The Fake News Crew Claims, Without Evidence, That the FBI Did Not Seize Trump's Passports

More lies from the Truth Tellers.

Reportedly, CBS is considering not renewing Norah O'Donnell's contract. She's reportedly a diva and a b-word and her ratings aren't good.

The DOJ spun her with a claim they weren't "in possession" of the passports -- note that that's not a denial of having stolen them in the first place, just a lawyerly claim about not currently being in possession of them -- and Norah rushed right out, without asking follow-up questions, to claim this meant the DOJ was contradicting Trump.

The DOJ later confessed the truth: The FBI had stolen the passports.

There was no search warrant signed by an Epstein lawyer for these passports so they were illegally stolen by Biden's Gestapo.

Norah had better be careful. There must already be chatter that she's too old to be a news anchor. Stupid Senior moments like this only add to the perception that Granny Norrie needs to be put in an Old Anchors Home.

Of course, the Smart Set of NeverTrump completely failed to notice that the DOJ, in claiming they were not "in possession" of the passports was pointedly not denying they had previously been in possession of them.

That's because they're so smart!!! And so honest and honorable! They're so truthful they can't even comprehend that others might twist the truth!

Leftwing propagandists and Gestapo supporters Adam Kinzinger, David Frum, and Peter Strzok -- the last, an actual Gestapo agent -- seized on the lie and propagated it:

The leftwing Gestapo press is now attempting to blame and shame Trump for publicizing the FBI's illegal seizure of his passports, as if he's in the wrong to do so.


As if he's required to keep secrets for them.


And why should he? This seems very shady. The FBI seems to have "forgotten" to note that they stole the three passports on their post-raid inventory report, like they were covering up, yet again, one of their crimes.

The inventory list is required to be a complete and exhaustive list of all property and documents taken from a citizen, of course, so a citizen knows what was taken from him, and there's a record of it, so he can get it back.

But the FBI left the passports off of it.

Just another careless oversight, I'm sure.

Law enforcement can't just take a person's passport without a judicial order restricting a person's travel. Trump hasn't even been charged with any crime, let alone be made subject to such a bail condition. He has every right to travel outside the US, and every right to retain his passports.

The FBI suggested that the removal of the passports was an accident:


"In executing search warrants, the FBI follows search and seizure procedures ordered by courts, then returns items that do not need to be retained for law enforcement purposes," the spokesperson said in a statement Monday evening that did not mention the passports.

This seems like an odd explanation. Trump almost certainly did not store his passports with the government documents that the search warrant targeted. Those are items usually stored in a secured personal space, like a safe or perhaps a locked desk drawer (or maybe a dresser drawer?). It's not the kind of item that would have been easily swept up by accident even in a broad search, in other words. It's possible, but appears unlikely unless this was one of the clumsiest search-and-retrieval operations conducted by the FBI.


That brings us to the second question: Why weren't the passports listed on the inventory? FBI agents certainly know what passports look like. The inventory is a legal record of everything the FBI took out of Trump's home in executing the search. There may be some understandable fuzziness on the identity of each and every single sheet of paper in those boxes, but passports are unique and instantly recognizable -- and look nothing like the documents in question. The inventory was specific enough on August 8 to include separate entries for "handwritten note," "Executive Grant of Clemency re: Roger Jason Stone Jr," and two entries logging "binder of photos."

But no one noticed three passports? Again, this either indicates that the FBI conducted this raid in an incredibly sloppy manner, or something else is afoot.

Of course, this makes sense if the entire exercise was a pretext in order to simply grab as many of Trump's personal documents and confidential correspondents with lawyers as possible in order to contrive a legal case against him.

But I'm sure we should continue giving the benefit of the doubt to the agency that has already been found to have lied repeatedly and found to be without candor and integrity by the Inspector General. And which was supposed to create an action plan for addressing its habitual departures from the truth, but didn't even bother sidelining the agents directly responsible for all the Russiagate lies. In fact, the FBI just assigned them to lying about the Hunter Biden laptop.

We are not living in a democracy nor a republic.

The IRS can seize your passport administratively if you have a tax dispute with them.

If you owe more than $5,000 in child support, the government can refuse to issue you a passport.

That was my read, yeah. They took 'em without justification and outside of their scope, got caught and returned them before pivoting to "we don't have them!" It's lawyer talk, as you mentioned.

