Kyrsten Sinema: "No" on Democrats' Hot New Plan (Same As Their Old Plan) Of Ending the Filibuster to Pass a Federal Bolshevikization of State Voting Laws

Phew.

Yesterday's news that Democrats were pressuring Manchin to allow them to suspend the filibuster rules just for one vote -- a vote that would trump all other votes; one ring to rule all the other rings and in the darkness to bind them -- made me wonder if Sinema were already on board and that Manchin was the only obstacle remaining.

But no. As Yoda said: "There is another."

Kyrsten Sinema supports the elections reform bill that Democrats are considering a year-end push to pass. She doesn't support a shortcut around the filibuster to get it done.
The Arizona moderate is making clear that she intends to keep protecting the Senate's 60-vote requirement on most legislation and she isn’t ready to entertain changing rules to pass sweeping elections or voting legislation with a simple majority.

In a statement to POLITICO, a spokesperson said that Sinema "continues to support the Senate's 60-vote threshold, to protect the country from repeated radical reversals in federal policy which would cement uncertainty, deepen divisions, and further erode Americans' confidence in our government." Since joining the Senate in 2019, Sinema's been a fierce defender of the filibuster and warned that reversing it could lead to terrible outcomes for Democrats down the line.

Well, obviously, once you set the precedent that you can suspend the filibuster for any bill you deem "very important," a lot of bills will be deemed "very important."

Though, honestly, I don't know if the GOP will do this very often. They're cowards and most of them are liberals anyway, who collude with the Democrats to make sure liberal policy preferences always prevail, while they pretend to oppose them.

And every time they collude to engineer a Democrat victory, they immediately send you fundraising letters that say "By gum, we were outfoxed again! Gee willickers how does this keep on happening?! Please send us $100 so that we can buy better Brain Medicine so that the next time we will be better prepared to Fight For You."

Sinema says she supports the "voting rights" bills on the merits. Which worries me, but for now, I'm reassured.

26 What Sinema may be worrying is that the election bill will definitely be held up by court challenges and may not go into effect until after the 2022 elections at the earliest. Thus, if the Republicans win in 2022 both branches, the minority in the Senate will be neutered by violating the sacrosanct filibuster which would neuter her as well.

So, throw the sop of supporting it in principle but keeping her options open is the best play for now.

I don't think there's anything about filibusters in the Constitution. It was simply a gentleman's agreement between the two sides. That doesn't work very well when neither side contains gentlemen.

But the fact remains the left play the long game: take over the institutions one at a time over years and years, and be willing to take a temporary loss for a permanent gain. Not really, the math works like this--for the dems to get anything through they need McConnell's acquiescence as he controls those 'wildcards' like Murkowski and Collins, probably Romney as well. They vote against McConnell, no money for their reelection from the Leadership fund. The base already hates them.

McConnell uses the legislative filibuster to grift and do failure theater and would never support removing it as his hold would disappear on the GOP conference.

I think that's largely true, but it is still a gamble. Not all positions are known, but importantly the future is unknown. That sounds stupidly simple, but it's something a lot of people forget. Right now, there is zero risk to nuking the filibuster, either as a one-off or in general. The Republicans are useless criminals and the Democrats are effective criminals and there are too few who aren't to swing things beyond scoring political points.

I'm glad that's in there when Dems have complete control, but if I'm being intellectually honest, the Founders didn't put in 60 votes when they could have.

It's supposed to be a bare majority, with the VP being President of the Senate as the tie breaker.

Just like when Dems made 60 votes the standard for all judicial appointments, that seemed to violate the Constitution.

The issue with changing the Senate rules is that individual senators have a lot more power than in the House. Under House rules, especially now, the leadership says jump and the rank and file have to say how high. In the Senate, the maj and minority leaders are schedulers and fundraisers for their party. The Senate could grind to a halt with most of their legislation requiring steps for unanimous consent--thus one senator objecting could bring the whole thing to a stop. Right now, Wyden is holding up Uighur sanctions on the Chinese and Biden appointees. If House rules are adopted, he doesn't have that power to hold either up.

That is why true believers get little accomplished in the Senate--the rules themselves are designed for consensus on legislation passage but giving enormous power to individual senators to block things. Hard to give up that power to be one of the backbenchers.

If it can be undone by a bare majority, you can make the case its still "kosher". But the Senate essentially operates in a way contrary to the Founders intention.

First 100 years or so, there wasn't really a filibuster.

The modern application of the filibuster is basically from segregationist Democrats in the 60's that wanted to stop civil rights bills. It was a sort of "one off" that became the de facto rule.

The problem with this line of argument is that the founders expected the people would overthrow any authoritarian government that came to power in the US.

There is no provision in the constitution to allow the feds to mandate clot shots or pay illegal aliens or any of the million other things the government does now, so it doesn't matter if 51, 60 or 100 Senators vote for something.

The problem is, of course, that we the people, have not responded as expected by the founders.

Yes, McSally was my congresswoman, and she always sucked. GOPe all the way. Also, a terrible retail politician. Very stiff, had trouble connecting with people, and not at good at the fundraising stuff either.

