"Psychic" Accuses University of Idaho History Professor of Masterminding Murders of Four Students Based on Tarot Card Readings; The Professor Sues for Defamation

Via Hot Air, there's no free speech right to just defame someone based on "psychic" twitches.

A University of Idaho professor sued a TikTok poster for defamation after she published videos accusing the professor of killing four students in an off-campus home last month.

Ashley Guillard, a self-styled internet sleuth with roughly 108,000 TikTok followers, has posted dozens of videos in which she accuses Rebecca Scofield, the chair of the school's history department, of orchestrating the four students' killings. She says she based the accusation on tarot card readings.

...

In a complaint filed in Idaho's federal district court on Wednesday, Scofield said Guillard's TikTok videos were false and that she did not comply with two cease-and-desist letters demanding Guillard take down the videos and issue an apology.

Scofield is seeking an unspecified amount of compensatory and punitive damages and has requested a jury trial.

"Guillard's false TikToks have damaged Professor Scofield's reputation," the complaint reads. "They have caused her significant emotional distress. She fears for her life and for the lives of her family members. She has incurred costs, including costs to install a security system and security cameras at her residence. She fears that Guillard's false statements may motivate someone to cause harm to her or her family members."

Not that she should need it, but she does have an alibi:

Scofield in the suit also said she was in Portland, Ore., with her husband during the time of the killings and checked out of a hotel in the city hours after the killings occurred.

Unfortunately, the "psychic" is, get this, a lunatic and attention-seeker. Regarding the lawsuit, she dismissed any chance she'd stop making defamatory videos about Scofield.

"I'm not stopping, so let's just start there," Guillard said in one of the videos.

In a later post, Guillard said she was "gleaming with excitement" that she would have to opportunity to "present my ideas in court" about the killings.

The police had been searching for a 2011-2013 white Hyundai Elantra that might be connected with the murder. On December 17, they found a abandoned Hyundai Elantra 450 miles away in Eugene, Oregon, but they're not sure if it's the one they've been looking for. I doubt it. It's all banged up.

Recently, Ben Mogen, father of slain student Madison Mogen, stated his belief that the killer will be caught, because this people just can't get away with crimes like this any longer.

"From the very beginning, I've known that people don't get away with these things these days," Mogen told the outlet. "There's too many things that you can get caught up on, like DNA and videos everywhere. This isn't something that people get away with, that goes unsolved."

But that is obviously not true. And now that it's six weeks after the slaughter, it's looking more and more like this killer may escape justice, at least until he kills again.

I doubt there will be another killing. Something about these murders never smelled right to me. I think there is much more to the story, and I think it involves one or more of the kids being targeted. This seems like a one-off crime of passion.

Is it possible there is another Richard Speck running around killing random people in their homes? Yes. But this crime seems not the work of a serial killer to me.

A minor quibble about "free speech" here. You do indeed have a free speech right to defame and libel someone. The govt. can't "censor/prior restrain" such speech.

But, as this lunatic is learning, you are libel for damages said speech does in the case of libel and defamation.

Guillermo del Toro tells the story of when his father was kidnapped in Mexico when he was a young man. The police told him to shut the doors to any psychics because they would show up with promises they could never keep but the ability to take payment now.

He went home to find that his mother had let in at least one psychic who was telling her he could find her husband.

49 One of the best Penn and Teller Bullshit episodes was about psychics.

They videotaped a college class where the students were asked to fill out a survey, and then, some time later, they were given the results. But first, they were asked to raise their hands if they thought the descriptive paragraph applied to them.

Most of them raised their hands.

Then, one student was asked to read their paragraph, and it quickly became apparent that all of the students had the same paragraph in front of them.

True. But by "crime of passion" I don't necessarily mean a spur-of-the-moment outburst of violence. I think this was planned to one degree or another. But where I differ from the narrative is that I think one or more of the kids were deliberately targeted by someone who wanted them dead for specific, personal reasons. That's the "passion" aspect I was referring to.

It would also help if I had any confidence whatsoever in the competence of the LE investigating this. I don't. I think they fucked this up from the get.

But a careful person watches those shows, would surely wear gloves and a mask, take a safer route, be far away by the next day. Then again, most killers are pretty dumb, driven by ? rage.

I remember the scene from The Last Action Hero from when the movie villain crosses over into the real world. After incredulously watching a dude getting mugged on the sidewalk and having his high-tops taken, and the police don't immediately show up, the villain tries an experiment. He strolls into a nearby apartment complex, shoots a random person, and loudly announces his deed to one and all. No one calls the police, and a couple of people tell him to stop making noise! He considers the result for a minute, then smiles a most villainous smile.

The percentage is actually higher in that most murders consist of criminals killing each other. The police in urban areas often 'know' who killed who but proving it in court is almost impossible where almost all of that information comes from hearsay and nobody says nothing in official statements. That leads to gangs doing their own version of street justice in typically incompetent style by hitting bystanders as well.

142 I was on flight last month and the woman sitting next to me was a new tarot card reader. She had to consult this small, thick booklet to get the meaning of the cards she dealt.

One of stewardesses asked about the cards and the newbie gave her a free reading. The reading sounded just like a horoscope from a newspaper. "Beware of red licorice on Tuesday but a true schwanza awaits you at a gate in the coming weeks. Stay off cracked sidewalks and be sure to drink your Olvatine".

