Supreme Court Accepts Cases Challenging s.230 Immunity for Tech Monopolies

This is a dangerous case. This isn't a win for Team Freedom, I don't think.


The Supreme Court said Monday it would take up a case that could fundamentally change the way Google and other tech companies are governed by Section 230 of the Communications Decency Act, which protects them from lawsuits over content created by users.

In 2015, Nohemi Gonzalez, a 23-year-old U.S. citizen studying abroad in France, was murdered by ISIS terrorists who fired into a crowed bistro in Paris. Her family filed suit against Google, arguing that YouTube, which Google owns, aided and abetted the ISIS terrorists by allowing and promoting ISIS material on the platform with algorithms that helped to recruit ISIS radicals.


Lawyers for the Gonzalez family argued in their petition to the High Court that "despite extensive media coverage, complaints, legal warnings, congressional hearings, and other attention for providing online social media platform and communications services to ISIS, prior to the Paris attacks Google continued to provide those resources and services to ISIS and its affiliates, refusing to actively identity ISIS YouTube accounts and only reviewing accounts reported by other YouTube users."

Google is arguing that its platforms are protected by the Section 230 portion of the Communications Decency Act of 1996, which provides a legal shield to internet companies against lawsuits for "third-party" content posted on their platforms.

I say it's a dangerous case because this seems to me to be a case where Section 230 is actually intended to provide immunity. And I'm afraid the court might, in affirming that, over-affirm that point, and wind up granting these monopolies the power they claim they have, which is an untrammeled right to censor, whether in good faith or bad, without any liability whatsoever, and to make what are clearly publisher decisions, including about what stories to elevate and which to suppress and what headlines to themselves write -- again, with total immunity afforded to no other publisher in the world.

It's also dangerous because the argument that "the algorithms must be changed to stop speech that 'causes harm'" is the leftist censor mafia's entire argument, and that is the central legal claim of this case. If the family pressing the lawsuit prevails on its theory that the tech companies are at fault for not tweaking their "algorithms" to suppress "harmful content," then all the tech companies will say that their censorship of "anti-trans" and "anti-gay" and "anti-woman" and "anti-minority" and "anti-Muslim" and anti-etc. content is no longer just their choice -- it's required by US law as mandated by the Supreme Court.

A good outcome would be for the Court to affirm that s.230 immunizes platforms against harms caused by the writings of third parties -- but then adds dicta (advisories not directly related to the case or necessary to the ruling) that such immunity is available only to platforms when behaving as platforms, and only when they are acting in good faith.

Maybe add a footnote reminding that s.230 caveats its immunity on the premise that moderation will be done in "good faith."

That could then be used as precedent in a later ruling.

The really dumb thing about this debate, though, is that we're like prisoners with the key to our cells hanging around our necks. Simply unplug the big techs (is FB or Twitter actually that important n anyone's life?), though I will admit it is very difficult to get away from Google.

My gut check reaction is to say that there is zero chance of this happening, but the Roe decision has given me some hope to the contrary.

That said, I will amend my gut check to assert the chance of this happening merely approaches zero.

26 The current state of the law is untenable, but the correction may be worse. The Courts aren't going to solve this problem. Congress won't solve this problem. The States are probably in the best position to do a course correction, but I don't like those odds either. In short, we may be screwed for a bit.

Social media isn't really like anything we've had before and there needs to be thought on liberty, economics, and how to classify them. They aren't a utility. They aren't merely a business. I heard it being discussed this morning. Something like 50% of the population now gets their news from social media. Imagine the bias when only conservatives are removed. As is the case now. And Trump still won in a landslide.

Related, there was a video floating around in 2020 by a Hillary supporter discussing how Google could influence 14M votes on election day by simply reminding Democrat voters - known by their search histories - to go vote via banners on the home page and pop ups and such, while Republican voters didn't get anything on their phones.

I don't see the big tech firms themselves listed, so what's the mechanism? A handshake agreement? A contract? Promises of eternal friendship? What's the process on the big tech side.

Because a bunch of assholes setting up a site to "file tickets" is meaningless if the other party doesn't service those tickets. If this is meaningful, it's because those tickets are actually getting worked, which is obvious cartel behavior. These firms should have been broken up under antitrust laws ages ago.

