WHY IS THIS EVEN POSSIBLE?

I don't understand legal reasoning. Or, perhaps I should say, I don't understand certain aspects about American jurisprudence. For example, civil asset forfeiture. How did that ever become a thing? "Sir, you're under arrest for blah blah blah and therefore we get to take everything we think is connected with your criminal activity, which, whoopsie, is pretty much everything you own. Too bad. We'll decide later if we want to actually charge you with a crime. Meanwhile, good luck trying to get your property back back."

How did that ever pass constitutional muster? I thought "no person shall be deprived of life, liberty, or property without due process" was a bedrock principal of our system of government. So how is it 'due process' when your property becomes forfeit just because some LE agency decides to raid your house?

I just don't get it.

Another thing I don't get is something that happened at the Rittenhouse trial on Friday:

Assistant District Attorney James Kraus pressed for 'a multitude of lesser charges' to be put before the jury when they are sent out to deliberate Monday

The same thing happened to George Zimmerman during his trial a few years ago. Just as the jury was being led out, the prosecution said, "oh, by the the way, in addition to 'A' and 'B' I want you to also consider charges 'C, 'D', 'E', 'F', and 'G' as well." I was shocked that nobody protested what seemed to me to be an obviously sleazy end run around due process. Because if anyone is charged with a crime, they ought to be allowed to rebut the charge, or at least defend themselves. But this tactic short-circuits any possible defense.

The assumption seems to be that the jury has all of the evidence and testimony it needs to adjudicate the new charges. But why? That's not obvious to me. If I were charged with a different crime, I might want to call different witnesses, or introduce different evidence. If I were the defense attorney, I'd be hollering at the prosecutor "look, pal, if you want to charge my client with new crimes, get your ass back in here and argue your case in open court!"

And if I were the judge, I would threaten the state with prosecutorial misconduct.

As I said, this is one of those crazy things lawyers and courts do, and it probably makes sense to them, but not to me. I just don't understand.

If Rittenhouse survives this, he will then face a state and federal civil trials, and that's another pet peeve of mine. Because it seems to me to be another way that prosecutors can sneak an end run around due process, in this case, the double jeopardy rule. In addition, in civil trials, the standards of evidence is not as high, which makes the prosecutor's job easier. Especially in a case like this, where accumulating a "preponderance" of evidence probably wouldn't be difficult. But that's the subject for another rant.

Search me, OM. I have no clue. It shouldn't have. Civil asset forfeiture is appalling. If you want to argue that a person is not entitled to ill-gotten gains and they should be seized, then there's a basis for an argument there - but that presupposes that the state has proven that gains are ill-gotten. This, by the way, is how some PDs have Ferrari squad cars and shit. They're seized from drug dealers.

But CAF can be used on its own. Driving with a large sum of cash? Well, large sums of cash are suspicious, don't ya know. Seized as ill-gotten gains, with a lawsuit with a preposterous title like "The People of the Commonwealth of Pennsylvania vs $23,500.23" Want to pursue asset confiscation following a conviction? Okay, we can talk about that. Asset seizure *without* a conviction or even reasonable suspicion? Fuck you.

Oh I get it - it happened when "Conservatives" decided that oh, this was only going to be used against Bad People and Drug Dealers, so lets wink and let everyone know that it's just fine with us. Amazing that leftists used to kind of be in favor of Civil Rights, but now they are All In on expanding Government Power in any way possible.

We on the right have been on a century long Love Affair with expanding Government Power by allowing Law Enforcement to do whatever they want to do. We are all slowly waking up to the fact that this has been a huge mistake on our part, perhaps one of the biggest mistakes we've made. (although giving up the Education Establishment might be even bigger)

Also, @dhershiser, the Roman government was pretty vehemently anti-Christian for a pretty long time. Nero burned them to light his garden. It proved to be an unstoppable force, but Rome viewed it as a significant threat to its own power.

90 Why dismissing the Gun Charge was so important - the existence of that charge left hanging out there was the one thing that had me (and Andrew Branca) more worried than any other factor in this trial.

The significance of the Gun Charge was that if they found him guilty on that (and the law itself was very ambiguous and the outcome hard to predict) then THAT simple fact of conviction on any criminal matter would have been used to negate his self defense claim on *every* charge.

