I'm certainly no expert, but in this case, it really doesn't matter. Whomever he nominates will be confirmed. And unlike under a Republican president, it won't be along party lines. Actually, the court has a vote on merits the same week that they hear oral arguments. That is done to assign opinion writers--the Chief get that ability if in the majority and the ranking senior justice does the honors if the Chief is not in the majority.

Opinion becomes final when published and at times, a majority opinion can end up a dissent if it does not have a majority when published. Obamacare decision is believed to be that way.

No, ask Rhomboid. The Senate rules have a lot of potential for mischief even in the minority apart from the filibuster. There is all sorts of requirements, holds, unanimous consent motions, and so on. The House is majoritarian and can shut down a minority quickly. The Senate, not so much. That is why the kabuki dance on filibuster was pretty much going to fail due to senior senators liking their power that way.

Witness the Harriet Miers collapse or Reagan's two strikes in 86, and so on.

The political team does not want another disaster on hand via a collapsed nomination and the key Dem senators do not want to defend an indefensible idiot. Interest groups want a reliable nominee and so on.

I think the ideal situation would be for Schumer, looking like he's in control, to go through all the machinations to get Biden's first nominee through the committee and then to a floor vote where Mitch, actually extending his pimp hand, unites the Republican caucus against the nominee and gets Manchin to side with him. Manchin, of course, having just come off of an episode where he increased his popularity in his home state by being a thorn in Biden's side.

It would take months of the senate's schedule and leave the Democrats with nothing but disappointment going into the midterms.

Honestly, I think the more law you study, the poorer and less wise a connection you have with the law and justice in general. At least, that's the overwhelming tendency I've noticed. Stuff that is a no-brainer obvious call starts to get all nuanced and blurry the more law you study and the longer you practice.

Look to his later opinions on free speech etc. Black originally supported Gobitis but both him and Justice Douglas changed their votes partially because the US was at war with Nazi Germany and its blood oaths to its leaders. In Engel v. Vitale, the vote was 6-1 on the court and Hugo was more or less arguing consistently that forced speech is not allowed whether a secular pledge or a religious one as a condition of attending schools. His opinion on government aid to religious schools in Everson v. Wall actually cited the Jefferson letter as allowing NJ to aid religious schools regarding bus fares which was later extended by the court.

If you want to exclude justices on grounds of bigotry of one sort or another, then you would clear all the court.
