Sefton: sefton at cutjibnewsletter.com | Nearly a Month After the Supreme Court Leak, Investigators Are Finally Asking for Clerks' Phone Records, and to Sign AffidavitsThe signing of the affidavits is important because while the leak itself might not have been a crime, lying to a federal officer in an investigation is a crime. Or, as we've just found out: May be a crime if you're a Republican. It's not a crime at all if you're a Democrat who's lying to advance the left wing's political agenda. Why is this "major escalation" only happening now? The guests Megyn Kelly had on to discuss this predicted that the leaker would be found quickly but only because they believed these elementary, basic steps of investigation would be undertaken in the first days of the investigation. And yet here we are, almost a calendar month later, and only now are they fixin' to start ponderin' a consideration of the beginning of the most basic possible investigatory steps they could take. Is this because Roberts told the Supreme Court Marshal to "keep it collegial" and not to be intrusive? Or did the Marshal just decide to go easy on the liberal clerks on her own? (I think it's a her.) Does Roberts really want to find the leaker, or is he really trying to help the leaker escape detection? In any event, clerks, plural, are considering lawyering up rather than cooperate with the "major escalation" in the probe (which is really just doing basic stuff that should have been done in the opening hours of the investigation).Supreme Court officials are escalating their search for the source of the leaked draft opinion that would overturn Roe v. Wade, taking steps to require law clerks to provide cell phone records and sign affidavits, three sources with knowledge of the efforts have told CNN. Some clerks are apparently so alarmed over the moves, particularly the sudden requests for private cell data, that they have begun exploring whether to hire outside counsel. ... Chief Justice John Roberts met with law clerks as a group after the breach, CNN has learned, but it is not known whether any systematic individual interviews have occurred. It's an open question as to whether they even bothered to interrogate the clerks individually? Holy shit.

Lawyers outside the court who have become aware of the new inquiries related to cell phone details warn of potential intrusiveness on clerks' personal activities, irrespective of any disclosure to the news media, and say they may feel the need to obtain independent counsel. "That's what similarly situated individuals would do in virtually any other government investigation," said one appellate lawyer with experience in investigations and knowledge of the new demands on law clerks. "It would be hypocritical for the Supreme Court to prevent its own employees from taking advantage of that fundamental legal protection." Sources familiar with efforts underway say the exact language of the affidavits or the intended scope of that cell phone search -- content or time period covered -- is not yet clear. ========== Abolish clerks! They are not to be trusted! Posted by: TheJamesMadison, fighting the system with Kobayashi at May 31, 2022 01:15 PM (LvTSG) 7

Way I figure it is, since they haven't issued a subpoena to the cell phone carriers, this is an official "heads up" to the guilty clerk to drag this out and delay.
IIRC, most carriers delete all texts from their servers in like 90 days. And, recall the odd case of Kal Penn getting "mugged" but all they took was his cell phone, not his wallet, watch or anything else. So this is all being done to stall until they can whitewash it away. Posted by: People's Hippo Voice at May 31, 2022 01:26 PM (gHhiB) 100

Doesn't mean I like a 2 tiered system, but getting a lawyer and not letting the FBI put some throw away crime on you because they can't prosecute a real crime doesn't upset me. I admit to wanting a pound of flesh for what they've done to the country, but I don't expect I'll be getting it. Posted by: Inogame at May 31, 2022 01:26 PM (53oGX) 101

National Economic Council Director Brian Deese on Tuesday argued that the U.S. is in a position of strength to combat high inflation, following President Biden’s release of a three-part plan to lower rising prices. “The economy we have right now is in a transition from this period of historic economic growth to a period that can be more stable, resilient growth. That requires focusing on inflation and doing so from a position of relative strength,” Deese told CNBC.