It's a lot like something from the Cruz campaign in 2016 that stuck in my craw. When the topic of his birth and citizenship came up (he was born in Canada), he he never owned a Canadian passport. Of course he didn't. Nobody owns his own passport, it is issued by - and remains the property of - the state (State Department, in the US case). It made me wonder whether he actually did have a Canadian passport at one time. Probably not, but man, he's a lawyer and it sounded awfully lawyerish.

Now consider how this scales down. How much stuff - either because it's controversial or valuable - gets "accidentally" omitted? They come execute a search warrant on you, and then suddenly your gold or guns or ammunition or wall art goes missing and then - mysteriously - there's no record of it.

I can buy that. Mistakes happen, especially when you're executing a raid and don't know the landscape.

The key words here are due process of law and that does mean court review of any decision by an administrative agency but there may be a distinct constitutional issue with those provisions such as issuance. The IRS and child support clause rely on the Agee case but the original Kent decision is in tension with Agee regarding specifically what administrative agencies are allowed to do and when under the various Passport acts.

This is par for the course. Most of "TRUMP'S LIES" were exactly this kind of thing. For example:

These aren't lies. At worst, they're "puffery" and that word exists because of the need to legally differentiate a lie from an exaggeration or statement of opinion.

Yes I get the sarcasm. But, the Ds gerrymandered so obviously in NY that even dem appointed appellate judges couldn't find a way to say it was ok and made them redraw the maps. If they were just a little more subtle it would have been fine and the maps wold have been upheld by the appellate courts. they must have thought that no amount of obviousness would upset the appellate judges, but they (for once and surprisingly) were wrong.

It's not gerrymandering - quite a few inner-city Congressional districts vote 80-95% Democrat. It would take gerrymandering to change that - as in Oregon, where Portland is now in four Congressional districts, to spread Portland's Democratic voters as widely as possible.

Yes and no. The constitutional amendment created the "independent redistricting commission" which is evenly made up of GOP/Dem commissioners. the amendment failed to say what happens if the commission doesn't produce a map b/c they can't get a majority vote on a map (which was predictable with a 6-6 split).

A reasonable interpretation would be that if the IRC fails to produce a map, the legislature gets to draw the map. Otherwise, who draws the map?

Had the maps the legislature produced been reasonable (i.e., subtly gerrymandered), I'm pretty confident the courts would have found that interpretation correct, b/c it's the most obvious solution and the easiest. B/c the maps the legislature produced were so obviously gerrymandered, the Court instead essentially found that if the IRC doesn't produce a map, the courts get to produce the maps (that to me is judicial activism).

The NYS amendment specifically reserves court review for any apportionment and furthermore provides specifically that district lines are not to be drawn to protect incumbents (which is why Maloney and Nadler are in a district now) nor to favor political parties in order to reduce competition. That is not activism but rather legitimate constitutional oversight specifically mentioned in the NYS constitutional amendment. See page 8 of the online official NYS Constitution at teh Sec. of State office. The legislature can't violate explicit Constitution wording if the Constitution is to mean anything.

They have to get a warrant to search your house, they cannot legally just kick the door in and take what they want. Anything obtained in this manner is "fruit of the poisoned tree" (I believe is the term) and is not permissible in a court of law as evidence.

You are conflating 2 different points. the IRC amendment left unaddressed what would happen if the IRC could not submit a map. The constitution doesn't say "if the IRC doesn't submit a map, the Court automatically gets to do it". But that is essentially what the court found. Oversight in the NYS Constitution is to review a map enacted by the legislature. Now, after the court threw out the maps b/c of the IRC issue (again, not b/c of gerrymandering),

The whole fiasco was that it was the deposit company that was being investigated--NOT the boxholders. Don't remember whether the warrant distinguished though.

Some have, others have had to go to court over it. Basically, the agency required people to prove that the contents in those boxes were obtained legally and that the box holder owned them.

The whole fiasco was that it was the deposit company that was being investigated--NOT the boxholders. Don't remember whether the warrant distinguished though.

The warrant allowed entry into certain boxes only, and records belonging to the company running the facility. The suspicion was that the company was allowing criminally attained assets to be stored there. The warrant deliberately excluded the others.

Yes, of course it was, but as Margot Cleveland and others have noted, there already IS a legal case in the Southern District of Florida, in which Trump is suing Hillary Clinton and the FBI. It is entirely possible that this raid was intended to prevent documents from being used in that lawsuit by sweeping them up into some kind of "investigative privilege" limbo. Note that they got a lot of attorney-client privileged material that they are going to have to give up. This is rotten enough that (fingers crossed) the civil case judge will assert his court's jurisdiction over the materials.

