SOURCES: McCONNELL BETRAYS US AGAIN; CAVES TO PELOSI AND SCHUMER, WILL PASS SPECIAL LAW ALLOWING LEGACY MEDIA COMPANIES TO FORM MEDIA CARTEL WITH ANTI-TRUST EXEMPTION

Of course. Of course.

The law would allow the media to form a monopoly cartel for purposes of negotiating with social media regarding the rules for carrying their stories.

The law would also allow legacy media to demand that social media not carry the stories of non-legacy media, or brand criticism of them "disinformation," or demand that social media companies limit criticism of them, or demand that criticism of them be banned altogether if the social media company wants to link their stories.

Or to demand that platforms exercise certain preferred censorship policies in exchange for the right of posting their stories.

Say goodbye to Twitter's brief period of relative free-ness -- this bill is designed to force Elon Musk to re-institute all the censorship policies that existed previously.

Attempts were made to add amendments to make it clear the bill should not permit that -- but Democrats blocked the amendments. Giving their legacy media clients/co-conspirators the green light to do all those things.

And McConnell just signed up for it.

Senate GOP Leader Mitch McConnell has caved to outgoing House Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer and will allow the National Defense Authorization Act (NDAA) to include the highly controversial media cartel bill the Journalism Competition and Preservation Act (JCPA), sources familiar with the matter told Breitbart News.

Over objections from House GOP Leader Kevin McCarthy, the likely next speaker of the House come January 3 of next year, other congressional leaders acquiesced to lobbyist pressure and agreed to include the JCPA in the base text of the NDAA. McCarthy was the only member of congressional leadership to fight back against the inclusion, but was overruled three to one after McConnell caved.

The JCPA has absolutely nothing to do with national defense, so the move--a swan song of sorts for Pelosi, who just announced she is leaving congressional leadership but retaining her House seat after Democrats lost the majority to the GOP in the midterm elections--is an egregious step for an outgoing leader of the past against precedent as the NDAA has generally been reserved just for national security matters.

Proponents of the JCPA have been struggling for over a year to move the controversial proposal through Congress, hitting roadblocks every step of the way in committee hearings and fierce opposition from Republicans like McCarthy and others including Jim Jordan, Steve Scalise, Marsha Blackburn, Tom Cotton, and more.

That's why lobbyists supporting the bill on behalf of deep-pocketed industry interests zoned in on two must-pass legislative vehicles in this lame duck session of Congress as last ditch efforts to pass it before the GOP formally takes control of the House next year: the NDAA or a spending bill like an omnibus spending bill currently also being negotiated.

But because the NDAA is proving to be more of a lift than previously thought, the prospects of an omnibus spending bill to fund the government are dimming in recent days--leaders may instead pursue a continuing resolution (CR) to fund the government at the year's end--which makes the NDAA a more attractive prospect for these leaders to attach unrelated proposals like this JCPA one to force them through in the waning hours of this Congress into federal law.

The JCPA, essentially a transfer of wealth from Silicon Valley to the discredited and distrusted corporate legacy media, is highly controversial. Beyond the financial payouts to media companies, they will be able to form a "joint negotiating entity"--a cartel, immune from antitrust law--to negotiate with Big Tech companies on the "terms and conditions" for carrying their content.

Censorship is sure to be a frequent demand of media companies. Despite provisions in the bill that purportedly stop media companies from negotiating the suppression of any one competitor, there is nothing to stop them asking their content to be prioritized over broadly-drawn categories that are used as pretexts for censorship, like "disinformation."

Breitbart News has closely covered how the bill continues to enable the censorship and sidelining of conservative media.

Democrats have been fighting to get McConnell to agree to an omnibus spending bill that would fund almost all of Biden's next year -- passed by a Democrat House.

Obviously, a Republican House would not deliver a spending bill on such generous terms. So Republicans have pushed for just passing a short-term continuing resolution to get us into next year, then undertaking the omnibus, when the situation is better for Republicans.

Sounds like the best plan, right?

Wrong -- Mitch McConnell wants the omnibus spending bill now, with maximum leverage for Democrats.

Why?

Because he's afraid that a Republican House won't fund Ukraine as lavishly as the Democrats would.

So he's prioritizing Ukraine over America.

