Merrick Garland: I'm Letting Biden's Hand-Picked Personal Praetorian Guard Collect The Evidence Against Him Because I Don't Want To "Complicate" the Investigation Or Something


Per the Wall Street Journal, Merrick Garland's excuse as to why he sent an armed team of FBI agents to search and confiscate Trump's documents but is letting Biden's lawyers -- most of whom don't even have security clearances -- conduct the searches themselves is because... he doesn't want to "complicate the later stages of the investigation."


Mr. Trump's supporters have accused the Justice Department of a double standard in treatment; Mr. Biden's supporters have pointed to the president's legal team's cooperation and swift moves to inform the Justice Department of the documents' discovery as a key difference...

President Biden's legal team has cooperated with Justice Department investigators, helping it avoid more aggressive actions by law enforcement thus far....

One reason not to involve the FBI at an early stage: That way the Justice Department would preserve the ability to take a tougher line, including executing a future search warrant, if negotiations ever turned hostile, current and former law-enforcement officials said.

Oh, they're not getting a search warrant now so they can get one latter if they have to. Because the law is that You Can Only Get One Search Warrant.

Wait, that's not the law at all. You can get as many search warrants as you need.

So this is a lie.

Yet the Biden team's bumpy rollout of its discoveries--it only confirmed the document discoveries after news reports and has offered few new details--complicates its attempt to draw a hard distinction between Mr. Biden's actions and those of Mr. Trump, said John Fishwick, who served as the U.S. attorney for the Western District of Virginia during the Obama administration.

"He is the sitting president, there's no reason for him to hold back anything about this," Mr. Fishwick said. "It makes it harder to say it's apples and oranges, and it undercuts the argument that you were different."

So Merrick Garland doesn't want to "complicate" the investigation by... involving his own law enforcement agents of the FBI.

Complicate it? How? By protecting the chain of custody, as David Strom of Hot Air suggested?

By insuring that none of Biden's more "helpful" cronies doesn't decide to reduce the number of classified documents he's discovered to be in possession of and simply destroy the the evidence? Maybe one of these lawyers comes across a code-word clearance document about Ukraine energy mentioning Burisma and thinks, "No way I'm turning this in," and slips it into his sock, Sandy Burger style.

Nah, we wouldn't want FBI agents to prevent that kind of thing. That would "complicate" the whitewash Merrick is planning.

Let's just trust Biden's hand-picked Praetorian to do the evidence-collection for law enforcement agents who are, theoretically, making the decision whether or not to prosecute him, based partly upon the expansiveness of the evidence discovered.

Yeah, that's true, and it sucks that it's selectively applied.

But it shouldn't be true to begin with. We have a FISA judge (Contreras) that rubber-stamped a wiretap on a major party nominee because Strzok and Page said it was cool, and no more than that.

Those courts are supposed to have the highest standards, blah blah blah, because of the secrecy. But they crossed the Rubicon on the word of a lunatic and his horsebride who mentioned at a dinner party that they think Trump's yucky.

If this is the rule there... then ask - did the fish rot from the head, or the other way around? I'd wager that top appointees like Contreras have a long career of issuing shady warrants on request, going all the way back to their first day on a local bench.

Biden's documents are classified materials relocated to a private residence while he was VP.

We don't know that. Trump isn't resting and he likely has his own people making inquiries, especially where classified documents are concerned.

If there is a bigger story here - and I have said all along there is - we don't know *what* Biden has in his possession aside from what we've been told so far. Some folders in a garage. Some folders here and there.

All they had to be was scared it would be gotten ahold of by Trump - the only person they truly fear. And they would want to control and deploy the story in their usual controlled fashion to make it "old news" as quickly as possible.

451 I'm pretty convinced the only reason Biden's lawyers were going through all the papers was to sanitize Hunter-Joe influence peddling docs. While they were there, this other thing came up and they decided not to bet their law licenses on hiding classified docs.

What the GOP should do now is serve Subpoenas or preferably get judicial restraining orders prohibiting any destruction of docs by JFB until they get to the bottom of both the classified docs and Hunter-JFB investigations. A lot of lawyers will bend the rules on interpreting what documents are "responsive" to a request but if a Court gives an order not to destroy docs most won't.

As I said in an earlier thread, essentially a GOP president in order to have any chance is going to have to cross the Rubicon and go scorched earth on the Deep State as well as the Uniparty.

I doubt Trump can do that because that is not his bag. DeSantis, though might. The rest of the GOP potential nominees though give little or no sign that they would do so. Most people are not willing to do a Lincoln or a Cromwell where you burn a lot of the village to save it. History usually damns them.

The problem is that it indicates that there are barely ten (about half the resistors) that are honest pols in DC. Siding with the Uniparty really gives Trump no leverage that he did not have if he kept his mouth shut. In essence, the deal with McCarthy does little to advance constitutional governance. Trump is trying to work within the system but when the system as a whole is broken, you get very marginal results.

Likely, when the Obama Regime exited, they did their best to hoover up a lot of documents (originals and no copies) concerning a lot of policy matters, such as the Iranian Nuclear treaty.
I read somewhere the other week that the Biden Junta was worried that Trump had documents pertaining to that Iran Treaty, and he could release them at the appropriate time. And remember, that Presidents DO have exclusive privilege to declassify document, etc. Vice Presidents do not.
My guess it that Obama, Biden and Kerry all have classified documents about the Iran nuclear treaty (that would show treason) that they gathered up before leaving office in early 2017, and Trump (his staff) may have found things that they missed. I would like to have the Eff-Bee-Eye search Mr. Kerry's residence for classified documents. I have a feeling something would be found.

512 Biden will never be charged with anything, so there's no need to really worry about the specifics past the point of using the classified doc mishandling to pressure him to resign.

On the other hand, I'd be surprised if Biden's lawyers have not already destroyed evidence here. The only reason why the DoJ is standing around with its hands in its pockets, looking down at the floor, is because they know what's going on and why: those docs are in Biden's unauthorized possession because they are incriminating, and Biden and his lawyers know it.

There is no other realistic explanation for why people who have no clearance and no need to know are being permitted to rifle through classified materials.
