Judge Issues Stay Against Brandon's Vaccine Mandate for Navy Seals: "There Is No Military Exclusion for the Constitution"

In other words, the Constitution does not stop functioning just because you happen to be defending it.


A federal judge granted a temporary injunction Monday against a federal vaccine mandate for Navy SEALs, who sued President Biden because they were seeking a religious exemption.

Judge Reed O'Connor, the U.S. District Court Judge for the Northern District of Texas, issued the stay in response to a lawsuit filed by First Liberty Institute in November on behalf of 35 active-duty SEALs and three reservists seeking a religious exemption, as first reported by Fox News Digital.

"The Navy service members in this case seek to vindicate the very freedoms they have sacrificed so much to protect. The COVID-19 pandemic provides the government no license to abrogate those freedoms. There is no COVID-19 exception to the First Amendment," O'Connor wrote in his ruling. "There is no military exclusion from our Constitution."

The SEALs represented in the lawsuit were all members of various Christian denominations and objected to the vaccine mandate based on "their sincerely held religious beliefs," claiming the military was violating their constitutional rights.

"We are aware of the injunction and are reviewing it," said Pentagon spokesman John Kirby.

I noted in a post last week that while the military is legally required to evaluate religious-exemption requests on an individual case-by-case basis, it has denied all of the requests submitted with identical form letters.

A commenter asked if that would help make the case that Brandon was acting illegally. The judge seems to have noticed: "The Navy provides a religious accommodation process but by all accounts, it is theater."

Religious exemptions to the vaccine requirement are virtually non-existent. In the past seven years, the Navy has not granted a religious exemption to any vaccine requirement.

To adjudicate a religious accommodation request, the Navy uses a six-phase, fifty-step process. See Supp. Decl. of Andrew Stephens, Ex. 1, ECF No. 62. Although "all requests for accommodation of religious practices are assessed on a case-by-case basis," Phase 1 of the Navy guidance document instructs an administrator to update a prepared disapproval template with the requester's name and rank. Based on this boilerplate rejection, Plaintiffs believe that this process is "pre-determined" and sidesteps the individualized review required by law.

As explained below, the record indicates the denial of each request is predetermined. As a result, Plaintiffs need not wait for the Navy to engage in an empty formality. In addition, whether the vaccine mandate violates Plaintiffs' First Amendment rights is a legal question well suited for the courts, not the Navy's administrative process. The Court finds that exhaustion is futile and will
not provide complete relief, and therefore the case is justiciable.

The facts overwhelmingly indicate that the Navy will deny the religious accommodations. The Navy has denied twenty-nine of Plaintiffs' thirty-five accommodations requests. Outside of Plaintiffs' requests, the Navy has, to date, never granted a religious accommodation request for the COVID-19 vaccine. In fact, in the past seven years, the Navy has never granted a single religious exemption for any vaccine. Several Plaintiffs have been directly told by their chains of command that "the senior leadership of Naval Special Warfare has no patience or tolerance for service members who refuse COVID-19 vaccination for religious reasons and wants them out of the SEAL community."

The Navy's accommodation process confirms those fears. The Navy uses a fifty-step process to adjudicate religious accommodation requests. Under the standard operating procedures for the process, the first fifteen steps require an administrator to update a prepared disapproval template with the requester’s name and rank. In essence, the Plaintiffs' requests are denied the moment they begin. That prepared letter is then sent to seven offices for review. After those offices review the disapproval letter, the administrator packages the letter with other religious accommodation requests for final signature. The administrator then prepares an internal memo to Vice Admiral John Nowell, asking him to "sign . . . letters disapproving immunization waiver requests based on sincerely held religious beliefs."

Then, at step thirty-five of the process, the administrator is told--for the first time--to read through the religious accommodation request. At that point, the disapproval letter has already been written, the religious accommodation request and related documents has already been reviewed by several offices, the disapproval has already been packaged with similar requests, and an internal memo has already been drafted requesting that Vice Admiral Nowell disapprove the religious
accommodation request.

Note, however, that analysis goes to justiciability, whether or not the court can decide this issue or not. The Navy says no, you may not, because we've not reached a final decision on these cases; the court says, be serious, you made your decision at step one of the supposedly "fifty step process." Actually, at step zero-- you have a blanket policy of rejecting all requests and pretending you evaluated them.

Then the court goes on to evaluate under the Religious Freedom Restoration Act, and finds they'd likely win on the merits.

As I've mentioned before: This is another front in Brandon's attempt to purge the military of anyone who might be a Trump voter. They're using vaccine hesitancy as a proxy for Trump-voting.

I wonder what the median latency between exemption demand and exemption rejection is. I'll bet it's not all that high. But they're totally reading them and the processing them based on merit. Just like how the FBI read all of those Clinton E-Mails and were quite sure there was no classified information changing hands. All of the tens of thousands of them. In a day or two.

23 It is a curious disconnect between the Navy and my experience in the private sector. I have asked lots of current and former colleagues who filed exemption demands about their outcomes. Across many companies (though all within my industry), the acceptance rate among people I have asked is 100%. I even got to read some of them. Some were good. Some were laughably bad. All were accepted, and accepted quickly. The piece of the private sector into which I have visibility appears to just be rubber-stamping all of the exemption demands. Just like the Navy, I suppose, albeit in the opposite direction.

