The Fake News Crew Claims, Without Evidence, That the FBI Did Not Seize Trump's Passports

More lies from the Truth Tellers.

Reportedly, CBS is considering not renewing Norah O'Donnell's contract. She's reportedly a diva and a b-word and her ratings aren't good.

The DOJ spun her with a claim they weren't "in possession" of the passports -- note that that's not a denial of having stolen them in the first place, just a lawyerly claim about not currently being in possession of them -- and Norah rushed right out, without asking follow-up questions, to claim this meant the DOJ was contradicting Trump.

norahodonnelltooold.jpg

The DOJ later confessed the truth: The FBI had stolen the passports.

admissionaboutpassports.jpg

There was no search warrant signed by an Epstein lawyer for these passports so they were illegally stolen by Biden's Gestapo.

Norah had better be careful. There must already be chatter that she's too old to be a news anchor. Stupid Senior moments like this only add to the perception that Granny Norrie needs to be put in an Old Anchors Home.

Of course, the Smart Set of NeverTrump completely failed to notice that the DOJ, in claiming they were not "in possession" of the passports was pointedly not denying they had previously been in possession of them.

That's because they're so smart!!! And so honest and honorable! They're so truthful they can't even comprehend that others might twist the truth!

Leftwing propagandists and Gestapo supporters Adam Kinzinger, David Frum, and Peter Strzok -- the last, an actual Gestapo agent -- seized on the lie and propagated it:

The leftwing Gestapo press is now attempting to blame and shame Trump for publicizing the FBI's illegal seizure of his passports, as if he's in the wrong to do so.

As if he's required to keep secrets for them.

And why should he? This seems very shady. The FBI seems to have "forgotten" to note that they stole the three passports on their post-raid inventory report, like they were covering up, yet again, one of their crimes.

The inventory list is required to be a complete and exhaustive list of all property and documents taken from a citizen, of course, so a citizen knows what was taken from him, and there's a record of it, so he can get it back.

But the FBI left the passports off of it.

Just another careless oversight, I'm sure.

Ed Morrissey writes:

Why would the FBI have taken Trump's passports as part of a search purportedly aimed at retrieving classified material? Passports don't have anything to do with Trump's retention of allegedly classified material, nor would they have any material connection to the DoJ's investigation into January 6, which this search warrant appears to facilitate sotto voce.

Please stop trying to sound smart by dropping in these tasteless foreign expressions. You don't even use them correctly.

Law enforcement can't just take a person's passport without a judicial order restricting a person's travel. Trump hasn't even been charged with any crime, let alone be made subject to such a bail condition. He has every right to travel outside the US, and every right to retain his passports.

The FBI suggested that the removal of the passports was an accident:

"In executing search warrants, the FBI follows search and seizure procedures ordered by courts, then returns items that do not need to be retained for law enforcement purposes," the spokesperson said in a statement Monday evening that did not mention the passports.

This seems like an odd explanation. Trump almost certainly did not store his passports with the government documents that the search warrant targeted. Those are items usually stored in a secured personal space, like a safe or perhaps a locked desk drawer (or maybe a dresser drawer?). It's not the kind of item that would have been easily swept up by accident even in a broad search, in other words. It's possible, but appears unlikely unless this was one of the clumsiest search-and-retrieval operations conducted by the FBI.

That brings us to the second question: Why weren't the passports listed on the inventory? FBI agents certainly know what passports look like. The inventory is a legal record of everything the FBI took out of Trump's home in executing the search. There may be some understandable fuzziness on the identity of each and every single sheet of paper in those boxes, but passports are unique and instantly recognizable -- and look nothing like the documents in question. The inventory was specific enough on August 8 to include separate entries for "handwritten note," "Executive Grant of Clemency re: Roger Jason Stone Jr," and two entries logging "binder of photos."

But no one noticed three passports? Again, this either indicates that the FBI conducted this raid in an incredibly sloppy manner, or something else is afoot.

Of course, this makes sense if the entire exercise was a pretext in order to simply grab as many of Trump's personal documents and confidential correspondents with lawyers as possible in order to contrive a legal case against him.

But I'm sure we should continue giving the benefit of the doubt to the agency that has already been found to have lied repeatedly and found to be without candor and integrity by the Inspector General. And which was supposed to create an action plan for addressing its habitual departures from the truth, but didn't even bother sidelining the agents directly responsible for all the Russiagate lies. In fact, the FBI just assigned them to lying about the Hunter Biden laptop.

