Judge Rules FBI Agent Who Conspired With Meta (FaceBook) to Bury Hunter Biden Story Can Be Deposed in Lawsuit

Weird how Christopher Wray is completely disinterested in this.


A federal judge on Monday ruled in favor of deposing an FBI agent accused of "colluding" with social media companies to suppress the Hunter Biden laptop story.

Judge Terry A. Doughty of the Western District of Louisiana ruled that FBI Assistant Special Agent in Charge Elvis Chan must be deposed under oath for his alleged involvement in coordinating with Meta to censor the Hunter Biden laptop story prior to the 2020 election.

"Chan had authority over cybersecurity issues for the FBI in the San Francisco, California region which includes the headquarters of major social-media platforms and played a critical role for the FBI in coordinating with social-media platforms related to censorship," Doughty wrote in his Monday court order. "Even if Chan played no role in the Hunter Biden laptop communication issue, he may have knowledge of who did, and his deposition is nonetheless warranted."


The decision relates to a lawsuit filed in May against the Biden administration. In that suit, Republican Attorneys General Eric Schmitt of Missouri and Jeff Landry of Louisiana accused top-ranking government officials of working with the giant social media companies Meta, Twitter and YouTube "under the guise of combating misinformation" in order to achieve greater censorship.

On Oct. 10, the AGs identified Chan and 46 defendants in the suit. Chan was cited for his alleged "critical role" in "coordinating with social-media platforms relating to censorship and suppression of speech on their platforms."

The court on Oct. 21 authorized Chan's deposition, but Chan's attorneys filed a motion to reconsider that ruling, which was denied on Monday.

Chan argued through his lawyer that Meta claimed that he was not the agent who colluded with them.

But note that no one is here under oath saying that -- his lawyer is citing a claim made by Meta, not made under oath. (And a disputed claim to boot.)

The judge pointed out, correctly, that if he wasn't the agent who told Meta to bury the Hunter Biden laptop story, he can just say that under oath and have a very quick and easy deposition.

But of course he can't say that under oath, which is why he's attempting to avoid the deposition entirely.

Those bridges have now been destroyed, but instead of taking up positions on the east bank, they're apparently pulling back another 15-20 km (I haven't see confirmation on this other than the one article). The supposition is that they're trying to get out of range of Uke artillery on the west bank. However, they won't be out of range of HIMARS or other assets, and the Ukes will almost certainly establish a bridgehead on the east bank as soon as they can. This will bring the Ukes even closer to cutting off Crimea.

Can anyone make sense of this from a military perspective?

They might accept something like in former Yugoslavia, where the UN takes over as a peace keeper, but this would be solely a fig leaf for Putin. Sooner or later, it'll revert to Ukraine.

I've been wondering how the Ukes would continue the offensive with the Dnieper in the way, but now it'll be much less of a challenge, and they clearly have the military momentum. Trap, any crossing with be concentrated and it will be Ukes that have problems with logistics. Also gives a breather to Russian troops and allows redeployment to other theaters. I think Kherson was a political prize not a strategic one unless the Russians were planning on rolling up the Ukes all the way to Odessa. Once that option closed, little sense in retaining it as logistics would be difficult and the troops would be in meatgrinder where the Ukes would be able to probe and attack at weak points but the Russians were stuck due to difficulty in reinforcement and logistics.

Smart move by Russia for a change.

Husbanding ammunition doesn't necessarily mean they're out, could indicate they're low. We had a couple battles in the American Revolution where we started firing much closer due to being low on ammo, still able to put up a good fight from the right positions.

I mean the Ukrainians could gamble on them being nearly out of ammo and try to cross and push as rapidly as possible so it doesn't end up with them pressed against a river(Russia sitting just over the river was their mistake, leads me to believe they didn't originally plan to take the city and opted to when it looked like Ukraine might capitulate), but I don't think is a bet most generals would take.

This is a civil case. I think it would be up to the plaintiffs in the lawsuit -- the AGs -- to seek sanctions against Chan for perjury. Good luck with that. Possibly a state prosecutor could prosecute a perjury charge, but it's highly unlikely.

Not really, the Russians have been having difficulties in getting the Ukes to concentrate. A trans Dneipr assault would do that for them so the Russians could use their traditional artillery barrages and missiles effectively. By trying to contest the entire Dneipr bank with forward deployed troops risked what the Germans did in Fortress Europa. Spreading everywhere is a recipe for weakness and if no mobile reserve exists, is a recipe for failure.

Same reason Israelis pulled back to Golan Heights as it was defensible rather than the plains leading to Damascus.

1st Amendment lawsuit--if Meta etc were acting as agents for the federal government then a) they can be punished for constitutional actions (no sovereign immunity attains to them), be subject to consent decrees governing their conduct going forward banning coordination with government, and c) a similar requirement for teh Feebs, Homeland Security etc. as they are not permitted to censor viewpoints nor would be their agents.

