwin and his followers is earth-shattering, plus the system can claim it is in the justice business and not even a big shot like Alec Baldwin is above the law.

I had one and even with my 29 year old cataract filled eyes could keep 45 rounds on the 8 inch plate at 7-10 yards. That was a sweet shooter but heavy as an anvil.

It's China, so with their corruption I wouldn't be so sure.

In the long run, it's better to run low on weapons now, than to wait and discover that our manufacturing capabilities are low when we're in the midst of a shooting war involving US forces. The Chinese aren't likely to try anything with Taiwan for another 4-5 years, due to the lack of sealift capability.

1911s were either made for WWI or WWII. The replacement parts were not as tight as the OEM pistol. I still prefer the 1911 but I do like the double action of the M9. BTW - my armorers made me a very special 1911 to qualify with the pistol. The PMIs were envious.

Blanks are loaded with a very fast powder and designed to make noise with muzzle flash. A wad is placed on the end of the powder charge in order to make the powder burning more even and avoid spillage of the powder. The end is then crimped in some fashion. The wad and powder charge is sufficient to kill someone at close range such as a mock suicide and to injure a bit further off.

Dummy rounds have a bullet in place but no primer in centerfire versions. I have never seen a rimfire dummy round for obvious reasons, you could not tell between them and a real cartridge. Sometimes these are painted or have literally holes in teh body so they can be identified.

Snapcaps have a solid body of something like aluminum or plastic and the primer cup at the back is filled by either plastic or some sort of springloaded brass in order to not damage the firing pin when dry firing (pulling the trigger for practice or to ensure proper function of the firearm).

We also had a contract with a few embassies for their security to use the range, but that's another story. It's China, so with their corruption I wouldn't be so sure.

In the long run, it's better to run low on weapons now, than to wait and discover that our manufacturing capabilities are low when we're in the midst of a shooting war involving US forces. The Chinese aren't likely to try anything with Taiwan for another 4-5 years, due to the lack of sealift capability.

My last boss before I left the Army in '91 was an SF Master Sergeant who'd spent most of his career training Central and South Americans, including a stint with the Contras. He told a story about how the Contras all wanted pistols, because in their minds pistol = El Jefe.

So they laid out a bunch of different pistol types on long tables for the Contras to pick and choose. Whatever the Panamanian arms merchants could get their hands on. Each man would pick up a pistol and shake it next to his ear. If it was quiet (meaning tight and well-fitted) they's drop it on the table saying "No bueno". But if it rattled like a set of maracas, they'd smile "Ahhhhh... bueno!". Because they were used to old 1911s that were as loose as Sandra Fluke's piss-flaps. And those 1911s never jammed.

Funny thing about shooting wars, peace-keeping missions, etc is that they tend to show up outside of regularly planned events. I'm not sanguine enough to think that PRC, the Norks, and Iran haven't noticed this policy decision, and are making plans accordingly. The idea that the US Marine Corps might have fewer ATGW than one might find in Mogadishu really bothers me.

He also played minor league baseball. Worked the front office for the Portland Mavericks in the late 70's, which his dad Bing Russell owned. Great documentary about it "The Battered Bastards of Baseball".

DA/SA intended to prevent accidental discharges also can lead to inaccuracy versus the old single action trigger of the 1911. You have to practice the Crunchenticken of the DA/SA more than for example a Glock.

Honestly. If you can't put the first round out of DA/SA on target at speed, the trigger press is the issue - not the trigger.

Yes, but those are different than dealing with a full-scale invasion of Taiwan, which would require massive logistics capabilities which the Chinese don't have. As for those brushfire wars... the problem isn't that Ukraine drained our capabilities, but that our capabilities were allowed to deteriorate to such an extent in the first place.

I ran my new CZ P-10 F on Saturday. While I won't carry anything but DA/SA (decocked), the P-10 is just one damn fine pistol. I'm perfectly happy to carry it in a proper Level 2 holster.

Since Saturday, two of my buds went out and bought P-10s. One of which was running his old fav G19 on Saturday as well.

It's a little light in the fore end, so I added a TLR7 and a little bit stronger DPM spring to it to see if I can shorten the recoil wave. We'll see how it goes.

BTW, as you already know, the P229 DA/SA also belongs in the category of Damn Fine Pistols, along with my fully Cajunized 75B PCR.