I know why they tried to move her up to senate. She ticked off a lot of popular identity-group boxes: woman, veteran, trailblazing pioneer (as one of the first female fighter pilots), lesbian, etc. But she was always a lot better on paper than she was in person.

Brnovich is at least a conservative, which already puts him miles above McSally or any of the Dims.

As a registered independent, on primary election day 2018, I asked for the Democrat ballot at my polling place. I voted for her opponent in the primary, conducting my own "Operation Chaos".

However, I can see independents rationally selecting the Dem ballot in 2024 to retain her, which will help her clear the major hurdle for re-election. General election will probably be a formality, in comparison.

197 Filibuster isn't "unconstitutional" since nothing in the constitution says "Senate can't have internal rules that require supermajority voting on some issues." In fact, the constitution specifically says "Each [chamber] may determine the Rules of its Proceedings."

You can say it's contrary to Founders' intention or whatever, but yeah most things in the modern state are. So no particular reason to get bent out of shape about Senate filibuster on that basis since it would probably be about 1 millionth on the list of things about present day US government the Founders wouldn't like.

The Republicans in Washington represent the Chamber of Commerce and big campaign donors, not mere voters. The Medical/Pharma industry was a big reason that Obamacare was not rolled back--the gush of federal money would be stopped to that industry.

If they were to be active legislatively, it would not be to your liking. So, Republicans, absent getting rid of large numbers of officeholders, are essentially King Log.

Technically yes, but... they really needed to pass this within the first 6 months of Biden's term, they all knew that. They knew that McConnell and Co. wanted to pass the Infrastructure bill, so they wasted 3 or 4 months playing games with linking the two until that all fell apart. Now - higher inflation reports are coming weekly, and the more people find out about what's in the BBB, the more they hate it. The chances for passing it are getting less and less each week, which is why putting it off for a month or two is fatal.

My partner got a great deal on an older version of the test, so it's not too expensive, either! Weird, though, that I have to have my eyes closed for the test. It uses a really thick swab that has to vigorously and repeatedly deep swab my throat. Leaves a bad tasting residue, too, but it's worth it to know I'm safe, and my partner is really supportive!

Not true, you can under senate rules eventually talk out the opposing party by exhausting all debate. That was how the Civil Rights Act was passed over a filibuster.

But, if the Senate only works 3 day weeks on the floor, not so much as the time required would be weeks. The old filibuster rule from 1917 to the 70's was actually more effective in some ways as it prevented actions that the minority was adamantly opposed to but on other actions, if the senators opposing it were not present and voting, the number of votes needed dropped quite a bit. They worked longer weeks on the floor and could also exhaust debate on important issues.

The Air Force on Monday discharged 27 people for refusing the Covid vaccine.

A Navy Commander was also fired from his job as the executive officer of a warship for refusing the Covid vaccine.

Commander Lucian Kins was fired last Friday as second in command of the USS Winston Churchill, Navy officials said.

Meanwhile, the Pentagon is actively considering mandating a Covid booster shot for all active servicemembers.

If the initial data hold up, Omicron is the end of this. It's essentially the cold now. It's non-severe in most cases and spreads easily. Delta and the Wuhan prime virus will be killed off by it. It'll rip through the population, kill next to no one and that will be it. It's just another cold floating around.

Germany, Australia, Japan...those might be nice reward ambassador positions. Turkey seems more like a punishment. Place is a borderline shithole, you'll never get credit for accomplishing something, and there's a high chance the place becomes an issue, and you get associated with it.

I wouldn't care if they were successful 100% of the time on everything they did. That's. Their. Job. They're not getting any *more* of my money than they already take from me in taxes to pay their salaries. No politician should ever be asking me for my money for anything. If they're successful, good, that's their job. If they're unsuccessful, what makes them think I'm going reward their failure with a donation? They already have my money in the form of their salaries that are paid for with taxpayer dollars. How about they pool their salary money together and use that to spend it on whatever they need to do their jobs.

The Fifth Circuit noted that the government is likely to prevail on limiting the scope of the nationwide injunction, and as such, the appellate court stayed the injunction with respect to jurisdictions outside of the 14 states included in the lawsuit. In other words, although the CMS Rule is still halted in the 14 states that brought the lawsuit in Louisiana, and in the other 10 states that are part of the Missouri lawsuit, for everywhere else, the injunction is lifted. If you state didn't sue, then you aren't covered.

That's my read on the situation. The Democrats are running scared at the moment, and they're aiming to avoid an even worse shellacking than the one in the cards for 2022. Sinema is in a red-ish state, so this will only make her more popular. Democrats in blue states, who don't want to get rid of the filibuster, and don't want to be blamed for the next 20 years of inflation, can do the same "Aww, shucks, we tried" routine the Republicans do every time it happens on our side.

As Ace pointed out when Obamacare didn't get repealed, the filibuster is a tool for the party in power, because it allows them to refrain from making politically self destructive moves and to placate the base at the same time. To vote against something while actually voting for it, and vice versa.
