So was the Louisiana Purchase in the same vein as people were already living in the territory? Articles of Confederacy established the perpetuity of the union explicitly and would apply at least to the original 13.

Nobody in the Confederacy was prohibited from leaving the Union. They weren't able to take the land and establish a new state. Acquisition or defense of territory is not innately oppressive or an infringement of individual rights, though that can occur.

There are no countries that allow you as an individual to stake out land and declare it your own country.

It is the prerogative of who wins, and that hasn't been determined yet. The existing arrangement is breaking down as the state infringes upon long-held rights. Using the American Revolution as an example, there wasn't much reason to revolt until the Crown started imposing upon the colonies.

Morons. Yes, the government can take it back but only after due process and by the proper agency. The U.S. Forestry Agency can't take your passport. Border Patrol and ICE can take it on the spot.

Anyone can walk across the border whenever they want, unless there's a guard standing right there. What a passport does is give you the protection of the US Government while you're physically in the jurisdiction of another's. As Whig pointed out, under our law it is *not* a privilege but a right, so Brennan was wrong.

I agree, good points all. In most of the rural South, public baptisms were done in rivers and ponds; but those kinds of things are a bit hard to come by in Kansas and the rest of the plains, so this what became traditional there.

You're mixing the question of 'who should win' with 'what does winning mean'. If the king of France conquers Italy, he now rules Italy. He then holds authority in Italy.

Countries are established and maintained by force. Government is the monopoly on force in a region. There is not a moral principle that says "Germany shall exist as an autonomous and unified state". It merely does or does not. We were not especially entitled to the land we took from Mexico, but is the US's now and we would defend it.

There is a way to reconcile the two arguments though. Social contract theory indicates that people accept some limits on their liberty by a government under consent. If that government becomes tyrannical and destroys ancient well rooted rights, then the social contract is void and it becomes a state of nature where a person can no longer claim that acting on behalf of such a state is legitimate nor can any purported regime argue that it should have a monopoly of force. For a recent application, prior to the US invasion, the prior Taliban regime was recognized only by Pakistan as a legitimate government which made legitimate any aid to groups within Afghanistan to remove the illegal regime as hunky dory under international law.

Whether the establishment or existence of a given country(including our own) is morally good or favors our interests is something else entirely. But neither the Confederacy or Union were inherently legitimate or illegitimate due to the means by which they were established.

If you want a refutation, John Hart Ely does a pretty thorough job--the court is not a majoritarian institution and the Constitution does not create a democracy where majority rules but rather a Republic. If Larry believed in States Rights, I could even go along with him. Because there will be some state - there are, after all fifty - with enough contrarian views that I can be happy there. What happens in the other 49 states, after all, doesn't bother me much.

Depends on whether you believe consent of the governed or not. You are arguing on the basis of positivism--what exists is therefore what is legitimate. Social contract theory though contradicts your thesis because in that each person gives up a bit of their rights to government in order to protect the rest of these rights. The rights are inherent to the individual and government cannot create them. Locke focuses on property but others focus on different rights including Rousseau.
Essentially, what you are arguing is the entirely illusionary institution known as the 'state' which in reality is no more than a shared agreement among individuals. States per se have no rights--only powers and limitations on those powers because they are not human. Humans within a state have the right to self defense writ large if they commonly agree that the state is valid.