We are not living in a democracy nor a republic.

Now consider how this scales down. How much stuff - either because it's controversial or valuable - gets "accidentally" omitted? They come execute a search warrant on you, and then suddenly your gold or guns or ammunition or wall art goes missing and then - mysteriously - there's no record of it.

This is par for the course. Most of "TRUMP'S LIES" were exactly this kind of thing. For example:

Trump: "This is going to be the biggest, most beautiful wall you've ever seen! It's gonna be an amazing wall! It's going to be a ribbon of strong, secure concrete across the entire border!"
Fact Check: "The primary building component of the wall is steel fencing material and it is not planned to be continuous across the entire border, as the border wall will contain numerous passage points in its construction to facilitate border crossings. Three Pinocchios."

These aren't lies. At worst, they're "puffery" and that word exists because of the need to legally differentiate a lie from an exaggeration or statement of opinion.

It's not gerrymandering - quite a few inner-city Congressional districts vote 80-95% Democrat. It would take gerrymandering to change that - as in Oregon, where Portland is now in four Congressional districts, to spread Portland's Democratic voters as widely as possible.

That's because the people of MA are enlightened and support the party of the little guy. They are free from the blight of misinformation because they reject Faux News and rely on the NYT for objective news. The districts are drawn with only a mind towards fairness (here's a link to a study that sort of says, in tortured terms, that MA's districts are very drawn in a non-partisan way).

If the rest of the country was like MA, we'd have paradise. Now, I'm going to avoid Boston after dark because I fear for my life.

Yes and no. The constitutional amendment created the "independent redistricting commission" which is evenly made up of GOP/Dem commissioners. the amendment failed to say what happens if the commission doesn't produce a map b/c they can't get a majority vote on a map (which was predictable with a 6-6 split).

A reasonable interpretation would be that if the IRC fails to produce a map, the legislature gets to draw the map. Otherwise, who draws the map?

Had the maps the legislature produced been reasonable (i.e., subtly gerrymandered), I'm pretty confident the courts would have found that interpretation correct, b/c it's the most obvious solution and the easiest. B/c the maps the legislature produced were so obviously gerrymandered, the Court instead essentially found that if the IRC doesn't produce a map, the courts get to produce the maps (that to me is judicial activism).

Absolutely, 100% correct. If this is to be solved by a person or cabal rather than a popular uprising, it must be done the Ivan IV way - and I have recommended that outcome (the best outcome) for years.

Do it exactly like he did - form the Oprichnina up as a shadow government, and unleash the Oprichniki on the boyars with bloodthirsty abandon... but let them know that, while they are free to strip the boyars of their property, their families, their dignity, and their lives, their role ends with the boyars. If they try to hang on to anything besides their piles of loot, they will be treated as the new boyars, by the new Oprichniki. When the task is over, so is the Oprichnina.

The bus electrification underway in Amsterdam, for example, was happening at system operator discretion, absent of analysis of which neighborhoods were bearing the burden of pollution health impacts. “The rider shouldn’t notice any difference,” the transit experts told us. This is in contrast to U.S. transit planning where equity analyses are required, riders and neighbors can participate in a process, and transit agencies are called out if they don’t (rightly so) prioritize communities most impacted by air pollution and poor transit service.

Leon Panetta, who served as defense secretary and CIA Director under the Obama administration, told CNN's Jake Tapper on Monday that there is a process for declassifying confidential government information and requires sign-off from other agencies.

"If presidents want to declassify, they have to follow that process which basically requires that it be referred to the agencies that are responsible for classifying that material," Panetta told CNN. "They have something to say as to whether or not that material should be declassified."

"So there is nothing that I'm aware of that indicates that a formal step was taken by this president to in fact declassify anything. Right now, this is pretty much BS," he added.

212 From a strictly technical point of view, the FBI is proving, once again, their reputation far outshines their actual performance.

Their warrant was incredibly vague, and had it gone to a real, non-corrupt judge for signing, it wouldn't have passed muster. They have already been proven to have collected documents not on the warrant. They have already been proven to have an incomplete accounting of all the documents they took.

If this was a run of the mill raid against a drug kingpin or a mafia don or some random businessman, a good lawyer would be able to have any evidence collected thrown out of court.

