THE MORNING RANT: Utterly Predictable Fraud at “Zero Emission” Vehicle Startup, and the Prominent CEOs Who Fell for the Hoax

You’ll never believe this, but the founder of a snake oil “zero-emission” vehicle start-up is being tried in federal court for engaging in fraud against investors.

Nikola Motor Company had been promising zero-emission heavy trucks and various forms of zero-emission personal vehicles (including electric vehicles) for years, and because EV fanboys are so desperate to be seduced by smooth-talking confidence men promoting the EV vision, Nikola’s founder, Trevor Milton, had a huge number of people ready and willing to be fleeced to invest.

Nikola Corp. founder accused of fraud in trial's opening [AP – 9/13/2022]

In 2020, Nikola's stock price plunged and investors suffered heavy losses as reports questioned Milton's claims that the company had already produced zero-emission 18-wheel trucks fueled by hydrogen gas.

The company paid $125 million last year to settle a civil case against it by the Securities and Exchange Commission. Nikola, which continues to operate from an Arizona headquarters, didn’t admit any wrongdoing.

You’ve got to appreciate Milton’s moxie. Investors have been so brainwashed by the sustainable, green evangelizing of politicians and the media, that they were desperate to throw their money at Milton. He even produced a pretend vehicle to keep people excited.

In his opening, [US Attorney Nicolas Roos] promised that witnesses would show that Milton was committing fraud when he staged an “unveiling” of what he described as a fully functioning truck that was actually missing major parts like gears and motors and that had to be plugged into a wall's electrical socket to turn on its lights.

But there were videos of it rolling down the highway!

Well it was “rolling” all right. “Coasting” might be a more accurate term.

Roos said Milton “doubled down” with the fraud a year later when a video was released that showed the truck supposedly operating when it was really just rolling down a hill.

What about “pre-orders?” As I’ve written about recently, part of the EV scam is press releases, enthusiastically promoted by a credulous media, which generate excitement by talking about a huge number of pre-ordered vehicles.

Roos said Milton also was lying when he claimed billions of dollars in orders had been booked. In reality, the prosecutor said, 95% of the reservations were “just expressions of interest, but were reservations that could be canceled at any time.”

Here’s a short video with Mr. Milton repeatedly stating that “This is a real truck. This is not a “pusher’.” Real trucks produce their own propulsion. This one was propelled by gravity. It was not a real truck.

Speaking of People Duped by Nikola and Trevor Milton…

Among the gullible suckers duped by Mr. Milton was…the CEO of General Motors.

Trevor Milton founded buzzy EV company Nikola and positioned himself as the next Elon Musk—then his $34 billion house of cards came crashing down [Fortune – 9/13/2022]

He even duped a gullible General Motors, who signed a partnership just weeks before his elaborate ruse was uncovered.

When GM signed the deal, CEO Mary Barra failed to properly explain what technology her company was actually securing. Hindenburg Research was convinced GM merely looked to bask in the collective shine of its charismatic founder, “a forward-thinking, fresh, visionary entrepreneur capable of rivaling Elon Musk’s allure.”

GM has thousands of employees who could have quickly sniffed out this fraud, simply from their expertise in operating, designing, and manufacturing mass market vehicles. Unfortunately for GM, their CEO is not one of those employees.

Not only did Mary Barra take the bait on the Nikola fraud. She has swallowed the EV fad hook, line, and sinker, promising that GM will go 100% electric by 2035. Although I love to laugh at woke fools in corporate executive suites, it breaks my heart that Barra and her fellow GM executives are taking actions that will destroy a once-great company and put tens of thousands of American workers out of their jobs.

If anyone is working on a perpetual motion machine, or perhaps a machine that can spin straw into gold, give your contraption an eco-name of some sort, and then give Ms. Barra a call. You can bet she’ll throw some of GM’s remaining treasure at it.

*****

And Still Speaking of Nikola and Awful CEOs

Did you notice that the Nikola truck in that video had the livery of US Xpress on it? But of course.

Nikola - US Xpress.JPG

As I documented a couple weeks ago, US Xpress went woke in 2021 and now it’s in deep financial peril, furiously letting go of staff as its stock price tanks and it hemorrhages cash.

