This motherfucker needs to be impeached.Chief Justice John Roberts on Tuesday directed the marshal of the Supreme Court to launch an investigation into the source of a leaked draft opinion showing that a majority of justices were poised to overturn Roe v. Wade. "This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here," Roberts said in a press release that verified the authenticity of the document published Monday evening by Politico. ... "To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed," Roberts wrote. "The work of the Court will not be affected in any way."The Marshal handles security for the court. It also serves papers and disburses some funds. (a) The Supreme Court may appoint a marshal, who shall be subject to removal by the Court, and may fix his compensation. (b) The marshal may, with the approval of the Chief Justice of the United States, appoint and fix the compensation of necessary assistants and other employees to attend the Court, and necessary custodial employees. (c) The marshal shall: (1) Attend the Court at its sessions;I don't see "investigate crimes" on there. I don't see "subpoena witnesses' phone and email records" on there. So if you're scratching your head trying to remember what big crimes the Marshal of the Supreme Court cracked, the answer is none. None big crimes. Which is as Roberts wants it. Note Well: I do not have to believe in the FBI to also know that Roberts believes in the FBI, nor to know that Roberts avoided calling the FBI for entirely different reasons than commenters would have for avoiding calling the FBI. Those of you saying "Well the FBI is corrupt anyway" -- yeah, Roberts obviously disagrees. He is not avoiding the FBI for that reason. He is avoiding the FBI so that he can avoid an investigation entirely. What the Marshal of the Supreme Court does, primarily, is provide security, and right now, the leaker has put five people on the list for would-be assassins. Not a single person in the Marshal's staff should be doing anything except providing security and investigating threats to the lives of the five conservative justices. And yes of course, the Secret Service should be bringing in all sorts of resources and bodies too. So yes, the FBI should be handling the leak investigation. ... But meanwhile -- Schumer's looking to get the FBI to investigate the conservative justices for perjury, it seems.
And it's not just Schumer. This sourc*nt wants in, too.

Is there any crime to investigate?
My theory is that the White House leaked to Politico. Sotomayor, or her clerk, gave them the draft document as a warning of what was coming so that the Dems would have time to prepare a response. The White House then decided to try and either bully a justice into switching sides, or to whip up anger and distract from the admin's failures. Roberts knows this, but also knows that it's not the first time that an administration has been given advance notice of a ruling and doesn't want that to become common knowledge. Last night when all the commentary was that the leaker would be disbarred, throw out of SCOTUS, and get a gig on MSNBC, I doubted it. I was tempted to put out my own opinion/prediction that not only would the leaker not be punished, but will probably be on the court one day. If not SCOTUS, perhaps a federal judge position, or a state supreme court.

Leaking this report was not a "crime" under the criminal code; however, it was a gross violation of the internal rules that govern the Supreme Court's internal operations. Using the FBI would be absurd, since they are now just the Secret Police for the Democrat Party

This is what happens when all of your institutions are corrupt. I think there is a pretty strong chance it was one of our intel agencies which leaked it. They have shown a propensity for this sort of thing, and Biden has used them in the past to go after political opposition and to spy on other branches of government. Most likely is a leftist law clerk. But I would put the intel agencies at number 2 on the suspect list, and Roberts' office as number 3. The other thing Schumer going after the conservative justices does is head off any move to impeach whichever leftwing justice caused, or allowed this to happen. This sort of breach is exactly the sort of thing you would impeach a judge for --- not the substance of their rulings. At times, the court tires of endless decisions on trivial matters involving a precedent is has been largely undermined by subsequent decisions. From Roth in the late 1950's to the Miller v. California decision in 1973, the Court wrestled with how to define obscenity. Eventually, the court decided that community standards should determine what is obscene. Even later decision after the internet came about, the Court simply extended the community standards to the internet instead of allowing local jurisidictions to effectively enforce local standards on the world wide internet. Plessy itself was chipped to pieces prior to Brown v. Board of Education, the only question was when would it fall. Even Brown itself distinguishes the Plessy decision from Brown not by explicit overruling but by stating that 'separate but equal has no place in education.' He is avoiding the FBI so that he can avoid an investigation entirely. Tradition has the chief justice voting first (Burger changed the rule for him but Rehnquist changed it back--dunno about Roberts) to decide which side wins and which side loses. Then by order of seniority, each justice then votes with the most junior normally voting last. Then opinions to write up the legal reasoning of who wins and who loses are assigned--The Chief Justice, if in the majority gets to assign the opinion writer, if in the dissent, then the most senior justice in the majority assigns it. Dissent is more idiosyncratic and ultimately unimportant except for signalling. But, until the final decision is released publicly via Supreme Court reports, the majority can become a minority (apparently the Obamacare case was an example). The timing of this is too suspicious given that the draft was written months ago. This was a democrat party operation. One of their shifty dirty tricks companies like Perkins Coie had some operatives get to know some clerks, found one with a weak spot, maybe used a honeytrap or some drugs, and made an offer of plenty of money plus keeping the clerk's social peccadilloes under wraps. My theory is that the White House leaked to Politico. Sotomayor, or her clerk, gave them the draft document as a warning of what was coming so that the Dems would have time to prepare a response. The White House then decided to try and either bully a justice into switching sides, or to whip up anger and distract from the admin's failures. Roberts knows this, but also knows that it's not the first time that an administration has been given advance notice of a ruling and doesn't want that to become common knowledge.