Of course, things are different when the target is an enemy of the regime.

I’m sure there were some people who were running things that had very high-security clearances, but if you’re going to turn 20 or 30 [or 40] FBI agents loose ...you’re opening the possibility of somebody who doesn’t have the appropriate security clearance to see this top secret, super secret, Special Access information... See page 8 of the online official NYS Constitution at teh Sec. of State office. The legislature can't violate explicit Constitution wording if the Constitution is to mean anything.

I'll bet it happens all the time. Just robbery by ruffians.

288 They do NOT say "Returns anything NOT specifically named in the warrant"...which IS required in the warrant process, they need very specific grounds for very specific items, from very specific places/locations, for very specific reasons, pertaining to very specific crimes/i]

Right, this is key. Its actually illegal for them to go into areas or collect items not permitted in the warrant. The 4th amendment rights and right to property and privacy both mean that the US government can only act in contradiction to that with specific, very clear, limited reason and scope.

They have to get a warrant to search your house, they cannot legally just kick the door in and take what they want. Anything obtained in this manner is "fruit of the poisoned tree" (I believe is the term) and is not permissible in a court of law as evidence.

And, I refer to Ivan IV for a reason - the boyars were a very close parallel to the American Deep State, rendering "proto-Russia's" ancient tribal/monarchical systems impotent with their incessant, treacherous intrigues.

When Ivan took the crown, the boyars were a lawless and unaccountable class of bloodsucking courtiers who ran everything. By the time he finished with them, they had been physically eradicated as a ruling class for all time, the country we know as Russia had been founded, and his dynastic line ruled without question for centuries.

It was extremely disruptive and caused huge problems for his government, economically, diplomatically, and militarily. But it *had* to be done, and he did it. It's the template for Deep State bullshit, and how to handle it.

As drawn by the Dems, Nadler's district would have been the west side of the lower half on Manhattan (like from 9th Ave to the river), across the financial district and across the Brooklyn Bridge to Brooklyn, down a bit of the Brooklyn coastline, up a bit inland, and over to a large glob of middle Brooklyn.

I think the Dems also tried to create a district that would have run across the Throgs Neck Bridge, but I'm not too sure about that.

More bullshit from Panetta, there are laws dealing with classification but that is for control of underlings--not the President and these evil clowns like Panetta are purposefully bumfuzzling the public. Specifically, there is a hierarchy of laws here--explicit stated constitutional powers of a branch and reasonable and past interpretation of inherent powers of a branch. The commander in chief power and likewise similar stated powers regarding diplomacy grant the president an outsized role in foreign affairs and defense matters. That is where the President has a constitutional right to disclose or not any information relevant to the security and defense of the US regardless of whatever statutes or agency regs say.

I can understand that statement provided that the ruling junta that overthew the government back in January 6th 2021 perceives Trump as not recognizing the New America "Government" that bears no resemblance or even homage to the previous Constitutional Republic of 1788.

You are conflating 2 different points. the IRC amendment left unaddressed what would happen if the IRC could not submit a map. The constitution doesn't say "if the IRC doesn't submit a map, the Court automatically gets to do it". But that is essentially what the court found. That is what I consider judicial activism. the most reasonable interpretation of the blank left by the NYS constitution would be if the IRC could not produce a map, the elected representatives of the people - the legislature - would produce the map. It makes no sense to say the court automatically gets the next crack at map drawing and the constitution does not say that.

the leg's maps were overturned b/c the IRC did not produce a map. Not b/c they were gerrymandered. That's a very different thing. the court essentially held that if the IRC fails to produce a map, the legislature cannot produce a map. Which means, de facto, the Court gets to do it.

Oversight in the NYS Constitution is to review a map enacted by the legislature. Now, after the court threw out the maps b/c of the IRC issue (again, not b/c of gerrymandering),

Yes, of course it was, but as Margot Cleveland and others have noted, there already IS a legal case in the Southern District of Florida, in which Trump is suing Hillary Clinton and the FBI. It is entirely possible that this raid was intended to prevent documents from being used in that lawsuit by sweeping them up into some kind of "investigative privilege" limbo. Note that they got a lot of attorney-client privileged material that they are going to have to give up. This is rotten enough that (fingers crossed) the civil case judge will assert his court's jurisdiction over the materials.

cont'd. the court then appointed a "master" to draw the maps and allowed parties (really anyone) to give the master maps they thought he should use. The leg cont'd to rely on their egregiously gerrymandered map and the republican judge - appointed master simply disregarded those maps.

