Wednesday Morning Rant [Joe Mannix]

Ignorant Techno-Policing

Over the past year, there have been some startling revelations about government and technology and how the government uses technology to achieve its ends. The common theme in all of it is the rank incompetence and profound ignorance that seems to permeate every interface between policing and technology. The examples that come immediately to mind are the Rittenhouse and Sussman trials.

During the Rittenhouse trial, I was horrified to see how lackadaisical people are with data and their gross overestimation of their own knowledge and expertise. The DA and his team were tossing files back and forth as E-Mail or SMS attachments. No good chain of custody, no verification that the files were unchanged, no robust protocol. This is unacceptable, and no technically-savvy organization would permit such behavior. When the police enhanced a video clip that ostensibly showed Rittenhouse doing ... something, the defense challenged it and the police put their expert up for questioning. The defense dismantled him.

He was not an expert, he was an operator who used software he had been trained to use. He didn't know how the software worked, and he didn't understand what underlying technologies were used. He just knew how to click the buttons and produce an output. Everyone involved in the prosecution was a technological cargo-cultist. They went through the motions but they didn't know how anything worked. Despite their profound ignorance and blind trust, however, they were thoroughly convinced they knew everything. They called themselves experts and then got humiliated by non-expert outsiders who trapped them with their own ignorance.

The revelations around the Sussman trial do nothing to improve the perception that these people are incompetent and not motivated by justice. The entire "secret connections to Alfa Bank" was predicated not on some known data channel or evidence that Trump's businesses were colluding with Russian information ops, but instead was based on misunderstanding communications related to E-Mail spam. Per my understanding, someone at Alfa was on a mailing list for spam. This is not nefarious. In this case the feds - unlike the locals in the Rittenhouse case - did have people with enough expertise to question this. These people were ignored, because it was good enough to keep pushing forward with their crimes and besides, they knew in their guts that Trump was guilty and so the ends justified the means - and it looked great to people who don't know anything. Very high-tech.

These people who have the gall to convert a republic into a technocratic police state are also ignorant and stupid in their chosen domain. Technology is magic, and it says what they want it to say. Anyone who questions it from the inside is ignored and anyone who questions it from the outside is called a white supremacist. They're not experts. They're not even armchair enthusiasts. They just press the buttons and railroad their opponents. They don't understand (or they ignore) "garbage in, garbage out" and fall back on "the computer says he's guilty!"

Years ago you'd speak to the doctor and they'd speak to you. Today you speak to the doctor but they're looking at a computer screen. When they speak to you, they're often looking at the computer screen. Because you've got to click this button and you've got to complete this screen and so on and so on.

My initial objection to the death penalty was the incidence of innocent men and women convicted on the basis of "evidence" presented by incompetent or malicious prosecutors.

DNA technology, properly used, is able to free some of these wrongly convicted.

41 When I was in college studying cybersecurity. One of the classes was computer forensics. The professor was often called as an expert witness for the FBI.

The stories he'd told about how accomplished lawyers would try and demolish him on the stand were scary. They'd ask things like how certain archaic file systems worked in an effort to discredit him as a witness.

I decided then and there that I'd never be able to be an expert witness because I'd never feel confident enough to put someone's life in my hands through my testimony because I might not be able to cite from memory the difference between FAT32 and NTFS file systems and how they work at the machine level.

48 On the Trump/Alfa server, there is the issue of DNS lookups. IIANM, Georgia Tech was getting DNS data from various entities including the office of the POTUS for "research purposes".

The "experts" didn't see what they wanted to see and one of involved parties attempted to mock up DNS data to incriminate Trump. To the layman, this looked legit. To prosecutors and even the FBI - it looked legit. Legit until someone with experience and expertise in how DNS works. Then it was all b.s.

They are told that calculators will do the math, and spellchecker will take care of the writing. What this implies is that people are not prepared to handle life without mechanical assistance, not to mention what it does to creativity. Our last great adventure was going to the moon 50 years ago, and we can't even get people into space now. We jumped from steam trains to jet travel in 20 years, and yet gave up on supersonic travel in the 1960s, and haven't moved the needle on travel speed in the ensuing 50 years.

Two thoughts:

1. Fortunately, there's absolutely no possible way that this could be abused. No one would ever ask for a transfer from some base with unpleasant weather, for example.

