Stacks said one of the agents told him, "we're the federal government and we can do anything we want to." This was all over an SBA loan the owner secured through the Federal Emergency Management Agency to recover tornado losses to his home, warehouse, and associated equipment. /7

A documentary called "Rampant Injustice" exposed some of the Obama-era federal abuses of power. The video features a reenactment of the Mountain Pure Water raid. I was told that the misconduct of the agents were even worse than was depicted in the video.

Surprise: Political "experts" aren't experts, and their pronouncements and predictions are less accurate than those of random members of the public.

Cable news and talk radio are brimming with political experts -- pollsters, consultants, former politicians, etc. -- who supposedly have keen insight into what will happen in the world of governance. The thing is, when they make predictions on political matters, they're pretty bad at it.

Between the 1980s and early 2000s, Philip E. Tetlock, a Professor of Psychology at Penn focused on politics and decision-making, conducted a long-term study in which he recruited 284 people whose professions included "commenting or offering advice on political and economic trends" to predict the outcome of various political events. At the same time, he had laypersons do the same, collecting 82,361 forecasts over two decades. When the study concluded, the experts barely outperformed the non-experts, if at all.

Reviewing Tetlock's work, Professors Adrian E. Tschoegl and J. Scott Armstrong, both at Penn, noted, "Beyond a low threshold, additional expertise did not result in greater accuracy in forecasting, and there was some evidence that those with the most expertise were less effective at using new information and thus less able to improve their accuracy."

A study published in 2008 echoed Tetlock's results. A Swedish researcher had members of the public, journalists, and political scientists attempt to forecast the outcome of Swedish parliamentary elections. When all of the predictions were aggregated, members of the public were actually most accurate.

Well, I mean, here's the thing: They're not being measured or tracked on these things, apart from these few random studies. What gets measured gets improved; what doesn't, doesn't.

These flakes and phonies are allowed to make as many bad predictions and "wish-casts" as they like without ever being called to task for it.

We see that now in the media, with no one in the media bothering to check any more if "reporters'" reports are actually, you know, accurate. "Reporters" who simply lie are rewarded and allowed to simply continue lying because their lies please a constituency.

So why do political experts endure and get rewarded with outrageously high fees if they regularly offer such poor prognostications? Armstrong has a theory: The Seer-Sucker Theory.

"No matter how much evidence exists that seers do not exist, suckers will pay for the existence of seers," he wrote. "One explanation is that the client is not interested in accuracy, but only in avoiding responsibility. A client who calls in the best wizard available avoids blame if the forecasts are inaccurate."

I was very briefly hired in a job involving advising clients. I knew nothing about the subject matter. The two pieces of advice I was given: Make definitive statements; people aren't paying you for vague or wishy-washy bullshit, they can imagine that themselves. They already have uncertainty. They want certainty. So give it to them.

And: Just say it confidently. Doesn't matter if you have no idea what you're talking about. Say it confidently.

I guess those are really the same advice, in two different formats.

Every media jerkoff you see on TV is just following that advice.

And also: They're lying for a partisan audience.

And also: They're possibly being paid to front for some client.

Don't believe a word they say.

The media first couldn't wait to call the FBI raid on Trump's home a "raid" to maximize the idea that he was a criminal being targeted, but as the overreach by the FBI became clearer and the Deep State became more defensive, they began running from the term.

And oh yeah -- their Democrat Commanding Officers ordered them to stop calling it a raid.

Not sure that DC has jurisdiction. Vicinage in the Constitution requires a trial in the jurisdiction where the crime occurred. In this case, it would seem that the SD of Florida would be the jurisdiction responsible for any trials. Hard to make DC jurisdiction out of alleging illegal retention of documents in FL.

The particularity clause binding warrants is simply blown away by referring to all documents Trump generated as president. Trump could go to court as Nixon did and argue illegal seizure plus damages.

What is notable about Nixon's papers is that the Government eventually had to pay millions to Nixon for seizing his papers.

This is an example of the shit legal work that government lawyers put into warrants. It says something for the incompetence or collusion of the magistrate judge that he would sign off on such a ridiculously overbroad search warrant. Only Hillary or Garland would be stupid enough to argue that Trump's entire presidency was a crime.

Allegedly but you can have multiple grand juries investigating in different jurisdictions. You have to be tried in the place where you committed the crime and ONLY the defendant can move for a change of venue--not the government. That is called vicinage and is in the Sixth Amendment because the Brits shipped colonial prisoners to Nova Scotia to be tried for admiralty crimes like smuggling. Nova Scotia was like DC in that it was basically a British Naval base and that is about it. See 6th Amendment, "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law. . ."

You can do that but it is still a reversible error if a judge hears about it.

The std. if more likely than not that the defendant committed an illegal act. Stupid prosecutors wanting only a win will include evidence (hearsay, etc.) that could never be submitted in court with the intent of investigating and proving it later via grand jury subpoenas for evidence or testimony. Ethical prosecutors will more or less use the evidence that they intend to prove in court.

More likely than not is a relatively lenient std but most grand jurors have never taken a look at the Federal Rules of Evidence nor the court cases that originated many of those rules.

Law schools are turning out some really bad graduates in recent years that have heads filled with muck. Many of these end up working in the criminal justice system because of Public Service Loan forgiveness. Sounds like the prosecutor is using the prima facie approach (that viewing the facts in the most favorable light for the prosecution) which is used in dismissal motions during a trial. The difference is that the 'facts' at though point have been through cross examination etc.

Ideally, if the DOJ followed normal procedures of actually wanting to be able to introduce the evidence into court with no arguments, the target is notified and then a district court judge usually hears arguments why and why not a warrant should be quashed.

Exigent circumstances require fear of evidence being moved or destroyed and that is the argument DOJ used. However, waiting three days to execute the warrant undercuts that argument somewhat.

Yes! She even used the term "prima facie" and explained its meaning. The issue I have is after the perfunctory presentation of affidavits etc, some of the charges are not at all compelling (others are). I have questions, but those questions will only be resolved at trial.

So then in all honesty I can't say that I am convinced "more likely than not". The only way you get to "more likely than not" is if you start with a prior that "cops don't lie", "defer to authority", "prosecutors always act in good faith" etc. But then if you do that, what's the point of the grand jury? So I refuse to weigh those general factors (other than assuming the affidavits are truthful - if I don't assume that then I got nothing). But I know most people can't help but weigh those factors.

Anyway, just rambling here. But it's been illuminating.

481 The left media struggles to appear all knowing and all controlling - they desperately trot out numerous 'make-work' projects as media entities like doofus fake outfits called "RawStory", "Business Insider", "Arnet", "Talking Points Memo", "the Hill"...etc. These are just NY Times and WAPO story force multipliers - their job is to fill your inbox with the same exact stories filed by the usual same 10 or 12 liberal writers at those entities, over and over again.

Its meant to make it look like no one in the entire world is conservative, everyone in the world is a liberal purple haired doink - it is you that is different! But look at all their borrowed bylines, its the same dozen NYT or WAPO writers, over and over and over again....