This case should be decided as narrowly as possible. The solution to the big tech censorship problem isn't some new rule or - G-d forbid - some blue ribbon commission for online fairness, it's to break up the big tech monopolies. When one of the descendant companies - or some new company - achieves a new monopoly (which will always happen in social media at least, since social media depends on network effects), break that up, too.

The thing is, though, is that it's not as hard as it seems. We were doing just fine when Google, for instance, was the best search engine in 2015. Today, even the worst alternative search engines are at least as good as that. It's not like we need search to be much better than that to get along just fine now.

You're a platform? No censoring except for what's already illegal, i.e. kiddie porn, but then you can't be sued.

If they are going to frame that ISIS propaganda was outside their control then why was, say, their political meddling within their moderation? One involves a radicalized jihadist, the other case involves someone killed by jihadists and the Anti Terrorism Act allowing lawsuits over that.

FWIW, the court may also accept the current 11th circuit and the 5th circuit split regarding whether states may regulate big tech or whether federal law preempts this under 230.

Virginia law says that minors - of ANY age - MUST be considered adults in terms of health care treatment for the following: mental health, STDs, birth control, pregnancy or family planning, substance abuse. If a minor does not want to have medical information shared with a parent on one of those topics, the medical provider may not even confirm or deny that they are treating that minor.

I don't know how many other states have that, but I suspect that the groomers will use this law to circumvent the new school model program for trans.

Authoritarians want more thought crime prevention, which is what the Gonzalez family is asking for in this case. Anti-authoritarians should fear this case, if you fear the SCOTUS is squishy. It amazes me we are so degraded that the Gonzalez case even gets this far.

The answer is simple and, therefore, will never be implemented.

1. If you censor something at the behest of a government, you are bound by the restrictions on governments.
2. If you are not subject to item 1 AND you choose to censor, you must clearly, and specifically, detail what you censor. Failing to do so is fraud and you will be punished accordingly.
3. You are not permitted to coordinate with any other tech/media organization towards censorship. Doing so makes you an illegal cartel and you will be punished accordingly.
4. If you organization holds >80% of the market in a particular area, you are a de-facto monopoly (the Microsoft rule) and you are permitted no freedom to coordinate/censor/control anything.

Which means they cannot challenge Texas's law on First Amendment grounds by arguing that they are not platforms, but publishers. If they are not publishers, they have no First Amendment protections.

We need a national version of Texas's law.

If they collude independently which is happening, they can be sued on antitrust grounds and many states have state versions the Sherman Act in state law as well. The tech social media companies are being faced with nibbling by ducks at a time when online ad revenues margins seem to be declining and they are making themselves hated by general citizens.

Ugh. The law states "shall not be treated as a publisher of speaker".

That's the problem. They are, and they are not being penalized for it. Where they should be liable is under section 2, civil liability. On my opinion because they are selectively using their process to target certain types of speech, and not others. They are using their process in a discretionary manner. So it's not that they don't have the capabilities. I would argue they do, and are using it in a manner inconsistent with the ability to escape civil liability as the law is written.

Yeah I agree. Its basically impossible, short of telepathy, to chain some video to someone's action. Call it the "Schitt's Creek" test. One of the things I recall from that show is that the gay guy (and later his partner) were most often shown having normal everyday problems, and normal everyday couples problems. There was very little focus on acceptance. Everyone was pretty much cool with it from the start.

I even remember reading commentary from LGBT folk about how much they enjoyed that not all the conflict was about sexuality.

Denial of cert establishes no precedent. The case was turned back to district court for a trial. Once again, interlocutory appeals (granting cert, when the lower courts have not issued a final ruling or judgment and bypassing the appellate process refusing an injunction) is not the same thing as ruling on merits of the case. Current precedent allows the vaccine mandate for even citizens under Jacobson v. Mass but arguably federalism might be an argument that could be used to narrow that decision.

It is cold comfort for health care workers but that is the way that Scotus rolls usually and Medicare/Medicaid funding laws give FedGov a big statutory say in how the healthcare system is run.

That whole incident was insane. It can't even be summed up succinctly without cutting out a lot of important details. The cult was weird as hell.