My point is if the maps hadn't been so egregious, the appellate courts would likely have found the interpretation of the NYS Constitution vis a vis the IRC was the correct one - that if the IRC fails to produce a map, the legislature gets to produce the map. B/c that makes the most sense, the actual elected representatives of the people, not a court, should get to draw the maps if the IRC fails in its duty.

but, b/c the maps the leg put forward were so egregious, the Courts went with the lower courts ruling, which is, again, essentially if the IRC doesn't produce a map, the Courts get to. Which begs the question-which court? so now, going forward, the 6 dem members of the IRC can simply refuse to participate in an IRC vote and the Courts will always draw the maps. Of course, next time around I'm betting it's be a dem judge.

400 Oversight in the NYS Constitution is to review a map enacted by the legislature. Now, after the court threw out the maps b/c of the IRC issue (again, not b/c of gerrymandering),

Posted by: Mehive
------------------
Your argument here is that the legislature can do what the commission cannot. But there is no affirmative power to do that in the amendment and furthermore the legislature was required to start with the plan receiving the most votes (e.g. the tie vote). They failed to do that. So, the amendment states clearly what the criteria are in NYS law regarding the commission and that commission was charged with the redistricting--not the legislature. The legislature then as a subagent or tie breaker of the Commission decision would not be able to act independently in this matter but would be bound to the same criteria that the commission would. That is arguably a fairer reading of the amendment than yours which seems to be that which is not specifically forbidden and applied specifically to the legislature applies in the absence of an agreement by the primary constitutional authority. Wise or not, the NYS places the commission over the legislature in this matter.

Once a district 'fills up' then no more can be added. At the end, to fill in any holes and gaps you swap areas in and out of districts. You could even add rules disallowing adding areas to districts that make it too uncompact.

If there is a tape and if he intends to release it, then it is probably to catch the FBI lying. Veritas does this same thing and always has. Release a small piece (or, in this case, disclose that you have it and can or will release it) and let them scramble for cover and tell more lies, then release another piece, then repeat.

This is the dirty little secret of the law. The vast majority of decisions get made by the same judge even if he or she is proven biased or even reversed by an appellate judge. Posted by: Elric Blade
--------------------
Part of it is that a judge is supposed to clean up their own mess rather than palm the workload off on another judge. But, I believe we would be better served by panels of three judges in important cases which we did in our earlier days of the Republic. By doing that, it removes the incentives for judges to fly their freak flag because they have to justify what they did to colleagues and higher courts. Until the 70's, a few cases used three judge district court panels with a direct appeal to the US Supreme Court. All that is left now are apportionment decisions.

Incorrect. Re read the amendment. the leg can veto the IRC's submission and create a map from scratch. the issue wasn't whether the leg used the IRC map, the issue was that the IRC did not have a majority vote to send ANY map to the leg.

the constitution still keeps the ability to draw maps with the leg by giving the leg veto power of the IRC's maps. NOWHERE in the constitution does it say that if the IRC fails in its duty the court gets to create its own map from scratch. that's an unreasonable interpretation of a badly worded constitutional amendment.

and again, which court? Which judge? Out of the many, many, many supreme Court justices in NY - which one "automatically" gets to draw the maps when the IRC fails in its duty? Again, the trial court's interpretation of the NYS Constitution was judicial activism.

What the trial court should have done is found that based on the actual wording of the NYS constititon, which expressly gives the leg veto power over the IRC's maps, if the IRC fails its duty, the leg gets to draw a map. then, that map can be challenged. That's not what happened.

The receipt erroneously lists several containers of Top Secret, Secret, and Confidential documents. The actual security status of these documents is in dispute and has yet to be definitively determined, so far as I know.

Before the warrant and receipt were made public, the FBI leaked to WaPo that classified documents were seized. WaPo ran with it as a single anonymously-sourced story.

So far as I've seen, all stories by all media sources have repeated this lie as "classified documents seized by the FBI." It's notable that no media sources, even those that are supposedly right-leaning, have drawn a distinction between classified documents and documents "marked as classified."

Ah yes - the old tried and true liberal 'veto by screeching'. You see, certain limp wristed conservatives can't take the infernal screeching: "just make it sthaaap!" so the suggestion is capitulation as a remedy. And the result? More screeching - hey, it works!