2. Doing this will have the effect that the left's most loyal supporters are unlikely to be located in the places where they want to oppress the locals.

It's something that worries me, actually. I was a computer geek as a kid and that was when things were hard to use and you had to know something to make it work (although the people earlier had to *really* know shit that I never had to consider). The kids coming up now are technically savvy and experienced, but it's all very easy and so you don't need to know anything about how anything actually works. That is a good thing from the standpoint of access (there are now basically no barriers to entry to use these tools), but a bad thing in terms of building expertise.

A Police call is NOT disqualifying... you need to be convicted of something, or a restraining order, or in some places a stay in a Psych ward.

If you watch closely, the camera moves, it turns and reveals more than the original picture. But I was willing to shrug at that because: future tech, who knows what they can do with it, because its sci fi.

Its when CSI enhances the reflection off a person's eyeball from a security cam footage that you're just in the realm of stupidity

ha, yeah ... no limit. My camera gives me about 10MB pictures ... I can actually enlarge quite a bit and still have clarity, observe detail I couldn't see with the naked eye.

"Enhance" is something else, but that can also be useful. I take pics of my fields when plants are just emerging, then turn saturation way up and the little plants show up as bright green, instead of nearly invisible.

Most of the time (from my experience of working in government for a short period of time, and watching my government in actions) the people in our government act with a malicious (or at least wanton disregard) intent and do so in a fashion oblivious to the rule of law and proper procedure.

Most of the time when I worked in government, the SOP was "this is how we've always done it", regardless of whether or not that is proper or even legal.

This mostly works because your average person also has no idea what proper procedure is and assumes government officials do it the right way, and so they must accept their lot in life.

We have created a leviathan so large and complex that neither the official guiding it nor the citizen subjected to it has any clue as to the true nature of the beast.

yeah, well, there was one show i saw wherein they had security camera footage of a van driving by. couldn't see the license plate because of the angle. so they had the computer rotate the van to make the license plate come into view.

i laughed and quit watching the show. iirc, it was an early episode of that fbi show that cbs is showing. i'm guessing i haven't missed much, although i see it's spawned a couple of spin-offs.

I both really like and really loathe Clarke's work. He had a wonderful imagination, but his view of humanity was garbage. It's interesting to contrast 2001 with Interstellar.

I had a phone call yesterday from a professor of computer science (in other words, someone who *should* know something of how programs operate) say that it should be a simple operation to completely revise our enterprise level software (PeopleSoft) to do what she wanted to do.

I had to patiently explain that it was anything but simple. And I'm not even close to an expert on that system. I just know from experience that the level of modification she wanted was not only technologically challenging, but also politically difficult.

Scribes are usually people who aspire to med school. The schools often require a year or two of scribing, which sounds reasonable, since you want to make sure this person is a good fit before using a slot for them, then finding out they can't stand blood. OTOH, it also works out very conveniently for the doc, who no longer has to use a tape recorder and then transcribe his patient notes. I'm sure they plowed the savings back into lowering patient costs. \s

Did IT work for a Doc who did that. His Scribe was a full blown Nurse. Needed to be because there are sometimes things the computer brings up which are relevant, and the 'scribe' had to have enough medical knowledge to know what to bring to the Docs attention.

System worked well.

The bigger problem is, oddly enough, noise. Sonic booms travel surprisingly far, and city people get pissed off when aircraft rattle their windows. So government gets involved. Noise abatement regulations put so many restrictions on where you can run supersonic transports that it becomes impossible to run them anywhere except for long-haul, intercontinental, over-ocean routes. Makes it impossible to run them at a profit, because you have no economy of scale to reduce costs of the aircraft itself.

Several things go on with gun barrels--for the most part, no barrel is perfect and has various tool marks, etc. that CAN (not will) engrave on the bullet particularly from the lands of the barrel and its throat/muzzle. In addition, certain manufacturers use certain barrel twists, different types of rifling, different land and groove counts, and so on. Plus the bullet can be measured for size, weight, etc.

Then you have the bullet. Lead bullets engrave beautifully from the bore but if too hard--they shatter making determination difficult or if too soft they mushroom on impact which also destroys useful information. Plated and fmj bullets are a bit better about holding together but in a shallow or worn rifling/barrel situation, may not engrave sufficiently to id.