143 Most murder cases are solved by physical evidence left at the scene, or some sort of relationship between killer and victim. Without those, it becomes more difficult to solve.

Well you have to consider. You find a body, and its not suicide or natural death. Who could have done it? There are over 7 billion people in the world. Any of them could have, save yourself since you know you didn't. Now its up to you to narrow that down. If you have nothing to grab on to in order to make it easier, its going to come down to luck or somebody saw something and is willing to talk.

Usually, if it was targeted to a particular person, you'd expect 1 (or 2 if you think the boyfriend had to go) victims and the rest alive. If you had a cautious killer, he'd kill everyone in the house - better safe than sorry. Here, he killed 4 and left 2 - that's almost a "can I get away with it" type of killing.

I mean, knife killings are not always quiet. Granted, the theory is the other 2 roommates were sleeping/completely sloshed, I think...but that was a risky move, especially b/c smell alone can wake you up...and the sheer amount of blood was gonna lead to smell...

Suddenly she was dead and the body was hidden in bushes behind some tennis courts, after her phone pinged off towers miles away (the phone was on her body when it was found).

Within hours, the cops and the county prosecutor issued a statement that "no foul play" was suspected. Their rush to assure people everything is A-OK flies in the face of all the available evidence, but they are obviously determined not to find whatever malefactor(s) might be involved.

College town cops and county prosecutors don't impress me much.

201 I saw an interesting true crime show. A girl was raped and murdered in a maintenance room in the hotel where she worked. Although they had DNA, they couldn't find a match and none of the other evidence pointed to the killer. They did find a tiny valve that might or might not be related. Some weeks later, a detective takes his car into a tire store. While there, he over hears two employees discussing their suspicions about a third employee. The detective learns that the valve he found is a tire valve and that, apparently, when changing or repairing these tires, it's common for the tiny valves to be expelled from the tires only to be later found in employees' hair, cuffs, and pockets. Using these, he builds a case and gets a conviction. A chance conversation and learning what the tiny valve was broke that case. Something similar may happen here.

251 Uh, no. That would presume you've thought of every other possibility, something you can never know.

Well there was some confusion on what exactly deductive reasoning is.

In essence, he's right, deductive reasoning is systematically removing (deducting) all false conclusions until all that is left is the truth. But as you say, its usually impossible to remove ALL the alternatives, because they are nearly infinite.

Which is why he'd also use inductive reasoning, where you add up all the most plausible possibilities, until you come up with a total solution that is the most likely course of events.

Between the two you can do pretty well because most of the "possible" events that deduction examines are so implausible and stupid that they can be disregarded without further study: no, aliens did not arrive and build a pyramid that reflected the sun's light through a crystal skull through the attic window, causing a gun to go off and kill the victim.

281 If the psychic is expressing her OPINION that the professor was involved in the murder, it is only defamatory if it implies knowledge of defamatory facts. Like, "I have insider information from the investigating officer, and based on that information it is my opinion that she committed the murder." That type of statement could be defamatory even though couched as an opinion. However, if the psychic's opinion is clearly based on nothing more than Tarot card readings, then the opinion could not imply knowledge of defamatory facts and should not be actionable. The 1st Amendment allows our crazies to be crazy.

289 269 I may be wrong but from what I understand most standard police work is a playbook. What I mean is that these aren't rogue cops with a mission to find STREET JUSTICE, its a job you clock into and follow procedure step by step, and if that doesn't work you put it in the cold case file and start on the next one because you don't have free time to go after cases that aren't solvable by normal methods.
Posted by: Christopher R Taylor
--------
This case won't follow the standard protocol because of the number of people killed in one event. My guess which could totally be off base is that a relationship however tenuous exists of the killer and victims or the victims' families. Which is why they hold out a possibility of solving it.

Smart cops won't release much if any details of the crimes (which makes it difficult to determine if the cops are incompetent btw) and only ask the public for help for matters that do not matter if the fact is disclosed or not to the killer or even killers.

After all, it is possible that two were involved in the killings rather than one. Dual serial killers are rare but do exist.

Also its completion. Nothing says your client is innocent of a crime as well as finding the actual perpetrator. Just proving that the evidence is not sufficient to convict, well that doesn't exactly exonerate them.

The joke term for defenses is Toddi or Soddi. Toddi is the other dude did it (if two or more named individuals are involved), Soddi is some other dude did it (used to blame unknown persons or others related to the case). That is assuming the rarity of actually going to trial at all.

Then, you get some defense lawyers that pretty much do plea bargains for the guilty all day long while spending little time in court cases. They rely on their relationships with prosecutors and police (often they are former prosecutors themselves) to make advantageous pleas for their clients.

US murder case clearance rate is around half, and that doesn't include cases where there's no conviction - just an arrest.

This is the all time low, since the 1950s.

As the police state has grown enormous and gotten whiz-bang new tools like cell-phone tracking, DNA, video surveillance, etc., it has grown piss-poor at crime-solving, for the obvious reasons.

1.) They're dependent on the tools, and have lost the skills.

2.) Criminals, on the other hand, are not generally the retards popular culture portrays them as, and it doesn't take a genius to take a few basic precautions that circumvent the billion-dollar apparatus the cops have.

3.) Police agencies use the violence in the streets to justify more spending every election cycle, and have little motivation to re-learn that basic stuff.

Anybody who believes what CSI: Huuuur Da Durrrr says over the physical reality in front of their dumb faces whenever they go out at night is seriously checked out.