That gun charge was the biggest wild card in the entire trial. Now it's tossed out of the deck.

The argument is better made for Orthodoxy. Secular authority over the Church was the big divide between east and west(with western Christianity positing that the authority of the Emperor is below that of religious authorities), though the English did it eventually as well. Thanks to Caesar's job as Pontifex Maximus before he became Emperor, the Roman Emperor was traditionally the highest religious authority.

While IANAL, I was a LEO for a number of years, and I can say with certainly that, yes, this is a bullsh*t run around due process. Most crimes, including lesser crimes, will have completely different elements from one another that would need to be proved in court. You just can't assume that just because you think you proved all the elements for Capital Murder that you can just throw in a Manslaughter charge after the fact . . . you know, just in case the Murder doesn't stick. Gotta prove the Manslaughter charge as well.

And I wouldn't trust a jury to be able to make the fine points of distinction regarding a lesser charge and save me if that happened, even if they had all the evidence and deliberation for a higher charge.

I think his mistake was asking both the Defense and the Proseuction to write instructions, and then merging them. He ended up (predictably) with an incoherent mess. He should have spent the weekend writing them himself, using the two sides only for reference.

I've read that he is the longest serving Trial Judge in Wisconsin - he might be getting a bit lazy in his old age.

Looking at Yasmine's 50-something photos reminded me of some recent photos I saw of Paulina Poriskova, who's in her mid-50's. Paulina's face has aged, of course, since she was a young model, but she still looks very good, and she hasn't had plastic surgery. She has stayed in great shape, and from the shoulders down she looks like a woman half her age.

If Yasmine had made the effort to stay in shape, she could probably look quite good now as well.

406 Decades ago, I was on a jury in a Chicago suburb. Kid pulled some kind of disruption after a HS sports game. There were two charges against him.

The jury (save one assho woman) was as serious and trying to be fair as you'd ever want judging you. The arresting officer seemed like a creep. The kid seemed like a punk. The altercation was pretty much he said he said.

We ended up splitting the verdict. I always regretted that. Should have been not guilty altogether.

Don't tell anyone, but if I'm ever on a jury again with multiple charges on what is really only a single alleged offense, I can't imagine doing anything but thumbs-up or -down.

While I never had to sit on an actually Jury, I did get called more than a few times and had to go to the Court House once to get the stuff. While I was there almost every piece of instructional paper they handed me was laminated or in a book. I don't recall ever seeing a Judge having to read through multiple copies of Jury instructions.

492 A lawyer versed in the law for this state said on Friday that the being able to intro lesser charges at the 11th hour is a feature not a bug of their state legal system. In the past they were allowing cases to go forward where they were way overcharging the defendant with crimes, so if the jury did have to find them guilty there, was no way to not throw the book at them. Cutting off a head when they really just need a slap on the wrist. Lesser charges were introduced to prevent the punishment not fitting the crime if the crime really was not so bad.

If the judge is throwing out bogus charges, awesome, and hopefully that helps Kyle be pronounced innocent on the larger ones, but does not throw a bone to the jury to still be able to convict him for something, anything.

Still think judge should have called it a mistrial with prejudice when the prosecutor attacked Kyle for his basic right to plead the 5th. But whatever.

The Colt 1911, the Barretta 9mm, the Remington 700 are all battlefield weapons. Some could even argue that the most popular plastic guns like the M&P were designed specifically to win a DoD award to replace the battlefield pistol Barretta.

So if I came up with a design of a suppressed full-auto that never saw a battlefield, that weapon is OK?

Are the police all in on surrendering their "battle field" weapons?

569 the "Christianity was created by the Roman Empire" thing isn't exactly the "hot take" you're presenting it as.

It's not widely known, because it isn't super popular to talk about, but there is a reasonably large group of historians that believe this to be true, based on some pretty solid evidence.

I don't necessarily believe it, but it's not the complete ridiculous hogwash that it may appear to be on first blush. And honestly, anyone that wants to have a faith based in understanding and knowledge should know about it.

A good place to start is Joeseph Atwill's "Caesar's Messiah: The Roman Conspiracy to Invent Jesus'". He makes a pretty good argument.

I think that Jesus was a real guy, who started a religion, and the evidence in the book was a Roman attempt to co-opt it for their own use, as opposed to them creating it whole cloth. But it's an interesting read.