Arguably under Six Unknown Federal Agents v. Bivins, there could be both financial liability for those individuals that did the constitutional violation as well as agency liability. Bivins was narrowed a bit later but all of those rulings during the Burger and Rehnquist era are beginning to be reevaluated.

I saw that, if you're referring to that small peninsula at the mouth of the Dnieper. They were special forces, and they were running up the peninsula, liberating towns, but I couldn't see how that was sustainable in the long term without a major push and logistical support.

That's a much better play than a direct crossing. Smaller forces conducting skirmishes and guerilla operations crossing piecemeal. You need intel and to force the Russians into specific positions to create a safe crossing location (which is still a hell of a mountain to climb even when doing it correctly). Keep poking in the hopes they make a mistake.

They're sticking their heads into the same noose that Surovikin just pulled his forces west of the Dneiper out of. It's relatively easy to cross near Kherson, because the river is narrow and shallow there.

The danger for the Russians was that the UAF blows the Kharkova dam and washes out all fixed and pontoon bridges, trapping 30,000 troops on the Kherson side, with no ability to reinforce or supply except by air.

If Ukraine starts pushing significant amounts of troops and materiel across, they risk being stuck on the wrong side of a now 2-mile wide river that's impossible to bridge.

Every attempt they make to land troops near Energodar or the Kinburn spit, where the river is that wide gets detected and destroyed almost to the last man.

I think it's unrealistic to believe there is a large disparity between Ukrainian and Russian troops. Russians are probably getting a better casualty ratio (American Revolution is another decent reference) but these are extremely similar civilizations, born of the same military structures in relatively recent time periods.

Ukraine has been able to rely on a numbers advantage from drafting huge numbers of people, whereas Russia started this war with something approximating parity to Ukraine's standing forces. As Russia's recent call up fills out the lines, it'll turn more into a purely logistical affair.

You are very likely correct on the state.of the Russian forces, but if they are fighting IAW their doctrine, they will establish a main defensive belt about 15-20 kms from the front line (in this case the river). This allows their artillery to range throughout the depth of the security zone that is the area from just across the river to their main defensive line.

You just can't break trenches like the Napoleonic warfare and prior days where morale was king, not without tanks.

On paper, assuming Russia didn't escalate further(big assumption), Ukraine could win if provided with a couple thousand tanks. The West has consistently denied requests of this nature, possibly out of fear of escalation.

No, it won't kill men by the thousands, but think about the impact on morale knowing that you could die at any second and have no idea it's coming. There's a reason the Russians are using blocking battalions (aka shoot the retreaters) and the Ukes aren't.

I doubt the plaintiffs will agree in this case to such a motion. The defense will undoubtedly raise it subsequently but it weakens their attempts at dismissal to raise it now. Essentially, the Otter Animal House defense does not play well.

I would sell Meta short for other reasons but this does not help as it continues to be pinched in ad revenues from Apple and Google and the Metaverse seems to be a bridge too far. Someone in the future may benefit for Fakebook blowing billions into it (like Apple benefited from Xerox PARC project) but it will not be Fakebook investors.

Given how cautious they've been in assaults I'd be seriously skeptical of any reports regarding use of barrier troops. Russia has generally been acting extremely casualty sensitive. If they were willing to tolerate higher losses they could have closed things out much more quickly.

Ukes captured about 440 intact tanks of various kinds, 650 other armored vehicles in Kharkov battles in Sept. About a 100 or so modernized T72 Czech tanks are being supplied by the latest arms deal apparently. About half the Uke tank force is composed of captured Russian tanks and probably the disabled ones left by departing forces gives quite a bit of spare parts to keep them running.

Not the several thousands that you estimate they need though. Not sure that many tanks are even around anymore in the West.

My favorite one of those was in Utah. It was a billboard advising that people be cautious in construction zones. It showed a picture of a construction worker in a work zone and read, "These guys don't have airbags. Go slow through the Cone Zone!"

Essentially when Russia conceded the offensive to Ukraine in September, their front was overextended. So, the Russians behaved as they have in the past but their decentralized way of recalling reserves and conscripts based on region was haphazardly done leading to training and supply collapses. Apparently politics has also limited callups and conscription in St. Peterburg and Moscow areas which means a lot of non Russian ethnics from across the Federation are being snared instead.

My guess is that you are getting a real mixed bag from this which does not do much for unit cohesion and functioning.

BoA SA we made finals, but technical issues nabbed us 13th, our worst BoA finish EVER.

UIL, we did ok, but our band director's young daughter (sophomore) had 2 oboe solos and botched the 2nd one in Finals gaining us 9th, our 2nd worst UIL Finals finish ever.

Said director doesn't have a whole lot of fans at this point.

Banks will also loan money to fund those investments.

If global warming was real:
1) They would be legally required to disclose and quantify that risk to investors-- none of them do.
2) banks wouldn't dare lend on that risk ( even with floodinsurance)-- but all of them do.

It's all bullshit because none of the people calling it a crisis are actually acting like it is.
