Hawaiian Judge In Georgia Presumes to Overturn the State's Six Week Law on Abortion, Citing... Roe V. Wade; He Says Roe Had Been In Effect When the Law Was Passed

I don't expect this "reasoning" will survive an appeal.

A judge overturned Georgia's ban on abortion starting around six weeks into a pregnancy, ruling Tuesday that it violated the U.S. Constitution and U.S. Supreme Court precedent when it was enacted three years ago and was therefore void.

Fulton County Superior Court Judge Robert McBurney's ruling took effect immediately statewide, though the state attorney general's office said it filed an appeal. The ban had been in effect since July.

The American Civil Liberties Union of Georgia, which represented doctors and advocacy groups that had asked McBurney to throw out the law, said it expects abortions past six weeks of pregnancy to resume Wednesday at some clinics.

Kara Richardson, a spokesperson for Georgia Attorney General Chris Carr, said in an email that the office filed a notice of appeal and "will continue to fulfill our duty to defend the laws of our state in court."

Andrea Young, executive director of the ACLU of Georgia, said Tuesday was a "great day for Georgia women and for all Georgians."

"Today their right to make decisions for their own bodies, health, and families is vindicated," Young said in a statement.

Andrew Isenhour, a spokesperson for Republican Gov. Brian Kemp, said McBurney's ruling placed "the personal beliefs of a judge over the will of the legislature and people of Georgia."

"The state has already filed a notice of appeal, and we will continue to fight for the lives of Georgia's unborn children," he said in a statement.

Rep. Ed Setzler, the Republican from Atlanta suburb of Acworth who sponsored the law, said he was confident the state Supreme Court would overrule McBurney and reinstate the ban.

McBurney wrote in his ruling that when the law was enacted, "everywhere in America, including Georgia, it was unequivocally unconstitutional for governments -- federal, state, or local -- to ban abortions before viability."

Therefore, the state's law "did not become the law of Georgia when it was enacted and it is not the law of Georgia now," he wrote.

The state had argued that the Roe decision itself was wrong and that the Supreme Court ruling wiped it out of existence.

McBurney did leave the door open for the legislature to revisit the ban.

Now that the Supreme Court has overturned Roe v. Wade, the prohibition on abortions provided for in the 2019 law "may someday become the law of Georgia," he wrote.

But, he wrote, that can happen only after the General Assembly "determines in the sharp glare of public attention that will undoubtedly and properly attend such an important and consequential debate whether the rights of unborn children justify such a restriction on women's right to bodily autonomy and privacy."

Impeach and remove.

Setting the typical lefty framing aside, this is exactly what happened. The legislature passed the law. He doesn't like the law and suspended it with an illegal delaying action (the judge has to know that this will be thrown out) so that the post-runoff hangover (if Warnock wins) will compel the legislature to blink.

And it will probably work, in part because the GOP never expected to have to actually deliver on promises regarding abortion, and doesn't particularly want to do so. I suspect a lot of abortion restrictions will be blocked or rolled back over the next year, so that it can "be settled and in the past" come election season.

69 The frustrating part of the dissolution of Roe is that the opportunity to educate people through actual debate over the subject never occurred.

The battle lines are drawn in such a way that it's just an "issue". You're for it or you're against it. The "it" is never discussed.

And rather than states reflexively creating abortion "sanctuaries" or immediately outlawing it, we actually had the chance to change hearts and minds about what abortion is, what it looks like at various stages, the gruesome practices, the money-making demons who take orders for parts, as well as the heartbreaking stories of those who saw it as their only alternative.

But we just keep bashing each other over the head with sledge hammers. And dumb judges from HI will dictate what happens in GA.

Same here. Voted no on all the local judges. Also for my Rep. I voted for both the Democrat and Republican candidates (can still do that on paper ballots) since both were sleaze. My vote won't count, but can't be "cured" if I had left it blank.

They were actually very divided on the issue. At the time of the convention, there was a prominent impeachment trial--the Hastings trial in England. England only did a couple of impeachments more and then ceased the practice in the early 1800's.

In the debate, some argued that impeachment was in effect toothless and likely to be used as a political tool for a majority, others more defensively argued it was the only way to remove corrupt and/or traitorous officials. In the end, the second group won but the high bar for conviction means that the toothless and politically danger side was right. The other alternative of majority impeach and convict was never really considered.

I could actually sort of see the Judges view on this... a Law made something illegal... but that law was then overturned by the court... making said action legal.

The overturn of Roe however, saying that the original overturn of said law, putting the law BACK in place, would mean that anyone who broke said law, while it was not in effect, could potentially be prosecuted under said law. Thus creating an Ex Post Facto dilemma.

Ex post facto means prosecuting people under a law for their actions before that law existed, which is never the case here. There is no prosecution of people for their actions 5 years ago under this law. If someone was charged for their actions two years ago they presumably could point to a conflict with Roe in their defense, but that isn't ex post facto.

The judge in this case knows the law is currently valid, he just made a hamfisted excuse to throw it out because, as he explicitly stated, he wants to extract a political cost to passing it again.

Its value is only what others choose to accept because it is not backed by anything other than artificial scarcity from an algorithm. So, you must trust the algorithm, you must trust the holder of your tokens and the validity of the block chain, and you must trust that the value is somewhat stable so others will accept it for goods or services in the real world.

Bitcoin apparently does not have any informational security to prevent government from reclaiming it based on public ledger transactions. The Colonial pipeline ransomware and the recent tracking of a Silk Road bitcoin theft to a guy in Gainesville GA is another example of it. Monero is a bit more secure in theory dunno about Ethereum or lesser known crypto. Theft is also apparently fairly easy with a lot of these platforms.

Fiat currency has the same problem except that the Fedgov requires it and state/local govt to accept it as legal currency. Silver and gold are probably better stores of wealth if not appreciation (the banks are interfering with the metals market) because they are traditional stores of wealth.

If it gets bad enough, cans of food, booze, dope, medicine, etc. and a barter economy might strike up.

The USD is accepted everywhere because it is the medium on international trade, though that is slipping. However it has a lot of inertia so it is not going anywhere anytime soon.

Crypto has the benefit of being instantly cleared electroncially in a peer to peer fashion like an email, without the faffing around with banks and international credit. It also has that shared ledger which is fantastic for reviewing transactions.

When silver, gold and electrum were introduced as trading commodities they were as good as barley and goats, but more convenient. One of the big uses though was to write treaties, prayers and agreements on it since that way the promises made were honored as long as they were deemed more valuable than the metal. I believe crypto's principal uses will be those instead of as "money"

I don't think its just going to be a little bit bad. This isn't just another recession. Mainly because the great reset is really being pushed. A lot of money forces want that. They make more money off destruction and regulatory capture than they do slow growth. Also, structurally we no longer have an expectation of being saved by an outsider (Trump) because the elections are rigged. We'll at least get a great recession if not a great reset.

I don't think its just going to be a little bit bad. This isn't just another recession. Mainly because the great reset is really being pushed. A lot of money forces want that. They make more money off destruction and regulatory capture than they do slow growth. Also, structurally we no longer have an expectation of being saved by an outsider (Trump) because the elections are rigged. We'll at least get a great recession if not a great reset.

I dunno. What I do know is that it will hit the service and tech industries particularly hard as they have built up quite a lot of corporate bloat .