Clearly, joining the military negates quite a few ways you normally can express your rights. For example, you are not permitted to say certain things that you can as a civilian. You cannot quit the job when you want. You cannot say "no" to a direct order without severe consequences, etc.

I'm not sure this line of reasoning actually can hold up to a legal challenge as much as I agree with the results.

I'm guessing even most of the CEOs want nothing to do with this. They don't want to enforce it, they don't want to deal with labor headaches at a time where labor is tight. But they feel the need to require vaccines because elite society is requiring it. But the exemptions are giving them a good reason to get around it for those willing to put in the effort. In a free society, this would not be necessary. But if your observation is true, it is also an indication that they know it is theatrical bullshit.

People's word choice and idle remarks matter because it shows you windows into their thinking. Both Swallowell and Biden made the remark that since the American populace does not have nukes, it does not matter.

I would also point out, ROE and respect for civilian casualties will probably be quickly shunted off to the side- just like civil liberties have been silenced for J6 people.

42 Yeah this one I am not sure about. Forgetting about the particulars of this vaccine for a moment. We in the Military have been getting shots, flu shots and others for ever. And in a sense it is a direct order with all that goes with direct orders in the Military. And yes when you join the Military you do sacrifice certain rights. Bottom line you really can't have every single Soldier Sailor and Marine deciding which Orders to follow and which not to.

Now I wish this had not gotten political, sigh, but it did. Anyway I am pretty sure a higher court will over rule this Judge at least in respect to the Military.

If I am reading that correctly, it seems that the normal process is to accept an exemption demand. If the vice admiral has to approve an exemption denial, then that seems like a *huge* bottleneck that would not usually be used in normal (non-COVID-related) operations. Is that correct?

I wonder if this isn't still an issue though?
Since day one, soldiers are told they give up certain of their rights even though they are trained to give fight and if it happens, die, for the rights of others. As a result we have the UCMJ vice civilian courts for a military judicial system and the Company Commander has the legal authority to fine and confine soldiers found guilty of wrong-doing.
What am I missing?

Clearly, joining the military negates quite a few ways you normally can express your rights. For example, you are not permitted to say certain things that you can as a civilian. You cannot quit the job when you want. You cannot say "no" to a direct order without severe consequences, etc.

I'm not sure this line of reasoning actually can hold up to a legal challenge as much as I agree with the results.

Its certainly an indication how political everything is around COVID. In normal times, I would agree with you. But get the right judge now and you can make headway. Ultimately, I would expect the courts to side with the Navy for the reasons you stated. But the seals may just have enough political cache to cause some sort of political movement to help the greater freedom loving cause.

A very good question.
I try to follow it locally as I used to command a recruiting company. The last year has been rough. Still good applicants joining, but I sense a trend (without access to specific data) of a downward spiral.
There will always be a certain percentage of high school graduates who will join the military, but the number of those who qualify are becoming fewer, and while inflation tends to support recruiting, the local MacDs is hurting for people and will start at $16.50/hour with signing bonus. Hard to fight that.

Agreed. Joining the military means you have died a partial civil death. Moreover, it is not entirely clear that military justice falls under Article III of the Constitution which establishes a court system. A more likely home is Article I, Section 8. Even Article II has a better argument in that POTUS is Commander-in-Chief.

The fact they have a process is proof they know it's necessary under applicable laws and regulation ( hint, the military is not exempt from the RFR Act). They can't make whimsical judgments for approval. This is no different then ruse's like "shall issue" in civilian land. They have a very good chance on that basis alone.

Approved, yes. But have not completed long term safety trials and follow ups. That is customary for any drug, but more so for a new class of therapeutic, which mRNA vaccines are. And even after long term studies, many drugs are pulled after approval due to adverse events that can affect less than 50 people. Rota vaccine, vioxx, actos... The FDA knew of 1000 who died from the vaccine by Feb 2020.

Comirnaty got a letter from the head of the FDA, did not follow the normal process but it is "approved". You aren't getting Comirnaty because they aren't making it. They aren't making it because the approved one, doesn't give them liability protection. You are getting the one still under EUA. The "work around" supposedly is that they are identical. But they do say they are different. They have different legal status when it comes to liability.

Either way, it is still experimental as a matter of actual science. There is no long term data at all, is there?

It is the safest way to not lose if you get sued. Deciding which religion matters is an auto-lose, so you either approve all or none. The military has always approved none for religious exemption and almost none for disability exemption (for Covid, there have been a tiny few disability approved and a few more "temporarily approved" for a certain time to lapse before shot necessity).

But the military would say "military readiness" vs "less impacts to military readiness" and go from there...again, I was military. Right. This is basically the thinking of the Fed District Court Judge. (But Its going to be overturned, not because its wrong, but because it isn't.)

They have the right to object. Not contested. That is why there is a process. The process is a farce and being automatically rejected without consideration. Its an open and shut situation.

I was dead in the middle of rural West Virginia traveling through to Kentucky and stopped to get gas and out walks a US Navy Lieutenant in Summer White uniform. I stopped her and asked her what the hell was a US Navy Lieutenant doing in the middle of Appalachia. She said nope, not Navy she was in the US Public Health Service and that was her uniform.