There was a huge scandal a few years back when all the science about "accelerants" and so on with fire forensics were proven to be unreliable and often spurious. Sorry, Backdraft. I think the same thing is going to happen with DNA in the future, proof that its ot nearly as reliable and that the massive resampling results in unreliable results.

Which you can totally fuck up by dropping a handful of range pickup brass at the crime scene. Even if you can match a particular casing with a particular gun, it creates reasonable doubt about the evidence.

Asimov wasn't a particularly good storyteller or writer, but he had interesting ideas delivered in an interesting setting, and that's good enough for Sci Fi. Science Fiction is about ideas and exploring the implications of those more than writing and storytelling. Sometimes you get people who bring those two things together like Jules Verne and Ray Bradbury but its not very common.

To finish, actually studying bullet marks and identifying the firearm requires sufficient knowledge of the examiner, a large reference collection, and sufficient engraved information on the bullet from the barrel in order to make the id. With less and less information, the id becomes much more unclear and similar effects happen with the passage of time. It is more an art that uses scientific methods than a true science.

Not really, firing pins for a variety of reasons are a wear item and similar to the DA/SA difference in POI versus POA, can have different impact patterns based on the softness of the primer cup, debris in the firing channel, worn springs, and so on.

I've had the fun of crafting firing pins for obsolete firearms in the past with no replacement parts and you learn a bit about the ideal tip versus one that has a bit of wear.

Most of what you see on TV regarding forensic science, or even what is presented in court by 'experts' is garbage science that like polygraphs are highly dependent on the expert providing the evidence. A fair one will acknowledge uncertainty in results.

Superman's costume is made from that Krypton blanket Ma Kent found in his escape ship, so it's kind of indestructible too. I can't recall about the Flash's uniform, though. Maybe he can generate a kind of force field around himself that makes it possible for him to move at such speeds. Green Lantern did. (I think; it's been a loooong time since I read Silver Age DC Comics.)

They did--look up the now discredited FBI Lab tests that alleged that they could identify bullets in a box of ammo by comparing the fired bullet with its alleged unfired bullets in the same box of ammo.

Ky case blew that test out of the water resulting in having to reinvestigate quite a few crimes.

If no ammo recovered they use the same brand of ammo for their comparison tests. As I said previously it's not an exact science but evidence that has to be collaborated with other evidence.

Until fairly recently, SF was considered to be mostly a male-oriented genre, read by boys and men who naturally would want to see boys and men as the leads. Clarke sold that kind of story because that was what editors wanted. That it aligned with his own preferences was gravy, I guess.

They MIGHT, I say might be able to identify the type and make of firearm with enough comparison sources and an experienced firearm examiner but generally they test a known firearm obtained with a search warrant or discarded and then compare from test shooting the bullet or shell casings with those gathered at the scene.

I am somewhat aware of these things but identifying a firearm from a firing pin and a shell casing is not really something within their capabilities other than ruling in or out certain firearms. As you add more points of comparison, you get a better result because you have more independent variables to confirm your hypothesis that the firearm in question was the one used in a shooting.

Notice you added the ammo similar to that used in the shooting which is another independent variable along with no subsequent damage/wear on the firing pin which is another.

In practice, most of what you see in TV or Movie land is mumbo jumbo used to speed the plot along rather than for specific technical accuracy. Even the reality shows focus on the 'good' forensic evidence examples in cases instead of the uncertain ones which introduces selection bias.

Not to pick on a sore spot but the type and make of ammo determines the gun shot residue patterns generated. GSR is another useful investigative tool that uses the specific powder chemical composition and its primer to determine the distance between the firearm and the target. Given enough of it, you can also get an guess about the position of the target versus the shooter, determine who is the shooter, and so on.

IN self defense shootings, that is why it is very unwise to use self reloaded ammunition because any exculpatory evidence from the gsr can be excluded from the trial by prosecutors as hearsay and self manufactured evidence while any incriminatory evidence will be admitted under statements against interest of the accused. Guy went to prison in NJ based on that. Using factory ammo prevents that as evidence introduced exculpatory or otherwise comes in under business records exception.