Mr. Fuller made it very clear that the focus of his leadership had nothing to do with shipping goods, or making a profit, but instead on things such as creating “a safe space for open dialogue about important issues that impact women, the LGBTQ+ community…”

Actually, you could predict exactly what happened next - the company started circling the drain. It had a massive financial loss in the first quarter of 2022 and then laid off about 5% of its workforce.

Did that cure US Xpress’ woes? No, it did not. Another awful quarter just led to another massive round of layoffs.

US Xpress’ death-by-mismanagement was clearly foretold when looking at old headlines such as this one from back in 2016…

U.S. Xpress to add Nikola’s hydrogen-electric truck [Fleet Owner – 12/13/2016]

U.S. Xpress Enterprises Inc. announced that the company is one of the first and the largest truckload carrier to order the Nikola One. The company said it expects the zero-emission, hydrogen-electric semi-truck will be a part of its fleet when the Nikola Motor Company starts production in 2020.

Seriously, is there an easier mark than a woke, left-wing CEO?

Songs of the Season

Harvest Moon.JPG

Enough about the EV scam. It’s Friday, and it’s the most wonderful time of the year – early Fall!

So whatever happened to Harvest Moon being a thing in early Fall? In my younger days, the first school dance was likely to be the Harvest Moon Dance. There were Harvest Moon festivals, and the first autumnal advertising was likely to invoke the Harvest Moon.

The Harvest Moon is usually in the latter part of September, and sometimes even in early October, but this year it came early, on September 10.

Here’s a beautiful version of Neil Young’s “Harvest Moon” that is fully compliant with Throckmorton’s Law. Have a great weekend!

10 Going Green, written by Robert Flocius, Partner at Boston Capital.

Probably the best post ever published on the subject of zero-emissions. Definitely worth the read!

"Batteries do not create electricity – they store electricity produced elsewhere, especially through coal, uranium, natural-powered power plants or diesel-powered generators.” So the claim that an electric car is a zero-emission vehicle is not true at all.

Since forty percent of the electricity produced in the United States comes from coal power plants, thus forty percent of the electric cars on the road are carbon-based.

But that's not all of it. Those who are excited about electric cars and a green revolution, should take a closer look at the batteries, but also wind turbines and solar panels.

A typical electric car battery weighs a thousand pounds, roughly the size of a suitcase. It contains 25 pounds of lithium, sixty pounds of nickel, 44 pounds of manganese, 30 pounds of cobalt, 200 pounds of copper and 400 pounds of aluminum, steel and plastic. There are over 6,000 individual lithium ion cells inside.

15 To make each BEV battery, you'll need to process 25,000 pounds of salt for lithium, 30,000 pounds of ore for cobalt, 5,000 pounds of resin for nickel, and 25,000 pounds of ore from copper. In total, you have to dig out 500,000 pounds of dirt for a battery.

The biggest problem with solar systems is the chemicals used to turn silicate into the gravel used for the panels.

To produce sufficient clean silicon, it must be treated with hydrochloric acid, sulfuric acid, fluoride, trichlorotane and acetone.
In addition, gallium, arsenide, copper-indium-gallium diselenide and cadmium telluride are needed, which are also highly toxic. In addition, silicone dust poses a danger to the workers and the tiles cannot be recycled

Wind turbines are non-plusultra in terms of cost and environmental destruction.

Each windmill weighs 1,688 tonnes (the equivalent of the weight of 23 houses) and contains 1300 tonnes of concrete, 295 tonnes of steel, 48 tonnes of iron, 24 tonnes of fiberglass and the hard-to-win rare soils Neodym, Praseodym, and Dys to prosium.

16 Each of the three blades weighs 81,000 pounds and has a lifespan of 15 to 20 years, after which they must be replaced. We cannot recycle used rotor blades.

Admittedly, these technologies can have their place, but you have to look beyond the myth of emission freedom.

“Going Green” may sound like a utopian ideal, but if you look at the hidden and embedded costs in a realistic and impartial way, you’ll find that “Going Green" does more damage to earth’s environment than it seems.