DOJ has probably seen what is on it. They accessed the surveillance network a while ago. Surprised they didn't disable it remotely for the raid. Probably a sign they rushed it and it came from high up. On the operational level they wouldnt have made this oversight.

Which begs the question-which court? so now, going forward, the 6 dem members of the IRC can simply refuse to participate in an IRC vote and the Courts will always draw the maps. Of course, next time around I'm betting it's be a dem judge.

This is the dirty little secret of the law. The vast majority of decisions get made by the same judge even if he or she is proven biased or even reversed by an appellate judge. I have been asked by clients how the process of moving for recusal or remand after appeal works. They are usually very surprised that the question gets decided by the very same judge who you are accusing of bias or who you accused on appeal of screwing up.

Your argument here is that the legislature can do what the commission cannot. But there is no affirmative power to do that in the amendment and furthermore the legislature was required to start with the plan receiving the most votes (e.g. the tie vote). They failed to do that. So, the amendment states clearly what the criteria are in NYS law regarding the commission and that commission was charged with the redistricting--not the legislature. The legislature then as a subagent or tie breaker of the Commission decision would not be able to act independently in this matter but would be bound to the same criteria that the commission would. That is arguably a fairer reading of the amendment than yours which seems to be that which is not specifically forbidden and applied specifically to the legislature applies in the absence of an agreement by the primary constitutional authority. Wise or not, the NYS places the commission over the legislature in this matter.

It would be better to just do a game. The interested parties all get a turn (Ds, Rs) on a map divided into equal population areas. Each side takes turns adding an area to a district. Once a district 'fills up' then no more can be added. At the end, to fill in any holes and gaps you swap areas in and out of districts. You could even add rules disallowing adding areas to districts that make it too uncompact.

Part of it is that a judge is supposed to clean up their own mess rather than palm the workload off on another judge. But, I believe we would be better served by panels of three judges in important cases which we did in our earlier days of the Republic. By doing that, it removes the incentives for judges to fly their freak flag because they have to justify what they did to colleagues and higher courts. Until the 70's, a few cases used three judge district court panels with a direct appeal to the US Supreme Court. All that is left now are apportionment decisions.

There is no way any sane individual should allow any cameras in their adult bedroom/bathroom/dressing spaces. If any video exists it CAN be hijacked / stolen / hacked.

If there is such video of Trump's delicate spaces while on vacation, my bet is he knew they were coming.

This isn't true. The IRC proposes a map, the leg votes on the map. If the map doesn't get a majority vote in the leg, the leg gets to create its own map from scratch. In this instance the IRC refused to propose a map b/c no map got a majority vote in the IRC. So there was nothing for the leg to vote on.

Frankly, whoever came up with the concept of the IRC is an idiot. the amendment is terribly written and the very concept of an evenly split partisan committee agreeing to a map is delusional.

Nope, the Constitutional amendment itself is silent about what to do about the failure of the IRC to submit a second plan. Even in that case, the legislature is allowed to amend but not wholesale replacement with their preferred map and then there is apparently a 2012 statute involved as well that restricts the powers of the legislature in redistricting. In both cases, the courts have historically been involved in redistricting in NY as well as the legislature so the legislature has never had unfettered discretion in redistricting even before Baker v. Carr was decided.
Reading the three court opinions, it is clear that the courts rejected clause bound interpretivism in favor of using the commonly decided text and intent giving a clear meaning to the amendment. Thus, the legislature cannot do what the IRC cannot. The lesser cannot overrule the major grant.

You ignored what the courts ruled here because it does not agree with your position. I found that largely the courts rejected your opinion on several grounds---one is that the legislature has never had unfettered gerrymandering power and that the amendment limits the legislature to amending the second plan--not writing it from scratch. Here is where a doctrine of common law comes up--one who comes to court must have clean hands. The unstated issue is that the IRC Dems purposefully tanked the second map from the Commission in order to force it through the legislature where they had partisan advantage.

The amendment also does not specify a certain court as some states do where challenges must be made such as the Supreme Court in whatever district Albany NY is.

And again and again Democrats believe the lies and help spread them like idiots, at summe point there needs to be real criminal and monetary penalties for all these people and the organizations/ companies they work for, because otherwise they'll never learn (or even then they may never learn since thei didn't from the whole fake Indian vet story)