Senate conservatives press McConnell to punt on omnibus
BY ALEXANDER BOLTON - 11/30/22 6:47 PM ET

Senate conservatives on Wednesday sent a letter to Senate Republican Leader Mitch McConnell (Ky.) urging him to skip a year-end omnibus spending package and instead insist on a short-term stopgap funding measure to punt spending negotiations into next year, when Republicans will control the House.

"We believe it would be both imprudent, and a reflection of poor leadership, for Republicans to ignore the will of the American people and rubber stamp an omnibus spending bill that funds ten more months of President Biden's agenda without any check on his reckless policies that have led to a 40-year high in inflation," they wrote.

Sen. Rick Scott (Fla.), who challenged McConnell for the top Senate Republican leadership job earlier this month, signed the letter along with Sens. Mike Lee (R-Utah), Ted Cruz (R-Texas) and Mike Braun (R-Ind.).

The senators wrote that Republicans "must not accept anything other than a short-term continuing resolution that funds the federal government until shortly after the 118th Congress is sworn in."

Republicans will control a small House majority next year, giving them more leverage over the top-line spending numbers of an omnibus package, as well as whether to include earmarks in the legislation, which some conservatives argue are a waste of money.

...

McConnell told reporters Tuesday morning that there was "widespread agreement" at a White House meeting between Biden and congressional leaders on the need to pass an omnibus.

...

The GOP leader softened his comments somewhat after meeting with the Republican conference during lunchtime Tuesday.

...

"It's a difficult choice, frankly," McConnell acknowledged. "If you're interested in reducing spending, probably the best way to do that would be a one-year CR."

"If, on the other hand, you're concerned about the defense of our country and the funding of the Ukraine war, you're somewhat hesitant to go in that direction," he said.

That's a difficult choice, huh, Mitch the Bitch?

And that's why he's giving the legacy media the power to demand censorship -- so he can get his Ukrainian funding in the National Defense Authorization Act.

I'm done.

I'm out.

Let it all burn.

I am officially out.

I've given decades to fighting for this miserable, piece-of-shit corrupt party. We make ourselves enemies of a vindictive state which harasses us, investigates, audits us, and imprisons us, and for what? So Mitch McConnell can make his little deals and sell us out every fucking time so the Democrats win anyway?

I'm done, it's over, fuck this, I'm blackpilled.

You win, McConnell. It's your party. It's all your party.

You go out there and you rouse the voters with your stirring speeches about... serving the corporate class, championing the corrupt government of Ukraine over the American people, and maintaining "collegiality" with your fellow corrupt plutocrat monsters.

You go out there with your electrifying band of vote-getters, your Lisa Murkowskis, your Mitt Romneys, your John Cornyns, your Richard Burrs.

You go out there and you win the Senate with your charm and your Murderers' Row of Millionaire Grifters.

I'm done.

I'll continue fighting the ideological/cultural war, but I'm done with the political one. It cannot be won, not as long as the Republican Party is just the controlled opposition of the Democrat Party.

I will not spend a single joule of effort fighting for corrupt, repulsive, China-owned McConnellism.

This is almost certainly a consequence of the Ukrainians striking Russia's main strategic bomber base at Engels, which is a long way from Ukraine. (Old Soviet-era drones were apparently used.)

Things may get sporty if the Russians think that NATO is starting to strike at Russia's strategic nuclear assets via its Ukrainian proxy.

The caselaw is quite complicated here--private actors are not able to do what they want nor do organizations, especially those engage in commercialization of speech, have unlimited ability to do so.

Cartels are often subject to state regulation as well under mini Sherman acts and I am not sure that Scotus and lower courts will not treat allowing some media to cartelize speech under government authority would not make them state agents which is not permissible nor allowing viewpoint discrimination. Essentially, Scalia and Kennedy are gone that would probably allow it. Roberts will blow in the wind, but Alito, Thomas, and possibly Kavanaugh, Barret, Gorsuch might not.

The Republicans will not spend one dime less than the Democrats. Possibly - but only possibly - on different things, but not one penny less.

This isn't about money and it's not about budgetary politicking. Those are just excuses. This is about Mitch McConnell and the GOP giving one more gigantic "fuck you" to the American people. It's a "smell the glove" moment.

Anytime the government gets involved in legislation involving the press either pro or con requires strict scrutiny even if spending is involved. Means that government must justify its spending and law by proof and supply evidence that it is not engaging in viewpoint discrimination.