I'm not opposed to mining, electric vehicles, wind or solar energy. But this is the reality of the situation.

Zero emissions is such a silly phrase.

Approximately ten seconds of mild brain work tells you this not only isn't possible, but that any emissions reduction will be small, unless you generate nuclear power.

About ten more seconds of moderate brain work tells you, working from an assumption of coal-derived power, that the increase in methane from mining more than offsets the (very, very presumptive) benefit of the small reduction in CO2.

Without nukes, the zero-emissions vehicle has always been a risible idea.

90 GM has thousands of employees who could have quickly sniffed out this fraud, simply from their expertise in operating, designing, and manufacturing mass market vehicles.

Hell, back twenty years ago, when I worked for a famous tractor and tire company, the corporate leadership bought into every bit of laughable crap that floated down the sewer in front of them, as long as it thoroughly saturated in the catchy catch-phrases of the day.

The conceptualization of their shifting paradigms resulted in the weeks long training programs where us employees were given things like a brass egg. Which we were expected to polish. (Outside of the trainers hearing, we referred to these as turds) I couldn't begin to guess how much money corporate spent on these boondoggles, but I know this, I experienced it....over the twenty years I worked there, there was always another on deck which was kicked off with much corporate fan-fare just as soon as the previous one faded into obscurity.

This is nothing new, and you can bet your shrinking 401k that they're already preparing to roll out the new, New, NEW GM right now. Coal was the second-largest energy source for U.S. electricity generation in 2021—about 22%. Nearly all coal-fired power plants use steam turbines. A few coal-fired power plants convert coal to a gas for use in a gas turbine to generate electricity.

What they always mean (and what is in the fine print), of course, is "Zero *Tailpipe* Emissions." It's a form of NIMBYISM. The emissions don't come out of my car - in fact, they come out of some dirty power plant far away from me - and so they do not, in fact, exist.

Just like the input materials. Lithium mining is filthy, environmentally destructive, exploitative of child labor and pays the miners a slave wage for high-risk work, but all of that happens on some other continent and so it, too, does not exist.

Honestly, the state sounds like they are in the right...if she didn't have a college degree, and thus no possible career outside of minimum wage, after you broke up...then, the cheapest option is to have you pay the degree and then end the alimony once she graduates.

Way cheaper than permanent alimony for life...so, you got off very lucky...

I countered that these were different concepts. Man could not fly. I added that if he imagined that we could, surely we could go to the roof of the building and he could test his thesis. He did not take me up on the challenge.

146 There is a psychological phenomena in fraud whereby the victim is more likely to take a chance on the fraud if the payout is higher.

In other words, if someone proposed something sketchy for a return for only $100, and you had low confidence in the proposal, you would decline.

But, if the person promised $100 million for the same sketchy proposal (Or promised to save the planet from global warming) people are more likely to agree with the plan and fall for the scam.

A technical, engineer type absolutely savaged the company a couple weeks ago when Rolls Royce pulled out of an agreement to supply engine technology to BOOM. So, basically this still on the drawing board plane now has no engines.

Yet... United AA put in an order for several of these planes. That don't, and probably won't exist.

That person gets made whole by being able to pursue a career if you ditch them - if that means getting the degree later, that's what it means.

It's a great incentive to be smart about who you marry and to not just ditch your family and kids on a whim.

Now, if you want to limit alimony years to number of married years, we can talk...

Nope. You have been telling me it's a commuter. It is. It's boring as heck, too. I don't care if it goes fast in a straight line. It's still boring. I'd rather look at a 1986 Grand National any day of the week.

Way cheaper than permanent alimony for life...so, you got off very lucky...

One of the major problems they are having with hydrogen fuel is that it has to be converted into what they call Blue Ammonia so it is stable to transport. No real practical way to do that.

My theory is that there's a spike in divorces -- or couples seriously considering divorce -- because of CV19. Couples who were unhappy going into CV19 lockdowns only became more unhappy, and now that CV19 is "over" they want out. Couples that were on the fence were forced to really live with each other during the lockdowns, and that made things worse and now they want out.