It'll be a general, unattributed lack of candor, no referrals for prosecution, and a recommendation for new training modules. Like it always is. And that's a good thing. One more blatant assault on an institution goes unpunished, permanently eroding its overall (perceived) integrity. The more these institutions chip away at themselves, the fewer people who still believe in them. They're finally achieving what should have happened forty years ago - a catastrophic loss of confidence in American federal government. IMHO, the response should be that it is a condition of your employment that you provide the requested info. If you don't, well, I guess you're no longer a clerk for a SCOTUS justice. I'm kind of confused by some of the comments. We've spent the last four years with the joke "two weeks" yet the rending of cloth around here about an aquital is kind of surprising to me. Did anyone actually expect guilty verdicts for anything? Sending someone to jail has never been in the realm of possibility, why are y'all getting worked up about it? You've known for years that only Republicans can commit crimes that result in jail time. The point of Durham has always been exposure in a way that removes doubt of the corruption. And given what was admitted under oath, that is what happened. This is about building public demand to reject the institutional corruption. It may have little chance of success, but it has a higher chance than prison for Democrats and deep state. We as a nation have two paths we can go down. Totalitarian take over of the country by leftists/deep state or restoration through elections or revolution. The preferred path of the leftist, stealth absorption of government power, has now been taken away from them due to events and public exposure. Minnesota’s DFL party hasn’t lost a statewide election since 2006, but they apparently are taking no chances. Over the last few days a mini-scandal has emerged, as DFL operatives apparently plotted to take over the Grassroots Legalize Cannabis Party, which siphons votes from the Democrats. While this doesn’t seem to have been captured on audio, it is claimed that they intended to change the party’s name to the “MAGA Party,” thus wasting Republican rather than Democratic votes.

The point of Durham has always been exposure in a way that removes doubt of the corruption. And given what was admitted under oath, that is what happened.
This is about building public demand to reject the institutional corruption. - I think it's good too, but almost for a mirror___ reason of yours. The point of Durham wasn't so much to expose corruption - that's been exposed for awhile. To most people (the ones with eyes and hears, to see and hear), Right or Left, it's a quotidian reality of American public life. To us - we all knew this was coming. Some like it and some don't; it's still a foregone conclusion. But a significant portion of the Right is always hoping for #Steiner to come in #TwoWeeks. Always grasping at the next straw. It's the product of blind loyalty to various ruined institutions. They thought Durham would really come. And with every straw that gets pulled short, they get a step closer to taking the red pill. So I'm good with it: keep on doing it. Over and over again. Don't throw them in that briar patch, Br'er Fox. Posted by: @TheRealWilliamHayes at May 31, 2022 02:00 PM (FIJ+3) 333

Posted by: blaster ---- I said above (and would have added more words except for pixy) that it is marginal. It proves what we have known for years. But us knowing it isn't enough. Having it admitted to in court, regardless of verdict, does allow us to argue more effectively with people who try to call us conspiracy theorists. This is just one minor example, but couple it with 2000 mules, (and I could list other examples but pressed for time) and it starts to shape public perception. Enough that you have solid majorities that are rejecting the narratives. I see it in the polling. The public isn't buying what they are being sold. Ay yi yi, don't bother. If you someone is truly committed to the whole fraud, then they can't be convinced it's a fraud. Just let them enjoy it. They'll try to sell you a ticket to the show - but if you're not in the demo, then don't buy. It's only like nine people total, anymore, anyway. That's at most an argument for the integrity of Durham, not the system or process. People don't really care whether Durham is a ham & egger. But I stopped expecting anything to happen with Jeff Sessions. Posted by: Someguy's at May 31, 2022 02:17 PM (dOlhY) 430

Durham did something extremely valuable. He put on a show, an illusion, a pageant of jurisprudence. And he did it pretty good. Good enough to get JackStraw excited about the cliff-hanger and next season's episodes. Posted by: Nic of the Day at May 31, 2022 02:19 PM (ZUrPc) 439

Actor of the Day
Ian McShane was in The Pirate with Christopher Lee. Ian McShane was in Pirates of the Caribbean with Johnny Depp, who was in Black Mass with Kevin Bacon. 1700 English would sound like an Irish accent more than a British one. His arrival as Blackbeard was good, sounding 200 years out of step with the other characters. Creepy. He was amazing in Deadwood and good in John Wick.