Posted by: CrotchetyOldJarhead

The case involved forgiveness, not deferring repayment. General forgiveness under the emergency act from 9/11 is not authorized, deferring payments is authorized under a statute. Neither have issues constitution wise as Congressional spending, borrowing, and taxing clauses are almost absolute (except when the Bill of Rights is involved).

Simply put, no one today really wants what Jefferson proposed as the standard for necessary and proper laws as would even arguably rule out veteran benefits as not being necessary and proper to providing for an army and navy which are specific clauses in the Constitution. That would also make the Air Force and Space Force unconstitutional among other things.

So skeptical that this bill does anything regarding content in social media. Disfavored stories are already algorithmically disfavored. I think this is an attempt to find a way to force tech to pay media for content.

Not sure that media content is actually valuable to social networks though, so not sure all the political capital being expended here is worth it.

There is an exception to wiped away when you die, NEVER consolidate student loan debt with a spouse. If held separately, it is cancelled for an individual if they die or are disabled permanently. If consolidated together, the remaining spouse is on the hook.

Same with those parental loans. NEVER take them out to finance education--never, never, never. Go to a cheaper school or military instead to pay for it instead of burdening parents or co-signers. Yutes with those loans have died and left parents on the hook for those debts.

It was simply a stupid idea to go to war over two economic basketcase provinces. France did something similar with its obsession with Alsace Lorraine to its sorrow after losing them to the Germans. The Arabs have been lamenting losing territory to Israel for decades and are just now realizing that they have ignored other enemies to their states.

------------------------------

It's not as simple as all that. Putin isn't the untouchable dictator everyone makes him out to be - he still has to consider public sentiment and his allies in government.

Russian law doesn't allow him to send unlimited amounts of troops onto foreign soil, hence his "Special Military Operation", much like George W. Bush's AUMF in 2001 allowed him to get his foot into Afghanistan and Iraq, and then use the sunk-cost fallacy to keep ramping up our commitment.

Once the LPR, DPR, Kherson and Zaporhizhia oblasts had their referendum to join Russia, NOW it's Russian soil, and he can call up as many reservists as he wants, as they're not technically being deployed abroad.

As far as their battlefield successes, they have now captured 20% of Ukraine's land mass, secured a land corridor to Crimea, as well as secured Crimea's water and power supply from the Dnieper river which Ukraine cut off in 2015. And they're also destroying Ukraine's military, which we built. That's not exactly an L.

Closest guess from unverified sources is that is some form of misfolded proteins like amyloid proteins accumulating as plaque.

The mechanisms by which the vaxx and Covid attack make it seem like it is the spike protein and the body's immune response to it that causes abnormal responses by attacking organs.

One explanation for the sudden death circumstance is silent covid and vaxx spike damage to internal organs leading to shutdown because the vaxx trained the immune system not to respond to the spike allowing it to flourish and reproduce in various organs to their detriment.

412 I am afraid that Putin and his looters are about as competent as our elites from reading Russian sources on the debacle in Ukraine.

Simply put, if your society is rotten and incompetent in believing what is not so; your leaders will be too.
Posted by: whig at December 05, 2022 03:28 PM (bDjBG)

It's not primarily over the provinces, which as you note aren't that valuable. It is what they believe to be preemptive action to prevent NATO from using Ukraine to loop up into core Russian territory. Mutual misreading of intentions going on (though it doesn't help that the US was posturing at bringing Ukraine into NATO).

So he's prioritizing Ukraine over America.

War in Ukraine is part of China's plan to starve the free world. It also helps destabilize Russia which could be said their number 2 enemy.

Bad idea most generally as there are always other options usually involving cheaper schools.

Easier for courts to say no than yes in such matters as Scotus does not even have to hear it but simply allow a court of appeals to uphold a district court injunction. The whole Hawaiian judge meme came from a judge in Hawaii blocking Trump from enforcing the plain letter of the law. Other district court judges allowed the enforcement to go forward like in Boston but were not reported.

I simply made a remark, not a prediction, that it will end up in the courts and it might not find favor with them depending on how the new Trump justices rule.