508 Were the FBI agents who took the TS/SCI documents cleared to handle such documents?

Being that the FIB has the francheise to issue out clearances, its a given that everyone on site had it.

There is no way any sane individual should allow any cameras in their adult bedroom/bathroom/dressing spaces. If any video exists it CAN be hijacked / stolen / hacked.

If there is such video of Trump's delicate spaces while on vacation, my bet is he knew they were coming.

I saw one report that Merrick Garland not only was not surprised, but had been wrangling with th decision for WEEKS.

516 499 Wise or not, the NYS places the commission over the legislature in this matter.
Posted by: whig at August 16, 2022 01:00 PM (CXr4y)

This is correct - and the Dems paid for that. They could have simply amended the law to suggest affirmation by the legislature was needed - but they couldn't even do that. Posted by: Boswell at August 16, 2022 01:15 PM (+Cgut)

This isn't true. The IRC proposes a map, the leg votes on the map. If the map doesn't get a majority vote in the leg, the leg gets to create its own map from scratch. In this instance the IRC refused to propose a map b/c no map got a majority vote in the IRC. So there was nothing for the leg to vote on.

Frankly, whoever came up with the concept of the IRC is an idiot. the amendment is terribly written and the very concept of an evenly split partisan committee agreeing to a map is delusional.

I would want an accounting of those present, those that handled documents and their levels. I'm sure Presidential level clearances would excuse most flatfoots.

Posted by: rickb223 at August 16, 2022 01:27 PM (qfVDK)

518 What the trial court should have done is found that based on the actual wording of the NYS constititon, which expressly gives the leg veto power over the IRC's maps, if the IRC fails its duty, the leg gets to draw a map. then, that map can be challenged. That's not what happened. Posted by: Mehive
-------------------------
Nope, the Constitutional amendment itself is silent about what to do about the failure of the IRC to submit a second plan. Even in that case, the legislature is allowed to amend but not wholesale replacement with their preferred map and then there is apparently a 2012 statute involved as well that restricts the powers of the legislature in redistricting. In both cases, the courts have historically been involved in redistricting in NY as well as the legislature so the legislature has never had unfettered discretion in redistricting even before Baker v. Carr was decided.
Reading the three court opinions, it is clear that the courts rejected clause bound interpretivism in favor of using the commonly decided text and intent giving a clear meaning to the amendment. Thus, the legislature cannot do what the IRC cannot. The lesser cannot overrule the major grant.

You ignored what the courts ruled here because it does not agree with your position. I found that largely the courts rejected your opinion on several grounds---one is that the legislature has never had unfettered gerrymandering power and that the amendment limits the legislature to amending the second plan--not writing it from scratch. Here is where a doctrine of common law comes up--one who comes to court must have clean hands. The unstated issue is that the IRC Dems purposefully tanked the second map from the Commission in order to force it through the legislature where they had partisan advantage.

522 The second point is that the court specifically rejected your approach to clause bound interpretivism and using court precedents was required to give meaning to the text based on a natural reading and the intent behind the amendment which was to reduce partisan and incumbent protection in redistricting. The state legislature purposefully chose to stuff it and paid the price.

Your other argument does not hold water either--historically the courts have to interpret the law including the constitutional amendment--the interpretation is what the legislature ran afoul of. The amendment also does not specify a certain court as some states do where challenges must be made such as the Supreme Court in whatever district Albany NY is.

523 This story also includes one if the stupidest "aha" moments yet, as to try and save their own asses the Democrats are actually trying to use the excuse "well Trump said it was one expired passport and two active passports, when really out was 2 expired passports and one active passport, so see he's just lying again."

Another is "why was Trump keeping his passports in boxes of classified material?" Or more likely Trump's team just gathered up whatever was left in his office, boxed it up, and took it to MAL, which would show there was no intent (you know the thing that got Hillary off the hook despite with heart there being all the intent in thr world)

So far this whole fiasco has been Trump says something, DoJ/FBI leaks story to dispute him, five seconds later Trump is proven right. And again and again Democrats believe the lies and help spread them like idiots, at summe point there needs to be real criminal and monetary penalties for all these people and the organizations/ companies they work for, because otherwise they'll never learn (or even then they may never learn since thei didn't from the whole fake Indian vet story)