458 The case involved forgiveness, not deferring repayment. General forgiveness under the emergency act from 9/11 is not authorized, deferring payments is authorized under a statute. Neither have issues constitution wise as Congressional spending, borrowing, and taxing clauses are almost absolute (except when the Bill of Rights is involved).

I'm not clear on where the 9/11 point is drawn from. The point (I'm not making very well) is that drool bib wearing kiddie sniffer is ignoring existing contract law under the guise of 'emergency powers' invoked for an epidemic he has publicly stated is over and yet no one in congress has the stones to voice that, let alone bring it in front of the court. And even if they did, SCOTUS has generally shown itself to be weak and submissive to the other branches.

490 It's not primarily over the provinces, which as you note aren't that valuable. It is what they believe to be preemptive action to prevent NATO from using Ukraine to loop up into core Russian territory. Mutual misreading of intentions going on (though it doesn't help that the US was posturing at bringing Ukraine into NATO). Posted by: Red Turban Someguy

The initial incursion was because the Russians alleged mistreatment of their own plus ire in the overthrow of their client Ukrainian president. Essentially the whole Russian policy smacks of the 19th century rather than the 21st and instead of promoting civil society in Russia, Putin sought to build his foundation on oligarchs, resource extraction, and supporting mischief in the Mideast, Venezuela, etc. to promote high oil prices.

It is and was a foolish belief that Russia was a superpower rather than a decaying rentier state. So, Putin made a gamble that he could pull off what he did in Georgia and in 2014 with the seizure of Crimea and parts of the Donbass.

I think regardless of the final result, it will be a pyrrhic victory if any for both Ukraine and Russia along with the rest of the world.

496 Yutes with those loans have died and left parents on the hook for those debts.
Posted by: whig at December 05, 2022 03:23 PM (bDjBG)

I decided a long time ago that I am only here on this Earth for my "yutes" - I would rather be burdened with their loans and their debts than them - after all, I forced them both to go.

I didn't take out very much in loans for their college educations because I could afford to pay for it, but what very little that is there is not for them to repay - I never had that growing up, I paid my way through college. But I spent a great deal of time paying for it rather than spending time on what college was for - it's a social status finishing school for young men and women - no trade is learned. You learn how to communicate and network. You will not learn a skill.

501 458 I'm not clear on where the 9/11 point is drawn from.

Higher Education Relief Opportunities for Students (HEROES) Act of 2003

There is no 'contract' law applying if one party decides that the other party does not owe what is paid. The debt is to the government and not to individual taxpayers. Since Frothingham, individuals have not been able to challenge federal spending decisions on the basis of being a taxpayer. Under the Flast exception, individual challenges are enabled for spending that violates the Bill of Rights. Student loan deferral does not but others may have standing to show the executive alone does not have a statutory or constitutional power to forgive it.

Depends on which colleges you go to and what major you do as to whether it is a finishing school.

There are better ways if a parent is bound to pay money for a kid's schooling which is a loan against assets rather than a family loan. Family loans are usually the worst of the bunch as far as legal protections versus std. loans.

And almost always, there are cheaper schools and opportunities around that provide an education with less debt than going to expensive schools and often the education at those schools is better than many of the premier schools in teaching one how to learn.

507 I join you with my blackpill. I have been a registered Republican since 1978 but no more. Time after time, the latte Republicans have sold us out, always with an excuse. In their little black hearts, they were thinking "who else ya gonna vote for?"

Well, no more. I may vote Republican if someone worthy is running but otherwise they get no further support from me, and I've contributed quite a bit to the GOP over the years. I'm changing my affiliation to Independent.

No more.

Marxist Mitch needs to be replaced.

524 "Because he's afraid that a Republican House won't fund Ukraine as lavishly as the Democrats would.

So he's prioritizing Ukraine over America."

Well, y'know, if the Republicans had shown any interest in WINNING THE WAR against the enemy that threatened to burn us all to cinders for more than 50 years, this might be a worthwhile argument.

Instead you keep trying to snatch defeat from the jaws of victory.

I can't say I'm fine with this - the media companies all need to burn to the ground, and they will, and this will delay the process a little - but if that is the price to be paid to make sure we, or Ukraine, or somebody, BREAKS RUSSIA, permanently - then, okay.

Russia, as a state, is something that is not capable of existing in a state of peace with its neighbors. It does not understand the idea of not attacking. It can't.

It has to be destroyed.
